Computer/Network
Staff will be working with Nylex and AT&T to establish new fiber optic connections between City Hall and the River Lodge and the Park Office. Currently the City’s data usage exceeds what is efficiently available on the current sorely outdated lines. Updating the infrastructure will allow for growth and greater capacity and will reduce issues created by phone and computer data overloading the broadband capacity. This will be a fairly large project, and it’s an exciting opportunity for expansion of infrastructure to the City’s benefit.

Computer/Network
Nylex spent a total of 89.15 hours for the month of July and 15.3 hours for the month of August working on various issues throughout the City network. Nylex continues to maintain City networks, servers, hardware and software. The average time Nylex spends working for the City of Fortuna is 30 to 40 hours a month.

STAFF REPORT
City Council Consent Item
DATE: September 19, 2022
TO: Honorable Mayor and Council Members
FROM: Aaron Felmlee, Finance Director
THROUGH: Merritt Perry, City Manager
SUBJECT: Finance Department Monthly Report
STAFF RECOMMENDATION:

Receive report as an informational item.

EXECUTIVE SUMMARY:

Recognized Obligation Payment Schedule (ROPS) Prior Period Adjustment (PPA):

The Recognized Obligation Payment Schedule (ROPS) is the authorizing document that enables the Successor Agency to proceed with winding down the affairs of the former Fortuna Redevelopment Agency and make payments to all its enforceable obligations and projects in progress for the fiscal year. The City, as the successor to the former Fortuna Redevelopment Agency, annually gets approval for its ROPS through the Humboldt County Oversight Board and historically receives between $700 thousand and $1.1 million through the ROPS approval process (January of each year) to wind down the former Fortuna Redevelopment Agency’s activities.

Pursuant to Health and Safety Code (HSC) section 34186 (c), Agencies are required to submit their PPA form to the County Auditor-Controller (CAC) for review by October 1, 2022. This form reports the differences between the estimated obligations on past ROPS and the actual expenditures. Agencies must report the actual expenditures that were expended three years earlier than the upcoming annual ROPS period. Failure to submit the PPA report can result in lost revenue to the City in future ROPS submissions. Finance staff is pleased to announce that the City’s PPA has been submitted and received by the California Department of Finance.

Fiscal Year 2021-22 Financial Statement Audit:

July 1 signaled the start of a new fiscal year for the City. As such, staff is working on closing the previous fiscal year and preparing for the City’s annual financial statement audit. The Cities auditor will be Michael O’Connor from R.J. Ricciardi, Inc., CPA who also performed last year’s audit for the City. Last year Michael and his staff were unable to come onsite due to COVID which made the interim audit work more difficult and time consuming to complete. However, this year Michael and his staff are considering coming on site for a week to conduct interim audit. If they are unable to come on site staff is prepared to conduct interim audit work remotely.

Finance staff have been preparing for this interim audit work by preparing the necessary reconciliations, reports, adjustments and backup information that is required during the audit

STAFF REPORT
City Council Consent Item
DATE: September 19, 2022
TO: Honorable Mayor and Council Members
FROM: Cameron Mull, Director of Parks & Recreation
THROUGH: Merritt Perry, City Manager
SUBJECT: Parks & Recreation Monthly Report for July & August 2022 STAFF RECOMMENDATION:

Receive report as an informational item.

EXECUTIVE SUMMARY:

Director’s Report
• Parks staff were able to execute a successful two months of City-sponsored events in July and August without any major issues. This includes the city’s largest events of the year, such as the Fortuna Rodeo, Auto Xpo, and Hops in Humboldt. Summer is the busiest season of the year in Parks & Recreation, so many other events, facility and park rentals, summer camps, etc. were still executed as smoothly as possible by City staff. • The regularly scheduled Rohner Community Recreation and Park District (RCRPD) monthly meetings occurred on 7/6 and 8/3. Most notably, estimated amounts associated with an aquatic facility for the construction, operation and maintenance, cost recovery/ revenue, and an estimated bond rate over time for were discussed and presented to consultants LACO & Associates. These numbers are required so that calculations by LACO for annual per parcel rates for a future Benefit Assessment can be determined.

Discussing and identifying aquatic facility features allowed the consultant CounsilmanHunsaker to determine what those associated costs would be, in order for LACO to make the most accurate per parcel rate calculations.
• Plans and features for the future basketball courts rehab project in Rohner Park were finalized with City staff and landscape architect Erin Ponte. This project will be funded by Measure E, and is planned to go to bid in mid-September, with construction following as soon as possible. This project will replace the existing court with two paved, fenced-in courts with new posts and backboards, and may include additional park features and amenities, depending on cost limits.
• Plans and features for the Newburg Park expansion and rehab project were discussed with planners Ontiveros & Associates, with landscape architect Erin Ponte generating conceptual designs. The focus on the project will be to develop the adjacent 8.4 acre parcel that was recently purchased using Prop 68 Per Capita funds (combined City + RCRPD funds). Plans for additional parking, regulation soccer fields, walking trails, and bathrooms have been discussed thus far. This project will be funded by Measure E. • The Parks Dept. received a letter from California State Parks notifying the City that is was not selected/ not being awarded a $3.2 million project using Prop 68 Rural Recreation and Page 18 Consent Item e

Tourism (RRT) grant funds. This was a project that both the City and the Rohner Recreation and Park District applied for separately (two applications) in January 2022 for the potential development of a newly constructed park on a 7+ acre parcel located along the Eel River on Riverwalk Drive.

Parks & Facility Maintenance
• The entire River Lodge facility was cobwebbed from top to bottom, as well as cleanup being performed in the parking lot
• Extensive preparation, break down, and clean-up for the 3rd of July event in Newburg Park was executed
• Weed pulling was completed in the LID basin at City Hall • The deep pit BBQ’s in Rohner Park were cleaned and prepped for the Rodeo • The Rohner Park stage received wood repairs in various locations • Extensive park preparations for the Rodeo and associated carnival was completed • The Rohner Park men’s bathroom was damages due to arson/ fire damage, so cleanup was completed in time for the start of the Rodeo
• An equipment shed in Rohner Park was vandalized w/extensive graffiti and entirely repainted prior to the start of the Rodeo • The medians on Fortuna Blvd. received multiple irrigation repairs • Set-up and breakdown/ cleanup was completed for both the Jr Rodeo and (with a switchover to) the Fortuna Rodeo events in Rohner Park during the events on 7/13-7/17 • Graffiti was painted over in the Rodeo grandstands
• A broken water pipe was repaired in the Rodeo corrals • Extensive preparation for the Auto Xpo event on 7/22-7/24 was completed • Unsafe foot boards were replaced on the Rohner Park footbridge off 14th St • Cleanup was completed after the Auto Xpo
• A decorative wooden bench with plaque were installed on the front porch of the Monday Club, donated by the Fortuna Garden Club and created by East High students • Newburg Park received irrigation repairs and were programmed • A Prop 68 sign was erected at the newly acquired Newburg park expansion parcel, per the grant guidelines
• The rodeo grounds were prepped for a Gymkhana event rental on 8/6-8/7 • Picnic tables and trash cans were delivered and retrieved form 10th/main for the monthly street fair on 8/5
• Preparation and cleanup occurred for the annual Hops in Humboldt event held on 8/27 • A community garden beds project was planned and discussed, with raised garden beds to likely be placed in a portion of the horseshoe pit area to be maintained by the Fortuna Sunrise Rotary and community members
• All fire extinguishers were checked for proper safety, use Depot Museum
July’s visitation total at the Fortuna Depot Museum was 337 people. This is lower than our typical pre-COVID July visitation totals due to a number of factors. This summer we are open 5 days a week (Wednesday through Sunday for June, July and August) rather than 7 days a week as we were in the pre-COVID era summers. High gas prices are also likely contributing to smaller numbers of summer travelers. Our July visitation totals in recent years were: 2021: 487, 2020: 14 (open only four days in July 2020 due to COVID restrictions), 2019: 596, 2018: 537, 2017: 699, Page 19 Consent Item e

Drop-in volleyball on Sunday evenings continued throughout July, with attendance ranging from 7 - 15 players per night. Drop-in basketball will resume in the fall.

Much of July was spent operating our summer youth day camp programs, Kiddie Kamp and Summer Fun. We were able to add some campers from our wait-lists in July, for a total of 61 campers registered for Kiddie Kamp in July and 91 campers registered for Summer Fun in July.

We had another Leader in Training (L.I.T.) join the program for a total of 4 L.I.T.s, who ranged in age from 13 – 15, who assisted Camp Leaders with activities while learning and developing their own leadership skills. We have also a volunteer working with both camps through the Reaching for Independence program who assisted leaders with facilitating crafts and activities. Over the course of the month we had a cumulative total of 280.5 volunteer hours with our camps.

Staffing continued to be a challenge for the new First 5 playgroup, and opening was pushed back to mid-September, with a new plan to train current staff on the position once camps have ended for the summer. The First 5 Humboldt new playgroup will be for kids’ ages 0-5 and their caregivers.

Skating
The Fortuna Skating Rink operated Public Skate Saturday nights and Sunday afternoons for the first two weekends and the last weekend of July. Friday Public Skate have been on hold until our summer camp programs end in August, due to facility use overlap and staff availability. The skating rink was closed for both the weekends of Fortuna Rodeo (7/16-17) and Auto Xpo (7/23- 24). Adult Night continued as an ongoing event the last Saturday of the month. Over the course of the month the skating rink hosted 7 private parties with 123 attendees, and in addition to the 187 skaters that attended public skate, hosted an overall total of 310 skaters in the month of July.

EXECUTIVE SUMMARY:

Public Works Director/City Engineer
Annual Contracts
In August staff released for informal bid the annual concrete, paving, and striping contracts. Bids are due back in early- to mid-September for all contracts, and staff anticipate taking award recommendations to the Council on the October 3rd meeting.

Rohner Park Basketball Court Project
In 2022 parks and engineering staff have been working on developing plans for the Rohner Park Basketball Court Reconstruction Project, which proposes to replace the existing court at Rohner Park with two new courts. The new courts will include upgraded rims and backboards, acrylic court surfacing, protective fencing, and a courtyard with landscaping and picnic tables. In early September, the plans were finalized and the project was advertised for bid, with the bid opening date set for October 6th. Staff anticipate taking the project to the Council for an award recommendation at the October 17th meeting.

HSIP Grant Applications
In August and September staff worked with our on-call engineering consultant to develop a Highway Safety Improvement Program (HSIP) grant application. The application was successfully submitted on September 9th. The grant application includes improvements to several of the City’s signalized intersections, and the proposed work would include updating the signal cabinet controllers, signal heads, pedestrian push buttons, and re-evaluating signal timing based on current traffic patterns. Staff anticipate hearing on the success of this application by early 2023.

P Street Sewer Line Replacement
During routine sewer camera activities in early 2022, the utilities crew found a portion of sewer pipe on P Street, in between 9th Street and Garden Lane, to be in disrepair and in need of replacement. In early September staff began working with our on-call engineering consultants to develop design plans for the repair, and staff anticipate completing the work sometime in early to mid-2023.

Kenmar Road Interchange Improvement Project
The City’s engineering consultant completed and submitted to Caltrans the draft 30% design plans for the Kenmar roundabouts in August. Caltrans has completed their review of the plans, and at this time staff are anticipating that in the next month the City should have approved 30% drawings which can be used in the City’s final CEQA and NEPA documentation for the project, which is currently under development. Staff anticipate that CEQA and NEPA adoption will be finalized in early 2023, and therefore the preliminary design and environmental documentation work will be completed, and staff will be working to identify other forms of funding that can transition this project into the final design phase.
12th Street Interchange Modernization Project
With the Council authorizing contract award at the September 6th meeting, staff have begun working on contracting with GHD. Staff anticipate contracting to be complete within the next month, and work should begin on the project in October. 12th Street Stormwater Project
The City’s engineering consultant has been working on developing the 90% design plans for the 12th Street Stormwater project, which will include installing LID raingardens and new stormdrain pipe along 12th Street in front of the high school. In August, City staff potholed for utilities along 12th Street in a number of locations to identify conflicts or constraints for the design of the new stormdrain pipe. At the time of this staff report the potholes have not been fully restored with hot mix asphalt, however that work should be completed soon.

• Staff worked on the aeration piping in the out-ofservice aeration basin, installing new pipe, unions, and tees to resolve minor air leak issues. Staff also replaced clogged piping for an air lift pump in one of the sidestream process tanks. • Staff changed out the chlorine residual analyzer for
the chlorine contact basins (see photo inset left). The new unit replaces an older one that required excessive
operator time and attention, and often read inaccurately, causing numerous effluent violations. The new unit also matches the other one
at the plant, which is
used to register
complete dechlorination of the
final effluent. Both
units now have identical parts and reagents, improving
plant redundancy and operator training.
• Staff replaced the grit screw in the cyclone grit classifier (see photo inset right). The old one had worn down over the years beyond proper operability. This unit operates in an extremely abrasive environment, removing sand and
grit from the wastewater. The new unit should improve
grit removal efficiency and last for years to come.

SUBJECT: River Lodge Conference Center and Fortuna Monday Club Monthly Report for July and August 2022
STAFF RECOMMENDATION:

Receive report as an informational item.

EXECUTIVE SUMMARY:

The River Lodge and Monday Club held a total of 35 events in the months of July and August.

Events included eight monthly meetings, one Baby Shower, five Weddings, one Anniversary Party, three memorials and one Baptism Party. American Ag Credit held a three-day conference at River Lodge, and we continue to cater lunches for Rotary on Thursdays.

We began implementing the new fee schedule on the 1st of July. Honoring prices that were agreed upon in the new budget.

In August, a new Conference Center Coordinator was hired. Her name is Kaylyn Stainbrook, and she has quickly become a great asset to the River Lodge and Monday Club. She has updated forms online and in the office. Kaylyn also went right to work on promoting River Lodge on Social Media.

On two separate occasions, Sandy Dale from Fortuna Union High School, rented River Lodge for professional development. The first was a Grow Agriculture Education Conference for Agriculture teachers. The group was here until 9 p.m. on the first three days, and on their last day here, the group stayed until 10 p.m. enjoying s’mores, refreshments, and comradery around a bonfire.

The second event was a professional development day for the Fortuna High School Staff.

While July was the month for weekend weddings, August was the month for Class Reunions on the weekends.

COVID testing through DHHS took place on five days during July and August. The attendance for testing is down, but we will continue our MOU with them on a month to month basis, as long as there is a need.

CalFire Finance was in the Coho room for eight days. This group is responsible for incident debriefing and taking care of finances after the Six Rivers Lightning Complex Fire.

STAFF REPORT
City Council Consent Item
DATE: September 19, 2022
TO: Honorable Mayor and Council Members
FROM: Ryan Plotz, City Attorney
THROUGH: Merritt Perry, City Manager
SUBJECT: Authorize the City Manager to Continue Teleconferenced Public Meetings for City Council and all City Committees, Commissions and Boards Pursuant to Assembly Bill 361, Resolution 2022-25
STAFF RECOMMENDATION:

Staff is recommending that the City Council reconsider and approve the findings adopted in Resolution 2021-25 pursuant to Government Code Section 59453, as amended by Assembly Bill 361, and authorize the continued use of virtual meetings EXECUTIVE SUMMARY:

Signed into law in September 2021, AB 361 amended the Brown Act to allow legislative bodies to meet via teleconference (or other virtual means) during a proclaimed state of emergency in accordance with relaxed teleconference procedures, rather than under the Brown Act’s more onerous teleconference rules.

Under AB 361, the City may utilize the less onerous teleconferencing provisions when a public meeting is held during a state of emergency proclaimed by the Governor and the Council finds that (i) State or local health officials have imposed or recommended measures to promote social distancing, or (ii) the legislative body finds that meeting in person would present imminent risks to the health or safety of attendees.

As set forth in the proposed resolution, circumstances continue to exist that allow the City Council to utilize the less onerous teleconferencing provisions under AB 361. In particular, the state of emergency initially proclaimed by the Governor has not been rescinded and remain in place and the California Department of Public Health continues to recommend measures to promote social distancing.

Although the City Council has returned to in-person meetings, Staff anticipates the need to utilize virtual meetings, from time-to-time, based on changed circumstances. Accordingly, Staff recommends that the Council continue to make the required findings under AB 361 for so long as those findings can be made and to authorize the City Manager to utilize virtual meetings under AB 361 when necessary or desirable according to law. For this reason, Staff will include an agenda item on the consent calendar at least once per month for the Council to consider re-affirming the findings in the proposed resolution to provide Staff and Council flexibility in conducting public meetings.

STAFF REPORT
City Council Discussion Item
DATE: September 19, 2022
TO: Honorable Mayor and Council Members
FROM: Merritt Perry, City Manager
SUBJECT: PG&E Inability to Provide Services to Eel River Valley STAFF RECOMMENDATION:

Staff recommends that the Council receive an oral report from the City Manager regarding recent information from PG&E regarding its lack of ability to provide new service from Fortuna south throughout the Eel River Valley.

Following the report, it is recommended that the Council receive public comment, discuss the report and provide any desired direction. It is not anticipated that any representatives from PG&E will be available to answer questions.

DISCUSSION:

The City recently became aware of the inability of PG&E to provide new facilities with service both on city projects, and by speaking with developers with projects that have been denied service.

The City initially became aware that PG&E was unable to provide services upon the completion of the Tesla battery backup system at the Kenmar lift station in January of this year. PG&E indicated that its substation was inadequate and the batteries could not be connected until improvements were made. In July, staff became aware that a request for an increased capacity service (1600 Amp) was requested for an existing building located on the former PALCO Mill Site (Mill Site), and was denied by PG&E. During the same period of time, staff was in the process of reviewing a proposed distribution facility at the Mill Site, that proposed a 3000 Amp service, and became concerned that PG&E may not be able to serve this development, despite PG&E’s issuance of a “will serve” letter that indicated PG&E would serve the proposed project. Staff also was informed that developers in Rio Dell were also hearing from PG&E staff that it would not be able to serve new commercial customers.

In June of this year, staff inquired with PG&E as to whether or not it would actually be able to serve the proposed Mill Site development, and other projects in the City, given the known inability to serve other nearby projects. PG&E responded with uncertainty, and asked for time to analyze the situation. Staff continued to regularly request a meeting with PG&E, and to be briefed on the situation. A meeting was ultimately held on September 13th with the City Manager, Public Works Director and five representatives from PG&E.

At the meeting PG&E conveyed the following (summarized by staff, no information was provided in writing):

Page 2 of 3 ends

• Fortuna is served though three key substations including Newburg Substation, Carlotta Substation and Rio Dell substation. There are transmission lines serving the Eel River Valley that come from Cottonwood to the east, Eureka to the north and Laytonville to the south.
• The substations and transmission lines are at capacity and PG&E’s ability to provide service to new customers is extremely limited and likely they not be able to connect new commercial customers with limited exceptions (where their modelling indicates pockets of capacity and load projections for new projects fit within the areas where capacity is available).
• PG&E is not currently passing as much current through its transmission lines as it used to, to avoid the generation of heat and voltage issues that could lead to starting fires. • Over past several years, PG&E has continued to connect new customers within the Eel River Valley and Southern Humboldt County, in areas where the transmission lines were designed to pass through, but not provide the number of additional service connections that they are currently providing.
• PG&E estimates that once funding is available, it will take between 2-5 years to make the necessary upgrades needed to the substations and 7-10 years to make the needed upgrades to the transmission lines before capacity to allow new services can be provided. The anticipated cost of the needed upgrades is expected to be in excess of $900M. • PG&E continues to issue “will serve” letters to projects in progress, despite the fact that they may not be able to serve those business for many years. • It is likely that much of the capacity left will be allocated projects that have already submitted service applications.
• PG&E has not planned for capacity for the natural growth of the cities in Humboldt County. • The Cities in northern Humboldt County are not in the same situation as they have additional high capacity transmission lines from other locations.

City staff is concerned that PG&E’s inability to provide service to the City Fortuna and Eel River Valley will greatly diminish the City’s ability to grow, could impact critical infrastructure projects, housing projects, climate action plan measures, and negate many of the economic development efforts the city is working on.

Some of the projects that could be affected if PG&E cannot provide the needed power for Fortuna include:
• The City’s required upgrades to its wastewater treatment plant could be delayed and lead to enforcement action and fines
• Recently approved multifamily housing, and future housing developments may be delayed, or canceled, further exacerbating the housing shortage • New progress toward development at the Mill Site, which has sat vacant for decades, could be stopped and the site could again sit vacant for decades perpetuating blight in a large area of the city, and eliminating the potential for economic development. • Projects such as the City’s police facility could be delayed if power service is uncertain (although this is an upgrade and there may be capacity, as this is a smaller project) • The development of the Strongs Creek Plaza area and Riverwalk areas could be delayed and business unable to build there.
• The push to electrify existing homes and vehicles to offset climate impacts of GHGs may not be possible. This includes the development of new electric vehicle charging stations.

• Businesses that demand power may locate in Eureka and Arcata instead of Fortuna. • The City could see a stagnation in revenue as a result of diminished growth opportunities.

The City of Rio Dell is in a similar situation as the City of Fortuna and has been advocating for projects within their City since last March, that have not been served power. Rio Dell has filed a complaint with the CPUC and will be meeting with representatives from PG&E to discuss the situation on September 15th.

Staff have completed the following items to help mitigate the impacts of the situation including:
• Staff have communicated with developers with projects within the City that electrical service is questionable, to provide them an opportunity to reduce risks on their investment.
• We have also urged PG&E to communicate its inability to serve new customers, and modify its “will serve” letters to indicate the uncertainty of providing service and minimize the chance of developers incurring expense, without being able complete their projects.
• Staff have submitted a complaint to the California Public Utilities Commission (CPUC) regarding the situation and asked for a meeting to discuss PG&Es responsibility in this situation and look for solutions as to how it can be resolved. • Staff have communicated with 2nd District Supervisor Bushnell, who has been briefed on the situation and is advocating with State elected officials for a response to the situation. • Staff has requested that our City Attorney consider the situation and assist with a developing a formal complaint to the CPUC, or recommend other avenues to resolve the situation.

RECOMMENDED COUNCIL ACTION:

1. Receive staff presentation and review Council questions with staff

2. Open Public Comment

3. Close Public Comment

4. Provide direction to staff as appropriate
