RESOLUTION OF THE FORT BRAGG MUNICIPAL IMPROVEMENT DISTRICT BOARD
ADOPTING AN IMPACT FEE NEXUS STUDY
WHEREAS, a report entitled “City of Fort Bragg Impact Fee Nexus Study” dated January 29, 2024 (the “Study”) has been prepared by Lechowicz + Teng under contract to the City; and WHEREAS, the Study is on file in the Office of the City Clerk, available for public inspection, and incorporated herein by reference; and WHEREAS, on February 12, 2024, a full and fair public hearing was held with respect to the Study; and WHEREAS, such hearing was noticed as required by law; and NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Fort Bragg and the Board of Directors of the Fort Bragg Municipal Improvement District No. 1 do hereby adopt the Study; and BE IT FURTHER RESOLVED that square footage of impermeable surface is an appropriate basis for calculating a fee for storm drainage facilities because it is a measure of the impact a development project has on the amount of storm water that is not absorbed by the soil on the project; that square footage of dwelling units is not as appropriate of a measure of such impact because dwelling unit square footage causes a multi-story building to be charged more than a single-story building that covers the same ground square footage; and that charging based on impermeable surface does not discourage the construction of small units; and BE IT FURTHER RESOLVED that this Resolution shall be effective immediately upon adoption.
The above and foregoing Resolution was introduced by Council/Board Member ________, seconded by Council/Board Member ________, and passed and adopted at a regular meeting of the City Council of the City of Fort Bragg/District Board of the Fort Bragg Municipal Improvement District No. 1 held on the 12th day of February, 2024, by the following vote:
