TITLE:
Receive Report and Consider Approving the OMNIA Partners Cooperative Purchasing Agreement for the Bainbridge Park Playground Improvements Project, City Project PWP-00096; Authorizing Construction Agreement with Akeff Construction, Inc.; Approving Budget Amendment No. 2022/23-14; Authorizing City Manager to Execute Contract (Amount Not to Exceed $341,279.48; Account No. 419-5031-0731); and Finding the Project Exempt from CEQA under 14 CCR 15301 ISSUE:
In March 2022, City Council gave direction to proceed with replacement of the playground equipment at Wiggly Giggly Playground in Bainbridge Park. During the summer and fall months, staff worked to engage the public in the equipment selection and planning process. On November 28, 2022, Council accepted the playground layout with minor recommended changes. As the layout was finalized, the City began work with OMNIA Partners to evaluate the use of a cooperative purchasing contract with GameTime for the purchase of the playground equipment. In accordance with Fort Bragg Municipal Code (FBMC) 3.20.030 (F), staff is recommending use of this piggybacking procurement process with OMNIA Partners and Akeff Construction for this project. The Project is exempt from further CEQA review as an alteration of existing facililties under 14 CCR 15301.
ANALYSIS:
The project scope includes purchase of the new playground equipment, demolition and disposal of the existing playground equipment, and installation of the new equipment. OMNIA Partners is a Government Purchasing Cooperative Service and use of this type of procurement on this type of project is consistent with FBMC 3.20.030 (F). The OMNIA service employs cooperative purchasing of the equipment, establishes a capped percentage price for the playground demolition and installation, and leverages an existing competitively bid contract from another government agency for assurances on best pricing.
At the November 28, 2022, Council meeting, staff was directed to find a way to maintain at least the existing number of swings since the proposed layout at that time reduced the number of swings from the ten (10) currently existing, down to six (6) proposed. Staff worked with GameTime to change the selected adult exercise equipment (Figure 1) in order to increase space and offset the costs of the additional swings. The current plan now has twelve (12) swing seats. This was accomplished by making four of the swings tandem swings (Figure 2 and Figure 3).
The final site plan (Attachment 3) shows the final proposed layout for this project. The existing concrete pathways, benches, wood mulch, and other complimentary features in the playground area are proposed to stay. The demolition will consist of displacing the wood mulch, removal of old equipment and installation of new equipment.

RECOMMENDED ACTION:
Adopt resolution accepting use of OMNIA Partners Government Cooperative Purchasing Contract to purchase equipment from GameTime and construction services agreement with Akeff Construction Inc. for the Playground Replacement Project and approving Budget Amendment 2022/23-14.
ALTERNATIVE ACTION(S):
Refuse the cooperative purchasing contract and put the project to bid instead.
FISCAL IMPACT:
This project will be funded by the following three different source funds.
The City was awarded $177,952 from the Prop 68 State Parks Per Capita Grant, and the State allocated these funds for either the playground or the soccer fields. In March 2022, Council programmed the Per Capita funds for the soccer fields (Resolution 4527-2022 ). The soccer field project remains viable but is delayed due to two failed bids due to excessive project costs. The soccer field project is back on the drawing board to determine other options for reducing costs and evaluating upcoming potential funding sources, including an upcoming Clean California Grant solicitation. Since the Per Capita funds do expire (Dec 2024), and this is an eligible project with a budget shortfall, staff is recommending their use.
The City was awarded $25,000 from the State Farm Grant last summer. These funds were programmed and budgeted for use in this project by Council in September 2022 via Resolution 4586-2022.
The Capital Improvement Project budget in the FY 22/23 was for $200,000 from the facilities fund.
The project total is $341,279.48, and the total budget available (with the three sources described above is $402,952. Budget Amendment 2022/23-14 (Attachment 4) is needed to re-program the Per Capita Funding as proposed in the resolution.

GREENHOUSE GAS EMISSIONS IMPACT:
There will be a short-lived increase of greenhouse gas emissions during both the manufacturing of the playground equipment and the construction from equipment necessary for the performance of the work. All Air Quality Management District best management practices for minimizing greenhouse gas emissions during construction will be incorporated into the daily activities of this project.
