Subject: Item 5C REQUEST: Item 5C be removed from the consent calendar for separate discussion
Mayor Godeke and Councilmembers:

Please include this email in the public record for the August 24, 2026 City Council meeting.

Please forward this public comment to the Mayor and all Councilmembers and include it in the meeting record for Item 5C.

I request that Item 5C be removed from the consent calendar for separate discussion.

The proposed amendment adds $9,495.45 to the Lumos & Associates on-call engineering and surveying contract, bringing the total from its original $80,000 authorization to $141,097.95-an increase of $61,097.95, or approximately 76.4%.

The resolution states that the costs had already exceeded the projected budget by June 2026, and the attachment is labeled a "Contract Close Out Addendum." This appears to ask the Council to approve costs after the additional work was performed. The packet does not explain who authorized work beyond the existing contract limit or why Council approval was not obtained beforehand.

The additional work is described only as "General Engineering Services." The packet provides no projects, assignments, dates, personnel, hours, deliverables, invoices, fee schedule, or expense breakdown supporting the $9,495.45 increase. It also states that sufficient funding exists in "the project account" without identifying the project, account number, available balance, or any expenditure that may be displaced.

The original agreement, previous amendments, applicable fee schedule, insurance documentation, and authorization records are also absent, leaving the public unable to verify the complete contract history and continuing terms.

I am not asserting that the additional engineering work was unnecessary or that the amount is unreasonable. I am objecting to retroactive approval of an expenditure above a Council-approved contract ceiling without adequate documentation or explanation.

Before approving Item 5C, please identify the work performed, its cost basis, who authorized it, the funding account, and the controls that will prevent future work from exceeding an approved contract limit before Council authorization is obtained.
