City Council Consent Item
DATE: December 5, 2022
TO: Honorable Mayor and Council Members
FROM: Ryan Plotz, City Attorney
THROUGH: Merritt Perry, City Manager
SUBJECT: Authorize the City Manager to Continue Teleconferenced Public Meetings for City Council and all City Committees, Commissions and Boards Pursuant to Assembly Bill 361, Resolution 2022-25
STAFF RECOMMENDATION:
Staff is recommending that the City Council reconsider and approve the findings adopted in Resolution 2022-25 pursuant to Government Code Section 59453, as amended by Assembly Bill 361, and authorize the continued use of virtual meetings EXECUTIVE SUMMARY:
Signed into law in September 2021, AB 361 amended the Brown Act to allow legislative bodies to meet via teleconference (or other virtual means) during a proclaimed state of emergency in accordance with relaxed teleconference procedures, rather than under the Brown Act’s more onerous teleconference rules.
Under AB 361, the City may utilize the less onerous teleconferencing provisions when a public meeting is held during a state of emergency proclaimed by the Governor and the Council finds that (i) State or local health officials have imposed or recommended measures to promote social distancing, or (ii) the legislative body finds that meeting in person would present imminent risks to the health or safety of attendees.
As set forth in the proposed resolution, circumstances continue to exist that allow the City Council to utilize the less onerous teleconferencing provisions under AB 361. In particular, the state of emergency initially proclaimed by the Governor has not been rescinded and remain in place and the California Department of Public Health continues to recommend measures to promote social distancing.
Although the City Council has returned to in-person meetings, Staff anticipates the need to utilize virtual meetings, from time-to-time, based on changed circumstances. Accordingly, Staff recommends that the Council continue to make the required findings under AB 361 for so long as those findings can be made and to authorize the City Manager to utilize virtual meetings under AB 361 when necessary or desirable according to law. For this reason, Staff will include an agenda item on the consent calendar at least once per month for the Council to consider re-affirming the Consent Item 4c
findings in the proposed resolution to provide Staff and Council flexibility in conducting public meetings.
FISCAL IMPACT:
There is no current fiscal impact associated with approving the findings in Resolution 2022-25.
RECOMMENDED COUNCIL ACTION:
Reconsider and approve findings in Resolution 2022-25. Consent Agenda vote.

THROUGH: Merritt Perry, City Manager
SUBJECT: Approve Supplemental Budget Request to Purchase “Insight” and “Onboard” Subscriptions from NEOGOV and Authorize the City Manager to Execute a Three-year Agreement not to exceed $28,887.80
STAFF RECOMMENDATION:
Approve a Supplemental Budget Request (SBR) for the Purchase “Insight” and “Onboard” Subscriptions from NEOGOV, to be used for employee recruitment and onboarding for new hires.
EXECUTIVE SUMMARY:
Over the last several years, the City has partnered with NEOGOV to provide online recruitment, or job posting software services, to the City. The City uses NEOGOV to post jobs in a widespread and professional manner to audiences looking for employment in the public sector. NEOGOV is well known, used commonly by municipalities and provides a cloud-based management suite that specifically serves public sector and education industries. The suite supports the entire employee lifecycle including automated applicant tracking, onboarding and can include training and performance management. The City would like to improve our application process to include online services for applying, internal ranking, scheduling interviews and completing pre-hire tasks, and to provide online onboarding services for new hires.
The Onboarding module will allow the City to process hiring documents online for newly hired employees, and then transition the information into the City’s current Human Resources (HR) and payroll systems. This will reduce the amount of duplicative information that an applicant has to type and allow the City to process the information electronically. The software will save time by allowing the applicant to complete new-hire paperwork prior to starting work, and allowing City staff to process new hire information more efficiently. Another key goal the software will meet is to create continuity for the HR department by training multiple employees to perform all tasks associated with recruiting, hiring and onboarding new employees. This redundancy is vital to the City’s succession planning and forward thinking and will be a great asset for the City by having multiple employees capable of performing necessary tasks using the software.
Together, these two modules (posting/hiring, onboarding) will create a powerful tool for the City’s HR Department to minimize paperwork, reduce staff time for processing hiring paperwork, and Consent Item 4d
create a digital process for hiring. This will be more appealing to interested candidates and presents the City’s onboarding process in a highly efficient and more professional light.
NEOGOV is an industry standard for hiring software. Their customer lists span the entire United States, and the City has successfully used them for the past few years. NEOGOV also has the capability to transfer data to current City enterprise software (Tyler Technologies), which is important in saving time and data entry accuracy. The two services provided by NEOGOV will allow the City to take an applicant from application to hiring with integration into the City’s HR and payroll systems in a quick and effortless process. The amount of time saved will be measurable and increase productivity. This will allow HR staff to spend less time processing paperwork and more time assisting employees. The process will also be more flexible for new employees as they will have a seamless, time saving process to fill out their new hire paperwork online. Overall, these new software modules will allow for a streamlined process for all involved.
City staff worked with representatives from NEOGOV who provided software demonstrations, and meetings about training, implementation, and to obtain estimates for costs. The request for funding was not included in the previous budget cycle, because staff did not have detailed information about the software at that time. Currently the quote provided by NEOGOV is a locked rate they have offered the City upon Council approval, however, rates will increase after January 1, 2023. Staff is requesting approval of the SBR instead of including the costs in the next budget cycle to get the best pricing, but also due to timing. Full implementation of the new systems will take anywhere from three to six months so waiting for the next budget cycle would push this project out by another year.
FINANCIAL IMPACT:
On August 2, 2021 and November 15, 2021 Council approved a total of $45,000 from the American Rescue Plan Act (ARPA) funds for Council Chamber audio and visual upgrades. The actual costs for the upgrades came in under budget, at $41,713.10. Staff also applied for a United States Department of Agriculture (USDA) Grant to help cover the costs. The City was successful in obtaining the USDA grant, which reimburses qualifying projects at 60%.
As part of the annual ARPA reporting requirements, the City reported the use of $26,282.00 of ARPA Funds to the United States Department of Treasury for the Council Upgrade Project prior to receiving the USDA Grant, which can’t be changed. This means the City will be able to submit $15,431.10 through the USDA Grant and will receive $9,258.66 from the grant. Below is a table which hopefully simplifies the approved ARPA funds and available USDA grant funds, less the cost of the Chamber Upgrade Project and the cost of the first year and subscription to NEOGOV.
Total Amount of ARPA Funds Approved by Council for Chamber Upgrades
$45,000.00
Total Cost of Chamber Upgrades -$41,713.10
Remaining Unspent ARPA Funds that can be re-allocated for NEOGOV $3,286.90 Total USDA Grant Funds that will offset the use of ARPA funds left from the Chamber Upgrades
$9,258.66
Amount of ARPA and Grant funds to be re-allocated and allocated for NEOGOV Year 1 and Setup Fees
$12,545.56
Cost of NeoGov Year 1 (FY 22-23) -$11,701.40
Remaining Balance $844.16
Consent Item 4d
The purchase of the two modules and subscription will cost the City $28,887.810 over the next three years. The costs incurred during the first year will include the discounted subscriptions and set up fees of $11,701.40, which will be funded from the surplus ARPA funds from the Chamber Upgrade Project and the USDA Grant funds. The SBR is only required for the first year, and the two subsequent years will be included in the City’s annual budget process and could be paid for by other grant funds currently being sought.
RECOMMENDED COUNCIL ACTION:
Approve Supplemental Budget Request for to Purchase “Insight” and “Onboard” Subscriptions from NEOGOV including the use of ARPA funds and Authorize the City Manager to Execute a Three-year Agreement not to exceed $28,887.80 Consent Agenda vote.

SUBJECT: Approve a Supplemental Budget Request and Authorize the Chief of Police to Purchase an Unmanned Aerial Vehicle Utilizing Funds from the National Opioid Settlement, Resolution 2022-35
STAFF RECOMMENDATION:
In accordance with the City of Fortuna’s Military Policy (California Assembly Bill 481), approve through a Resolution of the City Council of the City of Fortuna, the procurement of certain military equipment items, specifically, an Unmanned Aerial Vehicle (UAV). In addition, approve a Supplemental Budget Request for the purchase of an Unmanned Aerial Vehicle and authorize the Chief of Police to purchase the Unmanned Aerial Vehicle (UAV) utilizing funds from the National opioid Settlement.
EXECUTIVE SUMMARY:
On May 2, 2022, the City Council of the City of Fortuna passed Ordinance Number 2022-753. As a result, section 2.10.150 of the Fortuna Municipal Code was added to comply with California Assembly Bill 481 which among other things, added Chapter 12.8 to Division 7 of Title 1 to the California Government Code providing certain requirements for the funding, acquisition, and use of military equipment, as defined, by local law enforcement agencies.
In sub-section one (1), section 7070(c) of the California Government Code defines Unmanned, remotely piloted, powered aerial or ground vehicles (UAV’s) as “Military Equipment”. Upon the approval of Ordinance Number 2022-753, the current inventory of all items defined as “Military Equipment” which were determined to be in the equipment inventory of the Fortuna Police Department was also approved and incorporated. The current approved inventory includes one Mavic Pro Fly More Combo Platinum (UAV). This particular UAV is technologically obsolete and was purchased by the previous administration with hopes of implementing a UAV program. The project never came to fruition for unknown reasons.
UAV programs have become a standardized resource for law enforcement agencies nationally. The deployment of UAV’s assist officers or incident commanders with mitigation tools. Normally, Business Item 5a
UAV’s can assist and deploy to assist with the following:
Lawful Surveillance and/or Court Ordered Surveillance of Crime and Criminal Activity including Drug Trafficking Organizations (Core Strategy: G – Prevention programs). Major collision investigations
Search and rescue missions for missing persons
Natural Disaster Management
Crime Scene Photography
SWAT, tactical, or other public safety and life preservation missions In response to specific requests from local, state, or federal fire authorities for fire response and/or prevention or mitigation efforts.
UAV’s serve a vital mission critical purpose for law enforcement agencies and enhance public safety for the community. Upon approval, the Chief of Police will replace and update department owned UAV equipment immediately and add the new UAV equipment to the existing department inventory of “Military Equipment”. The UAV resource should be readily available and utilized for enhanced mitigation strategies, and more sophisticated response capabilities for critical incidents.
FINANCIAL IMPACT:
The City recently received the first payment of $17,836.03 from the National Opioid Settlement.
The use of these funds is authorized for the procurement of the proposed UAV equipment and by using these funds; there will be no impact to the currently approved budget. Staff is recommending $7,000.00 of National Opioid Settlement funds (185-5500-2000) be utilized for the purchase of the proposed UAV equipment.

SUBJECT: Authorization to Award a Construction Contract for the Rohner Park Basketball Court Project (CIP 9106) to Mercer Fraser Company and establish a maximum contract amount of $250,000
STAFF RECOMMENDATION:
Authorize the City Manager to award the Rohner Park Basketball Court Project (CIP 9106) to Mercer Fraser Company and establish a maximum contract amount of $250,000.
EXECUTIVE SUMMARY:
The Rohner Park Basketball Court Project initially came into existence in early 2021 as a result of public comment during a Measure E meeting. At the meeting, members of the public expressed a desire to see the courts separated from Park Loop Road, and limit people parking on the court, which limits access to the City’s only public basketball facility. Additionally, the court itself is old and in need of refurbishment. The Measure E committee decided to allocate funding for a project at the basketball courts, and staff began working on the project.
Following the initial Measure E allocation, staff contracted with Ponte Landscape Architecture to develop a conceptual layout for the basketball court improvements. With public comment and staff input, the project as proposed has developed to include the installation of two new full-size basketball courts, full court striping with acrylic surfacing, perimeter fencing, and a patio with planters and picnic tables.
The final construction plans were completed and the project was first put out to bid in September.
The City received two bids, ranging in cost from approximately $300,000 to $370,000. The approved budget for the basketball court project was $125,000. Once underway, staff developed a a target budget for the project of $225,000, assuming funding would be used from the Measure E approved General Park Improvement and Acquisition Project funds. Because bids were far in excess of the target budget, staff elected to reject the bids and identify ways to bring the total project delivery costs down. The plans were revised to include minor alterations to the patio area, court dimensions, paving tolerances, and the elimination of other minor items from the contract (picnic tables, trash cans, etc.) that could be added later. The project was rebid in late October. The second bid period closed on November 17th, and the City received four bids, which are summarized in the table below.

c. Hydration station.
The apparent low bid for the base contract, which is the basis of project award, was submitted by Mercer Fraser Company with a total bid price of $178,400 and is within the City’s target budget.
City staff have confirmed that the bid received from Mercer Fraser Company was responsive and that Mercer Fraser is an experienced contractor capable of completing the project.
The total proposed budget for the project is $250,000, which would allow for the City to complete the base bid items, Bid Alternate 1 (Fencing), and provide for a construction contingency of approximately 10%. The contingency would be in place to cover unforeseen items or change orders during construction. Staff are not recommending award bid alternate 2 (a hydration station), as there are other water fountain facilities located nearby, and it can be added later if desired.
The draft Notice of Potential Award is included as Attachment A. If the project is awarded, staff anticipate executing the contract in January of 2023. After execution of the contract, staff would work with Mercer Fraser to establish a construction schedule, with an anticipated project completion date by June of 2023. Some delays should be expected, as we are entering the winter months and much of the work included in the project (such as the court surfacing) requires dry weather to complete.
FINANCIAL IMPACT:
The total budget requested to complete the project is $250,000 and includes $125,000 specifically approved for this project, and $125,000 from the General Parks Acquisition and Improvement Project. The General Parks Improvement and Acquisition Project, was created by the Measure E Committee to be used for non-specific park projects, acquisitions and to leverage grant funds when possible and has been rolled over from year to year in the past to build up a reserve for parks projects. The current balance in the General Park Acquisition and Improvement Project is approximately $215,000, and if the proposed budget amount is approved, $90,000 would remain for other projects. The proposed funding is summarized in the table below.
