STAFF REPORT
City Council Consent Item
DATE: October 3, 2022
TO: Honorable Mayor and Council Members
FROM: Ryan Plotz, City Attorney
THROUGH: Merritt Perry, City Manager
SUBJECT: Authorize the City Manager to Continue Teleconferenced Public Meetings for City Council and all City Committees, Commissions and Boards Pursuant to Assembly Bill 361, Resolution 2022-25
STAFF RECOMMENDATION:

Staff is recommending that the City Council reconsider and approve the findings adopted in Resolution 2022-25 pursuant to Government Code Section 59453, as amended by Assembly Bill 361, and authorize the continued use of virtual meetings EXECUTIVE SUMMARY:

Signed into law in September 2021, AB 361 amended the Brown Act to allow legislative bodies to meet via teleconference (or other virtual means) during a proclaimed state of emergency in accordance with relaxed teleconference procedures, rather than under the Brown Act’s more onerous teleconference rules.

Under AB 361, the City may utilize the less onerous teleconferencing provisions when a public meeting is held during a state of emergency proclaimed by the Governor and the Council finds that (i) State or local health officials have imposed or recommended measures to promote social distancing, or (ii) the legislative body finds that meeting in person would present imminent risks to the health or safety of attendees.

As set forth in the proposed resolution, circumstances continue to exist that allow the City Council to utilize the less onerous teleconferencing provisions under AB 361. In particular, the state of emergency initially proclaimed by the Governor has not been rescinded and remain in place and the California Department of Public Health continues to recommend measures to promote social distancing.

Although the City Council has returned to in-person meetings, Staff anticipates the need to utilize virtual meetings, from time-to-time, based on changed circumstances. Accordingly, Staff recommends that the Council continue to make the required findings under AB 361 for so long as those findings can be made and to authorize the City Manager to utilize virtual meetings under AB 361 when necessary or desirable according to law. For this reason, Staff will include an agenda item on the consent calendar at least once per month for the Council to consider re-affirming the findings in the proposed resolution to provide Staff and Council flexibility in conducting public meetings.

STAFF REPORT
City Council Consent Item
DATE: October 3, 2022
TO: Honorable Mayor and Council Members
FROM: Brendan Byrd, Director of Public Works/City Engineer THROUGH: Merritt Perry, City Manager
SUBJECT: Approval of a Contract with Mercer-Fraser Company for a Minor Street Paving Maintenance and Repair Project; Resolution 2022-27 STAFF RECOMMENDATION:

Adopt Resolution 2022-27 approving a Contract for Minor Street Paving Maintenance and Repair Project with Mercer-Fraser Company.

EXECUTIVE SUMMARY:

The purpose of the Contract for Minor Street Maintenance and Repair Project (“Contract”) is to contract with a qualified paving contractor to provide routine minor repairs and maintenance for City streets, on an on-call basis, for an amount not to exceed $710,000.00 for the one-year term of the Contract.

Section 2.50.070.D of the Fortuna Municipal Code provides that formal bidding is not required when the City Council finds that a negotiated contract best serves the City due to the nature of the contractual service. A standard public bidding process would not be appropriate for this Contract due to the on-call nature of the Contract and the importance of selecting a contractor who has the qualifications, equipment, crew and the availability to respond promptly to requests and to perform the work expeditiously, economically, effectively and safely.

Staff requested informal proposals from seven paving contractors, and received three proposals with the requisite qualifications to determine which contractor would best meet the City’s needs.

Staff will negotiate a contract with Mercer-Fraser Company, as the best qualified to provide the on-call maintenance and repair services for the City based upon overall qualifications, unit pricing, equipment, and availability.

The work will consist of removal and replacement of hot mix asphalt at various locations in the City. The locations are to be determined, and will be completed with this task order contract as items, which may come up throughout the year. The funding is broken out into multiple funds and is described in more detail below.

Consent Item 4d

Page 2 of 2 ends

FINANCIAL IMPACT:

The Contract will not to exceed $710,000.00 (seven hundred and ten thousand dollars) during the one-year term. The actual cost will depend on how much work is required during the one-year term.

The City has its Citywide Paving Project - CIP 9994 (fund 101 – Measure E and Fund 275 RSTP) listed in this year’s budget for $329,500 dollars, the SB1 Paving Project - CIP 9997 (fund 290) for $272,000. The City also has regularly budgeted items in its operational section (fund 260 – LTF) an Alley Maintenance budget of $8,000, and a grind and inlay budget of $50,000, with the remaining being for miscellaneous items. The remaining budget of $50,000 will come from various water, sewer or other regular projects requiring minor paving.

Adopt Resolution 2022-27. Consent Agenda vote.

STAFF REPORT
City Council Consent Item
DATE: October 3, 2022
TO: Honorable Mayor and Council Members
FROM: Brendan Byrd, Public Works Director/City Engineer THROUGH: Merritt Perry, City Manager
SUBJECT: Approval of a Contract with GR Sundberg Inc. for a Minor Concrete Maintenance and Repair Project; Resolution 2022-29
STAFF RECOMMENDATION:

Adopt Resolution 2022-29 approving a Contract for a Minor Concrete Maintenance and Repair Project with GR Sundberg Inc.

EXECUTIVE SUMMARY:

The purpose of the Contract for Minor Concrete Maintenance and Repair Project (“Contract”) is to contract with a qualified concrete contractor to provide routine minor repairs and maintenance for City streets, gutters and sidewalks on an on-call basis, for an amount not to exceed $100,000.00 (one hundred thousand dollars) for the one-year term of the Contract.

Section 2.50.070.D of the Fortuna Municipal Code provides that formal bidding is not required for individual on-call projects when the City Council finds that a negotiated contract best serves the City due to the nature of the contractual service. A standard public bidding process would not be appropriate for this Contract due to the on-call nature of the Contract and the importance of selecting a contractor who has the qualifications, equipment, crew and the availability to respond promptly to requests and to perform the work expeditiously, economically, effectively and safely.

Staff requested informal proposals from five concrete contractors and received two proposals, one from GR Sundberg and one from DCI Builders. After a review of the unit pricing for both bids, staff have selected to negotiate a Contract with GR Sundberg Inc to provide the on-call maintenance and repair services for the City. GR Sundberg Inc. was determined to bid the lowest pricing for curb and gutter, corner ramps, and driveway approaches which are the work items we plan to complete most often in this year’s contract task orders.

As noted above, this years’ work will include installation and repair of ADA compliant ramps, driveways, sidewalk, parking stalls, and miscellaneous repairs to City concrete facilities. The Capital Improvement Program includes the implementation of the City’s ADA Transition Plan, and ADA sidewalk improvements. All of these will be completed with this task order contract as well as other items which may come up throughout the year which require immediate response and do not lend to formal bidding procedures.

FINANCIAL IMPACT:

The Contract is not expected to exceed $100,000.00. The actual cost will depend on how much work is required during the one year term. The actual cost could be less than the not to exceed amount depending on the need for services. STAFF REPORT
City Council Consent Item
DATE: October 3, 2022
TO: Honorable Mayor and Council Members
FROM: Brendan Byrd, Public Works Director/City Engineer THROUGH: Merritt Perry, City Manager
SUBJECT: Approval of Professional Services Contract Task Order for the Water Tank Coating Project, (CIP# 0925)
STAFF RECOMMENDATION:

Approve a professional services task order under the on-call engineering contract for the Water Tank Coating Project, (CIP# 0925).

EXECUTIVE SUMMARY:

The City has an on call contract with GHD Inc. for various professional services. Staff is requesting the use of this on call contract to award the design and construction engineering phases for the City’s Water Tank Coating Project (Project). Based on inspections and recommendations from a specialized coating application consultant, the project would include stripping the interior and exterior coatings and applying a new coating system to the Campton Heights water storage tank (1 Million Gallon) and Hillside water storage tank (250k Gallon).

If approved, staff will work with GHD to negotiate and finalize the attached scope of work for the project. Staff anticipate completing design and bidding during the fall/winter of 2022 and proceeding with construction in early 2023. It is important to complete this project to avoid more costly repairs in the future.

FINANCIAL IMPACT:

This project will be funded by the Water Reserves Fund, 510. The total professional services contract amount requested for the first estimate authorization is $128,800. As shown in the scope from GHD, the fee would come lower if the construction timeline is a shorter than expected. The budget amount for this project in the five-year CIP program is $300,000. Additional funds in excess of the budgeted amount may be necessary for construction. Staff will have the actual costs after the project is designed and bid.

Hillside and Campton Tanks Recoating Project Scope of Work Dear Brendan,
The Campton Heights water storage tank (1 Million Gallon Steel Welded Potable Water Reservoir 75’ Diameter x 32’ Height Build Date 1989) and Hillside water storage tank (250K Gallon Steel Welded Potable Reservoir 37’ Diameter x 32’ Height Build Date 1989) exteriors were inspected by DB Gaya on April 2020, and interiors inspected by MIT Diving and Coating in June 2022.

Based on the inspections of the interior, Gaya Coating Consulting, Inc recommended stripping the interior coatings and apply a new coating system. Complete removal for both interiors and exterior with SSPCSP#10 (near white metal) surface preparation. Recoating of the interior may use either a 3 coat thin film system with a zinc primer or a 100% solids coating system from the water line down and use a thin film system in the ceiling utilizing zinc primer in conjunction with 2 coats NSF -61-600 epoxy including a stripe coat.

Based on the inspection of the exteriors and roofs, Gaya Coating Consulting, Inc recommended complete removal of the existing coating from the roof of both the Hillside & Compton tanks, with a surface preparation of SSPC-SP#10 (Near White Metal). Three different options for coating removal are proposed: Option #1 Perform surface preparation with a centrifugal blast machine and “Slurry Blasting” outer perimeter and appurtenances on the roof; Option #2 “Slurry Blast” the entire roof without the use of centrifugal blast machine; and Option #3 Dry abrasive blasting with nozzles under full containment. The exterior shell re-coating consists of pressure washing the entire shell with 3500 PSI Potable water and “HoldTight 102” soluble salt remover per the manufacturer’s recommendations, Dual Action Orbital Sanders on entire exterior shell and “Feather Back” areas of mechanical damaged and spot prime coat with epoxy. Then apply a full epoxy for intermediate coat, followed by polysiloxane finish coat.

Recommendations for the roof coating system is to apply Moisture Cure Zinc Primer, Epoxy stripe & intermediate Coat, and Polysiloxane finish coat. The zinc primer for the roof is to be applied by spray application. The subsequent epoxy and finish coat could be applied by roller applications unless open air spraying is permitted without the use of containment.

The following is a scope and cost estimate to provide bidding and construction management and inspection services for the Hillside and Campton Tanks Recoating Project. It includes the development of specifications for the bid and contract documents associated with the preparation and painting of the inside and outside of this tanks. It also includes Construction Monitoring of the coating of the tank. The detailed scope is as follows:
12591518 | Hillside and Campton Tanks Recoating Project Scope of Work 2 Task 1 – 1,000,000 Gallon and 250,000 Gallon Domestic Reservoir Interior and Exterior Coating Removal and Replacement, Bidding & Construction Management GHD will prepare project technical specifications and complete contract documents and bid package using the City’s front end boiler plates, and assist in releasing the work for bid to the newspaper as well as the Builder’s Exchanges, the notification of contractors of the availability of the bid documents, distributing bid documents to contractors and other interested parties, maintaining plan holders list, responding to contractor’s questions and issuing bid addendum, presiding over the bid opening and assisting the City in the issuing the Notice of Award and Notice to Proceed documents.

This task would also include construction observation services and well as responding to contract change orders, approving contractor requests for payment, and documenting the actual construction. SUBJECT: Consider Authorizing the City Manager to Negotiate a Contract with Watson Well for the Well 5b Project (CIP 9066), Resolution 2022-30 STAFF RECOMMENDATION:

Consider approving Resolution 2022-30, which authorizesthe City Manager to negotiate a contract with Watson Well for the continued development and testing of Well 5b.

EXECUTIVE SUMMARY:

In February 2022, the City’s contractor completed installing Well 5b at the City’s well field located on Eel River Drive. This well will replace the current Well 5, which has experienced performance reductions in recent years and ultimately requires replacement to ensure the City has a robust and resilient water source. As part of that construction contract, the contractor installed the new well and performed various pumping tests, including a draw-down test (to determine true well capacity) and turbidity testing (to determine that temporary construction sediments were sufficiently removed). After well testing was complete and accepted, City staff collected raw water samples from the new well and sent them to the City’s contract lab for analysis. These samples are required in order to bring the new well into active service through the Department of Water Resources (DWR).

In early spring the City received the sample results back from the lab which indicated all parameters were normal and consistent with the City’s existing wells, with a single exception. The manganese concentration came back approximately 20-times higher than what is consistently measured in the City’s existing wells. This concentration is also approximately 10-times higher than the allowable maximum contamination limit (MCL) that can be sent to the City’s distribution system.

The high manganese results in the new well is likely being caused by one of two possible issues.

First, the new Well 5b is the first and only of the City’s wells to be installed to a depth that projects into the lower Eel River aquifer, and therefore it could be that the water chemistry of that aquifer is different than what has been historically seen in the upper aquifer. Second, it is possible that although the previous pump testing was sufficient to develop the well and satisfy the specifications of the contract, it could be that residual effects of the construction and development could have resulted in artificially high manganese concentrations, one that could be remedied from further pumping/development. To work through these issues, staff worked with our consulting engineers Business Item 5a

Page 2 of 3 ends

to develop a number of pump tests and sampling regimes, which can be used to develop alternatives for how the City can move forward with bringing the new well into active service.

To perform the pump testing and sampling, the City requires a specialized well drilling contractor that has the equipment and expertise in this type of large-scale well development. As this is a relatively small project, and time is of the essence, staff are proposing an exception to bidding per City of Fortuna Municipal Code Section 2.50.070D. If awarded without formal bidding, staff are confident that this will serve the public interest by reducing costs and allowing for quicker project delivery.

Staff solicited four local (Northern California) well drilling contractors to provide directs bids to perform the work using the testing methods developed by the City’s engineers. The results of the bid solicitation are shown in the table below.

Table 1. Bid summary for continued testing and development of Well 5b.

Contractor Bid Price
Watson Well $32,047.90
Weeks Drilling and Pumping $53,146.80
Fisch Drilling Declined to Bid
Rich Drilling Declined to Bid
As shown above, Watson Well was determined to be the best contractor to complete this work in a timely manner. Staff and our engineers also feel that the bid cost is fair and reasonable. Per Fortuna Municipal Code Section 2.50.070 D, a draft Resolution has been prepared and included as Attachment A.

If approved Watson Well would look to mobilize to the site immediately and have the additional well development and sampling completed by the end of October. After the sampling results come back from the lab, staff will work with our engineers to determine how to best bring Well 5b online, and construction plans will be developed and bid as a separate contract.

FINANCIAL IMPACT
The project is funded by Water Reserve Fund 510 in the total amount of $200,000. Funding remaining after this effort will be used for future construction and continued engineering services.
