Notices Posted (Public Hearing, Agenda, Ordinance, etc.) 4 On February 25, 2022, Clerk staff attended a 6-hour virtual training, referred to as an Athenian Dialogue (AD). The dialogues are intended to explore leadership principals and practice, drawing on insights contained in a book that all participants have read. The premise of the Athenian Dialogue Society is the idea that clerks are leaders in very profound yet subtle ways, per the Athenian Leadership Society quoted on the International Institute of Municipal Clerk’s webpage.

The book for this dialogue was Capital Gaines: Smart Things I Learned Doing Stupid Stuff, but Chip Gaines. The book was a quick read or listen, but very motivating and overall, inspiring! Attending this serves two purposes, the first is after attending 10 Athenian Dialogues; a Clerk is eligible to join the Athenian Leadership Society fellowship. It is the highest recognition in the Athenian Leadership Society. The second purpose is that by attending this AD, Clerk’s receive points to put toward the education component of becoming certified as a Municipal Clerk!

RISK MANAGEMENT / HUMAN RESOURCES DIVISION
Risk Management
On February 24, 2022, staff attended the Redwood Empire Municipal Insurance Fund’s (REMIF) Board meeting. The meeting was held virtually and was well attended. Topics covered included Finance audit for program year ending 06/30/2021, Finance actuarial reports for general liability for REMIF legacy claims, and worker’s compensation for REMIF legacy claims, Finance Other Post-Employment Benefits (OPEB) for REMIF retirees, health plan, appointments to the Executive Committee and Health Care Committee, the REMIF building and general Governance.

There were also two closed session items regarding claims.

The week of April 18, 2022, CIRA Risk Manager, Erike Young, will be in Fortuna and Ferndale providing risk assessments for the cities. Staff will provide updates as more information becomes available.

On March 1, 2022, The Governor issued an Executive Order that suspended the Cal/OSHS COVID Emergency Temporary Standards (ETS) requirement for face coverings in the workplace. The Executive Order aligns the ETS with Center for Disease Control (CDC) and California Department of Public Health (CDPH) guidance that no longer requires face coverings for unvaccinated individuals.

City staff continues to provide COVID testing for all employees on site at City Hall at no cost to the employee. Chief Casey Day, Lt. Matt Eberhardt, Kendra Bailey, Buffy Gray and myself are all trained and certified to proctor the tests, and this service has allowed staff to assist employees in determining COVID status after any concern of exposure, or testing to return to work after a positive exposure.

The City continues to take all necessary measures to take the spread of COVID-19 seriously, and will continue to make the health and safety of all City employees, their family members and members of the community our priority.

There were two (0) new Worker’s Compensation claims and no new liability/tort claims filed as of February 1, 2022. There are currently two (2) ongoing liability claims.

Staff will continue to work with, George Hills and CIRA to effectively address and close claims and incidents as they arise.

EXECUTIVE SUMMARY:

Recognized Obligation Payment Schedule (ROPS):

The ROPS was successfully submitted to the Department of Finance (DOF) on January 31. The DOF requested supporting documentation, provided to the DOF on February 3, to certify the amounts being claimed. As the Council was made aware through the City Managers report at the last Council Meeting the City received notification from the DOF that an un-submitted report by the County Auditor Controllers Office jeopardized City funding in the amount of $200,000 - $400,000 for next Fiscal Year. I am pleased to report that the County Auditor Controllers Office quickly responded to the DOF request and submitted the report on February 24. The City has since received the final funding determination letter from the DOF with all funding requests tentatively approved.

EXECUTIVE SUMMARY:

City Engineer:
12th Street Interchange Modernization Project
The City’s $950,000 funding recommendation went to the California Transportation Commission (CTC) in December, and is awaiting a final approval in March of 2022. Based on discussions with Humboldt County Association of Governments (HCAOG), the City anticipates that funding will be available for programming after the March meeting. In March, staff developed and released a Request for Proposals for the Preliminary Engineering and Environmental Phase of work.

Proposals are due in April, and staff anticipate bringing the project to Council for award in midApril. 12th Street Prop 1 Integrated Stormwater Enhancement Project In early 2021 the City was notified that we were successful in receiving a nearly $1 million dollar grant to design and install stormwater improvements along 12th Street, including Low Impact Development (LID) raingardens and new stormdrain piping. Staff are awaiting the final grant for review and execution, which is expected in late March. Staff anticipate bringing a professional services contract to council for award in April.

Stormdrain Infrastructure Hazard Identification Project As noted in the previous monthly report, staff posted a second Request for Proposals for professional services to complete the stormdrain hazard identification assessment, which also resulted in no respondents. City staff has submitted a formal letter to Cal OES requesting that a non-competitive sole source contract award be allowed with our on-call consulting engineer, GHD, who has expressed interest in the project but was initially ruled out due to potential conflict of interest. Staff expect that contracting can take place within the coming month.

Tesla Battery Systems
The battery system at the City’s municipal well site remains ongoing, further site work needs to be performed to finish the elevated pad that the batteries will be installed on.

The battery system at the Kenmar water booster station remains waiting for a permission to operate (PTO) inspection from PG&E.

Consent Calendar Item 4g

Page 2 of 7 ends

The battery system at the wastewater treatment plant as of late January is fully operational.

Currently, battery power is running the site during the 4-9 pm power peak hour times. After a few months have passed, staff will assess the sites power consumption costs and report back to the Council.

Kenmar and Drake Hill Water Pump Station Emergency Stationary Generators In February the City’s consultant delivered the 90% design package to the City for review, and staff anticipate that by late April the project will be ready to bid. Due to the long lead times for generators in today’s market, it is likely that the project will be awarded late spring or early summer, but the construction will not commence until 2023. The City’s current schedule with Federal Emergency Management Agency (FEMA) for the hazard mitigation funding will expire before that time, and therefore staff are working with FEMA and Cal OES staff to perform a schedule update to extend the performance period to the end of 2023.

CDBG ADA Barrier Removal Project
This project includes Americans with Disabilities Act (ADA) barrier removal improvements for several proposed locations throughout this City, including new curb ramps at several intersections on Main Street, improvements to the Rodeo Grounds entrance, and sidewalk improvements along N Street. In January staff submitted an application packet to the Department of Housing and Urban Development (HUD), and are currently awaiting their response. After receiving the response from HUD, staff will better understand the overall project delivery timeline, and can provide a better estimate of the anticipated construction window.

WWTP Percolation Pond Rehabilitation Project
Staff put the annual percolation pond project out to bid in February and bids are due back on Friday March 25th. Staff anticipate taking the project to the Council for award on the first or second meeting in April.

Jameson Creek Fish Passage Improvement Project
All project and punch list work has been finalized. Currently staff are working to close out the project grants which includes monitoring and reporting documentation, and submitting final invoices. It is anticipated that this project will be fully closed by this summer. 12th Street Utility Undergrounding Project (Rule 20A)
The following update remains the same from the January staff report and has been left in as the anticipated timeline remains the same.

AT&T remains as the last utility with overhead facilities and poles on 12th Street. With the completion of the underground junction box in front of City Hall, last September, AT&T crews have been working to complete underground splicing and have been removing some facilities as work allows. Staff anticipates the entire project, including all pole removal and restoration, will be complete by mid-2022. Staff remains engaged with AT&T staff to ensure satisfactory progress on the project.

The team also completed 35 mark and locates with no missed marks resulting in no broken utilities.

Distribution System
This month, the Utility team changed out 12 dead meters and three old services that were badly in need of repair. The utilities team had three good leaks this month resulting in an estimated 133,200 gallons of water lost. The biggest leak was estimated at 900 gallons per minute (gpm) on Orchard.

The team dug up and replaced about 10 feet of pipe. In that 10 feet there were three previous patches that we cut out to replace with one single piece of pipe.

This old A.C. line on Orchard is recommended for replacement as multiple repairs have been made on it over the years. The leak on Hillside Dr. was also a six A.C. line that had a tree root wrap around it and crack it.

Collections System
On the collections side, we had one sewer back up on Newell. The team worked on the site for hours until getting it to drain, we then sent the camera in to find the reason we keep getting backups here and found a very bad blockage. It was a full plug of roots holding back all the solids. The team went in with the spinner head and finally got the plug demolished.

The team also started using the sewer camera at the North West end of town at Bryant Lane., and worked their way down Main Street, first cleaning the mains with our new VacCon truck then going in with the camera for inspection. We will be working on this project as much as we can unless emergencies arise.

Miscellaneous Tasks
The team has been training Street Maintenance Worker III, Tim Munsell, on driving certain vehicles, so he can
obtained his commercial driver’s license permit and is
working toward his commercial license.

The utilities team did monthly maintenance on the heavy equipment, greasing and checking all fluids.

Water Treatment/Wastewater Division- Chief Plant Operator Tesco Radio Upgrade Project: Technicians from Tesco worked at the City early in the month, changing out all remote booster pump station and sewer lift station radio telemetry equipment. This Capital Outlay project provides the City with the most modern and efficient radio communications infrastructure, while also complying with updated Federal Communications Commission (FCC) frequency requirements. The old radios were obsolete and extremely difficult to find parts and direct replacements.

Annual Fire Extinguisher Service: Staff gathered fire extinguishers from every City facility and vehicle for annual servicing. Upon completion, staff returned the recharged extinguishers to their proper location.

 Special sampling events: quarterly effluent acute toxicity; annual effluent chronic toxicity; and compost analyses.
 Cleaned the blower filters for the aeration basins.
 Serviced and rehabilitated the air compressor unit of the recycled water hydro pneumatic tank.
 The County Department of Environmental Health conducted its quarterly inspection of the City’s compost operations.
 Staff drained and cleaned Secondary Clarifier #5,
reducing the plant’s secondary treatment system to
just one clarifier. This is mainly due to
unseasonably low flows. Staff also rehabilitated the
clarifier’s metal infrastructure—grinding and
coating rusted areas of the rake mechanism and
discharge piping.

STAFF REPORT
City Council Business Agenda Item
DATE: March 21, 2022
TO: Honorable Mayor and Council Members
FROM: Merritt Perry, City Manager
SUBJECT: Authorize the City Manager to Submit an Urban Greening Grant, Resolution 2022-09
STAFF RECOMMENDATION:

Approve Resolution 2022-09 authorizing the City Manager to submit an Urban Greening Grant for the acquisition of forest land adjacent to the Vancil Reservoir and execute all related documents.

EXECUTIVE SUMMARY:

Signed into law on September 14, 2016, SB 859 (Chapter 368, Statutes of 2016) created the California Natural Resources Agency’s (Agency) Urban Greening Program, funded by the Greenhouse Gas Reduction Fund (GGRF). Approximately $47.5 million is available for urban greening projects that reduce Green House Gas (GHG) emissions and provide multiple benefits.

The State anticipates one funding cycle; however, funding cycles are contingent upon the number of competitive applications. There are no maximum or minimum grant awards and no required grant match.

Eligible urban greening projects will reduce GHG emissions, mitigate the effects of extreme heat, and provide multiple additional benefits, including, but not limited to, a decrease in air and water pollution or a reduction in the consumption of natural resources and energy.

A competitive project will maximize opportunities to reduce GHG emissions through project design and implementation as well as incorporate green infrastructure solutions that improve the sustainability and function of existing urban hardscapes and landscapes. In addition to reducing greenhouse gas emissions, SB 859 requires all projects to achieve measurable benefits. Per statute, all projects must do at least one of the following
 Acquire, create, enhance, or expand community parks and green spaces, and/or  Use natural systems or systems that mimic natural systems to achieve multiple benefits.

The grant application process is fairly straight forward and consists only of an online submittal.

Staff have identified a potential acquisition project that meets requirements of the Urban Greening Grant Program and proposes to acquire the approximately seven acre parcel adjacent to the City owned parcel that contains the Vancil Reservoir. This serves as a green-belt within otherwise residential area has provided a stunning backdrop to the Fortuna’s Rohner Park and in particular the Rodeo Grounds. Recently the parcel was logged and is currently being considered for development for residential purposes, for which it is zoned. Acquisition of this parcel will ensure this area remains a green-belt, a forested backdrop for the park, and opens up the potential for a trail from the Vancil Street area directly to Rohner Park. The figure below shows the proposed acquisition, as well as the other nearby city-owned parcels.

Staff has been in communication with the property owner and they are willing to sell the property and will provide a “willing seller” letter to accompany the grant application. The total cost of the project with title, escrow, appraisal and other costs is expected to be approximately $350,000.

Business Agenda Item 5a

Page 3 of 4 ends

FISCAL IMPACT:

The primary costs to the City will be staff time to develop the grant application and the costs of an appraisal, which will be contracted for in advance of the grant awards. If the grant application is not successful, the City will have to pay for the appraisal costs, which is expected to cost up $5,000.

Funding would come from Measure E funds that have been set aside for parks acquisition and improvement. If the grant is successful, the appraisal costs may be reimbursed as a part of the grant.

STAFF REPORT
City Council Business Agenda Item
DATE: March 21, 2022
TO: Honorable Mayor and Council Members
FROM: Merritt Perry, City Manager
SUBJECT: Approve Proposed Staff Position Changes and Pay Classification Changes STAFF RECOMMENDATION:

Staff recommends that the City Council approve the proposed pay classification changes including the corresponding organizational chart changes.

EXECUTIVE SUMMARY:

Staff is recommending the following position changes and reclassifications. Staff understands that in general the council would like to see staffing changes during the development of the annual budget, however, given the departmental needs the following changes are being recommended to make now in advance of the annual budget. Additional changes may be requested in the future.

Below is a list that with the current proposed changes with the purpose of each change:

1. Eliminate Deputy Director of Public Works and add Public Works Director - The recent resignation by the Deputy Director of Public Works led to the review of that position and its responsibilities. Staff feels that the City would be better served by removing the City Managers’ responsibility to Public works as its Director and having a full time, dedicated position to serve that department. Due to the demands on the City Manager for other assignments and projects outside of Public Works, there has not been sufficient oversight, staff development and the general participation needed by the department. By eliminating the Deputy Director position and adding the Director position, we expect to be able to provide the oversight and expertise needed in that department. This was previously brought to council for approval and staff were directed to proceed with the recruitment and approval of this change now would formalize that decision.

2. Eliminate Utility Lead Worker Position and Add Utility Shift Supervisor Position – It has been challenging for the City to find a qualified Utility Superintendent with the skills desired for that position, specifically someone that is able to handle both the technical and professional duties required of that position. Currently the lead worker has been filling in to provide an oversight of the utility crew, with less of a focus on the long term planning for the division than would be desired by a Utility Superintendent. Additionally, the Utility Lead worker is required to have similar number and level of certifications and responsibility level as the Wastewater Shift Supervisor but there is a significant disparity between the pay of the two positions. Reclassifying the lead worker as a shift supervisor would change the pay scale classification from an F32 to F39.

Business Agenda Item 5b

Page 2 of 3 ends

Staff feels that changing the Utility Lead Worker to a Utility Shift Supervisor, would provide adequate oversight needed for the Utility Division and the newly created Public Work Director and existing engineering staff could handle the technical and professional tasks that would be needed as a result of the continued frozen status of the Utility Superintendent Position.

3. Reclassify Recreation Program Supervisor– The Recreation Programs Supervisor position develops and oversees recreation programs and conducts hiring and oversight of several recreation staff positions. This is a highly responsible position with high expectations from both the public and City Manager. Currently this position is classified at the lowest pay category in the City that ranges from $16.20/hour (minimum wage) to $19.70 per hour.

Typically within our pay scale positions of a higher responsibility are paid at least 8-10% higher than those they supervise, and in this case the highest pay scale for the Recreation Supervisor is approximately 7% over Recreation Program Coordinators (which are supervised by the Recreations Supervisor) with a salary that ranges from $15.00 to $18.24.

Additionally, staff have reviewed this position and determined that this is more responsible position that oversees up to four Recreation Coordinators and 16 Recreation Leaders, and should be classified above the Facility Custodian, which has no oversight responsibilities or educational experience requirements. Therefore it is the opinion of staff that the Recreation Supervisor should be reclassified at least two steps above the Facility Custodian position to either to either F20 or F23. Step F20, has a salary that ranges from $17.65/Hr. to $21.48/Hr., which is approximately $1.45/hr. higher than scale F15. F23 is approximately $1 more per hour above F20. Therefore staff proposes to reclassify the Recreation Program Supervisor to the F20, pay classification. This proposed pay scale is comparable with Recreation Coordinator positions at other Humboldt County Cities but, remains significantly less than Recreation Supervisor Positions at other local cities.

FISCAL IMPACT:

The anticipated cost changes for the proposed organizational chart changes described above are shown in the table below:

Proposed Change
General Fund
Annual Cost
Impact
Enterprise

The proposed changes above reflect the current pay scales recently approved by the council. The proposed changes would increase the general fund budget by $11,200 and would result in an enterprise fund savings of $28,850. The costs for the Recreation Supervisor would come from Measure E.
