Notices Posted (Public Hearing, Agenda, Ordinance, etc.) 4 Clerk staff continues to participate in the City Clerk Association of California’s (CCAC’s) Educational Committee to aid in restructuring the CCAC’s educational offerings. A Request for Proposal (RFP) to develop a new institute for Clerks working to achieve Certified Municipal Clerk (CMC) and Master Municipal Clerk (MMC) designations is complete and has been sent to over fifty California Universities. There were six responding agencies and the committee narrowed down the candidates to three. Final interviews took place last week and the final selection is slated to go before CCAC’s Board by the end of the month. This is an exciting transition for the entire clerk community and I look forward to seeing such a significant change take place regarding the CCAC educational offerings.
On February 8, Clerk staff met with TecHome Solutions to trouble shoot ongoing glitches with Council Chamber hardware. It is believed most issues were resolved and Clerk staff continue trying to provide the best user experience for access to public meetings by live and virtual attendees!

Each training session will include the following: Lockout/Tagout from 8 – 10 AM and Confined Space from 10 – 12 PM. Lockout/Tagout practices and procedures safeguard workers from hazardous energy releases and attendees will learn necessary procedures to disable machinery or equipment to prevent hazardous energy release. Confined Spaces training will provide information that may aid in recognizing and evaluating hazards and possible solutions related to confined spaces.
These courses are designed to introduce or refresh many of the required safety elements and promote industry best practices that can reduce liability and injury risk. The primary audience for these courses is public work staff or staff with duties requiring them to have this knowledge.
Human Resources
The initial meeting with NEOGOV took place on January 25 and HR staff have started the training modules 1 – 8. HR staff are scheduled to meet weekly with the Insight specialist until implementation. The training consists of interactive modules that simulate the software’s recruiting process and an hour review and training with the specialist, Jamie Malley.

STAFF RECOMMENDATION:

EXECUTIVE SUMMARY:
Recognized Obligation Payment Schedule (ROPS):
The City of Fortuna became the Successor Agency to the Former Fortuna Redevelopment Agency after the State dissolved all Redevelopment Agencies back in 2012. As such, the City, as the Successor Agency, must submit an annual Recognized Obligation Payment Schedule (ROPS) to the State Department of Finance in order to receive funds to pay down the Former Fortuna Redevelopment Agency’s outstanding obligations.
The ROPS was successfully submitted to the Department of Finance (DOF) on January 31. The DOF requested supporting documentation, which staff provided to the DOF on February 2, to certify the amounts being claimed and will send a final funding determination letter to the City by April. The final funding determination will be incorporated into the annual City Budget and discussed with the Council during the City’s special budget workshops.
Fiscal Year 2023-24 Budget:
Staff presented the mid-year budget review at the February 6 Council Meeting. Conducting this review is the first step in preparing the FY 2023-24 budget. The next steps include staff compiling preliminary revenue estimates and soliciting each departments FY 2023-24 budget requests.
Part of the solicitation of department requests will be a separate list of items each department is requesting to be funded from the City’s transaction and use tax, Measure E. These lists will be presented to the Measure E committee on March 21. The committee then has a follow up meeting scheduled for April 4 to discuss which of those items presented to them will be included in the committee’s recommendation to the City Council. Once staff has compiled this information, a special budget workshop will be scheduled where it will be presented and discussed with the Council. Staff is targeting the beginning of May for the first special budget workshop with Council.
Consent Item 4d

The committee will consider this public input idea at the April Measure E regular meeting after staff have had the opportunity to put a cost estimate to the proposed projects.
The Measure E committee’s next regularly scheduled meeting is set for March 21, 2023 at 5:30pm.
The primary purpose of this meeting will be for the committee to receive funding proposals from City Departments.

Director’s Report
The chimney located at the Monday Club was demolished by Wendt Construction, due to a safety hazard that existed following the 6.4 earthquake on 12/20/22. The City is in the process of identifying funding sources in order to repair/ replace the chimney, with engineering plans for its replacement to be determined at a later date. Three USDA Rural Grant applications were submitted in January for River Lodge improvement projects: replacement of the window blinds/ coverings, replacement of the wheelchair lift, and an exterior stain. All grant projects require a 45% match, in which the City will identify the ideal funding sources, if awarded. The City is in the final stages of submittals for the Rohner Park basketball court rehab project with contractor Mercer-Fraser, in which the Notice to Proceed is expected to occur in February 2023, with the project likely completed in late spring or early summer. This project will replace the single court with two newly paved and painted fenced-in courts, and is funded by Measure E.
The regularly scheduled Rohner Community Recreation and Park District (RCRPD) monthly meeting was cancelled on 1/4, due to lack of pertinent agenda items or updates since the December meeting.

Recreation Programs
The first week of January was the final week of our Winter Break Camp for kids 5-12 years old.
We had 48 children registered for the 2-week program. Camp included Library field trips for our younger campers for story time, as well as a special guest visitor, with the Arcata Playhouse Wagon who led a couple theatre-arts themed activities. We utilized a volunteer with Reaching for Independence who assisted leaders with facilitating activities, for a total of 12 volunteer hours served with camp. Planning and development also began for the Presidents’ Week Break Camp coming up in February.
The 2023 Hot Shots Youth Basketball program for youth in Kindergarten through 4th grade began the month with player evaluations (the first time it has been implemented) and 3 Skills & Drills clinics took place over the 3 Saturdays remaining in January. We utilized a number of volunteers during Skills & Drills clinics, totaling over 50 hours. Well over half of the 307 registered players attended the free pre-season clinics. New training protocols and procedures were also developed for Hot Shots referees, as well as new procedures and information for our volunteer coaches.
Drop-in volleyball on Sunday evenings & drop-in basketball on Thursday evenings continued throughout January, with attendance ranging from 7-16 players per night at volleyball & 4-16 players per night at basketball. Drop-in Volleyball was closed Sunday 1/29 due to the primary volunteer facilitator being out of town.
Our playgroup for kid’s ages 0-5 and their caregivers, in partnership with First 5 Humboldt, also continued through January, every Thursday and Sunday from 10:30am – 12:30pm, with the exception of Sunday January 1, when playgroup was closed for the New Year holiday. Attendance ranged from 1-12 children at each session in January.
Skating
The Fortuna Skating Rink was open for Friday, Saturday, and Sunday Public Skate in January (closed Saturday 1/14 due to leaks from heavy storm). There were only two private parties offered on Saturdays in January due to Hot Shots program usage in the mornings. Over the course of the month, the skating rink hosted 13 private parties with 378 attendees, and in addition to the 1000 skaters that attended public skate, hosted an overall total of 1,378 skaters in the month of January.
Community Service
The Parks & Recreation Department had 4 people signed up to perform Community Service, and workers completed 46 hours throughout the months of January. The Community Service Work Program is a big part of the parks’ success. The workers help with trash pickup and various basic maintenance projects in Rohner and Newburg Parks, the River Lodge, and other Parks-maintained Consent Item 4e
spaces throughout the City. Since the program started in 1997, there have been 53214.75 service hours completed in the throughout the City of Fortuna.

Police Facility Remodel Project
The project was awarded to Sequoia Construction Specialties at the February 6th Council meeting.
Since that time, staff have been working on contracting and bonding with Sequoia, and engaging our project design team to finalize construction drawings per the changes to the project that resulted from the bid period addendums. Staff are anticipating that the contractor will mobilize to the site in early March. The police are working on bringing their operations back to City Hall, and they anticipate having the site fully vacated by the end of February.
In early February, staff conducted a meeting with Pacific Gas and Electric (PGE) at the site to determine how to upgrade the electrical service for the new police facility. PGE indicated that power will be available for the project, and currently the timeline to install the required improvements is in line with the proposed project construction schedule. PGE’s next step is to begin design for the project.
Staff have also been working with Silke Communications, who will be the dispatch radio upgrade contractor for the project. Staff anticipate finalizing a scope and budget for this portion of the project sometime in February, and plan to bring to the Council in March a Public Interest Finding for a contractor sole source with Silke Communications.
Water Tank Coating Project
In January, the City opened bids for the Hillside and Campton Water Tank Coating project. The City received four bids, with the low bidder being Simpson Sandblasting & Special Coatings out of Fontana. The low bid amount is approximately $870,000. Staff plan to bring the award recommendation for the contract to the Council, in addition to a Supplemental Budget request to recommend adding the necessary budget for the project, to the first meeting in March. 12th Street Low Impact Development (LID) Stormdrain Project Staff have been working with the City’s consultant engineers to finalize the design for the 12th Street LID stormdrain project, which will include raingardens and new stormdrain pipe along 12th Consent Item 4g
Street in between Loni Drive and K Street. The project is anticipated to be put out for construction bidding in mid-February.
As noted in a previous monthly report, during the design process staff found that portions of the new utility undergrounding project on 12th Street were installed in conflict with the proposed stormdrain pipe, specifically near the intersection of 12th and K Streets. Staff have been working with the utility providers to correct the conflicts in time for the City’s contractor to begin work, which is anticipated to begin in June of this year.
Utilities Division- Utility Lead
Service Call Summary
In January the utilities division completed 116 service calls by operators. Figure 1 below shows the distribution of service calls by type.
Underground Service Alert (USA) has changed their format and it no longer allows for tracking of how many mark and locates have been completed. There were zero miss-marks, resulting in zero broken utilities.

Water Distribution System
Read water meters and complete meter worksheet.
In the month of January the utilities team changed out 19 dead water meters. Continued to check service lines for lead.
Performed regulatory water system backflow testing.
In January, there was one water leak and one hit fire hydrant, see Table 1 below. The utilities division is still unable to get water meters due to supply shortages and staff spent five full days rebuilding and testing meters to replace dead meters in the system. 0 10

There was one sanitary sewer plug on St Joseph Street that backed up multiple times into a business. The utilities division televised the line and found that a communications line had had been installed which broke the sewer line. The utilities division repaired the sewer line and is working on site restoration.
Miscellaneous Tasks
The utilities division performed monthly maintenance on the division’s heavy equipment, including greasing and checking all fluids.
Alex Garza started his career with the City of Fortuna on the utilities crew as a Utilities II.
Water Treatment/Wastewater Division- Chief Plant Operator Storm Flow Response: Significant rainfall occurred during the first two weeks of the month. This rapidly increased wastewater flow into the treatment plant in the form of inflow and infiltration (I&I). This I&I flow was also most likely exacerbated by numerous potential sewer main breaks caused by the late December earthquake. Staff managed to operate and maintain the system through various process adjustments, succeeding in treating the increased flow without any effluent violations or sanitary sewer overflows (SSOs).
Division Staffing: Senior Wastewater Treatment Plant (WWTP) Division staff conducted interviews this month for a vacant Operator-in-Training position. One of the prospective applicants will be offered the position in early February.
City Projects: This past month saw progress on two, significant WWTP Division projects: City staff hosted the pre-bid walk for the annual percolation ponds rehabilitation project at the WWTP; and the bids were finalized and opened for the Hillside and Campton Heights tanks re-coating project. This latter item will be presented to City Council in March.

Staff installed a new flowmeter transducer for the Strongs Creek lift station flow that enters the WWTP. The old meter had ceased functioning due to corrosion. Staff replaced a broken exterior light fixture at the Laurelwood lift station that was damaged during the late December earthquake.
Staff spent a great deal of time cleaning and organizing in the WWTP garage building.
Decades of clutter were sifted through to free up significant space. Staff finalized and submitted major reports to State and Federal agencies this month including the 2022 Annual Wastewater Report, Volumetric report, and the Annual Biosolids report.
A professional service technician from the manufacturer of the WWTP belt filter press— BDP—visited the plant to assist in troubleshooting this important solids dewatering device.
Staff worked alongside the technician for training, and also replaced worn roller bearings and both pressure-side belts.

EXECUTIVE SUMMARY:
The River Lodge and Monday Club held a total of 30 events in the month of January.
There were six scheduled monthly meetings between the two facilities. One wedding, three birthday celebrations, two memorials, and one baby shower were also held.
CalFire held four separate trainings at River Lodge over a nine-day period. It’s always a pleasure having their group at River Lodge. The group is kind and courteous, while always offering to help with clean-up. They’re so appreciative of the space and have learned to utilize the River Lodge for break-out sessions during their trainings.
River Lodge catered a dinner for the Redwood Memorial Foundation committee and a luncheon for the Friends of the Fortuna Library.
The California Conservation Corps held a job fair at River Lodge. There were many businesses available to provide corps members with information about future careers.
Sunrise Rotary held their annual Seafood Boil Fundraiser. The Seafood Boil is an impressive event with traditional southern Cajun style. The food is cooked under the portico out in front of River Lodge and guests dine on a meal dumped right in the middle of their table.
There were three other large events at River Lodge in January:

STAFF REPORT
City Council Consent Item
DATE: February 21, 2023
TO: Honorable Mayor and Councilmembers
FROM: Cameron Mull, Director of Parks & Recreation
THROUGH: Merritt Perry, City Manager
SUBJECT: Supplemental Budget Request for the Addition of the Playgroup Program in the Recreation Division Budget
STAFF RECOMMENDATION:
Approve the Supplemental Budget Request (SBR) and adjust the FY22/23 budget to include the annual grant agreement with First 5 Humboldt to offer the playgroup activity to families.
EXECUTIVE SUMMARY:
The Recreation Division has offered a First-5 Humboldt sponsored & subsidized playgroup program for families with children aged newborn to 5 years of age since October 2022. A budget adjustment/ increase was made in FY21/22, but since the program will continue to be a staple of the City’s Recreation programs, an adjustment to the FY22/23 budget needs to be made. The Recreation Division’s grant application and current MOU was approved by City Council and secured in January 2022.
The MOU is an annual agreement between First 5 Humboldt and the City to financially support the program in the amount of $14,000 per fiscal year by offering this playgroup session to families twice per week (Thursdays and Sundays 10:00am-12:30pm). This grant will pay the staffing costs to facilitate the program (which has two staff as facilitators for each session), as well as for purchasing the necessary supplies and materials to operate the program. Thus, a SBR is necessary to increase the Recreation Division budget by $14,000 to adjust & account for these additional expenses.
For background, First 5 California is a state agency that utilizes tobacco tax revenue to support programs for newborns to 5 year olds (such as playgroups), which is then administered in the various counties. Recreation activities available for families in Fortuna with children under six years of age were limited, so the Recreation Division offered the program in 2022, which has proven to exhibit many positive outcomes for children in this age demographic. Children that attend playgroups are generally more prepared for kindergarten, learn about positive social interactions, are taught basic life skills early, and are provided resources in a positive environment for parents and young children to thrive.

First 5 Humboldt will continue to provide the City with $14,000 per fiscal year to operate the playgroup program for two sessions per week, so an SBR is necessary to account for this additional revenue and expenses. Revenue will go into Recreation Program Fees (100-4310-5400) and for expenses; $12,000 would come out of Part-Time Salaries (100-5165-5400) and $2,000 from Department Supplies (100-5500-5400). Quarterly invoices are submitted to First 5 Humboldt by City staff.
Some additional revenue is also collected; the program is free to the public (subsidized by First 5 Humboldt), but there is a suggested donation of $1 per session by families to assist with any additional operation and maintenance costs of administering it.
RECOMMENDED ACTION:
Approve the SBR and adjust the FY22/23 budget to reflect the addition of $14,000 to continue to offer Recreation’s playgroup activity. Consent agenda vote.

SUBJECT: Ratify the Fortuna Fire Protection District’s Ordinance No. 2022/2023-1 Adopting the 2022 California Fire Code, Title 24, Part 9, Based on the 2021 International Fire Code
STAFF RECOMMENDATION:
Adopt Resolution 2023-02 (Exhibit A), a Resolution of the City Council of the City of Fortuna Ratifying the Fortuna Fire Protection District’s Ordinance No. 2022/2023-1 Adopting the 2022 California Fire Code, Title 24, Part 9, Based on the 2021 International Fire Code.
INTRODUCTION:
On January 9, 2023, the Fortuna Fire Protection District (FFPD) passed its ordinance No. 2022/2023-1 adopting the California Fire Code and the International Fire Code Standards. The Fire Codes prescribing regulations governing conditions hazardous to life and property from fire and explosion, providing for the issuance of permits for hazardous uses or operations, establishing a fire prevention bureau and providing officers thereof and defining their powers and duties. A copy of the FFPD’s ordinance is attached as Exhibit B to the Council Resolution, along with the FFPD’s resolution of findings, No. 2022/2023-4 (Exhibit C to the Council Resolution), stating the facts and findings in support of the Fire District’s local amendments resulting from local climatic, geographical, and topographical conditions.
DISCUSSION:
The Fire Code is enforced by the Fortuna Fire Protection District. However, in order for the new Fire Code to be enforceable within the City of Fortuna, State law requires the City Council to ratify the FFPD action (Health and Safety Code Sec. 13869.7)). The Fire Code has been adopted independently by the Fortuna City Council by ordinance, but this separate ratification applies to the Fire District’s ability to serve within the City boundaries as well. In order for the city of Fortuna to be brought within the regulatory effect of the FFPD Ordinance no. 2022/2023-1, state law requires the City Council to ratify the FFPD action (Health & Safety Code No. 13869.7(c)).
The FFPD Ordinance will not become effective until ratified by the City Council, and thereafter forwarded to the California Department of Housing and Community Development. Resolution 2023-XX, if adopted by the Council, would ratify the FFPD’s action and direct the City Clerk to forward the resolution to the California Department of Housing and Community Development.
Consent Item 4k
ENVIRONMENTAL REVIEW:
This action to ratify the Fire Protection District’s adoption of the Fire Code is exempt from the California Environmental Quality Act (CEQA) guidelines pursuant to section 15061(b)(3) of the CEQA guidelines.
FINANCIAL IMPACT:
There is no fiscal impact to the City resulting from ratifying the Fire District’s ordinance adoption.
RECOMMENDED COUNCIL ACTION:
Adopt Resolution 2023-02. Consent agenda vote.

SUBJECT: 2021 Community Development Block Grant Application STAFF RECOMMENDATION:
Adopt the Resolution 2023-05 authorizing submission of a 2021 Community Development Block Grant (CDBG) PI Only ADA Barrier Removal Project.
INTRODUCTION:
The Community Development Block Grant (CDBG) program provides annual grants on a formula basis to states, cities, and counties. These grants serve to develop viable urban communities by providing decent housing and a suitable living environment, and by expanding economic opportunities, principally for low- and moderate-income (LMI) persons. The program is authorized under Title 1 of the Housing and Community Development Act of 1974, Public Law 93-383, as amended 42 U.S.C. 5301 et seq.
The State Department of Housing and Community Development (HCD) released the Community Development Block Grant (CDBG) NOFA on January 29, 2021 announcing approximately $30 million in federal funds for the 2021 CDBG program. Eligible cities and counties may submit Community Development and Housing applications for CDBG funds under the 2021 NOFA for a maximum per application request of $1,500,000.00.
The CDBG program requires that each funded activity meets one of the three National Objectives by either principally benefiting low-and moderate-income (LMI) persons, aids in the prevention or elimination of slums or blight, or meets a community development need having a particular urgency. LMI Limited Clientele (LMC), as defined by income limits or presumed benefit refers to persons who earn 80 percent or less of HUD Adjusted Median Family Income (HAMFI) for the county of residence. At least 70 percent of the funds awarded must benefit LMI individuals or households.
EXECUTIVE SUMMARY:
On April 5, 2021 staff presented the “City of Fortuna PI Only ADA Barrier Removal Project” for consideration. Sidewalk improvement is an approved CDBG activity and meets the State Objective for LMI person area benefit as at least 51.9 percent of the activity’s beneficiaries are low and Consent Item 4l
moderate-income persons. Areas were targeted that would improve access to public facilities including access to the Library, City Hall, Rodeo Grounds, and the Bike Park in Newburg Park.
The Council requested staff to add additional improvement locations and increase the budget.
Additional locations were added and the request for funds was increased to not to exceed $830,000.
The CDBG PI Only grant application was initially submitted on February 9, 2022 After review by the California Department of Housing and Community Development, it was determined that several locations would not fit within the scope of CDBG funding and these locations were removed from the budget. The Rodeo Grounds, Newburg Bike Park, and other locations were removed, while access improvements to the Fortuna Library, Downtown areas, and other high-need locations were retained. The budget for the remaining locations is $624,990.65.
The remaining PI funds will be used for a second application to be submitted at a later date.
FINANCIAL IMPACT:
The NOFA allows for grantees to use a total of 17 percent of the allocation for program administration costs. Activity Delivery, costs directly related and necessary to successfully complete a specific project, is covered in the grant award. There is sufficient available Program Income to prepare the CDBG 2021 application. If awarded, an approved CDBG application is 100 percent grant funded, including the costs to administer the grant.
RECOMMENDED ACTION:
Adopt Resolution 2023-05. Consent agenda vote.

SUBJECT: Authorization to Award a Construction Contract for the Corp Yard Roofing Project (CIP 9969) to Darin Thomsen Construction and establish a maximum contract amount of $150,000
STAFF RECOMMENDATION:
Authorize the City Manager to award the Corp Yard Roofing Project (CIP 9969) to Darin Thomsen Construction and establish a maximum contract amount of $150,000.
EXECUTIVE SUMMARY:
The City operates a Corporation Yard (Corp Yard) at 190 Dinsmore Drive, next to the City’s wastewater treatment plant. The Corp Yard is the building that houses the City’s Utilities and Streets divisions, in addition to the carpentry and mechanics shops. The Corp Yard Roofing Project has become necessary due to leaks that have developed in the carpentry and auto shops, which have significantly increased since last winter. The leaks will get worse and more numerous since the existing original roof has dozens of corroded seams, and for all intents the roof as a whole has reached the end of its service life.
The replacement project will also include new insulation, vents, skylights, jacks, trim, gutters and downspouts. The three skylights in the middle of the southern exposure will be omitted since they have little utility and would be a liability if solar panels were ever installed. The Project contract includes two bid alternates that staff recommend awarding. Bid Alternate A is to replace the Carpenter Shop 8.5-foot tall roll-up door with one that is 12-feet tall. The existing door is in need of repair because of poor functionality as a result of impacts due to clearance issues. A larger door would provide for more space and less potential for accidents throughout the years. Bid Alternate B is to replace damaged exterior wall sheet metal panels on the front corner of the building.
The Corp Yard Roofing Project bid package was released and publically advertised on December 12, 2022. The bid period ended on January 19, 2023, at which time the City received three responsive bids. The bid totals including base and alternate bid items are shown in the table below:

1. Replace roof, skylights, gutters, downspouts and trim
2. Replace carpenter shop roll-up door
3. Replace exterior wall panels on south side of southeast building corner The apparent low bid was submitted by Darin Thomsen Construction with a total bid price of $134,200 (including the bid alternates) which is within the total established City construction budget of $150,000. The Engineers Bid Estimate for the total project (base plus all alternates) was approximately $135,000.
City staff have confirmed that the bid received from Darin Thomsen Construction was fully responsive and that they and their sub-contractors have active licenses and registrations. Staff recommend awarding the contract to Darin Thomsen Construction.
If the project is awarded, staff anticipate being under contract in February. Mobilization and construction is anticipated to begin in April 2023, and will likely depend on weather. The draft Notice of Potential Award is included as Attachment A.
FINANCIAL IMPACT:
This project is funded by internal Capital Reserve Funds. See the table below for a breakdown of project funding.
Funding Source Water Capital
Reserve Funds
Sewer Capital
Reserve Funds Total Funding
City Fund Number 510 560 -
Funding Amount $75,000 $75,000 $150,000
As shown above, the total available funding for the project is $150,000. Staff propose to award the project to Darin Thomsen Construction and enter into a contract for $134,200 (the bid total), and to establish a maximum contract amount of $150,000 (the budget total). The approximately $15,800 difference between the bid total and the maximum contract amount would be reserved as a construction contingency to cover any unforeseen costs that arise during the project. The contingency would be approximately 10% of the total project value, which is a conventional value for construction contracts.
