TITLE:
resolution of the fort bragg city council approving an application for funding and the execution of a grant agreement and any amendments thereto from the 2019-2020 funding year of the state cdbg program ISSUE:
On February 10, 2020, the Fort Bragg City Council adopted Resolution 4233-2020 approving an application for the 2019/2020 funding year of the Community Development Block Grant (CDBG) program for a Public Improvement Project – Water Meter Replacement in the amount of $2,970,043 and authorizing the City Manager or designee to act on the City’s behalf, including signing grant agreements and any subsequent amendments. An application was submitted in the amount of $2,944,365 and the City was awarded CDBG grant funds for the activity. Contract #20-CDBG-12092 between the City and the California Department of Housing and Community Development (HCD) was executed on October 15, 2021 and will expire on October 14, 2024. The project has experienced supply and construction delays, which have resulted in the need for a time extension of several months. CDBG staff have indicated that a time extension may be processed which would extend the contract through June 30, 2025, to allow for supply procurement, construction completion, and grant closeout.
ANALYSIS:
Pursuant to Government Code Sections 40601 and 40602, the Mayor or Mayor pro tempore must sign any written contracts and conveyances made or entered into by the City, unless the City has an ordinance or municipal code in effect that specifically allows or designates contracts to be signed by an officer other than the mayor or mayor pro tempore. In the past, the CDBG program has accepted a resolution authorizing the City Manager or designee to handle all CDBG matters, including execution of contracts and amendments. In recent months, CDBG program staff have indicated that, for all cities, these government codes will be enforced for all new contracts. In the absence of such an ordinance, the Mayor must now be authorized to sign all contract and amendments, though the City Manager may still be authorized to execute and deliver applications, submit funds requests, reports, and other documentation.
In order to process the time extension, the CDBG program requires that the City Council adopt a new resolution approving an application for funding in the approved format of the Department of Housing and Community Development, included herein as Exhibit A. This resolution is not to approve a new application or additional funding, but for the administrative purpose of authorizing the Mayor to sign contracts and amendments for the existing grant in compliance with the California Government Code.
The proposed resolution may be adopted and the contract may be amended without holding an official public hearing, as there is no change to location, scope, purpose, beneficiaries, or budget.
FISCAL IMPACT:
The grant contract amount will remain the same. The grant funds will be adequate to cover all costs associated with the project and allowable general administration of the CDBG program.
CONSISTENCY:
The State CDBG mission is to improve the lives of low-and moderate-income residents through the creation and expansion of community and economic development opportunities, which supports livable communities for all residents. This mission is consistent with City Priority Areas established in City Council’s April 2019 Goal Setting process including Priority Area “Quality of Life” (public improvements projects); and Priority Area “Infrastructure” (community development capital projects).
IMPLEMENTATION/TIMEFRAMES:
The proposed Amendment would extend the contract expiration date from October 14, 2024 to June 30, 2025. We anticipate that the project and grant closeout will be completed by February 2025 (well before the amended expiration date).
