THIRD AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF FORT BRAGG AND COLD CREEK COMPOST, INC. FOR COMPOSTING SERVICES This Third Amendment to the Agreement between the City of Fort Bragg (City) and Cold Creek Compost, Inc. (Cold Creek) for Composting Services executed on October 27, 2015 (Agreement) is entered into this 28th day of November, 2022.
City and Cold Creek agree to extend the original Agreement as follows:
The Agreement, due to expire on December 31, 2022, is hereby extended for a period of 5 years. Agreement shall be valid until December 31, 2027, at which time it may be extended per Section 3 of the original Agreement.
All other terms and conditions of the Agreement shall remain in full force and effect, including the provision for annual price increases contained in Section 13 of the Agreement.
