RESOLUTION 2022-35

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FORTUNA

APPROVING THE ACQUISITION OF MILITARY EQUIPMENT, MAKE FINDINGS

PURSUANT TO THE MILITARY EQUIPMENT POLICY, AND AUTHORIZING AN AMENDMENT TO THE CITY’S MILITARY EQUIPMENT INVENTORY
WHEREAS, the City of Fortuna, California (“City”) is a municipal corporation, duly organized under the constitution and laws of the State of California; and WHEREAS, in 2021, the California Legislature approved, and the Governor signed into law Assembly Bill 481 (“AB 481”), which among other things, adds Chapter 12.8 to Division 7 of Title 1 to the California Government Code providing certain requirements for the funding, acquisition, and use of military equipment, as defined; and WHEREAS, in accordance with AB 481, the City adopted, by ordinance, a military equipment policy; and
WHEREAS, by way of this Resolution and in accordance with the City’s military equipment policy, the City Council desires to approve the acquisition of a certain military equipment item and make the necessary findings.

NOW, THEREFORE, the City Council of the City of Fortuna does hereby resolve as follows:

1. The Chief of Police is authorized to acquire an unmanned, remotely piloted, powered aerial vehicle in the amount of $7,000.00;

2. Upon acquisition, the Chief of Police shall amend the City’s Military Equipment Inventory to set forth (i) the description and cost of the item; (ii) its purpose; (iii) its authorized use; (iv) its expected lifespan; and (v) its estimated annual fiscal impact for maintenance.

3. In approving this acquisition, the City Council hereby finds that:
a. The equipment item is necessary because there is no reasonable alternative that can achieve the same objective of officer and civilian safety; and b. The equipment item is reasonably cost effective compared to available alternatives that can achieve the same objective of officer and civilian safety.

4. The Chief of Police is further directed to report on the acquisition and use of the approved item as part of the annual report required under the City’s military equipment policy.
