RISK MANAGEMENT / HUMAN RESOURCES DIVISION
Risk Management
There were no new Worker’s Compensation claims and no new liability/tort claims filed as of July 1, 2022. There was one new civil suite filed against the City on September 29, 2022. The City is working closely with our risk pool, California Intergovernmental Risk Authority (CIRA) and counsel with Leibert Cassidy Whitmore (LCW) to move both claims toward closure.
Date of Claim Type of Claim Status
03/10/2022 Civil Claim In progress
09/29/2022 Civil Claim In progress
There were two risk Board of Director meetings held over the last month, one for CIRA and the other for Redwood Empire Municipal Insurance Fund (REMIF). CIRA’s Board meeting took place September 28, 2022 and included a discussion item regarding California City’s membership in CIRA as well as a closed session that included conference with legal counsel. REMIF’s Board meeting took place on October 6, 2022 and included one closed session item and two action items, REMIF Health Plan renewal of Medicare Supplement Plan and waiving the copay for telehealth appointments as well as the adoption of a resolution establishing a 115 Trust or post-employment benefits trust.
On October 4, 2022, risk staff as well as several employees responsible for the oversight of City facility rentals participated in a Special Event Program Risk Management” training to learn about effectively transferring risk to user groups and for special events.
On October 11, 2022, risk staff attended a virtual training hosted by CIRA on “Return-to-Work” Services. The training was through an affiliated company called NPA, which offers specialized services to support injured employees returning to work faster, cutting Worker’s Compensation claims costs and complying with the American Disability Act (ADA) and the Fair Employment and Housing Authority (FEHA).
Consent Item 4b
Human Resources
On September 19, 2022, human resource and finance staff attended a presentation by NEOGOV, which is a company that provides interactive software to automate the hiring and onboarding process for the City. The software would improve the applicant experience, as interested job seekers would see a streamlined process and candidates would be able to create user profiles to submit applications electronically. Recruiting has seen significant changes post pandemic and quality software is now critical for outreach, sourcing and inclusion. Using technology accelerates the time to hire by centralizing the process of posting a job, attracting candidates, screening them and selecting qualified candidates, while ensuring recruiting compliance. Implementing this type of software will also streamline the onboarding process, allowing new hires to complete a majority of required paperwork prior to their start date. Staff intends to bring more information regarding NEOGOV to a future Council meeting.
The City has had a numerous recruitments over the last two months and staff continues to work diligently to select the most qualified candidates to add to our team! For more information about employment with the City of Fortuna, visit the City’s website www.friendlyfortuna.com, send e-mail to the Deputy City Clerk at [email protected], or call 707-725-7600.

Nylex has been coordinating with staff and AT&T to assess the sites where new fiber optic connections will be installed. AT&T walked the Patrol Operations Division (POD) October 11th and walked through the Parks and Recreation offices and Waste Water Administrative buildings on October 12th. The fiber optic lines are being put in place because the City’s data usage exceeds what is efficiently available on the current sorely outdated lines. Updating the infrastructure will allow for growth and greater capacity and will reduce issues created by phone and computer data overloading the broadband capacity. This will be a large project, and it is an exciting opportunity for expansion of infrastructure to the City’s benefit.

EXECUTIVE SUMMARY:
US Bank:
Staff have been working with our new US Bank representatives to decrease the amount of fees the City is charged per credit card transaction. I am pleased to announce that we were able to negotiate a 14% lower charge per credit card transaction which should equate to at least $6,000 in annual savings for the City.
Additionally, due to the Federal Reserve increasing the Fed funds rate, staff have been reviewing the investment policy. As the Federal Reserve increases the Fed funds rate it opens up new investment opportunities for the City to take advantage of. Staff are working with US Bank on a potential new sweep account whereby the City would be able to take advantage of the daily cash held in our Checking Account. Staff will be presenting this option as well as an overview of all the City’s investments at a regular Council Meeting in November.
Fiscal Year 2021-22 Transportation Development Act (TDA) Audit:
Finance received a letter notifying staff that the firm of Anderson, Lucas, Somerville & Borges, LLP (ALSB) has been engaged by the Humboldt County Association of Governments for fiscal year ended June 30, 2022 to audit Fortuna’s Transportation Development Act (TDA) activities.
The TDA requires annual audit examinations of all entities claiming Local Transportation Funds (LTF) which the City claims annually to help fund the Senior Bus Program as well as Streets Improvement Projects.
ALSB has requested staff prepare various schedules and other reconciliations that they require as part of the audit. Additionally, staff provided a number of documents for ALSB to review as part of the interim audit work. A draft audit report will be provided to the City upon the auditor’s completed review of the requested documents.
Consent Item 4d
Fiscal Year 2021-22 Financial Statement Audit:
July 1 signaled the start of a new fiscal year for the City. As such, staff is working on closing the previous fiscal year and preparing for the City’s annual financial statement audit. The Cities auditor will be Michael O’Connor from R.J. Ricciardi, Inc., CPA who also performed last year’s audit for the City. Last year Michael and his staff were unable to come onsite due to COVID which made the interim audit work more difficult and time consuming to complete. However, this year Michael and his staff are planning to come on site for a week to conduct interim audit, tentatively scheduled for later this month.
Finance staff have been preparing for this interim audit work by preparing the necessary reconciliations, reports, adjustments and backup information that is required during the audit process. Having these documents ready prior to the auditors’ arrival has provided for a smooth audit process in years past.
Measure E Update:
The Measure E committee held a regularly scheduled meeting on September 20. The primary purpose of this meeting was for Staff to review with the Committee the list of Measure E funded projects that were included in the Council Adopted Budget for Fiscal Year 2022-23. As part of this review staff highlighted via PowerPoint a few of the larger projects that staff have already begun working on this fiscal year. Staff additionally gave a preliminary review of how Fiscal Year 2021- 22 Measure E expenditures ended the year compared to what was budgeted.
List of Measure E items funded this month:

Director’s Report
The regularly scheduled Rohner Community Recreation and Park District (RCRPD) monthly meeting was cancelled on 9/7 due to a lack of agenda items, as LACO & Associates needed additional time to review financial assumptions associated with a future aquatic facility in order to develop calculations for a Benefit Assessment project. Water Treatment/Wastewater Division- Chief Plant Operator Wastewater Treatment Plant Upgrade:
Staff and senior management met virtually with members of the Regional Water Quality Control Board to discuss a Basin Plan Triennial Review. This came as a result of recent engineering studies that found discharging across the river to a new percolation field may result in overall impacts equivalent to the City’s existing percolation ponds. Alternative proposals will be presented to the Board such as flow augmentation and enhanced (tertiary) treatment, so that the City can possibly continue discharging to the existing percolation ponds.
Staff met with representatives of Tesco Controls Inc. regarding a proposal for a potential CIP project to upgrade the wastewater treatment plant’s computer control SCADA and PLC systems. These important data acquisition and automated operational control systems are crucial for proper plant functioning. The City’s versions are aged and obsolete.
Emergency Generator Project:
Colburn Electric worked at both Kenmar and Drake Hill booster pump stations, installing new conduit and excavating the pads for the new, emergency generators.
Staffing:
Three staff members of the Wastewater Treatment Plant Division attended CPR and First Aid training this month.

Wastewater Events & Maintenance Tasks Completed:
Staff worked on dewatering one of the side-stream process tanks at the wastewater treatment plant. This semiannual to annual maintenance task is important to keep previously processed solids rich in ammonia from
the main treatment system.
Staff drained, cleaned, and returned the chlorine
contact basins to service and the plant water
hydropneumatic tank.
Staff conducted preparatory work on rebuilding
components of the grit channel, replacing wearshoes on the flights. This system went down in May after a catastrophic failure. Parts were
ordered, but not all have been received yet. Plans
are to hopefully have the rehabilitation work
complete before winter.
Staff spent a great deal of time on rehabilitating
submerged metal in one of the plants secondary
clarifiers (see photo inset right). The suction rake
arm was badly pitted and rusted with deteriorating
truss rod supports. The supports were replaced and the arm was cleaned up and re-coated, which will provide many more years of service life.
Staff replaced a 4” isolation valve and a pump stator for one of the three primary sludge pumps. The existing valve was inoperable and the previous pump stator was worn beyond proper operability.

Two, large bull pine trees were removed at the
Water Wells Site (see photo inset right). These trees
had large branches hanging low over Eel River
Drive, and one of them was leaning precariously
toward the Tesla battery packs, the emergency
generator, and the main booster pump building.
Plans are to grind the stumps next and fill in the area with grass, which the Eel River Trap Club will
assist in mowing.
Staff completed rehabilitation work on the Well #4
building, tiling an interior wall to prevent water rot
caused by flushing and sampling operations.
Staff replaced one of the two exhaust fans in the
chlorine building at the Water Wells Site.
Staff trouble-shot a pump trip-out problem at the
Water Wells Site. All well pumps and the main
booster pump would shut off and then immediately
turn on again at random during their pump cycle for no apparent reason. Staff found and fixed a frayed wire, which resolved the issue.
General Services and Streets - General Services Superintendent The following is a list of scheduled assignments completed by the General Services staff in September:
Staff prepared and assisted in setting traffic
control measures for the last First Friday’s
event of the season. Traffic detours were
between Ninth Street and Twelfth Street.
Staff prepared traffic control measures for
Apple Harvest Festival prior to the event on
October 1, 2022.
Staff finished repairing the siding on the
kennel building at the Corporation Yard. A
forty-foot storage container was placed next
to the kennel that took the place of a carport awning.

Staff weed eat the Hillside Creek
drainage in between Fortuna
Boulevard and the mini storage.
Staff removed young alder trees to keep the channel clear from any obstruction during the wet season. (Pictured of Hillside Creek shown right)
Staff assisted the Utility staff on a new Twelfth Street water crossing. Staff assisted the Parks staff on preparation of the rodeo grounds for a California High School Rodeo Association event. Staff replaced broken boards in the grandstands, weed eat and mowed the arena area.
Staff ground out three tree stumps that caused damage to sidewalks on Baxter Lane. Staff placed form boards and graded with rock in preparation of new sidewalks.
In addition to the special tasks noted above, staff also engaged in the following regular routine maintenance activities including USA’s, street sweeping, recycling and trash management, road maintenance, vegetation management, and safety training and inspections. City Council Consent Item
DATE: October 17, 2022

FROM: Ryan Plotz, City Attorney
THROUGH: Merritt Perry, City Manager
SUBJECT: Authorize the City Manager to Continue Teleconferenced Public Meetings for City Council and all City Committees, Commissions and Boards Pursuant to Assembly Bill 361, Resolution 2022-25
STAFF RECOMMENDATION:
Staff is recommending that the City Council reconsider and approve the findings adopted in Resolution 2022-25 pursuant to Government Code Section 59453, as amended by Assembly Bill 361, and authorize the continued use of virtual meetings EXECUTIVE SUMMARY:
Signed into law in September 2021, AB 361 amended the Brown Act to allow legislative bodies to meet via teleconference (or other virtual means) during a proclaimed state of emergency in accordance with relaxed teleconference procedures, rather than under the Brown Act’s more onerous teleconference rules.
Under AB 361, the City may utilize the less onerous teleconferencing provisions when a public meeting is held during a state of emergency proclaimed by the Governor and the Council finds that (i) State or local health officials have imposed or recommended measures to promote social distancing, or (ii) the legislative body finds that meeting in person would present imminent risks to the health or safety of attendees.
As set forth in the proposed resolution, circumstances continue to exist that allow the City Council to utilize the less onerous teleconferencing provisions under AB 361. In particular, the state of emergency initially proclaimed by the Governor has not been rescinded and remain in place and the California Department of Public Health continues to recommend measures to promote social distancing.
Although the City Council has returned to in-person meetings, Staff anticipates the need to utilize virtual meetings, from time-to-time, based on changed circumstances. Accordingly, Staff recommends that the Council continue to make the required findings under AB 361 for so long as those findings can be made and to authorize the City Manager to utilize virtual meetings under AB 361 when necessary or desirable according to law. For this reason, Staff will include an agenda item on the consent calendar at least once per month for the Council to consider re-affirming the findings in the proposed resolution to provide Staff and Council flexibility in conducting public meetings.

FISCAL IMPACT:
There is no current fiscal impact associated with approving the findings in Resolution 2022-25.

SUBJECT: Supplemental Budget Request for Cleanup and Outreach Services with River Life Foundation
STAFF RECOMMENDATION:
Staff is recommending the Council authorize a supplemental budget request in the amount of $5,000 for cleanup and outreach services with River Life Foundation EXECUTIVE SUMMARY:
At the time the Fiscal Year 2022-23 Budget was being prepared staff were working with Caltrans on an agreement to provide supplementary funding for cleanup around the City, specifically in areas on or visible from the State right of way. In response, Staff reduced the City-funded requested amount of this project from $12,000 to $10,000, which was the amount the Measure E Committee recommended and Council included in the FY 2022-23 Budget. To date staff are continuing to work with Caltrans in an effort to obtain the supplementary funding, however the process has been slow and presenting some uncertainty. Due to ongoing need for outreach services and the coordination of volunteer cleanups, staff is recommending that the Council allocate an additional $5,000 for these services in the current fiscal year, as the current City budget is nearing full expenditure.
If approved, staff would immediately work with River Life Foundation to execute a Contract Change Order (CCO), increasing the contract value by $5,000. As the City’s existing contract with River Life Foundation, as well as a draft CCO, has been included as Attachments B and C.
If this budget adjustment request is not approved, it could lead to decreased litter and garbage removal and create a negative community image that would have an unknown negative economic impact to the City.
FISCAL IMPACT
Approval of the supplemental budget request from fund 100-6025-20000 will commit an additional $5,000 of Measure E reserve funds for cleanup coordination and outreach services. A supplemental budget request has been included as Attachment A.
RECOMMENDED ACTION:
Approve a Supplemental Budget Request for Cleanup and Outreach Services with River Life Foundation for $5,000. Consent Agenda vote.

SUBJECT: Award of Bid for the 2022 Vancil Tree Removal Project Ford Logging Inc.
DBA Pacific Earthscape
STAFF RECOMMENDATION:
Staff recommends the City Council award the 2022 Vancil Tree Removal Project to Ford Logging, Inc. and authorize the City Manager to execute all applicable documents.
EXECUTIVE SUMMARY
The City owns and operates the five million gallon Vancil reservoir located on Vancil Street in the City of Fortuna. The parcel the reservoir sits on is approximately 13 acres in size with the reservoir occupying approximately two and a half acres. There are redwood and fir trees surrounding the reservoir site that routinely drop needles and branches, which causes drainage issues and fence damage. The proximity of the existing trees to the reservoir results in an increased risk of fire damage. Additionally, there are four residences adjacent to the timbered portion of the site near Vancil Street that have requested that trees be removed from the City parcel that are in close proximity to their homes. This portion of the vegetation treatment project area will enhance structure protection from wildfire.
The portion of the project recommended for award to Pacific Earthscape is the timber operation portion of the project. The overall project will be completed in various phases and includes grading, drainage, tree removal, fencing and other site improvements is included in the City’s capital improvement program and is identified as project 9370. In July of 2021, the council approved a contract with BBW Associates (BBW), a forestry consulting company, to assist the City with permitting removal of some trees surrounding the Vancil Reservoir.
Since that time, BBW has prepared draft timber harvest exemptions and supporting background studies necessary for CAL FIRE to obtain approvals to harvest trees in close proximity to the reservoir, assisted with soliciting bids for the sale of the timber and identified the proposed location and operational parameters consistent with CAL FIRE Exemptions CCR 1104.1(b)(c) and 1038.c.
The planned selective tree removal will reduce wildfire hazard adjacent to residential structures and remove encroaching trees from the base of the Vancil reservoir. Tree removal is generally limited to within 100 feet of the reservoir fence, and trees selected for removal will remove ladder fuels, intermediate sized trees with poor form and trees around the reservoir perimeter that cast debris onto the structure roof. Removal of some trees is necessary for the water reservoir perimeter fence replacement as well. Some larger conifers with stronger form will be retained.
Consent Item 4l
BBW and City staff have reached out to adjacent neighbors and feedback that those adjacent to the timber harvest support the project.
In July 2022, the City advertised for bids the sale of approximately 65 thousand board feet (mbf) of timber. The City awarded a bid to Humboldt Redwood Company on August 15, 2022.
Following the timber sale, the City advertised for bids for Licensed Timber Operators to conduct the tree removal operations and received no bids. The project was advertised a second time and one bid was received from Ford Logging Inc. of McKinleyville, CA. The lone bid was based upon or $1,000/mbf gross volume shipped to Scotia, CA. The bid includes all mobilization, tree work and slash material clean up. There is a relatively high cost for the timber operation, as it will require climbing and pulling some trees along the residential interface and removal and or chipping of residual slash (limbs and tops).
Once the timber operations on the site are complete, the City will proceed with planning the remaining improvements on the site.
FISCAL IMPACT:
It is anticipated that the timber sale from the tree removal project will cover costs for the tree removal portion of the project and may generate a small amount of revenue. The project is budgeted for the remaining improvements at the site in the Fiscal Year 2022-2023 Capital Improvement Program and includes the costs for the forestry consultants, drainage, fencing and other site work.
RECOMMENDED ACTION:
Award the 2022 Vancil Tree Removal Project to Ford Logging, Inc. and authorize the City Manager to execute all applicable documents. Consent Agenda vote.

TO: Honorable Mayor and Council Members
FROM: Merritt Perry, City Manager
SUBJECT: Authorize City Manager to Contract with Clare Gibson Law to Provide Construction Legal Services
STAFF RECOMMENDATION:
Staff recommends the City Council authorize the City Manager to execute a contract with Clare Gibson Law to provide legal services related to public contract code, procurement and construction law and find that it is in the best interest of the City to negotiate for these services and not seek competitive proposals.
EXECUTIVE SUMMARY:
Clare Gibson has provided construction related legal services to the City of Fortuna for several years. Ms. Gibson routinely provides the City with updated front-end documents for construction projects, provides advice on bidding and award of contracts and has provided assistance on past construction projects when differences have arisen and have needed to be resolved either formally or informally. Ms. Gibson has done an outstanding job and provided sound legal advice whenever asked and responds very quickly to requests from the City.
Ms. Gibson recently worked with Jarvis Fay LLP and recently left that firm to work independently for her own law firm Clare Gibson Law. Given Ms. Gibson’s track record of providing a high quality service to the City for approximately ten years, staff would like to continue working with Ms. Gibson on construction related legal issues.
Section 2.50.060 of the Fortuna Municipal Code allows the City Manager to authorize the hiring of services for legal services and specify that the City manager shall negotiate for the authorized service, but that proposals shall be submitted whenever practicable by three firms. In this instance, staff is recommending that the council find that negotiations best serve the interest of the City to provide a continuity of service, and to not seek competitive proposals, in accordance with Fortuna Municipal Code Section 2.50.070.
The proposed contract from Clare Gibson Law was reviewed by our City Attorney Ryan Plotz and Mr. Plotz recommended staff continue to seek services from Ms. Gibson.
Consent Item 4m
FISCAL IMPACT:
Legal services are budgeted for in the Fiscal Year 2022-2023 budget in the amount of $50,000.
Work by Clare Gibson Law would be conducted under this budget or under the budget of the capital improvement project for legal, which advice is being sought.
RECOMMENDED ACTION:

STAFF REPORT
City Council Business Item
DATE: October 17, 2022
TO: Honorable Mayor and City Council
FROM: Cameron Mull, Director of Parks & Recreation
THROUGH: Merritt Perry, Interim City Manager
SUBJECT: PUBLIC HEARING: Receive Public Comment Concerning Unmet Transit Needs (UTN)
STAFF RECOMMENDATION:
Hold a public hearing concerning Unmet Transit Needs, and forward all public comment received to Humboldt County Association of Governments (HCAOG) for consideration.
EXECUTIVE SUMMARY:
Each year, the Transportation Development Act (TDA) Statutes require the Humboldt County Association of Governments (HCAOG), as the Regional Transportation Planning Agency (RTPA), to hold an Unmet Transit Needs Hearing for the purpose of evaluating the best methods of providing public transportation. It is local policy for HCAOG to request each member entity hold a public hearing on unmet transit needs annually. These local hearings are in addition to HCAOG’s required public hearing and there purpose is to broaden the hearing forum. The local hearings also provide City Council Members and County Board of Supervisors an opportunity to hear and respond to local comments. All persons and groups known to have interest in transit-related matters are notified in advance of these hearings. The appropriate public notices are also published in the local print media. The public is encouraged to offer any comments and/or possible solutions to various transit needs. By holding a public hearing at a Council meeting, the Council is acknowledging the receipt of public comments.
The City of Fortuna provides two transportation systems to serve Fortuna residents; the City operated Dial-A-Ride (DAR) system, and the Humboldt Transit Authority’s, Regional Redwood Transit System (RTS). RTS is a commuter service and covers a 65- mile stretch of Highway 101 from Trinidad to Benbow. Service runs from 5:30am10:30pm Monday through Friday and from 8:30 am to 9:30 pm on Saturday. There are 46 southbound and northbound trips on weekdays and on Saturdays. Adult Fares are $3.50 for a one-way trip and a monthly-unlimited pass may be purchased for $62.00.
The Fortuna Transit Bus Service is a Dial-A-Ride (DAR) system; the City operates two buses Monday through Friday from 8:00am-4:30pm. The Fortuna Transit Service is available to persons over the age of 50 or disabled persons living within the city limits of Fortuna. Riders call for bus service anytime during the previous calendar month for doctor’s appointments, one week in advance to reserve a ride for hair, work, lunch site, or Business Item 5a
other non-medical appointments, and the day-of or day before for shopping, visiting friends, & banking. Riders are picked up at their homes and delivered to their destination, and when they are ready to return home or travel to another destination, they call the Transit/ Parks office to dispatch a bus for service. Fortuna Transit’s DAR started weekly medical appointments to Eureka in July of 2018 (Measure E funded) to allow people to get the medical services they need in the Eureka area, since there are more medical providers housed there.
Staff continues to monitor expenses and revenues to insure compliance with the State Mandated 10% fare box recovery ratio. The fares for rides are $2.50 per ride or $22.50 for a prepaid punch card for 15 rides.
The primary purpose of TDA funds is to provide various types of transportation services to the public that are financially "reasonable" to fund, and secondarily to provide funds for roadway repair projects. Before HCAOG can allocate funds for purposes “not directly related to public transportation services, specialized transportation services, or facilities provided for the exclusive use of pedestrians and bicycles” (PUC Sec. 99401.5), HCAOG must first implement the unmet transit needs process. Because the primary purpose of the TDA is to fund transit, the unmet transit needs process is used to prove that there are no “unmet transit needs” that are “reasonable to meet” prior to funding street and road projects.
Council will not be asked to make a finding on Unmet Transit Needs. They are to receive public comment concerning transit needs and to forward findings on to HCAOG. If the RTPA and the HCAOG Board finds that there are no unmet transit needs or that there are no unmet transit needs that are reasonable to meet, the City of Fortuna may then expend excess TDA funds for non-transit purposes. A finding that there are unmet transit needs, including those that are reasonable to meet, delivers a mandate to the respective entity to set aside funds, to implement a program to meet those needs deemed “reasonable to meet.”
FINANCIAL IMPACT
Humboldt County Association of Governments adopted the 2022/2023 Local Transportation Fund Apportionment and Allocation of $447,970 to the City of Fortuna (allocation based on population size). Of that total amount, $212,787 is allocated to fund 590 for the Fortuna Transit system, $500 towards annual bus shelter maintenance, a required 2% set-aside for bike and pedestrian projects in the amount of $12,333, and $222,350 allocated to Fund 260 and Fund 265 for non-transit activities, which is budgeted to fund Capital Improvements/ Streets Projects.
RECOMMENDED COUNCIL ACTION:
1. Receive staff presentation and review Council questions with staff.
2. Open the Public Hearing.
3. Close the Public Hearing.

Citizen Participation Process for Assessing Unmet Transit Needs Transportation Development Act
The Humboldt County Association of Governments (HCAOG) is responsible for allocating Transportation Development Act (TDA) funds within the region. The TDA provides two major sources of funding, Local Transportation Funds (LTF) derived from a ¼ cent of the general sales tax and State Transportation Assistance Funds (STAF) derived from a tax on diesel fuel. Together, these TDA funds provide a significant revenue source for public transit in Humboldt County. The Unmet Transit Needs process is carried out annually to identify and evaluate any potential needs that are not being met through existing public transportation services. HCAOG is required to assess unmet transit needs prior to allocating LTF money for non-transit purposes, while STA is programmed to the Humboldt Transit Authority and Arcata and Mad River Transit.
Each jurisdiction has their own LTF account. Eureka and Arcata use the entirety of their LTF allocation for transit purposes. The County of Humboldt, Cities of Fortuna, Rio Dell, Blue Lake and Trinidad have funds remaining after paying their share for eligible transit uses. In these cases, the TDA allows LTF to be applied to local streets and roads budgets, including pedestrian and bicycle projects. In Ferndale, there are no eligible public transit services and the LTF allocation is applied to non-transit purposes.
Public Process to Make a Finding
HCAOG’s Social Services Transportation Advisory Council (SSTAC) leads the UTN process. Although only one hearing is required, public meetings are held to ensure residents in each jurisdiction are heard. The SSTAC considers all public testimony and input, determines if the suggestions meet the adopted definition of an unmet transit need and applies adopted criteria to determine if the need is “reasonable to meet”.
After comments close on December 31, the SSTAC will consider all the comments at their meeting on February 2023, direct staff on any needs to further analyze, and in April 2023 forward one of the following findings to the HCAOG board for consideration:
(a) there are no unmet transit needs; or
(b) there are no unmet transit needs which are “reasonable to meet”; or (c) there are unmet transit needs, including those that are “reasonable to meet” Potential Impacts to Local Transportation Funding
If HCAOG adopts finding (c), then the unmet transit needs shall be funded before any allocation is made for non-transit purposes (i.e. streets and roads) within the jurisdiction.
Funds for new or expanded transit services can be set-aside from sources other than TDA funds. For instance, in 2018 the HCAOG Board voted to set aside Low Carbon Transit Operations Program (LCTOP) funds for late-night weekday service on the Redwood Transit Service. The service was found based on ridership at that time to be an unmet transit need reasonable to meet, but could not be funded due to insufficient Local Transportation Funds available to all required entities. When COVID hit and ridership plummeted, these LCTOP funds were repurposed to support free fares.
Examples of Past Public Input and Findings
As a result of UTN findings in 2015-16, new transit services began to Tish Non-Village (Bear River Rancheria) and along Old Arcata Road. Both services were discontinued after two years because not enough people used the new service to sustain it.
Public comments often ask for later night service, Sunday service, more frequent peak service between McKinleyville-Arcata-Eureka, and bus service to rural communities.
Based on existing ridership, each of these fail to meet the required 10% farebox return ratio -- meaning there are not enough projected transit riders to meet minimum performance criteria necessary to sustain the services. If these conditions change, the Humboldt Transit Authority does not need a formal UTN finding to start new services.
Comments received through this annual process can provide valuable feedback to transit operators. For example, in 2021 several people commented that they needed a westbound bus stop near Titlow Hill for their children to get to school in Arcata on the Willow Creek Intercity line. The operational request was sent to Humboldt Transit Authority and HTA was able to set up a trial flag stop for use during the school year. Not all operational requests can be accommodated, but agencies make every effort to respond. In addition, public comments made during the Unmet Transit Needs process can be beneficial as a record of community need and help secure grant-funded opportunities such as first-last mile mobility solutions to expand access to transit.
Opportunities for Public Comment on Unmet Transit Needs • The form linked at the project page: https://hcaog.net/documents/unmet-transitneeds or visit the survey directly at https://bit.ly/humboldttransit • At one of the advertised public meetings;
• Written comments and/or feedback gathered from staff during direct outreach; • Comment submittals by email or telephone: [email protected]/444-8208
U N M ET T R AN S I T N E ED S
D EF I N I T I ON & R E AS ON A BL E T O M EET C R I T ER I A Unmet transit needs are, at a minimum:
(1) Trips requested from residents who do not have access to public transportation, specialized transportation, or private transport services or resources for the purpose of traveling to medical care, shopping, social/recreational activities, education/training, and employment; or
(2) Proposed public transportation, specialized transportation, or private transport services identified in the following, but not limited to: a Transportation Development Plan, Regional Transportation Plan, Coordinated Public Transit–Human Services Transportation Plan.
HCAOG Plans can be found at: http://hcaog.net/library
Additionally, unmet transit needs do not include:
❖ Improvements funded or scheduled for implementation in the next fiscal year. Two potential new services that will be reevaluated this year are:
• Express bus service between McKinleyville and Eureka during peak hours • Late Night Weekday Service on the Regional Transit System ❖ Minor operational improvements or changes such as bus stops, schedules, and minor route changes. Minor operational improvements are changes to service which do not affect the operating cost of the transit service either by requiring additional staff and/or additional vehicle hours of service or miles of service. ❖ Trips for primary or secondary school transportation
❖ Sidewalk improvements or street and road needs
Reasonable to meet criteria:
(1) To be considered “reasonable to meet”, a service must be operationally feasible and financially sustainable, as defined below:
a) The service must have adequate roadways, and must be safe to operate. b) Enough money should be available from identified sources of funding to pay for the marginal operating costs of the service continuously for three years. (2) The service must be projected to meet a minimum “marginal farebox-return-ratio” of 10 percent within 2 years. If multiple competing services are requested, other factors may also be considered such as estimated subsidy per passenger trip and passengers per vehicle hour of service. For new service, ridership and farebox-return-ratio thresholds will be considered.
(3) Pursuant to the requirements of TDA Statutes (Public Utilities Code Section 99401.5c, a determination of needs that are “reasonable to meet” shall not be made by comparing unmet transit needs with the need for streets and roads, for the allocation of TDA funds. (4) Once a service is determined to be "reasonable to meet" and is implemented, it can be expected that the ridership in the first 1-2 years of the new service will be less than the projected optimal ridership. Ridership should be evaluated at 6-month intervals to determine if service is meeting performance standards adopted by the transit provider, and specifically, whether the service meets a minimum 10 percent marginal fareboxreturn-ratio. If the service is being adequately promoted and fails to be within 60 percent of the identified standards after six months, 90 percent with the first year, or 100 percent within two years, the service may be cancelled and deemed "no longer reasonable to meet." An exception to this rule is when a community or group is willing to participate in sharing the ongoing cost of the new service.

STAFF REPORT
City Council Business Item
DATE: October 17, 2022
TO: Honorable Mayor and Council Members
FROM: Brendan Byrd, Public Works Director/City Engineer THROUGH: Merritt Perry, City Manager
SUBJECT: Project Update and Award of a Professional Services Contract for Newburg Park Expansion Project
STAFF RECOMMENDATION:
Receive staff presentation and recommendation and authorize the City Manager to award a Professional Services Contract for the Newburg Park Expansion Project to Ontiveros and Associates, for a total contract value not to exceed $92,500.
EXECUTIVE SUMMARY:
In 2022, the City purchased the vacant 8± acre parcel adjacent to Newburg Park from the Eel River Valley Community Center Foundation, with Prop 68 Per Capita funding from the State.
Staff have worked with a landscape architect to develop a master plan for incorporating the new land into Newburg Park that would include new amenities to the park including full size soccer fields, a skate park, basketball courts, trails, and additional playground, parking, and bathroom facilities. Unfortunately, the City has not been successful in obtaining grant funding for the project to date.
Despite lack of success with obtaining grant funding, staff have been compelled to advance the project using available City funding to include as many improvements as possible, although focused on the near-term goals of providing additional parking, soccer facilities, and trails. The concept for incremental project development as funding allows was shared with the Measure E Committee last year, the committee allocated for this fiscal year to advance the project.
In 2022, a topographic survey for the park by Ontiveros and worked with Ponte Landscape Architecture (PLA), to update the concept design. Updating the concept was necessary given that that since the time of the original layout the bike park has been paved and turned into a permanent feature in the location previously being considered for soccer fields. The updated concept has been included as Attachment A and includes the bike park in its current location.
Staff requested that Ontiveros and Associates, one of the City’s on-call engineers, provide a scope of work to produce design plans, specifications, and cost estimates for the park so that the improvements can be completed in phases taking into account the long-term plan for the site. The scope of work received will provide for construction plans that include drainage improvements, the addition two new high school regulation soccer fields, one smaller soccer field, a new parking Business Item 5b
lot off of Rohnerville Road with approximately 130 parking spaces, new prefabricated bathrooms and a snack shack, walkways, patios, and utilities that would connect the main amenities. The scope of work that was developed by Ontiveros and Associates, which has been negotiated and reviewed with City staff, is included as Attachment B.
Staff has reviewed the proposal from Ontiveros and Associates and feels that it is reasonable and that Ontiveros and Associates are well-qualified to complete the project. Additionally, they have been involved in various other projects on or near the site including the new McLean Foundation Campus, the 4-6 Water Intertie Project, and the recently completed topographic survey. Their familiarity with the project site and surrounding infrastructure provides a level of familiarity that will help deliver the project efficiently.
If awarded staff would execute a contract task order with Ontiveros and Associates under the oncall contract. Staff anticipate design taking place through the winter, and determining project phasing and bidding by the spring of 2023.
Once the design is complete, the City can identify phases to complete as budget becomes available, from either City sources or other grant programs.
FINANCIAL IMPACT:
The project currently has $500,000 in allocated budget the current fiscal year from Measure E, Fund 101. This fund will be used to cover the proposed work. Any unused funds will be used in the future for project construction.
Full project construction per the proposed design plans will require funding in excess of the remainder noted above, and staff will continue to work to identify additional project funding sources.
RECOMMENDED COUNCIL ACTION:
1. Receive staff presentation and review Council questions with staff
2. Open Public Comment
3. Close Public Comment
4. Authorize the City Manager to award a Professional Services Contract for the Newburg Park Expansion Project for a total contract value not to exceed $92,500. Voice vote.

RE: Civil Design for the Newburg Park Expansion and Additions in Fortuna, California.
Dear Brendan,
At your request, Ontiveros & Associates, Inc., (O&A) has assembled a proposal to provide Civil Design services for the Newburg Park Expansion and Additions in Fortuna, California. The area of interest is as defined in the draft topo limits provided by the city, which is approximately everything east of the existing ballfields. The basis of the design is the drawing prepared by Erin Ponte titled ‘NEWBURG PARK conceptual design_FINAL.pdf’.
The Scope of Work is as outlined below:
1) CIVIL DESIGN/PLANS
a) Construction Documents –Develop Construction Documents as required for the City of Fortuna Building and Public Works Department in accordance with Local and State Codes. Plans shall be delivered at 30%, 60%, 90% design stages and shall consist of the following:
i) Demolition Plan showing existing features to be removed, if required. ii) Civil Site Plan, based on the conceptual plan prepared by Erin Ponte. iii) Grading Plan showing elevations/grades for the hardscape surfaces, drainage facilities and new soccer fields.
iv) Utility Plans for New Building (water/sewer/drainage/lighting/electrical) showing connections to existing utility services.
(1) Lighting and electrical designs are not provided by O&A. Lighting/Electrical services will be designed by an Electrical Engineer under separate contract with the City. Information from the electrical design will be incorporated into the plans as they are available. v) Drainage / LID Plan showing required improvements from the Drainage / LID Design. See item #2.
vi) Irrigation Piping Plan

STAFF RECOMMENDATION:
Staff recommends the City Council receive a report from the City Attorney and discuss and consider authorizing the City Attorney to develop revised nuisance abatement regulations.
EXECUTIVE SUMMARY:
Pursuant to the City’s general police powers, the City has the right and ability to abate public nuisances, which are broadly defined to mean “[a]nything which is injurious to health…or is indecent or offensive to the senses, or an obstruction to the free use of property, so as to interfere with the comfortable enjoyment of life or property, or unlawfully obstructs the free passage or use, in the customary manner, of any navigable lake, or river, bay, stream, canal, or basin, or any public park, square, street, or highway.” (Civil Code, § 3479.) The City may declare what constitutes a nuisance by ordinance. (Gov. Code, § 38771.)
There are several ways in which the City may abate public nuisances. First, the City may bring a civil action in court to enjoin the nuisance. Second, the City may declare specified nuisances to be infractions and/or misdemeanors and prosecute offenders in criminal court. Third, the City may abate nuisances administratively. These remedies are considered cumulative, meaning that the City may use more than one remedy to abate a particular nuisance matter, depending on the severity, urgency, and level of cooperation.
Abating nuisances administratively is the most widely used method by cities and counties to abate nuisances because, on average, it is more efficient and economical than the judicial methods for dealing with common nuisance abatement issues.
The California Government Code provides express authorization for cities to abatement nuisances administratively and to collect the cost of such abatement by nuisance abatement lien, which may be foreclosed upon, or as a special assessment against the parcel, which is collected with real property taxes.
The City’s existing nuisance abatement provisions are principally contained in Chapter 8.16 of the Fortuna Municipal Code (“FMC”). Chapter 8.16, which is entitled “Property Maintenance”, was adopted by ordinance in 1990 and it does not appear that is has been updated since.
Business Item 5c
The City Attorney has identified several aspects of the City’s current nuisance abatement provisions that should be updated to conform to best practices and provide the City additional flexibility in combatting various types of nuisances. As part of a revised ordinance, the City Attorney would propose the following changes:
1. Re-define what constitutes a public nuisance. Section 8.16.020 currently defines what constitutes a public nuisance, and each declaration is specific to a condition of real property.
As part of the re-developed nuisance regulations, the City Attorney would propose, among other things, a catch-all definition of public nuisance so that any violation of the FMC (including the City’s Building Codes) would constitute a public nuisance.
By adding the catch-all definition, the City’s Code Compliance staff would have expanded authority to abate violations of the FMC that may not fit well within the specific property conditions listed in Section 8.16.020. This might include properties constructed without the proper permits or otherwise in violation of the City’s Building Code. This would also allow non-property related violations of the FMC (e.g., unlawful events) to be abated as a nuisance.
2. Add summary abatement procedures. Government Code Section 38773 authorizes cities to summarily abate certain public nuisances that pose a clear and imminent danger to, or require immediate action to prevent or mitigate the loss or impairment of life, health, property, or essential public services.
As opposed to the normal process, the summary abatement procedures would allow the City to abate the nuisance immediately due to the nature of the nuisance, followed by notice to the property owner.
3. Provide for better cost recovery, including attorney’s fees and costs.
4. Provide for better integration with other remedies, including the recently adopted administrative citation ordinance.
If authorized, the City Attorney will work with staff to develop an ordinance for the Council’s future consideration.
FISCAL IMPACT:
It is estimated to cost $1,850 in legal fees, which amount is within the budgeted amount for legal fees.
RECOMMENDED COUNCIL ACTION:
1. Receive staff presentation and review Council questions with staff
2. Open the Public Hearing
3. Close the Public Hearing
4. By motion, authorize the City Attorney to develop revised nuisance abatement regulations for the Council’s future consideration.

STAFF REPORT
City Council Business Item
DATE: October 17, 2022
TO: Honorable Mayor and Council Members
FROM: Merritt Perry, City Manager
SUBJECT: Consideration of the Subgrant of the City of Fortuna’s 2019 Allocation of the Permanent Local Housing Allocation (PLHA) Funds to the City of Arcata and Approval of the PLHA Subgrant Contract Agreement, Resolution 2022-31 STAFF RECOMMENDATION:
Staff recommends the City Council hold a public hearing to discuss and approve Resolution 2022- 31 certifying the Contract Agreement to subgrant the City of Fortuna’s 2019 allocation of the Permanent Local Housing Allocation funds to the City of Arcata.
INTRODUCTION:
In 2017, Governor Brown signed the Legislative Housing Package to address the state’s housing shortage and high housing costs. California Legislature Senate Bill 2 (SB 2), known as the Building Homes and Jobs Act, established a $75.00 recording fee on real estate documents to increase the supply of affordable housing. The Act established the Permanent Local Housing Allocation program administered by the California Department of Housing and Community Development (HCD). The PLHA provides a permanent source of funding to cities and counties to increase the supply of affordable housing units. These funds would be allocated as formula and competitive grants to entitlement and non-entitlement jurisdictions based on the formula prescribed under federal law for the Community Development Block Grant (CDBG) to be locally administered.
EXECUTIVE SUMMARY:
On August 17, 2022, the California Department of Housing and Community Development announced the Permanent Local Housing Allocation program 2022 Entitlement and NonEntitlement Local government Formula Component Notice of Funding Availability (NOFA). The NOFA announced approximately $331 million in calendar year 2021 funds plus an additional $131 million in remaining calendar year 2019 and 2020 funds for the Permanent Local Housing Allocation program for housing-related projects and programs that assist in addressing unmet housing needs. The deadline to apply for the 2019 allocation is November 30, 2022. A copy of the notice of funding availability can be found at the following website:
https://www.hcd.ca.gov/sites/default/files/2022-08/2022-PLHA-Formula-Component-NOFA.pdf The PLHA program runs on a five-year cycle and will be continuing into the future, however the allocations must be applied for annually and expended on Eligible Activities which address housing needs. Program Guidelines state that an applicant is only eligible to apply for their current and past two allocations at one time, meaning that the current application period (for 2019, 2020, and 2021 allocations) will be the last opportunity for jurisdictions to apply for and receive their 2019 allocation. Any 2019 allocations that go unclaimed after the application period will be Business Item 5d
reverted to the Housing Rehabilitation Loan Fund for the Multifamily Housing Program. Because Fortuna does not have the employee capacity to manage a PLHA award, the City is in danger of losing our allocation from 2019 in the amount of $108,619.
Section 300(c) of the PLHA Program Guidelines allows a local government to subgrant another local government to submit an application and administer on its behalf its formula allocation of PHLA program funds, provided that the local government enter into a legally binding agreement and the funds are expended for eligible activities consistent with program requirements. A copy of the PLHA Final Guidelines can be found at the following website:
https://www.hcd.ca.gov/grants-funding/active-funding/docs/plha-final-guidelines-11-19.pdf The City of Arcata is eligible to participate in the PLHA program and has been allocated an estimated $176,062 for the 2019 allocation. Arcata anticipates submitting an application before the November 30, 2022 deadline for eligible housing-related projects.
The City of Fortuna has successfully delegated funding to the the City of Arcata in the past. On April 19, 2021 the Fortuna City Council approved a Memorandum of Understanding with the City of Arcata and delegation of CDBG Coronavirus Aid, Relief, Economic Security (CARES) Act funds to assist in expanding Arcata House Partnership services. This included enhanced food pantry services and additional support staff onsite at the Arcata Annex to assist with intake as well as outreach in the community, including Fortuna, with the goal of finding COVID safe temporary housing in the near term and ultimately permanent housing solutions.
Subgranting of Fortuna’s PLHA funding to a local government would contribute to the overall improvement of affordable housing in Humboldt County. It seems appropriate to subgrant Arcata for the PLHA funds considering the past delegation of CDBG CV2/CV3 funding and observing the skillset of its staff in CDBG management. If the subgrant of funds is approved Arcata will receive the Fortuna’s full 2019 allocation in the amount of $108,619, as set forth in PLHA Guidelines Section 300(c).
The City of Fortuna is unprepared to proceed with the development of a program for PLHA funds at this time. City of Arcata staff have committed to working with the City of Fortuna staff to develop the capability to implement programs using PLHA funds in the future.
FINANCIAL IMPACT:
There is no direct fiscal impact with this action. Housing funds designated for Fortuna will be allocated to Arcata and remain in Humboldt County rather than reverting back to the statewide pool.
RECOMMENDED COUNCIL ACTION:
1. Receive staff presentation and review Council questions with staff
2. Open Public Comment
3. Close Public Comment
4. Approve the Contract Agreement by adopting Resolution 2022-31, read by title only and consent to the subgrant of the City of Fortuna’s 2019 PLHA allocation of $108,619 to Arcata to administer on behalf of Fortuna for housing-related projects. Roll Call vote.
