8 Connecting Travelers to Local
Businesses & Communities
t
Advertising Opportunities
What we're seeing:
• Many local businesses recognize the value and
participate.
• However, many more still haven't taken advantage of
this prime visibility.
• This means missed opportunities for both travelers and our communities.
• With thousands of people passing through each week, the potential economic impact is far greater than most realize.
Big Impact from a Small Footprint
The Collier Visitor Center plays a quiet but significant role in supporting:
1. Tourism: By driving visitors into our towns, parks, trails, and attractions
2. Local economies: Through referrals that lead to overnight stays, meals, and retail spending
3. Public safety: By sharing wildfire, weather, and travel information year-round
4. Community awareness: By educating visitors on history, natural resources, recreation, agriculture, and more
5. County identity: By offering a unified "welcome" that reflects our values and landscapes
When Boards ask, "Why does this matter to my district?"the answer is simple:
Because this center represents your community even if a traveler never drives directly through it.
11 A Shared Region Opportunity
• Serves travelers headed across Siskiyou County and beyond • Often the first point of contact for Lake Siskiyou, Klamath Basin, Scott Valley, Shasta Valley & more
• Reaches visitors before they decide where to go or spend time • Nature Walk Interpretive Trail was added in 2025
• Expands visibility for local programs, destinations & services • Reflects the full diversity of Siskiyou County
• Stronger impact through collaboration

Ft. Jones Police Department Monthly Report
May 2026
After a predominately dry April, it's the month of May that has brought us showers and more seasonable weather we are used to. While the rain has brought us a little relief it will also accelerate the growth of fuels that will become dry later. As you can see below in our code enforcement report we are focusing on the fire hazards around town and attempting voluntary compliance from property owners to take care of the issues at hand before they become a problem. In the past month just, I have been involved in the initial response to four fires caused by carless burning not counting the other officers responding to additional fires. Calling it being in the right place and the right time, but if first responders hadn't been within the area these fires could have been more destructive than they were.
Traffic- After a dry spell of no traffic collisions, we have had three in the past month within town limits. Fortunately, all were non-injury or very minor. While speed wasn't a factor, inattention or distracted driving was. These collisions could have been very easily more catastrophic in results due to this inattention. Officers will continue to show a higher presence in specific areas like Main Street, schools, and in areas where we see more pedestrian activity.
As always, officers continue to slow down traffic before reaching our town's limits by patrolling areas outside town and issuing citations. Please again, let us know if you witness problematic areas or inappropriate driving. Even in the event we do not see an incident take place, we can follow up and hold drivers accountable. We respect our constituents' privacy and will not disclose the source of information we obtain.
Schools- Graduation Day approaches us very soon and we are continually involved with events taking place within the school district and outside. Officers help assist and coordinate events, solidifying our partnership with the district while helping these activities become more proficient. Throughout the summer we will also continue developing protocols and policy in making our schools a safer environment from within and from outside influences. Our first complete year in partnership with the schools in regard to SARB and truancy stayed true and produced better outcomes than previous years. We hope to continue and grow our MOU with the district providing an even better service to our youth.
Animal Control- Several problematic dog issues are in the process of being rectified around town and we hope to see significant results within the next week or two. Etna is holding a vaccination clinic in early June, so if you know anyone needing their dog or cat vaccinated to be in compliance with local ordinances, please pass on the information. As you know, certain criteria is required before a pet owner can successfully register their dog with the city. We continue to help direct owners so they can complete these requirements in a short amount of time while being cost effective as possible.
Reports/Cases- As we approach mid-year, we are continuing to be at an average amount of written cases. I suspect as we continue into summer our case load will rise significantly. Having additional officers out in the area will also produce a rise in self-initiated cases while we continue our proactive stance.
Calls for Service- Throughout the past month we have seen a significant rise in calls for service including additional fire and medical response. Our coordination efforts with EMS and Fire continue to prove this close partnership is a must in our valley. One of the direct results of this close partnership is the safety of our first responders in having back up and being able to alleviate the workload by defraying the burn-out factor as we continue to see that rise in calls for service. Thank you to our fire departments and local EMS for making this partnership such a success.
Ordinance Enforcement- While we continue to absorb and take on new code enforcement cases especially related to fire hazards; we continue to follow up on and conclude cases that have been ongoing for quite some time. We are continually working with county and other jurisdictions enforcement teams with the hope to rewrite the code enforcement process making it more effective in adjudications for everyone. We continue to work with the D.A.'s office and will be holding a meeting for all when additional scheduling conflicts are resolved. An invitation will go out to all that are interested.
PAL- Recently we held another Hunter's education course with approximately another 30 individuals successful in obtaining their certification. These courses included our youth as well as adults interested in obtaining a hunting license or wanting education on hunting practices and safety when dealing with firearms. PAL tries to hold several courses throughout the year and are all attended well. If interested in a course, please visit our PAL website for the next opportunity to join us. These classes are free to everyone and do not have an age requirement although attendees must successfully complete a hundred question test to obtain their certificate.
While our clay birds' team is concluding their season, our swim team is just beginning theirs. It looks like it will be another great season for the swimming team, and we look forward to your support. We will also be holding another summer wrestling program beginning in July as well as holding several fundraisers for our Skate Park project.
Misc.- As mentioned above and at the last meeting, the Fire department and the PD have attended several town hall and fire meetings in anticipation of the upcoming fire season. We continue to work on our consolidation efforts and really appreciate both towns' involvement and support. EMS also held their annual MCI drill, this year, located at the Jr. High School, resulting in another successful and very important training opportunity.
Additionally, our invitation to come out on a ride-along still stands. This unique opportunity will provide you an insight in how the Police Department works on a daily basis as well as being able to directly observe the ongoings around town that most people don't get the ability to. ,ORT JONES

In conjunction with Etna Ambulance, we assisted in planning for and participated in our annual MCI drill at the Scott Valley Jr High School. This year this training met all the target benchmarks by bringing local and state fire response, EMS transport, Law Enforcement, dispatch, and various County support agencies together.
We have applied for several state and private grants to assist with upgrading various equipment needs. If awarded we'll bring those to council for approval later this summer or early fall.
We picked up our new to us Type 1 engine. We are currently working on getting it outfitted and will soon have new decals and be ready for response. Once it is in service we'll be sending our 2001Type 1 to the shop to have some major maintenance and repair work done.

There have been multiple escaped burns piles already this year. One was in Town and several out in the valley. Even though we may have moisture, this is a reminder that a fire will start even if it's wet. Larry Alexander got the grant for his company (Northern California Resource Center) for the removal of vegetation on the east side of town and up and around the water tanks, for a total of 345 acres, which includes along the slope. Larry's company has been working with Cal Fire and Fort Jones Fire Department for 2 ½ years with this grant. Everett was inquiring what will they be doing with the down trees. Larry explained that they would be thinning down the trees and removing the ones that fell. 6 to 8 inches landowner if bigger firewood program if they don't want the wood. Everett wanted to know ifNCRC will be clearing the area around the water tanks and how they will be dealing with the down trees that exist.

But the fire started under the ground and ignited the tree's roots, and his neighbor was the one who called.

Request received from the Collier Interpretive & Information Center (CIIC) to provide a one-time donation to support this gateway to Scott Valley and Siskiyou County.
Summary
The Collier Interpretive Center is a Information and Visitor Center on the way into Scott Valley and Siskiyou County which serves travelers and locals by providing a rest stop that offers educational recreational and functional facilities.
It is a policy decision whether the Council wishes to provide financial support for this organization.
Recommendation

Background
The CIIC is a joint powers authority with various governmental entities represented. The CIIC provides many resources for its visitors. These resources relate to tourism, local economies, public safety, community awareness and County of Siskiyou identity.
Council Member Johnson has been the Town of Fort Jones representative to this organization and has attended three meetings in the recent past. According to the information provided at these meetings, CIIC has many benefits for our communities such as informing visitors about the many interesting and beautiful places to visit in Siskiyou County and supporting small and local businesses. Annually, 6,063 visitors stop at the CIIC.
As an official Visitor and Information Center this site offers many opportunities to visitors to better get acquainted with Scott Valley and Siskiyou County. CCII offers educational

In addition, this organization supports youth and students and families through Cradle to Career Siskiyou to achieve their goals and be successful in life. CIIC also participates in a program through the North State Together which is a collaboration of many organizations providing training, mentorship and paid work experience.

Hi Silvia,
Please allow me to provide a little clarity about the CIIC JPA agreement. a. It comprises 9 cities (Dorris, Dunsmuir, Etna, Ft. Jones, Mt. Shasta, Montague, Tulelake, Weed, Yreka and I the County.
b. Each city is expected to provide a representative from their community to sit on the board to represent their community's interest. This person can be a council member or an active member of the community via written authorization from the city.
I c. Said representative is responsible for reporting to their council what is discussed from the Collier board I d. Usually the board president and another officer present to the councils annually on our budget and visitation numbers and answer any questions, however we have had some challenges meeting that goal the last couple of years.
e. Currently we have 1 part time employee (3 days a week) who is not working while we secure funding f. Our billing goes from July 1- June 30. So for the current year the cities that have paid are Weed - $267.50, Tulelake - $1000, Montague $500 - Mt. Shasta - $1000, and the county pays $916.67 monthly. g. The remaining cities have not paid or provided volunteers. h. Our advertiser support has decreased over the last 2 years and last year was down over $15K. i. Our goal is to have enough consistent funding to be open for 5 days per week. j. The board representatives are responsible for providing posters for events and any brochures they would like to display at the center
k. The Collier Rest Area serves over 1 million visitors annually and the visitor center welcomed 5694 visitors in 2025. And remember this is primarily on a 3 day week and we were closed approx. 7 weeks last year for repairs.
Please feel free to contact me directly.

The Town of Fort Jones has three expiring seats that are up on November 3, 2026. The action is to adopt a resolution giving notice of such election, and consolidating election services with the County of Siskiyou Elections Office for economies of scale.
Recommendation
Per the elections code the Town of Fort Jones has until July 1, 2026 (E 125) to call the election and request consolidation. This allows voters to receive notice of the upcoming election and allows for the Siskiyou County Elections Office to start planning all logistical steps related to.the November 3, 2026, election.
Background
The Town of Fort Jones will be holding a three-seat election on November 3, 2026.
According to the last Siskiyou County Elections Office, there are currently 392 registered voters in the Town of Fort Jones. If the Council approves these actions, the County of Siskiyou Elections Office will consolidate the election, saving taxpayers money and allowing for a more efficient electorate process.
Per the California Elections Code, the nomination period runs between July 13, 2026 and August 7, 2026 (E-113-E 88). This is the period when incumbents and other registered voters who reside in the Town of Fort Jones are 18 years of age, can come and pull nomination papers from the Town Clerk. In addition, to pull nomination papers with the Town Clerk, it is recommended that you make an appointment.
Fiscal Impact
The Town of Fort Jones 26-27 budget has allocated funds to pay for these election services in the amount of 5K.

Consideration of a Salary Adjustment for the Town Clerk of the Town of Fort Jones Summary
By motion consider a salary adjustment for the position of Town Clerk from step 1 to step 3 as per the approved Salary Schedule (attached).
Background
The Town of Fort Jones Town Clerk is appointed by Council (Municipal code 2.24.020).
The Town Clerk reports directly to the City Council with the City Council being responsible for holding regular evaluations. Ms. Corinne Guidi started her tenure with the Town of Fort Jones on September 15, 2025. Interim Town Administrator Hess had a check-in with her at three months, at her request. She passed the three-month probation, began receiving health insurance in January 2026, and retirement benefits in February 2026 but did not receive a raise. She is at step 1 of the Salary Schedule which equals $23.92 per hour.
The City Council held its first check-in with the Town Clerk on May 11, 2026 under a Closed Session meeting. At that meeting direction was given to the Town Administrator to bring back a salary adjustment for Council approval at a regular City Council meeting.
Ms. Guidi has taken the Nuts and Bolts, Sexual Harassment, Muni Billing and Ethics 1234 trainings and is interested in becoming a public notary. She has met her obligation to file a Form 700 Statement of Economic Interests.
Recommendation
The Town Administrator recommends that the Council consider approving a salary increase from Step 1 to Step 3 for the appointee serving in the position of Town Clerk. The actual increase in the hourly rate is $1.81 which brings the new hourly rate to $25.73.

Official City records kept at safe deposit box at Mechanics Bank and options for Council consideration
Summary
Documents related to Community Development Block Grants (CDBG) are being kept at a safe deposit box at Mechanics Bank.
Background
Recently the Town of Fort Jones was billed $130 for a safe deposit box at Mechanics bank.
Due to high staff turnover and lack of institutional history, staff requested that the Mayor and another Council Member access the box and find out about its contents.
Mayor DeAndreis and Council Member Garcia went to the bank and were able to see the box contents. It contains titles, deeds and promissory notes as well as other documents.
These types of City records, and normally all City records, are kept on site at City Hall under the custody of the Town Clerk.
Upon contacting SKF about the finding, the recommendation was that "I agree that the Deeds should be at City Hall in a safe or vault. Second, for those loans that have been paid, a Reconveyance needs to be completed and recorded against the property. This will remove the loan and any other requirements from the property and will be a good backup for HCD."
Staff is bringing this forward so Council may have a discussion about one of two solutions:
1) keep the safe deposit box and pay the annual fee or 2) make a one time purchase of an office safe/vault to keep these important records on site, and do away with recurring fees.
Recommendation
Staff recommends that Town Council discuss the two options: 1) keep the safe deposit or 2) purchase a safe/vault (see attachment A) for the approximate cost of $274.00 (see attachment A).
Fiscal Impact
There are funds to purchase this one-time equipment for City Hall.

Proposed Budget 26-27 and Resolution Adopting the 2026-2027 Budget for the Town of Fort Jones
Summary
Approve by Resolution the 26-27 Budget for the Town of Fort Jones including approval of Phase I of the Water Main Replacement Project for a total cost of $135,573.75 to be paid out of the Water Fund
Background
Reality
This 2026-2027 budget was prepared with the following assumptions in mind: 1) status quo budget with an accounting/finance position, 2) $85,000 was budget for a Town Administrator position, and 3) figures from the last Financial Transactions Report were used. The original 5% increase across services, materials and payroll was excluded from this budget. All departments were involved in the preparation of the document, projecting expenditures, and clarifying postings, grants and other revenues. It was certainly a joint effort by the Town of Fort Jones team, and I am appreciative of staff's dedication.
The Town Council has been focused on addressing its fiscal responsibility and reporting obligations, and as such has hired professionals who have focused on these realities.
The FTR (Financial Transactions Report) was submitted on time with the State Treasury and there are other reporting obligations the Town must fulfill to remain in good standing with State Treasurer Department as well as Auditor's Office (State and County).
In the current budget, allocations for buildings and staff time are being made directly to the pertinent funds, allowing a sharing of billable time and expenses to various funds, with the intent of alleviating General Fund charging.
The amount of sales and property tax revenues the Town has received for the last three years is:
2023- $514,855
2024- $403,073
2025- $499,160
Regarding fund balances, the Water and Sewer funds have the following funds $1,118,287.94.
Major expenses for 26-27 that should be closely monitored are public safety services.
In fact, the cost of the agreement to be approved tonight will be about 45% of the revenue that we receive annually. With income from Cops grant ($103,000) and Growth Allocation ($100,000) the actual cost to the Town of Fort Jones is still $164,000 or 32% of our total revenues. It is common knowledge that the current Police Department provides exceptional service to the Town of Fort Jones; however, the agreement cost is pivoting the finances of our town towards a structural imbalance that will need to be addressed or mitigated.
Initiatives
As an example of the Council's commitment to transparency and accountability, in early 2025 a consultant was hired to address the Community Development Block Grants (CDBG) and issue a Profit Income (Pl) report for HCD (State Housing and Community Development Department) as well as 2025 Loan Summary statements to loan holders.
At this point the consultant BKF has completed the following tasks:
• Housing Rehabilitation Loan Portfolio Review
• Financial Reconciliation & Program Income Accounting
• Program Income Compliance and Reporting
As of April 30, 2026, the original budget of $20,000 had been nearly exhausted. Council may need to consider the last goal:
• Ongoing and As-Needed CDBG Administrative Support
It is a Council decision to use BKF in an ongoing capacity for administrative support until a municipal accountant is on board. The work that has been performed is an important accomplishment to come into compliance with HCD requirements, which in turn may allow the Council to utilize CDBG funds for certain discretionary uses.
As of May 2026, HCD cancelled the monthly meeting and requested an update on the progress the Town of Fort Jones is making. Staff and BKF worked together to provide that update, with a draft of the first Profit Income (Pl) report, and the question was posed about funds being used for an emergency project (Water Main Phase I). While HCD did not affirmatively respond to the question, it was a fair exercise to recognize that HCD still wants to see more work on our part. Currently, the total amount in the bank for CDBG income is Account 0141 = $676,985.32 and account 0189 = $965,248.15. These are restricted funds that will only be used according to
requirements and standards set by HCD. In fact, all CDBG funds may be frozen until the Town can furnish a current audit to the State.
As with any organization which has been through transitions and staff turnover, the Town of Fort Jones is working towards a better place by meeting fiscal obligations, which will possibly lead to more grants and other sources of revenues. Audits are needed and the continuation of oversight and checks and balances are crucial for the financial health and survival of the Town of Fort Jones.
As a three-seat election is on the horizon (November 2026), the cost for these election services was also projected. Another exception to the status quo budget is a $2,500 expenditure for an adequate phone system for City Hall, which currently is non-existent.
Another area where the City Council has embraced progress and process is in the hiring of a Planning consultant (Mark Teague with PlaceWorks) to professionally review Planning actions. This allows the Council to act as the Planning Commission for the Town of Fort Jones when the zoning actions require it. Here the Council has a unique future opportunity to update its Municipal Code, regarding fees and cost recovery. This could be a plausible source of income as often staff's time is not being recovered, and the Town is subsidizing actions that could bring in revenue. In this area, the Council can improve revenues by establishing - via ordinance - staff time and recovery fees for items such as Boundary Lot Adjustments, Variances, and other Zoning actions.
In the area of capital improvements, the Town Council approved last year the study and design for the Water Main Replacement Project (Sterling to Douglas Streets). Currently, staff is proposing a two-phase approach due to the water main line leaking in front of the Cal Fire station.
Water Main Phase I: The funds for phase I are available in the water and sewer funds.
Data shows that 40,000 to 50,000 gallons of water are lost every day. Our Public Works staff has been diligent about informing the Town Administrator and seeking solutions.
Staff sought an engineer's estimate and plans for the repair from E&S, and the cost is $135,573.75 (see attachment A).
Water Main Phase II: The project is to completely replace the water main line between those two streets (Sterling to Douglas). This item will be coming back to Council for final approval and with a defined budget and plans. The total estimate for Phase I and Phase II for this project is $603,000.
Other projects that are in the works are the sewer project on Cowan St. and a rough estimate is at $200,000 in the sewer budget. This will need to come back to Council for formal approval and a solid estimate.
Yet another project for the 26/27 fiscal year, that Public Works is leading, is the Bridge Street construction and this will be paid by STIP - State Transportation Improvement Program for a total of $253,000.
Finally, this Council continues to be committed to the Waste Water Treatment Plan (VVWTP) project which will provide renewed infrastructure for the current and future residents. To date (May 2025-April 2026) $519,814.07 has been spent through the State grant. Much progress has been made including a vegetation plan that includes native plants; SHN also filed an amendment to the agreement to continue utilizing grant funds, and preliminary discussion/research about a rezoning and annexation process for 9.2 acres of land is ongoing. In June, we were informed by the consultant that the design is 90% complete and the completion of the project is estimated to be in 2029- 2030. There is $223,412.00 remaining in the grant which will likely all get spent over this next fiscal year. This effort is being led by SHN, our Public Works staff and Council Members who attend the meetings.
Also on the horizon is the change of location for the Community Park, funded by a grant that expires in 2028. Council has held a total of three community outreach meetings with the community, and the next step is to have Council approval on the location change for the new park. It is anticipated that this will come to Council in July 2026.
City Council has also invested in providing up to date equipment to staff by approving the purchases of a new utility vehicle and a Fire truck. In the future it would be fiscally prudent to include a CIP (Capital Improvement Project) budget where departments list their needs, attach a cost, and can come to Council for approval on top priority items. In the area of technology, the City Hall firewall was replaced, and new access points added, securing our infrastructure from outside threats and providing a more reliable Wi-Fi connection.
Organizationally, the Town Council is focused on valuing its employees, embracing current human resource practices, and enabling action and completion of sound initiatives. The team is motivated to modernize practices and is filled with proactiveness and initiative. Capitalizing on these facts, and the fact that the Council wants financial stability and sustainability, the hope is that Town of Fort Jones will continue working towards financial solvency and stability.
Future
The Town Council of Fort Jones is positioned to make great progress in three areas:
fiscal regulatory compliance, infrastructure improvements, and staff development and retention.
The greatest risk to the Town, and in particular to the General Fund, is the noticeable tipping towards a structural imbalance that needs addressing. In order to keep the
General Fund solvent for the past few years, Council has relied on STRIKE Team revenue and bulk water sales to operate all the required functions of the Town. In addition, FEMA (Federal Emergency Management Agency) funds (approximately $200,000) have provided unexpected relief. This model of relying on natural disasters to balance a budget and provide governmental services provides little assurance of fiscal continuity or guarantees residents the services that are required. In 2024-2025, the General Fund lost over $325,000 even with STRIKE Team revenue. The 2026-2027 budget again projects a loss in the general fund of $372,152. This model is having a drastic effect on the fund balance of the General Fund.
The future must include securing additional sources of income which could range from updated fees to a possible measure on the ballot, or foregoing passing on to the Fire Department revenues that are needed to supplement the General Fund, i.e. STRIKE Team and FEMA reimbursements.

STAFF REPORT
FROM THE TOWN ADMINISTRATOR
TO THE TOWN COUNCIL
June 8, 2026
Subject: 1. Amendment of current Law Enforcement Services MOU
2. Renewal of 2026-2029 City of Etna & Town of Fort Jones Police MOU Summary:
The Amendment of current Law Enforcement Services Memorandum of Understanding between the City of Etna and the Town of Fort Jones is needed to reflect the fiscal responsibilities agreed upon by both towns to within the current agreement coming to conclusion of its three-year agreement on June 30th, 2026.
In addition and to continue our police services partnership, a new three-year agreement between the two towns is in being proposed for approval based on the current fiscal responsibilities with a 5% increase of the first year followed by a standard 3% increase in the following two years to offset the impacts of inflation, rising costs of living, and to maintain the current level of service.
Recommendation:
Staff recommend the review of the current MOU and approval of an amendment to reflect and document past/current practices and financial impacts. The amended new Agreement amount for the current agreement should be $346,182 annually with a balance due for the last payment of the current year for $86,545.50 Staff also recommends the approval of the 2026-2029 Town of Fort Jones and the City of Etna's Law Enforcement services Agreement to solidify and continue our consolidated partnership to maintain a high level of public safety to our two incorporated towns. The new agreement between the two entities will cost the Town of Fort Jones $363,492 with a 5% increase (included) this first year, and a 3% increase for the following two years.
Background:
Since the inception of a consolidated partnership between Etna and Fort Jones to bring law enforcement services in December of 2019, each entity has continued to build on the success of that very partnership establishing a unique agreement to maintain mandated services while sharing the cost to better serve our communities. Each town has also combined and utilized state COPS funding and growth allocations to defray the continued rise in costs associated with a very complex service.
The City of Etna and the Town of Fort Jones when first entering an agreement established a six-month arrangement that continued through June 30, 2020. Building on the success of that partnership, both communities have continued to renew and maintain contractual agreements for police services, animal control, and code enforcement. An amendment to the current agreement is needed so the Town of Fort Jones can legally pay the new amount for the current agreement. Due to a communication lapse, the Town of Fort Jones did not update the current agreement to a new figure. The Town of Etna did take action on the matter. In addition, the current agreement was developed as a three-year contract and will expire June 30, 2026. This agreement is now up for renewal through 2029 to provide continued long-term stability, staffing levels and public safety services for the Town of Fort Jones.
Fiscal Impact:
The amendment to the current agreement is to cover the total cost of services at $346,182 annually for this last year of the current agreement.
The new contractual Agreement amount, plus 5% in year one equals $363,492 annually followed by a standard 3% increase in years two and three.

Fort Jones shall indemnify and hold harmless Etna, its officers, agents, employees, subcontractors and independent contractors from any claim or liability whatsoever based upon or asserted upon any act or omission of Fort Jones, its officers, agents, employees, subcontractors and independent contractors for property damage, bodily Injury or death or any other element of damage of any kind or nature occurring in the performance of this Agreement, including claims arising from enforcement of Fort Jones' Ordinances; excluding, however, such liabilities, claims, losses, damages, or expenses arising from the negligence or willful misconduct of Etna or its officers, agents, or employees. Fort Jones shall Indemnify and hold harmless Etna, its officers, agents, employees, subcontractors and independent contractors from any claim or liability whatsoever based or asserted upon any act or omission of Fort Jones, its 4 officers, agents, employees, subcontractors and independent contractors for property damage, bodily injury or death, or any other element of damage of any kind or nature occurring beyond the performance of the Agreement where such claim or liability bears a reasonable nexus to Etna's performance of its obligations under this Agreement; excluding, however, such liabilities, claims, losses, damages, or expenses arising from the negligence or willful misconduct of Etna or its officers, agents, or employees. By way of example, and not limiting the indemnity obligations of Fort Jones, if a dangerous condition of public property (such as an open excavation pit) caused a claim (for example If a criminal suspect was running from an Etna police officer fell in the pit), Fort Jones would owe indemnity and a duty of defense to Etna in such case. By way of further example, if a Fort Jones public works employee drove a vehicle to collide with a person who was at the side of the road because such person was stopped by an Etna police officer Incident to a traffic violation, Fort Jones would owe indemnity and a duty of defense to Etna on account of such claim. The above examples are intended to make clear that the dangerous condition, act, or omission of Fort Jones may have nothing to do with Etna's performance or providing of policing services under this Agreement, yet such dangerous conditions still fall within the scope of Fort Jones' indemnity and defense obligations to Etna because such a dangerous condition, act or omission bears a nexus to the performance of policing services under this agreement. Fort Jones shall defend at Its own expense, including attorneys' fees and costs, Etna, its officers, agents, employees, subcontractors, and independent contractors in any legal and/or administrative action of any kind based upon such alleged acts or omissions. The duty of Fort Jones to indemnify and save harmless as set forth in this Paragraph shall include the duty to defend. The indemnification hereunder extends to all costs, attorneys' fees and expenses incurred in obtaining expert testimony and in the retention, transportation and attendance of such expert witnesses as well as expenses related to lay or percipient witnesses, as well as any liability incurred or arising out of any such claim, the investigation thereof, as well as the defense of any action or proceeding brought thereupon as well as from any order, judgments, verdicts, decrees or settlements which may be reached or entered thereon.
The indemnity and hold harmless provisions contained herein are binding upon the parties hereto without regard to whether any insurance coverage or the insurance policy is available for the acts and/or condition for which the indemnity has provided pursuant to this paragraph. The indemnity and hold harmless provisions contained herein shall survive the termination of this Agreement and shall continue after such termination for any liability arising out of or as a consequence of this Agreement or the performance of any services under this Agreement. Etna shall provide evidence of liability coverage to Fort Jones and Fort Jones shall provide evidence of liability coverage to Etna related to this Agreement.
