A Request for Proposal (RFP) to develop a new institute for Clerks working to achieve Certified Municipal Clerk (CMC) and Master Municipal Clerk (MMC) designations is complete and sent to over fifty California Universities. On November 29, 2022, CCAC made the decision to extend the proposal deadline to December 30, 2022. The evaluation of proposals is expected to begin in January 2023.

On December 8, 2022, Clerk staff met with the City Manager and the City’s Council Elect, Kris Mobley and Kyle Conley as part of the onboarding process for our newest Council Members.

On December 15, 2022, Clerk staff attended a training on the recodification of the California Public Records Act (CPRA). The recommended changes to the CPRA were prepared by the Law Revision Commission to reduce the length and complexity of current sections, avoid unnecessary cross references, organize existing provisions, eliminate duplicative provisions and clearly express legislative intent without changing any substantive provisions.

RISK MANAGEMENT / HUMAN RESOURCES DIVISION
Risk Management
There were two new Worker’s Compensation claim and no new liability/tort claims filed as of November 1, 2022. The City is working closely with our risk pool, California Intergovernmental Risk Authority (CIRA) counsel with Leibert Cassidy Whitmore (LCW), and our Worker’s Compensation Third Party Administrator LWP, to move claims toward closure.

Date of Claim Type of Claim Status
03/10/2022 Civil Claim In progress
09/29/2022 Civil Claim In progress
Risk staff will be focusing on re-establishing a Citywide Safety Committee to focus on updates to the Injury, Illness Prevention Program (IIPP), COVID-19 Prevention Program and a Work Place Violence Prevention Program.

Human Resources
Human Resource staff worked with our partnering agencies in the Humboldt County Employment Relations Consortium and selected our annual training offerings through LCW. Our partnering agencies include Arcata Fire Protection District, our risk pool CIRA, City of Arcata, City of Trinidad, County of Humboldt, Redwood Coast Energy Authority, and the Wiyott Tribe. Our agencies collaborate each year to select four full day or eight half-day trainings on topics pertaining to employment relations. The complete list will be available to all employees at the beginning of 2023.

The City continues to search for and recruit qualified staff for open positions. At the December 5, 2022, Council meeting, the purchase of NEOGOV, state of the art Human Resource (HR) software Consent Item 4b

Computer/Network
Nylex has been coordinating with staff and AT&T to assess the sites where new fiber optic connections will be installed. AT&T continues to work with staff in various locations to determine best locations and needs for installation of the new fiber optic lines. Fiber optic lines are being put in place because the City’s data usage exceeds what is efficiently available on the current sorely outdated lines. Updating the infrastructure will allow for growth and greater capacity and will reduce issues created by phone and computer data overloading the broadband capacity. This is an exciting opportunity for expansion of infrastructure to the City’s benefit.

STAFF REPORT
City Council Consent Item
DATE: December 19, 2022
TO: Honorable Mayor and Council Members
FROM: Aaron Felmlee, Finance Director
THROUGH: Merritt Perry, City Manager
SUBJECT: Finance Department Monthly Report
STAFF RECOMMENDATION:

Receive report as an informational item.

EXECUTIVE SUMMARY:

SB90 Cost Claims:

Finance staff have submitted cost claims to the State as part of the State Mandated Claims Reimbursement Program. As a way of background, Senate Bill 90 (SB90) was passed by the State Legislature in 1972. The purpose of the SB90 program was to provide local agencies with a financial relief (reimbursement) from the State for the administration or operation of a required program either completely or partially. The State Controller’s Office annually receives, reviews, and audits the Mandated Cost claims. The claims are due by January 15 each year.

This year the City submitted claims for three different programs for a total amount of approximately $8,000. The claims are to be paid in the subsequent State budget if there is any appropriation; otherwise, there is no specific date. Historically the City receive about 85% of the total claim amount within a year. Some claims are still unpaid and date back as far as fiscal year 2005-06.

Fiscal Year 2021-22 Transportation Development Act (TDA) Audit:

Finance received a letter notifying staff that the firm of Anderson, Lucas, Somerville & Borges, LLP (ALSB) has been engaged by the Humboldt County Association of Governments for fiscal year ended June 30, 2022 to audit Fortuna’s Transportation Development Act (TDA) activities.

The TDA requires annual audit examinations of all entities claiming Local Transportation Funds (LTF) which the City claims annually to help fund the Senior Bus Program as well as Streets Improvement Projects.

ALSB has requested staff prepare various schedules and other reconciliations that they require as part of the audit. Additionally, staff provided a number of documents for ALSB to review as part of the interim audit work. A draft audit report will be provided to the City upon the auditor’s completed review of the requested documents.

EXECUTIVE SUMMARY:

Public Works Director/City Engineer
Water Tank Coating Project
Staff worked with our engineering consultants to finalize the project bid package for recoating Campton Heights and Hillside steel water tanks. The project was formally put out to bid on December 12th, and the bid opening is late January. Staff anticipate bringing the project to Council for award in early February.

Police Facility Remodel Project
The final design drawings were completed in October and the project was put out to bid on October 31st. On November 16th, staff conducted a mandatory pre-bid meeting at the future police facility site to provide contractors the opportunity to see the site and familiarize themselves with the requirements of the contract. The meeting was attended by 15 contractors, and staff feel confident that many local building contractors are interested in submitting bids for the project.

The initial bid opening date was December 1st, however, due to the number of questions that have been submitted by contractors staff have extended the bid period to December 21st at 2 pm. Over the past month, staff, with assistance from the City’s engineering consultants, have issued five bid addendums addressing over 75 questions received from contractors.

In November, staff submitted an application for electrical service upgrades to PG&E for the project. This is an item that is commonly completed by the General Contractor, however, in this case staff are hoping that an application submitted sooner will help to ensure PG&E engagement earlier on in the project. At this time PG&E has not indicated that there will be significant hurdles in the service connection upgrade for this project, but staff will continue to track that closely with PG&E staff.

If the bid opening date does not require further extension, staff anticipate bringing the project and the bid results to the Council in January.

Vancil Reservoir Rehabilitation Project
To date, all trees have been fallen and removed from the site, and there has been sufficient windows of good weather to complete operations onsite. The City’s General Services and Wastewater crews worked hard during the logging operation to keep the access roads and drainage systems functioning to expedite the contractors logging operation. Remaining items of work onsite include cleanup, chipping, and contractor demobilization.

Kenmar Interchange Improvement Project
The final draft initial study and mitigated negative declaration (CEQA document) for the Kenmar Interchange Improvement project has been completed and was circulated in early December. The document will be available for public comment through the beginning of January. Staff anticipate bringing the document to the Council for approval in early February.

Sanitary Sewer Master Plan and Stormwater Infrastructure Vulnerability Assessment Currently the City has a consultant working on Stormdrain and Sanitary Sewer Master Plans, to help guide and inform the City’s capital improvement program in the coming years. In the last month, the City’s consultant has worked to develop the engineering models used to assess the system for overall performance, and City staff participated in workshops to inform the design team of operation and maintenance considerations our public works crews are aware of. These master plan projects will be ongoing efforts throughout most of 2023.

Rohner Park Basketball Court Project
The Council approved the award of a construction contract to Mercer Fraser at the December 5th meeting. Since that time, staff have been working on contracting with Mercer Fraser. Staff anticipate having an update on the project construction schedule in January.

Corporation Yard Roofing Project
Staff have been working on developing a project bid package to replace the metal roof at the City’s corporation yard at 190 Dinsmore Drive. The project bid package was finalized and posted on December 12th, and staff anticipate bringing the project to the Council in early February for an award recommendation. Staff anticipate this project going to construction in late spring or early summer.

Corporation Yard Stationary Generator Project
Earlier this year the City received a USDA grant to add a stationary emergency generator and automatic transfer switch at the City’s corporation yard. Currently, the facility has no backup power during outages, and staff manually connect a small portable generator to keep the phone and internet systems active at the site during a power outage. The USDA grant will cover approximately 50% of the total project cost. In November, staff worked to develop a bid package, and the project was put out to bid in early December. The bid opening is in January, and staff anticipate bringing this item to the Council for contract award in January or February.

Utilities Division- Utility Lead
Service Call Summary
 In November the utilities division completed 86 service calls by operators. Figure 1 below shows the distribution of service calls by type.
 The division completed 36 Underground Service Alert (USA) mark and locates with zero miss-marks, resulting in zero broken utilities.

Figure 1. Utility division service calls by type in November.

Water Distribution System
 Read water meters and completed meter worksheet.
 The utilities team installed one new service to the system in the month of November.  In November there were no water leaks, but had one hydrant hit resulting in an estimated 24,000 gallons of water lost.
 In the month of November the utilities team changed out eight dead water meters.  Continued to check service lines for lead in accordance with EPA requirements.  Backflow Testing.
 The City has had a difficult time getting water meters so the utilities crew has been rebuilding meters in-house and testing the rebuilt meters afterwards to confirm accuracy.

We have had an 87% success rate rebuilding meters for reuse, and each rebuilt meter saves cost for the City and our ratepayers.

Wastewater Collections System
 The utilities team didn’t televise any sewer mains this month as we are short staffed. We now have almost a full crew and will be continuing this effort next month. 0 5

Wastewater Events & Maintenance Tasks Completed:
 The plant hosted a sludge dewatering demonstration
trailer from Process Wastewater Technologies, Inc.

Outside operators and engineers visited the plant to
witness the unit’s potential.
 A contractor installed a new gate at the Laurelwood
sewer lift station. This will provide access to the rear of the station for servicing storm drain piping.
 Staff removed a fallen tree near the Administration
Building at the wastewater plant.
 A contractor replaced some badly corroded gas piping
and fittings on the wastewater treatment plant boiler.
(See photo inset right).
 Staff rebuilt various wastewater plant pumps,
including a return activated sludge pump and a heat
exchanger recirculation pump.
 Staff used a VacCon truck to pump out numerous City sewer lift station wet-wells of grease and sediment, including rags and “flushable” wet-wipes.  A contractor conducted the annual service and maintenance on all chemical gas feed and leak detection equipment (including at the water wells Corrosion Control Facility). Staff also replaced some key process solution valves at the same time.  Staff placed the third primary clarifier online as seasonal rains began. Winter-time flows are higher and require more plant volume for proper treatment. As flows continue to increase, staff will bring more standby basins online to meet demand.  Staff cleaned out the headworks bio filter of old wood-chip media in preparation to replace the media and rehabilitate the unit.

Staff is recommending that the City Council reconsider and approve the findings adopted in Resolution 2022-25 pursuant to Government Code Section 59453, as amended by Assembly Bill 361, and authorize the continued use of virtual meetings EXECUTIVE SUMMARY:

Signed into law in September 2021, AB 361 amended the Brown Act to allow legislative bodies to meet via teleconference (or other virtual means) during a proclaimed state of emergency in accordance with relaxed teleconference procedures, rather than under the Brown Act’s more onerous teleconference rules.

Under AB 361, the City may utilize the less onerous teleconferencing provisions when a public meeting is held during a state of emergency proclaimed by the Governor and the Council finds that (i) State or local health officials have imposed or recommended measures to promote social distancing, or (ii) the legislative body finds that meeting in person would present imminent risks to the health or safety of attendees.

As set forth in the proposed resolution, circumstances continue to exist that allow the City Council to utilize the less onerous teleconferencing provisions under AB 361. In particular, the state of emergency initially proclaimed by the Governor has not been rescinded and remain in place and the California Department of Public Health continues to recommend measures to promote social distancing.

Although the City Council has returned to in-person meetings, Staff anticipates the need to utilize virtual meetings, from time-to-time, based on changed circumstances. Accordingly, Staff recommends that the Council continue to make the required findings under AB 361 for so long as those findings can be made and to authorize the City Manager to utilize virtual meetings under AB 361 when necessary or desirable according to law. For this reason, Staff will include an agenda item on the consent calendar at least once per month for the Council to consider re-affirming the Consent Item 4j

STAFF REPORT
City Council Consent Item
DATE: December 19, 2022
TO: Honorable Mayor and Council Members
FROM: Liz Shorey, Deputy Director of Community Development THROUGH: Merritt Perry, City Manager
SUBJECT: Supplemental Budget Request for $11,880 to Provide Supplemental Support for the Mill District Specific Plan
STAFF RECOMMENDATION:

Approve Supplemental Budget Request to allocate $11,880 to be received from the Caltrans miscellaneous revenue fund for additional tasks identified to complete the Mill District Specific Plan and authorize the City Manager to execute a contract with Planwest Partners.

EXECUTIVE SUMMARY:

City staff is underway with planning of the Mill District Specific Plan for infrastructure, design standards, land use, and zoning of the Palco mill site, funded by a LEAP grant from HCD ($65,000) and a Headwaters grant ($75,000 plus a $25,000 City match). Alternative land use scenarios are being designed for presentation at stakeholder and public meetings, with the goal of a preferred alternative to be presented to the Planning Commission for review, and the City Council for adoption. The first stakeholder meeting was held on 9/20/22, and numerous collaborative meetings have subsequently been held with a firm who is in the process of purchasing the mill site property and who has a vision that is generally consistent with the City’s economic and land use goals of the site. The specific plan will identify integrated infrastructure throughout the 75-acre site, and land uses and zoning that are market-competitive and economically viable.

Because of additional planning efforts in responding to developer input and an expanded scope, staff has identified extra steps needed to complete the planning project. These efforts include updating maps and analysis for the revised concepts, changes to land use and zoning, increased allowable commercial and industrial square footage that exceed the General Plan area limits, and review of General Plan conformance for the changes. Due to the modified scope, the degree of analysis under the California Environmental Quality Act (CEQA) will increase as well.

The detailed scope of work and cost proposal by Planwest Partners is attached to this staff report outlining the additional work beyond that originally contemplated as a result of coordination with the anticipated purchaser of the Palco mill site.

FINANCIAL IMPACT:

The total cost of the project is anticipated to be $176,880. This includes HCD and Headwaters Consent Item 4k

grants, and the requested amount of $11,880 to complete the project. The funds would be derived from the Caltrans miscellaneous fund for their materials testing lab on River Ranch Road that was paid to the City to compensate for the conversion of the River Ranch parcel from commercial to public agency and subsequent loss of sales and property tax income.

RECOMMENDED COUNCIL ACTION:

Approve a Supplemental Budget Request for $11,880 to provide additional support for the Mill District Specific Plan to allocate $11,880 to be received from the Caltrans miscellaneous fund and authorize the City Manager to execute a contract with Planwest Partners. Consent agenda vote.

SCOPE OF SERVICES
The City of Fortuna (City) is working with the purchaser of the former mill site located east of Highway 101, south of Newburg Road, and west of Fortuna Boulevard, a property that comprises the majority of the Fortuna General Plan Mill District. The new property owner does not have a particular plan at this time but appears willing to closely coordinate with City to develop the site in a manner compatible with the Mill District and the City’s ongoing Mill District Specific Planning. Planwest Partners Inc. (Planwest) will assist the City with the review of Mill District proposals, including the following tasks:

Task 1 – Assist City Staff with Property Owner Information Request, Responses, and General Plan and CEQA Conformance Review
Planwest will assist the City in the review of proposed land uses and design concepts, street and utility layouts, and other proposals provided by the property owner and evaluate potential compatibility with existing and proposed changes to Mill District policies and integration with existing development. Planwest will provide a summary of the property owner’s new proposals consistency with General Plan policies and current Mill District planning concepts such as total development (land uses, maximum total square feet, maximum total employment), proposed road connection and utility locations, potential for additional traffic or environmental impacts.

Planwest work will consider how potential buildout of the property based on the property owner proposal relates to relevant CEQA impact topics and/or the cumulative analysis. Advise staff on the differences between the proposal and existing General Plan policies, or ongoing planning assumptions relating to the Mill District, and potential environmental implications relating to CEQA compliance and the potential need for additional studies.

Task 2 – As Directed, Provide Alternative Land Use Proposals In response to property owner proposals and as directed by City, provide alternative land use proposals, which may include land use maps, land use policy, and proposed zoning regulations or performance standards to better achieve Mill District General Plan objectives and that meet the overall objectives of the property owner.

Task 3 – Evaluation of Potential Additional Mill District Planning Project Costs and Cost Share Options
Based on Task 1 review and direction from the City, provide recommendations regarding the elements of the property owner proposal that may require additional CEQA review or that would require additional amendments to the General Plan not contemplated in the existing Planwest Scope of Work for the Mill District Specific Plan and provide cost estimates for the additional work and how such work may affect the Mill District Specific Plan timeline.

SUBJECT: Supplemental Budget Request for the Purchase of Two Police Vehicles STAFF RECOMMENDATION:

Approve a Supplemental Budget Request (SBR) for the Purchase of two (2) police vehicles to provide funding in the current fiscal year that was previously approved for last fiscal year, but delayed due to supply shortages.

EXECUTIVE SUMMARY:

The City Council approved a supplemental budget request for the two purchases of two police vehicles using a combination of City Funds from Asset Forfeiture and USDA grant funds in fiscal year 2021-2022. Due to supply shortages, the vehicles were not available until the current fiscal year (2022-2023). Therefore, it is necessary to adjust the current year budget to reflect the purchase that needs to be made. The budget for the purchase remains the same as was approved by the Council on September 20, 2021.

The estimated cost for the purchase and outfitting of the vehicles is $120,000 and included two (2), 2022, Ford, Police Explorer, 4-Door, hybrid, AWD, vehicles with police equipment package and installation, graphics installation and all applicable taxes and fees. The vehicles will be purchased from Downtown Ford Sacramento as a “piggy back” based on a previous competitive bid by the State of California for the same vehicles.

The estimate for the vehicle purchase and outfitting is summarized in the table below:

Item Estimated Cost
Purchase of Vehicles from Downtown Ford $83,201.54
Equipment Package from Superior Installs $30,160.00
Vehicle Detailing by Visual Concepts $1,500.00
Contingency $5,000
Total $119,861.54

STAFF REPORT
City Council Business Item
DATE: December 19, 2022
TO: Honorable Mayor and Council Members
FROM: Merritt Perry, City Manager
SUBJECT: Organic Waste Disposal Ordinance Revision
STAFF RECOMMENDATION:

Staff recommends that the Council hold a public hearing and conduct a first reading of Ordinance 2022-757, revising Chapter 8.14 to the Fortuna organic waste disposal reduction regulations that implement and enforce CalRecycle organics regulations and SB 1383 compliance date from January 1, 2023 to July 1, 2023.

EXECUTIVE SUMMARY:

In September 2016, Governor Brown signed into law SB 1383 (Lara, Chapter 395, Statutes of 2016), establishing methane emissions reduction targets in a statewide effort to reduce emissions of short-lived climate pollutants (SLCP) in varioussectors of California's economy. The new law codifies the California Air Resources Board's Short-Lived Climate Pollutant Reduction Strategy, established pursuant to SB 605 (Lara, Chapter 523, Statutes of 2014), to achieve reductions in the statewide emissions of short-lived climate pollutants. Actions to reduce short-lived climate pollutants are essential to address the many impacts of climate change on human health, especially in California's most at-risk communities, and on the environment.

From 2016-2020, the California Department of Resources, Recycling and Recovery (CalRecycle) worked to develop regulations to achieve the goals of SB 1383. These new regulations were finalized by CalRecycle in November 2020. The regulations went into effect January 1, 2022 and every city and county in California is required to have an enforceable SB 1383 Ordinance in place by this date. The law establishes statewide targets to reduce the amount of organic waste disposed of in landfills (50% reduction by 2020 and 75% by 2025). It also sets a goal to rescue at least 20% of currently disposed edible food by 2025 and redirect that food to people in need.

The state defines “Organic waste” as food, landscape and pruning trimmings, lumber, wood, manure, cardboard, paper products, printing and writing paper, and other plant and animal- based products. The SB 1383 regulations require that jurisdictions conduct education and outreach on organics recycling to all residents, businesses (including those that generate edible food that can be donated), haulers, solid waste facilities, and local food banks and other food recovery organizations.

Business Item 5a

Page 2 of 2 ends

There are many parts of SB 1383 that will take time and effort to develop and implement. The City completed an Implementation Plan in collaboration with the HWMA and other jurisdictions in Humboldt County. A part of that effort was the development of a roadmap of options for how we might look to identify the requirements of the various portions of the new regulations. The City will have to make changes to the City's waste collection, recycling, and organics programs in the next few years to satisfy the requirements of SB 1383.

Ordinance 2022-755 was adopted by the council on June 2nd 2022 to satisfy the City’s requirement to adopt an enforceable ordinance, with implementation of the requirements delayed until January 1, 2023. Currently staff is still negotiating the franchise agreement changes with our franchise waste hauler (Recology) and do not anticipate being able to complete the franchise agreement changes until March of 2023. Additionally, Recology does not anticipate having the necessary equipment to implement mandatory collection (collection bins and trucks) of organic and solid waste, and currently there is not a regional facility that can process the organic waste for recycling.

The Humboldt Waste Management Authority (HWMA) is working on a project to create a tipping floor to process and haul organic waste to an approved facility. The soonest a facility would be available is July 1, 2023. Therefore, if the schedule for the HWMA facility is delayed, or Recology continues to experience supply chain delays for equipment, changes may need to be revised again in the future.

RECOMMENDED COUNCIL ACTION:

1. Open the Public Hearing

2. Receive staff presentation and review Council questions with staff

3. Open Public Comment

4. Close Public Comment

5. Motion to conduct first reading of Ordinance 2022-757, by title only and continue the public hearing to January 3, 2023. Roll call vote.
