STAFF REPORT
City Council Consent Item
DATE: August 15, 2022
TO: Honorable Mayor and Council Members
FROM: Merritt Perry, City Manager
THROUGH: Ryan Plotz, City Attorney
SUBJECT: Approval of Memorandum of Understanding between City of Fortuna and Fortuna Senior Center
STAFF RECOMMENDATION:

Approve the Memorandum of Understanding (MOU) between City of Fortuna and Fortuna Senior Center to use of Measure E Funds for senior programs.

EXECUTIVE SUMMARY:

The Fortuna Senior Center (FSC) requested $60,000 from Measure E derived funds for use for construction of their new senior center. City staff requested that the FSC revise their request to reflect funding to support programming, because with the contribution, they would not have enough to complete their project, and no resulting benefit to the public. The FSC revised their request consistent with the City’s request and it was recommended for approval by the Measure E Advisory Committee, and ultimately incorporated into the Fiscal Year 2022-2023 Budget.

In order for the City to provide the funds to the seniors, a MOU was necessary to identify the allowable uses, non-allowable uses of funds, and the reporting necessary by the FSC. The City Manager and City Attorney developed the attached MOU for the preceding purposes. The FSC has reviewed the draft and approves the provisions of the contract.

FISCAL IMPACT:

The contribution of $60,000 to the FSC will allow them to continue providing their programs and make progress on their new facility. The funds identified for use in this MOU are budgeted in the Fiscal Year 2022-2023 City of Fortuna annual budget.

RECOMMENDED BOARD ACTION:

Staff recommends that the City Council approve the MOU between the City of Fortuna and the Fortuna Senior Center. Consent Agenda vote.

The provisions of this section shall survive the expiration or termination of this Agreement.

If a general aggregate limit applies, either the general aggregate limit shall apply separately to this project/location (ISO CG 25 03 or 25 04) or the general aggregate limit shall be twice the required occurrence limit.  Automobile Liability: Insurance Services Office Form Number CA 0001 covering, Code 1 (any auto), or if Grantee has no owned autos, Code 8 (hired) and 9 (non-owned), with limit no less than $1,000,000 per accident for bodily injury and property damage.  Workers’ Compensation insurance as required by the State of California, with Statutory Limits, and Employer’s Liability Insurance with limit of no less than $1,000,000 per accident for bodily injury or disease.

Other Insurance Provisions
The insurance policies are to contain, or be endorsed to contain, the following provisions:

The City of Fortuna, its officers, officials, employees, and volunteers are to be covered as additional insureds on the CGL policy with respect to liability arising out of work or operations performed by or on behalf of the Grantee including materials, parts, or equipment furnished in connection with such work or operations. General liability coverage can be provided in the form of an endorsement to the Grantee’s insurance (at least as broad as ISO Form CG 20 10 11 85 or both CG 20 10, CG 20 26, CG 20 33, or CG 20 38; and CG 20 37 forms if later revisions used).

Primary Coverage
For any claims related to this contract, the Grantee’s insurance coverage shall be primary insurance coverage at least as broad as ISO CG 20 01 04 13 as respects the City of Fortuna, its officers, officials, employees, and volunteers. Any insurance or self-insurance maintained by the City of Fortuna, its officers, officials, employees, or volunteers shall be excess of the Grantee’s insurance and shall not contribute with it.

Notice of Cancellation
Grantee shall provide immediate written notice if (1) any of the required insurance policies is terminated; (2) the limits of any of the required polices are reduced; (3) or the deductible or selfinsured retention is increased. In the event of any cancellation or reduction in coverage or limits of any insurance, Grantee shall forthwith obtain and submit proof of substitute insurance.

Waiver of Subrogation
Grantee hereby grants to City of Fortuna a waiver of any right to subrogation which any insurer of said Grantee may acquire against the City by virtue of the payment of any loss under such insurance. Grantee agrees to obtain any endorsement that may be necessary to affect this waiver of subrogation, but this provision applies regardless of whether or not the City has received a waiver of subrogation endorsement from the insurer. However, the Workers’ Compensation policy shall be endorsed with a waiver of subrogation in favor of the City for all work performed by the Grantee, its employees, agents and subcontractors.

Self-Insured Retentions
Self-insured retentions must be declared to and approved by the City. The City may require the Grantee to provide proof of ability to pay losses and related investigations, claim administration, and defense expenses within the retention. The policy language shall provide, or be endorsed to provide, that the self-insured retention may be satisfied by either the named insured or City.

Acceptability of Insurers
Insurance is to be placed with insurers authorized to conduct business in the state with a current A.M. Best’s rating of no less than A:VII, unless otherwise acceptable to the City.

Verification of Coverage
Grantee shall furnish the City with original Certificates of Insurance including all required amendatory endorsements (or copies of the applicable policy language effecting coverage required by this clause) and a copy of the Declarations and Endorsement Page of the CGL policy listing all policy endorsements to City before disbursement of the Award. However, failure to obtain the required documents prior to disbursement of the Award shall not waive the Grantee’s obligation to provide them. The City reserves the right to require complete, certified copies of all required insurance policies, including endorsements required by these specifications, at any time.

STAFF REPORT
City Council Consent Item
__________________________________________________________________________________________________________________ DATE: August 15, 2022
TO: Honorable Mayor and Council Members
FROM: Merritt Perry, City Manager
SUBJECT: Award of Bid for the 2022 Vancil Tree Removal Project Timber Sale to Humboldt Redwood Company
STAFF RECOMMENDATION:

It is recommended that the Council award the 2022 Vancil Tree Removal Project Timber Sale to Humboldt Redwood Company and authorize the City Manager to execute all applicable documents.

EXECUTIVE SUMMARY
The City owns and operates the five million gallon Vancil reservoir located on Vancil Street in the City of Fortuna. The parcel the reservoir sits on is approximately 13 acres in size with the reservoir occupying approximately two and a half acres. There are redwood trees surrounding the reservoir site that routinely drop needles and branches which causes drainage issues and fence damage. The proximity of the existing trees to the reservoir results in an increased risk of fire damage. Additionally, there are four residences adjacent to the timbered portion of the site that have requested that trees be removed that are in close proximity to their homes.

A project to make improvements to the site including grading, drainage, tree removal, fencing and other site improvements is included in the City’s capital improvement program and is identified as project 9370. In July of 2021, the council approved a contract with BBW Associates (BBW), a forestry consulting company, to assist the City with permitting removal of the trees surrounding the Vancil Reservoir.

Since that time, BBW has submitted a timber harvest exemption and supporting background studies necessary to the California Department of Forestry (CDF) to obtain approvals to harvest trees in close proximity to the reservoir. The proposed location and operational parameters will be contingent upon and consistent with CAL FIRE Exemptions CCR 1104.1 and 1038.c6.

The planned selective tree removal will reduce wildfire hazard adjacent to residential structures and remove encroaching trees from the base of the Vancil reservoir. Tree removal is generally limited to within 100 feet of the reservoir fence, and trees selected for removal will remove ladder fuels, intermediate sized trees with poor form and trees around the reservoir perimeter that cast debris onto the structure roof. Removal of some trees is necessary for the water reservoir perimeter fence replacement as well. Some larger conifers with stronger form will be retained.

Consent Item 4d

Page 2 of 2 ends

BBW and City staff have reached out to adjacent neighbors and feedback that those adjacent to the timber harvest support the project.

In July 2022, the City advertised for bids the sale of approximately 65 thousand board feet (mbf) of timber. The City received two bids for logs from the project, one from Humboldt Redwood Company (HRC) and one from C.W. Wood Products. Based upon offered prices and accounting for trucking distances to the various log delivery destinations, staff determined the most advantageous offer for the City is Humboldt Redwood Company, (HRC) delivered to Scotia, California. The delivered log bid amounts are listed as follows:

Redwood
 HRC …………………….. $1,250/mbf.
 C. W. Wood Products ……..$975/mbf
Douglas fir
 HRC……………………… $550/mbf.
 C.W. Wood Products…… $500/mbf
Grand fir
 HRC……………………………$450/mbf
 C.W Wood Products………….$400/mbf
Once the timber harvest on the site is complete, the City will proceed with planning the remaining improvements on the site.

FISCAL IMPACT:

It is anticipated that the timber sale from the tree removal project will cover costs for the project and may generate a small amount of revenue. Small harvests such as this that include specific requirements to leave the site in a nice condition with no slash or debris have higher costs than a typical timber harvest. $150,000 is budgeted for the remaining improvements at the site in the Fiscal Year 2022-2023 Capital Improvement Program and includes the costs for the forestry consultants, drainage, fencing and other site work.

RECOMMENDED ACTION:

Award the 2022 Vancil Tree Removal Project Timber Sale to Humboldt Redwood Company and authorize the City Manager to execute all applicable documents. Consent Agenda vote.

STAFF REPORT
City Council Business Agenda Item

DATE: August 15, 2022
TO: Honorable Mayor and Council Members
FROM: Liz Shorey, Deputy Director of Community Development THROUGH: Merritt Perry, City Manager
SUBJECT: Second Reading to Amend the Fortuna Municipal Code Regarding StateMandated Procedures for SB 9 Urban Lot Splits and Two-Unit Projects By Amending Title 17 – Zoning Regulations of the Fortuna Municipal Code Chapter 17.09 – State Mandated Procedures, and Title 16 – Subdivisions Section 16.04.070—Urban Lot Splits. Ordinance 2022-752
STAFF RECOMMENDATION:

Hold the second reading and adopt standards to regulate SB 9 Urban Lot Splits and Two-Unit Projects, including recommendations by the Planning Commission, and repeal the Urgency Ordinance, by adopting Ordinance 2022-752.

DISCUSSION:

On January 1, 2022, Senate Bill (SB) 9 (the California Housing Opportunity and More Efficiency (HOME) Act) went into effect, allowing housing developments with two residential units on one lot within residential zoning districts without discretionary review or a public hearing, subject to certain criteria, and allowing lot splits as small as 1,200 square feet without discretionary review.

Jurisdictions may adopt local ordinances including objective zoning standards, subdivision standards, and design review standards as long as they do not conflict with or prohibit the provisions of SB 9.

Ordinance Amendments
Currently the City is operating under an urgency ordinance, adopted on January 18, 2022 (codified as FMC Chapter 17.09—State Mandated Procedures and Section 16.04.070—Urban Lot Splits).

The Planning Commission considered a non-urgency ordinance at a public hearing on February 8 th, forwarded it to the Council with a recommendation to approve. At a public hearing on April 4, 2022, the City Council returned it to the Planning Commission to consider adding design standards similar to those that were adopted in the City’s Accessory Dwelling Unit (ADU) standards.

The following SB 9 design standards were recommended by the Planning Commission on June 28, 2022, and reviewed by the City Council on August 1st and first reading held.

17.09.030.D.10. Objective Design Standards. Additions or new construction shall comply with the following:
a. Consistency with Existing Units. On a site already developed with an existing residential unit, the new unit shall be designed and constructed to match the existing paint color and exterior building materials, including but not limited to siding, windows, doors, roofing, light fixtures, hardware, and railings. b. Consistency Between Multiple New Units. If residential development is proposed on a lot where no residential units currently exist, the units shall be constructed using the same architectural style, exterior building materials, colors, and finishes. c. Garage Conversion. If a garage is converted to a new unit, the garage door opening shall be replaced with exterior wall coverings to match the existing exterior garage wall covering and detailing.
d. Entrance Orientation – Detached Units. The primary entrance to a detached unit shall face the front or interior of the parcel unless the unit is directly accessible from an alley or a public street.
e. Privacy Impacts. To minimize privacy impacts on adjacent properties, the following requirements apply to walls with windows within 8 feet of an interior side or rear property line abutting a residential use.
i. For a single-story wall or the first story of a two-story wall, privacy impacts shall be minimized by either: a 6-foot solid fence on the property line, or clerestory or translucent windows for all windows facing the adjacent property; the bottom of a clerestory window must be at least 5.5 feet above the adjoining floor.
ii. For a second story wall, all windows facing the adjacent property shall be located and designed to minimize privacy impacts on adjacent residential properties, as determined by the Planning Commission through the Use Permit approval process.
f. Second Story Decks and Balconies. Second story decks and balconies shall be setback a minimum of 10 feet from a side or rear property line adjoining a lot occupied by a single-family dwelling.
g. Outdoor Stairs. Outdoor stairs serving a second story dwelling unit shall be oriented to the interior of the lot, rather than a side or rear property line immediately adjacent to the dwelling unit.
h. Architectural Details. The following architectural detail standards are required for SB 9 dwelling units located on historic properties.

The size, shape, dimensions, and configuration of individual pieces or elements of the material may differ from the primary dwelling.
[4] If primary dwelling is predominantly stucco, stucco is allowed for the dwelling unit. i. The Planning Commission may allow exceptions to these design requirements through the Use Permit approval process for projects that utilize alternative design that are found to continue to minimize privacy, noise, and aesthetic impacts to a comparable degree.

Changes approved by the Council at the August 1st meeting consist of deleting the non-historic standards from the table, since they are inconsistent with the proposed written standards which apply to all units, relocating the planning commission design exception for clarification purposes, and removal of several irrelevant references to accessory dwelling units.

ENVIRONMENTAL ASSESSMENT:

Pursuant to Government Code sections 66411.7(n) and 65852.21(j) an ordinance adopted to implement SB 9 is not considered a “ project” under the California Environmental Quality Act (CEQA). The draft Ordinance is therefore exempt from CEQA.

FISCAL IMPACT: There is no immediate fiscal impact as a result of adopting the SB 9 Code amendments. Staff processing of future SB 9 projects will subject to a $1,000 application partial cost recovery fee that was adopted in the 2022-23 Fee Schedule.

WHEREAS, the City deems it necessary and appropriate to adopt standards and regulations implementing SB 9 within the City and to provide for the enforcement of these standards and regulations consistent with State requirements; and
WHEREAS, all legal prerequisites to the adoption of the Ordinance have occurred.

NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF FORTUNA DOES ORDAIN AS FOLLOWS:

SECTION 1. Recitals. The above recitals are each incorporated by reference and adopted as findings by the City Council.

SECTION 2. CEQA. Under California Government Code sections 65852.21(j) and 66411.7(n), the adoption of an ordinance by a city or county implementing the provisions of Government Code sections 66411.7 and 65852.21 and regulating urban lot splits and two-unit projects is statutorily exempt from the requirements of the California Environmental Quality Act (“CEQA”). Therefore, adoption of this Ordinance is statutorily exempt from CEQA because it implements these new laws enacted by SB 9. The City Council hereby directs staff to prepare, execute, and file with the Humboldt County Clerk a notice of exemption within five working days of the adoption of this Ordinance.

SECTION 3. General Plan. Based on the entire record before the City Council, and all written and oral evidence presented, the City Council hereby finds that this Ordinance’s amendments to the Fortuna Municipal Code are consistent with the City’s adopted General Plan, except to the extent SB 9 precludes consistency, for the reasons set forth below:

1. Land Use Element Goals LU-1 and LU-4, and Policies LU-4.4 and LU-4.6, LU-5.1, provide that new development should be complementary to the existing character of the City. To an extent permitted under SB 9, this Ordinance imposes objective development standards on urban lot splits Business Agenda Item 5a

Page 7 of 26 ends

and two-unit projects. Such standards include regulations governing lot size, unit size, setbacks, parking, and utilities. Collectively, such standards are intended to align SB 9 projects with the City’s existing development standards—which will lessen the impact of SB 9 projects on the community’s existing character, surrounding neighborhoods, and natural features. For these reasons, this Ordinance is consistent with Goals LU-1 and LU-4, and Policies LU-4.4 and LU-4.6, LU5.1.

2. Community Development Element Policies CD-1.1 and CD-5.5 provide that new development should, among other things, be compatible with the physical characteristics of the site and surrounding land uses. This Ordinance subjects SB 9 urban lot splits and two-unit projects to generally applicable and SB 9-specific objective development standards. Such standards will promote compatibility with the physical characteristics of the site and surrounding land uses by regulating, among other things, lot access, earthquake and fire safety, setbacks, unit quantity, unit size, and parking. For these reasons, this Ordinance is consistent with General Plan Community Development Policies CD-1.1 and CD-5.5.

3. Community Development Element Policies CD-1.7 and CD-4 provides that the City should identify, designate, and protect buildings, districts, and sites of historic importance in the City. In accordance with SB 9, this Ordinance exempts properties that are designated as historical or within a historical district. Exempting these properties will protect the City’s historical buildings, districts, and historic sites by ensuring that SB 9 lot splits and two- unit projects do not occur in these areas. Consequently, this Ordinance is consistent with General Plan Land Use Policies CD-1.7 and CD-4.

SECTION 4. Zoning Regulations Amendment. Chapter 17.09 – State Mandated Procedures of the Fortuna Zoning Regulations (Title 17 of the Municipal Code) is hereby amended and replaced as set forth in Exhibit “A,” attached hereto and incorporated herein by reference.Without modifying the substance, following approval of this Ordinance, the City Clerk shall cause the Zoning Regulations amendments to be consistent in form and style with the Zoning Regulations.

SECTION 5. Municipal Code Amendment. Section 16.04.070 of Title 16 - Subdivisions of the Fortuna Municipal Code is hereby amended and replaced, in full, as follows:

16.04.070 Urban Lot Splits
Urban lot splits, as authorized by Government Code section 66411.7, are subdivisions subject to this Title that shall be more specifically governed as set forth in Chapter 17.09 of Title 17 of the Fortuna Municipal Code.

SECTION 6. Effective Date. The effective date of this ordinance is thirty (30) days after its adoption by the City Council.

SECTION 7. Repeal of Ordinance No. 751. As of the effective date of this Ordinance, Urgency Ordinance No. 751 shall be deemed superseded, replaced, and repealed by this Ordinance.

SECTION 8. Severability. If any provision of this Ordinance or its application to any person or circumstance is held to be invalid, such invalidity has no effect on the other provisions or Business Agenda Item 5a

Page 8 of 26 ends

applications of the Ordinance that can be given effect without the invalid provision or application, and to this extent, the provisions of this resolution are severable. The City Council declares that it would have adopted this Ordinance irrespective of the invalidity of any portion thereof. ///

B — Development and Subdivision Standards

1. Objective Development Standards. An urban lot split, and any development of a parcel created from an urban lot split, shall comply with all requirements of this Chapter, all objective development standards set forth in this Code or otherwise established by the City, and all other City requirements that are not in conflict with Government Code section 66411.7.

2. Subdivision Standards. Except as otherwise expressly provided in this Chapter, an urban lot split must conform to all applicable objective requirements of the Subdivision Map Act (Government Code section 66410 et. seq.) and Title 16 of the Fortuna Municipal Code. The Director shall be the approval authority for both the tentative and final map.
a. Exception. No dedication of rights-of-way or construction of offsite improvements shall be required for an urban lot split. This exception shall only apply to the extent that Government Code section 66411.7 precludes the city from requiring dedications of rights-of-way or construction of offsite improvements. This section shall not preclude denial of an urban lot split if the project would have a specific adverse impact on either public health and safety or on the physical environment unless the applicant dedicates rights-of-way or constructs offsite improvements.

C — Grounds for Denial
The Director shall deny an application for an urban lot split if any of the following are true:

1. Development and Subdivision Standards. The lot to be split does not satisfy the requirements of subsection “B” (Development and Subdivision Standards) or subsection “D” (Standards Specific to Urban Lot Splits) of this section.

2. Zone. The lot to be split is not zoned for single family residential uses. If the lot is designated as a Specific Plan area, then it will be considered to be zoned for residential uses under this section if the lot is within a portion of the Specific Plan where a single family residence is a permitted use.

3. Statutory Exemptions. The lot to be split does not satisfy the requirements of Government Code section 65913.4(a)(6)(B)–(K). (See Government Code section 66411.7(a)(3)(C).)

4. Inspection.
a. Very High Fire Hazard Severity Zone. For lots within a very high fire hazard severity zone, the application does not include proof of an Business Agenda Item 5a

Page 13 of 26 ends

inspection by the City’s building official or other City designee confirming full compliance all existing fire and building code standards. b. Earthquake Fault Zone. For lots within a delineated earthquake fault zone, the application does not include proof of an inspection by the City’s building official or other City designee confirming full compliance with applicable seismic protection building code standards. Such inspection shall include all standard City requirements for development within an earthquake fault zone.

5. Historic Properties and Districts. The lot to be split is a historic property or within a historic district that is included on the State Historic Resources Inventory or the lot to be split is within a site that is designated by ordinance as a city landmark or as a historic property or within a historic district.

6. Prior Urban Lot Split. The lot to be split was established through a prior urban lot split, or the lot to be split is adjacent to a lot that was established through a prior urban lot split by the owner of the lot to be split or by any person acting in concert with the owner.

7. Impact on Protected Housing. The urban lot split requires or includes the demolition or alteration of any of the following types of housing:
a. Housing that is income-restricted for households of moderate, low, or very low income.
b. Housing that is subject to any form of rent or price control through a public entity’s valid exercise of its police power.
c. Housing, or a lot that used to have housing, that has been withdrawn from rental or lease under the Ellis Act (Government Code sections 7060–7060.7) at any time in the 15 years prior to submission of the urban lot split application.
d. Housing that has been occupied by a tenant in the last three years.

8. Lot Size.
a. The lot to be split is smaller than 2,400 square feet. b. Either resulting lot is less than 1,200 square feet. c. Either resulting lot is more than 60 percent or less than 40 percent of the original lot area.

Business Agenda Item 5a

Page 14 of 26 ends

9. Unit Count. Either or both of the resulting lots will have more than two units.

For purposes of this section, a “unit” is any type of dwelling, including but not limited to an ADU or JADU, except to the extent such definition is determined to be inconsistent with Government Code section 66411.7.

10. Easements. The applicant does not convey all easements required for the provision of public services and facilities.

11. Specific Adverse Impacts. If the Director makes a written finding, based on a preponderance of the evidence, that the project would have a “specific, adverse impact” on either public health and safety or on the physical environment and for which there is no feasible method to satisfactorily mitigate or avoid the specific adverse impact.
a. A specific adverse impact includes, but is not limited to, the following:
i. The subdivision or development within an Environmentally Sensitive Habitat Area, which is based on specific and defined environmental impacts on protected species and habitat as established by Federal, State, or local codes and regulations, as well as established procedures for mitigating and avoiding such impacts as set forth in the Fortuna General Plan.
ii. Any lot split which results in a driveway or other vehicular access that does not provide safe access into traffic or onto the lot from traffic.
b. Because Government Code section 66411.7 precludes the City from requiring any dedication of rights-of-way or construction of offsite improvements, the Director shall deny any application where either dedication of rights-of-way and/or construction of offsite improvements is necessary to satisfactorily mitigate a specific adverse impact, including but not limited to where a subdivision or development of property would otherwise require a dedication for sidewalk, parkways, curbs, gutters, street and road improvements or other traffic improvements.
c. The City Council may establish additional guidelines that set forth circumstances where a project will have a specific adverse impact on either the public health and safety or on the physical environment.

Nothing herein shall hinder or constrain the Director’s discretion to make written findings, based on a preponderance of the evidence, that a project would have a specific adverse impact on either public health Business Agenda Item 5a

Page 15 of 26 ends

and safety or on the physical environment and for which there is no feasible method to satisfactorily mitigate or avoid the specific adverse impact.

12. Not Feasible For Residential Use. If either resulting lot is not feasible for residential use.

13. No Legal Requirement. If for any reason, including but not limited to repeal of Government Code section 66411.7, initiative or referendum, court decision or any circumstance in which section 66411.7 does not obligate the ministerial approval of an urban lotsplit, or if for any reason the Directoris not required to ministerially approve an urban lot split.

D — Standards Specific to Urban Lot Splits

1. Applicability. The following development standards shall apply to urban lot splitssubject to approval under this Chapter. Thissection shall govern in the event of a conflict between this section and any other development standard contained outside of Chapter 17.09.

2. Lot Access. Each resulting lot must have direct access to the public right-ofway, which shall be shown on the tentative and final map. All accessways must meet the size and development standards of the Fortuna Municipal Code and Fortuna Improvement Standards and Specifications.

3. Unit Quantity. No more than two units of any kind are permitted on any lot created by an urban lot split. For purposes of this paragraph, “unit” means any dwelling unit, including, but not limited to, a primary dwelling unit, a unit created under Chapter 17.09.030 (SB 9 Two-Unit Projects), an ADU or a JADU.

4. Unit Size. Notwithstanding any other provisions of the Zoning Regulation, a unit other than an ADU or JADU on any lot resulting from an urban lot split shall be limited as follows:
a. The total floor area of each residential unit developed on a lot to be split must be less than or equal to 800 square feet and more than 500 square feet.
b. A primary dwelling that was legally established prior to the urban lot split and that is larger than 800 square feet in floor area is limited to the lawful floor area and structural footprint at the time of the urban lot split.

It may not be expanded.
c. A primary dwelling that was legally established prior to the urban lot split and that is smaller than 800 square feet in floor area may be expanded to 800 square feet in floor area after the urban lot split.

Business Agenda Item 5a

Page 16 of 26 ends

5. Setbacks and Building Coverage.
a. Subject to subsections (b) and (c) below, development on either or both of the resulting lots does must comply with all standard setbacks and building coverage for its location.
