STAFF REPORT
City Council Consent Agenda Item
DATE: March 7, 2022
TO: Honorable Mayor and Councilmembers
FROM: Cameron Mull, Director of Parks & Recreation
THROUGH: Merritt Perry, City Manager
SUBJECT: Supplemental Budget Request for Repairs to the Depot Museum for Window Damages Sustained by Earthquake
STAFF RECOMMENDATION:

Approve the Supplemental Budget Request (SBR) and authorize City staff to proceed with repairs to the Depot Museum windows.

EXECUTIVE SUMMARY:

On December 20, 2021, a 6.2 earthquake struck Humboldt County. Most park facilities avoided any major damages; however, the Depot Museum in Rohner Park sustained 23 cracked windowpanes, mostly on the North side of the building. Due to the facilities’ limited Building Maintenance and Repairs annual expense budget of $1,200, there are not enough funds to cover the cost for the replacement of the windowpanes. Additionally, the City’s insurance policy does not cover repair damages due to an earthquake.

Staff requested quotes for the repairs from three companies. Two companies were unable to provide a quote within a reasonable amount of time. Redwood Glass provide a quote for $2,975.

City staff is requesting an increase of $3,000 to the Depot Museum’s annual budget to the current fiscal year (FY21/22) for Building Maintenance and Repairs (100-5740-5600) to cover the costs of the repair.

FISCAL IMPACT:

The estimated cost of the window repairs is $3,000. The Museum’s annual expense budget for Building Repairs and Maintenance is $1,200. The cost for these repairs will increase the annual maintenance budget by $3,000 to $4,200, which will come from General Fund Reserves.

RECOMMENDED ACTION:

Approve the SBR and authorize City staff to proceed with repairs to Depot Museum windows.

STAFF REPORT
City Council Business Agenda Item
DATE: March 7, 2022
TO: Honorable Mayor and Council Members
FROM: Merritt Perry, City Manager
SUBJECT: Authorize the City Manager to Submit a Building Forward Library Infrastructure Grant, Resolution 2022-06
STAFF RECOMMENDATION:

Approve Resolution 2022-06 authorizing the City Manager to submit a Building Forward Library Infrastructure Grant and execute all related documents.

EXECUTIVE SUMMARY:

The City of Fortuna owns the building that houses the Fortuna Library at 753 14th Street. The Library is operated by the County of Humboldt consistent with a memorandum of understanding (MOU) between the City and the County. In accordance with the MOU, the City provides the building maintenance, janitorial and utilities and the County provides staff and operates the library.

There are no provisions in the MOU for needed building improvements or upgrades to the library, however, the City and County have worked collaboratively to make improvements to the building.

Most recently the County made accessibility improvements to the interior of the library and the city is in the process of improving the path of travel to the City parking lot at 11th and N Street.

Recently the State released a call for applications for competitive grant applications to address life safety and critical maintenance needs for public libraries in California, with a maximum award of $10M. There are many critical maintenance needs at the Fortuna Library including additional accessibility improvements, functional improvements for library spaces, and general building maintenance and upgrade needs. The deadline for grant submittal is March 21, 2022.

The County is taking the lead on the development of a grant application and is working with Whitchurch Engineering (under an existing contract with the County) to identify, design and estimate the cost for needed improvements to the Fortuna Library building. The City is participating in development of the grant, and ultimately will need to be the applicant for the project, as the City is the building owner.

FISCAL IMPACT:

The County will be providing the funding for the development of the grant application and the necessary matching funds. It is not anticipated that the City will be providing any funding for the project at this time. The City will be providing staff time to contribute to the development, administration, and oversight of the grant.

STAFF REPORT
City Council Business Agenda Item
DATE: March 7, 2022
TO: Honorable Mayor and Council Members
FROM: Casey Day, Chief of Police; and Ryan Plotz, City Attorney THROUGH: Merritt Perry, City Manager
SUBJECT: Submission of Military Equipment Use Policy
STAFF RECOMMENDATION:

Receive staff report, receive public comment, and adopt Resolution 2022-07.

EXECUTIVE SUMMARY:

On September 30, 2021, Governor Newsom signed into law Assembly Bill 481 (“AB 481”), which among other things, adds Chapter 12.8 to Division 7 of Title 1 to the California Government Code providing certain requirements for the funding, acquisition, and use of military equipment, as that term is defined in AB 481, by the Fortuna Police Department.

Principally, AB 481 requires the City to adopt a written policy governing the use and acquisition of military equipment (defined below). The policy must address each of the following items:
(1) A description of each type of military equipment, the quantity sought, its capabilities, expected lifespan, and product descriptions from the manufacturer of the military equipment.
(2) The purposes and authorized uses for which the law enforcement agency or the state agency proposes to use each type of military equipment. (3) The fiscal impact of each type of military equipment, including the initial costs of obtaining the equipment and estimated annual costs of maintaining the equipment. (4) The legal and procedural rules that govern each authorized use. (5) The training, including any course required by the Commission on Peace Officer Standards and Training, that must be completed before any officer, agent, or employee of the law enforcement agency or the state agency is allowed to use each specific type of military equipment to ensure the full protection of the public's welfare, safety, civil rights, and civil liberties and full adherence to the military equipment use policy.

Business Agenda Item 6b

Page 2 of 8 ends

(6) The mechanisms to ensure compliance with the military equipment use policy, including which independent persons or entities have oversight authority, and, if applicable, what legally enforceable sanctions are put in place for violations of the policy.
(7) The procedures by which members of the public may register complaints or concerns or submit questions about the use of each specific type of military equipment, and how the law enforcement agency will ensure that each complaint, concern, or question receives a response in a timely manner.

AB 481 outlines a multi-step process for the Council to formally adopt a military equipment use policy. The principle steps (and anticipated completion dates) are as follows:
(1) Submit a proposed Military Equipment Use Policy to the City Council – March 7, 2022 Regular Meeting; Resolution 2022-07.
(2) Following submission of Policy to the City Council, the proposed Policy must be made publicly available on the City’s website for a 30-day period – March 8, 2022 to April 15, 2022.
(3) Introduction and first reading of Ordinance approving Policy at a public hearing/regular meeting – April 18, 2022.
(4) Second reading and adoption of Ordinance approving Policy at continued public hearing/regular – May 2, 2022.

By adopting Resolution 2022-07, the Council is completing the first procedural requirement of AB 481, i.e., accepting the Police Chief’s proposed Policy. Once submitted, the proposed Policy will be publicly available on the Fortuna Police Department’s website, which is accessible at the following link: https://www.friendlyfortuna.com/departments/public_safety/index.php.

The proposed Policy is attached as Exhibit A to the Resolution. The proposed Policy is modeled after Lexipol’s Model Policy 706, with minor revisions to fit the City’s circumstances. Among other requirements in AB 481, the proposed Policy includes an inventory of the Fortuna Police Department’s current military equipment.

By way of Resolution 2022-07, the Council is only accepting the submission of the proposed Policy. The Council is not approving the proposed Policy. Pursuant to the requirements of AB 481, the Council will formally approve the proposed Policy, by ordinance, at a future regular meeting following the 30-day public review period.

DISCUSSION:

Assembly Bill 481 requires local law enforcement agencies to obtain approval of their respective governing body (here, the City Council), by adoption of a military equipment use policy, as specified, by ordinance at a regular meeting held pursuant to the Ralph M. Brown Act, prior to taking certain actions relating to the funding, acquisition, or use of military equipment. “Military equipment” is defined to mean:

(15) Any other equipment as determined by a governing body or a state agency to require additional oversight.

In order for the Fortuna Police Department to continue the use of any military equipment that was acquired prior to January 1, 2022, the City Council must begin the approval process (explained above) no later than May 1, 2022. Thereafter, the required policy must be adopted and in place prior to engaging in the following activities:
(1) Requesting military equipment made available pursuant to Section 2576a of Title 10 of the United States Code.
(2) Seeking funds for military equipment, including, but not limited to, applying for a grant, soliciting or accepting private, local, state, or federal funds, in-kind donations, or other donations or transfers.
(3) Acquiring military equipment either permanently or temporarily, including by borrowing or leasing.
(4) Collaborating with another law enforcement agency in the deployment or other use of military equipment within the territorial jurisdiction of the governing body. (5) Using any new or existing military equipment for a purpose, in a manner, or by a person not previously approved by the governing body.
(6) Soliciting or responding to a proposal for, or entering into an agreement with, any other person or entity to seek funds for, apply to receive, acquire, use, or collaborate in the use of, military equipment.
(7) Acquiring military equipment through any means not provided by AB 481.

The military equipment use policy must be a publicly released, written document governing the use of military equipment by the Police Department that addresses, at a minimum the items described in the Executive Summary, above. The proposed Policy addresses each of the requirements.

The City Council must make certain determinations before it approves a military equipment use policy per Government Code 7071(d)(1). Those findings are as follows: (i) the military equipment is necessary because there is no reasonable alternative that can achieve the same objective of officer and civilian safety; (ii) the proposed military equipment use policy will safeguard the public's welfare, safety, civil rights, and civil liberties; (iii) if purchasing the equipment, the equipment is reasonably cost effective compared to available alternatives that can achieve the same objective of officer and civilian safety; (iv) prior military equipment use complied with the military equipment use policy that was in effect at the time, or if prior uses did not comply with the accompanying military equipment use policy, corrective action has been taken to remedy nonconforming uses and ensure future compliance. The Council will consider these findings at the time of the introduction and first reading of the Ordinance at a future regular meeting.

Following adoption of the initial Policy, the Council will annually review a report submitted by the Police Chief that contains:

Business Agenda Item 6b

(4) The total annual cost for each type of military equipment, including acquisition, personnel, training, transportation, maintenance, storage, upgrade, and other ongoing costs, and from what source funds will be provided for the military equipment in the calendar year following submission of the annual military equipment report.
(5) The quantity possessed for each type of military equipment. (6) If the law enforcement agency intends to acquire additional military equipment in the next year, the quantity sought for each type of military equipment.

Additionally, Fortuna Police Department must also, within 30 days of submitting and publicly releasing an annual military equipment report, hold at least one well-publicized and conveniently located community engagement meeting, at which the general public may discuss and ask questions regarding the annual military equipment report and the Police Department’s funding, acquisition, or use of military equipment.

As noted above, by adopting Resolution 2022-07, the Council is accepting the Police Chief’s submission of the proposed Policy. The Council will consider the substance of the proposed Policy and consider adopting the proposed Policy at a future regular meeting following the public review period.

STAFF REPORT
City Council Business Agenda Item
DATE: March 7, 2022
TO: Honorable Mayor and Council Members
FROM: Siana L. Emmons, City Clerk/Human Resources Manager THROUGH: Merritt Perry, City Manager
SUBJECT: Approval of the Amended Full Time Classification and Pay Rate Schedule for Fiscal Year 2021-2022; Resolution 2022-08
STAFF RECOMMENDATION:

Consider approving the amended Fiscal Year 2021-22 Classification and Pay Rate Schedule for full time employees. Resolution 2022-08.

EXECUTIVE SUMMARY:

On February 22, 2022, City Council approved a two year Memoranda of Understanding (MOU) with the Fortuna Employees Association (FEA) and Fortuna Police Employees Association (FPEA), and a Resolution with the unrepresented/confidential employees. Each agreement is effective through June 30, 2024. These agreements included Cost of Living Adjustments (COLA’s) for the first year and second year of the agreement. The table below outlines the agreed upon COLA’s:

Fortuna Employees (FEA) 8% COLA effective April 1, 2022 and a 2% COLA July 1, 2023.

Fortuna Police Employees
(FPEA)
12% COLA and a one-time additional COLA of 4% to
pay classification F47 "Police Sergeants", effective
April 1, 2022.

Unrepresented/Confidential
Employees
8% COLA effective April 1, 2022 and a 2% COLA
July 1, 2023.

Staff is presenting an updated Full-time Pay Rate Schedule, which includes the negotiated increases for consideration, and is included as an attachment. Some of Fortuna’s Part-time employees received an increase to their hourly wage in January due to the increase of minimum wage from $15.00 to $16.00/hour. In addition, all other part-time employees received a 25-cent COLA, which was established in the previous round of negotiations. Staff anticipates returning to Council during the FY 2022-23 Budget adoption, with an updated part-time employee Pay Rate Schedule that will include the 8% COLA as negotiated by the FEA, and effective for part-time employees July 1, 2022.
