SECOND AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF FORT BRAGG AND COLD CREEK COMPOST, IN.C FOR COMPOSTING SERVICES This Second Amendment to the Agreement between the City of Fort Bragg and Cold Creek Compost, Inc. for Composting Services executed on October 27, 2015 (Agreement) is entered into this _____ day of _____________, 2022.
City and Cold Creek Compost, Inc. Agree to modify Section 13 of the Agreement and supersede amendment No. 1 as follows:
Cold Creek Compost, Inc. shall charge to City Franchisee $60.00 per ton for mixed organic Waste, effective November 1, 2022.
All other terms and conditions of the Agreement shall remain in full force and effect, including the provision for annual price increases contained in Section 13 of the Agreement.
