HR and Finance staff continue to participate in NEOGOV “Onboard” trainings and hope to launch the new platform before the end of the year. “Onboard” will create a more efficient work flow for new employees to submit required employment forms and will provide a time saving benefit for the Payroll and Benefits Administrator.

On September 6 and 7, 2023, Humboldt Count Employment Relations Consortium hosted two trainings at the River Lodge, presented by Leibert Cassidy Whitmore (LCW). The first was “A Supervisor’s Guide to Employee Rights” and the second was “A Guide to Implementing Public Employee Discipline”. The trainings were intended for all supervisors and managers and both trainings were well attended by local agencies.

On October 11, 2023, City employees participated in an online LCW training, “Public Service Customer Service” that took place from 1:00 – 3:00 pm.

STAFF REPORT
Consent Agenda Item
DATE: October 16, 2023
TO: Honorable Mayor and Council Members
FROM: Aaron Felmlee, Finance Director
THROUGH: Merritt Perry, City Manager
SUBJECT: Finance Department Monthly Report
STAFF RECOMMENDATION:

Receive report as an informational item.

EXECUTIVE SUMMARY:

Fiscal Year 2022-23 Transportation Development Act (TDA) Audit:

Finance received a letter notifying staff that the firm of Anderson, Lucas, Somerville & Borges, LLP (ALSB) has been engaged by the Humboldt County Association of Governments for fiscal year ended June 30, 2023 to audit Fortuna’s Transportation Development Act (TDA) activities.

The TDA requires annual audit examinations of all entities claiming Local Transportation Funds (LTF) which the City claims annually to help fund the Senior Bus program as well as street improvement projects.

ALSB has requested staff prepare various schedules and other reconciliations that they require as part of the audit. Additionally, staff provided a number of documents for ALSB to review as part of the interim audit work. A draft audit report will be provided to the City upon the auditor’s completed review of the requested documents.

Sales Tax Update:

Finance staff continue to closely monitor the City’s sales tax revenue streams. Sales tax revenue is the largest General Fund revenue source for the City and as such fluctuations in sales tax have the largest effect on the City’s finances.

For sales tax receipts between April and June 2023 the City of Fortuna actual receipts, excluding reporting aberrations, were down 3.0% as compared to April to June 2022. For comparison the County realized a 2.8% decrease and the State of California also realized a 2.8% decrease.

For fiscal year 2022-23 general sales tax and Measure E transaction and use tax totaled $3,973,992.

Although though the City budgeted conservatively for the year at a combined $4,083,000, revenue fell short by about $100,000.

Consent Calendar Item 4d

Page 2 of 2 ends

For comparison fiscal year 2021-22 combined sales tax and Measure transaction and use tax was $4,339,191. Fiscal year 2022-23 revenue fell by nearly 8.5% compared to fiscal year 2021-22. The declines can be primarily attributed to declines in the fuel and service stations (-19%) and general consumer goods (-13%) categories.

Additional information about how the City’s sales tax performed will be presented with the MidYear budget presentation scheduled for the beginning of February.

Measure E Update:

The Measure E committee held a regularly scheduled meeting on September 19, 2023 at 5:30pm.

The primary purpose of this meeting was for Staff to review with the Committee the list of Measure E funded projects that were included in the Council Adopted Budget for fiscal year 2023-24 and review preliminary results for FY 2022-23 for revenues and expenditures. Staff also highlighted sales tax revenue trends with the committee.

weekend. The rest of the staff began training following the twice-yearly skate staff meeting Sunday Sept 17th. Coordinators continued training time and support during week & weekend programming the following weekend.

Drop-in volleyball continued through the month on Sunday evenings, with attendance ranging from 8-19 players each night. Participants range in age from 11 through adults, and recently has had an uptick in middle-school-age attendees. Due to a significant increase in attendance numbers (Sunday Oct 1 had attendance of 27, with another 10 that opted out and left without playing due to overcrowding) we will be expanding our Drop-in Volleyball offerings. Beginning in early October we will be splitting the program into a dedicated youth session followed by a dedicated adult session. Both sessions will continue to take place on Sunday evenings, with youth running 5:30 – 7:30pm and adults running 7:30 – 9:30pm. Our drop-in program is staffed to manage payments, waivers, and facility care but we rely on volunteers to facilitate and organize teams & playtime. Two parents will be starting as volunteers to facilitate the youth session in addition to our current volunteer who will continue to work with the adult group.

Our playgroup for kids ages 0-5 and their caregivers, in partnership with First 5 Humboldt, took place Thursdays and Sundays from 10:30am – 12:30pm. Attendance ranged from 2-14 children at each session, with a special visit on the last Thursday of the month from our local librarian for Story Time.

Preparation continued on fall events, including the Apple Harvest Festival the first Saturday in October (Recreation is running a coloring contest as well as hosting a themed Apple Harvest Skate Night) as well as our 3rd annual Spook-A-Thon, a free youth Halloween carnival event scheduled for Saturday October 28th. This year we introduced sponsorship packages to streamline our donation solicitation process and in September we began donor, sponsor, vendor, and volunteer outreach. The Spook-A-Thon is entirely funded by the generosity of our local community through donations & sponsorships, and each year we have had over 500 children participate with total attendance over 2000 people.

Roller Skating
The Fortuna Skating Rink resumed normal hours starting Friday September 8th, and was open for Saturday, and Sunday Public Skate in addition to Friday and Saturday private parties. September’s theme skate was “Back 2 School!”. Through the month of September, the skating rink hosted 15 private parties with 500 attendees, and in addition to the 526 skaters that attended public skate, hosted an overall total of 1026 skaters over the course of the month.

EXECUTIVE SUMMARY:

Public Works Director/City Engineer
Police Facility Remodel Project
Over the past month, there have been significant advancements in the project as more subcontractors are able to mobilize and complete their work. Since the previous report, the foundation for the covered parking structure has been installed, the roofing has been substantially completed, the electrical rough-in is nearly complete, and the majority of the siding and windows have been installed. Over the next month, staff anticipate that in addition to continued work on the items above the insulation and drywall contractors will begin work, in addition to the painting and site work contractors. In staff’s most recent construction and schedule review meeting, Sequoia Construction is anticipating to be substantially completed in February of 2024, with only minor items remaining thereafter. This is approximately 2-months longer than was originally estimated, however, since the time of the original project schedule many unforeseen circumstances have been incorporated into the project or otherwise addressed. More information on these items is included in the separate staff report on the police facility project budget. Staff would like to note that although the extended schedule is not necessarily desired, it is anticipated to result in no impact to potential building readiness, as it is likely that power and data would not be available for the facility until sometime during the first quarter of 2024.

Water Tank Coating Project
The project was accepted as complete on September 19th, and the City has been back operating the water system at full storage capacity. Overall, the project was completed for approximately $130,000 less than the budgeted amount.

Water System Emergency Generator Project
With the Campton Heights tank completed and back online, staff were able to schedule the final interconnection of the stationary emergency generator at the Kenmar pump station. That interconnection is scheduled for October 10th. Once completed and accepted by the City and our construction managers, staff will file the notice of completion for the project and work to close out the grant documentation with CalOES.

12th Street Utility Undergrounding Project
Staffs understanding is that AT&T performed a successful fiber-optic ‘cut-over’ during the nights of October 4th and 5th, and now the overhead utilities along 12th Street, from L Street to Clendenen’s, are inactive. Staff are working with PGE to expedite their remaining contractor work, which will include removing the poles, aerial lines, and restoring sidewalk.

Kenmar Interchange Improvement Project
The preliminary design phase of the Kenmar Interchange project is anticipated to be completed in early 2024, and as the Council is aware there is no current funding programmed for any future project phases (final design or construction). In an effort to keep the project moving forward, staff submitted a funding request to HCAOG for this year’s regional State Transportation Improvement Program (STIP). After discussion at the Technical Advisory Committee (TAC) level, the funding recommendation that will be presented at the November HCAOG board meeting is for the Kenmar project to receive $3-million, which is anticipated to cover the final engineering plans, specifications, and estimate (PS&E) phase of work, and provide for a construction cost match (which the City could leverage for continued grant funding pursuits). If the HCAOG board approves the funding recommendations as presented, the funding request would go to the California Transportation Commission (CTC) in December, and the City could essentially continue design work on the project seamlessly after the conclusion of the preliminary design phase.

Water Treatment/Wastewater Division- Chief Plant Operator Wastewater Treatment
Table 2. September wastewater plant effluent flows for the past five years in Million Gallons (MG) and Million Gallons per Day (MGD).

Figure 2. September wastewater plant effluent flows for the past five years in Million Gallons (MG) and Million Gallons per Day (MGD).

Wastewater Events & Maintenance Tasks Completed:
 Staff worked on pumping back the 2.9 MG of water brought to the plant overflow pond from the Cal-Trans Fernbridge project in August. The Water Boards required Cal-Trans to dispose of this water at a treatment plant because it contacted fresh-poured concrete and had possible constituents of concern. Staff metered it into the plant flow slowly, over weeks, with no detriment to treatment.
 Staff worked with consultant engineers on a Basin Plan Amendment. This project will go before the Water Boards, and will entail drilling new monitoring wells around the wastewater treatment plant percolation ponds. Staff will then conduct extensive sampling.

The goal is to allow the City to continue discharging effluent to the percolation ponds during the dry season river-discharge prohibition period, as is current practice, despite recent studies that show a potential hydraulic connection of the percolation ponds to the river.

Water Events & Maintenance Tasks Completed:
 The water tank coating contractors completed their
work at Campton Heights tank this month. After proper
disinfection and testing, staff placed it online and
removed the temporary tanks from service. Staff also
replaced the top vent screen and hatch gasket material.

A separate contractor will arrive in October to replace the tank’s cathodic protection system.
 Staff worked with well-drilling contractors to conduct rehabilitation-work on Well #2 at the City’s water wells site (see photo inset right). Problems with pump
production required replacement of the pump’s droppipe and pump shaft. After proper disinfection and testing, staff will place the well back online in October.

General Services and Streets - General Services Superintendent The following is a list of scheduled assignments completed by the General Services staff in September:

has been restored with hot mix asphalt. Minor concrete repair of sidewalk, and gutter pan was performed by staff. The restoration of the trenches will be completed later this month.  Staff continues to water the newly planted vegetation in Phase A portion of the Rohner Creek project until the
rains become consistent.
 Staff placed new fall banners on the decorative street lights on Main Street.
 A citizen complaint prompted staff to trim hedge, trees, and vegetation at the end of Randolph Way.
 Staff removed the solar panel and reader board of the non-operating portable changing message board
(PCMS). Staff repurposed the trailer and functioning
hydraulics to the new radar sign trailer. The trailer is first being used currently on Rohnerville Road near Senestraro Way (see photo inset right).  Staff monitored and removed debris from the grates of the drainage inlets when a heavy rainfall event occurred during the month of September. Numerous calls for windfall and drainage issues came to public works call center.
 Staff continue to provide support to the parks department as they remain short-staffed.

In addition to the special tasks noted above, staff also engaged in the following regular routine maintenance activities including USA’s, street sweeping, recycling and trash management, collect batteries at City Hall, road maintenance, Dog Park maintenance, vegetation management including sniping of curbs, and safety training and inspections. Staff is available for questions, requests, and emergency responses to the community.

EXECUTIVE SUMMARY:

The River Lodge and Monday Club held a total of 27 events in the month of August.

Two wedding celebrations took place at River Lodge in
September. One of them was a reception for about 350 people.

The other was a wedding and reception with traditional
Japanese elements. The father of the bride constructed a chandelier made up of a thousand paper cranes (shown to the right). A family member of the bride, had folded the origami cranes over the past year. I have added a picture for your enjoyment. It was incredible.

There was one Celebration of Life at River Lodge in
September. Every memorial is significant. This memorial was for a 19-year-old killed in a car accident. The outpouring of love and help from the community, was felt throughout the whole planning process. Many people came together and took care of every detail, so that the family didn’t have to. The staff at River Lodge felt honored to be a part of this.

The City of Fortuna hosted two trainings from Liebert
Cassidy and Whitmore, LCW, focusing on Public Employee
Discipline. The trainings were held at River Lodge.

There were two fundraisers held in the month of September.

One for the Eureka Symphony and the other was the Redwood Preparatory School Gala. Both, have become annual events that do very well in raising funds for these two organizations.

Academy of the Redwoods held a Back to School Mixer at the Monday Club for their students.

A few spindles were broken out of the porch during the event. After students admitted to accidentally breaking them while taking photographs, the school agreed to pay for replacement.

The Parks crew was able to make those repairs the following Monday, after the event RECOMMENDED COUNCIL ACTION:

SUBJECT: Approve a Supplemental Budget Request for the Police Facility Remodel Project
STAFF RECOMMENDATION:

Approve a Supplemental Budget Request of $430,000 for the Police Facility Remodel Project (CIP 9104)
EXECUTIVE SUMMARY:

The Police Facility Remodel project began in March of this year and expected to be completed in the first quarter of next year. When the project was brought to the Council with a request to award the construction contract, staff presented the anticipated project budget, and it is summarized Table 1 below. Some of the items that were estimated as a part of the budget included:
 Project Construction and Construction Contingency
 Computer and Server System Installation and Start Up
 PG&E Power Service Upgrade
 Dispatch Radio System Upgrade
 Construction Engineering
As the project has progressed, the expected costs have become known, and better able to estimate.

Some of the items will cost more than expected, and some will cost less. For example, staff anticipate the PG&E service upgrade portion of the project will come in under the projected budget, and the computer system (IT) work will come in at budget. The total project budget summary is presented in Table 1, below. Overall, the total project costs are expected to come in higher than the original estimate. The primary reasons for the cost increase in each category are noted below:
 Project Construction and Construction Contingency – Currently the construction contract is within the approved construction budget, and most of the contingency has been used. The primary use of the contingency was to address a large number of unforeseen conditions that were encountered and needed to be addressed including changes to roofing, electrical, insulation, rot repair, and structural framing. More work was required than was described by the original bid documents
Business Agenda Item 5a

Page 2 of 4 ends

The total amount of the changes approved to date is within the Council approved contract amount. It is expected that the contingency will be exhausted on the base contract and the items added by change order in the table above. Additional funds will be necessary to cover the remaining changes that are necessary.

Staff will present a summary of the change orders at the council meeting on 10/16/2023.  Dispatch Radio System Upgrade – The total cost of the radio system was approximately $65,000 higher than originally estimated. The primary reason for the increase was cost inflation over the years since the original budget was estimated in 2018-19.  Construction Engineering – Several constructions related issued have arisen during the project that were not anticipated during the design of the project. Therefore, the City has had to engage the design engineer to revise drawings and calculations beyond what was expected. Staff anticipate only a relatively small overage in construction engineering in the amount of $10,000.

In addition to the planned items, staff are anticipating the need for furnishings for the building that were not part of the project, and the addition of photovoltaic panels to offset future utility costs.

Furnishings for the new building are anticipated to include items such as tables, dispatch consoles, evidence racks, armory racks, blinds and miscellaneous appliances that are not related to construction of the building.

The new photovoltaic panels would be installed on the former roof of the facility to offset future electric costs. Staff planned for the building to be solar ready, and updated the electrical design to readily accommodate a solar installation. Additionally, staff completed an application to PG&E for a solar interconnection which was approved under the previous net metering standards, that pay a higher rate than the current net metering standards. A discussion of the benefits of adding the solar photovoltaic panels follows the budget summary below.

FINANCIAL IMPACT:

The updated budget for the project is shown in the table below.

Business Agenda Item 5a

Page 3 of 4 ends

The addition of the photovoltaic panels will have an initial cost of approximately $112,000. The projected amount saved over the performance life of the panels (25-years) is $350,000. This provides the City with a net estimated savings of $238,000 over 25 years.

The Council allocated approximately $2,350,000 from the General fund (monies received from the ARPA), $825,000 from Measure E and the balance from Asset Seizure funds for this project. Staff is recommending taking the additional $225,000 project costs needed as well as the $112,000 solar project costs from Measure E reserves. Below is a summary of where Measure E reserves currently stand.

Measure E Reserves Amount
FY 23-24 Estimated Beginning Fund Balance when
Budget was adopted $4,525,264
FY 22-23 Updated Estimates (Measure E Revenue
shortfall) $(82,807)
FY 23-24 Budgeted Net Activity $(2,364,400)
Remove FY 23-24 budgeted item for Boom Mower
(USDA Grant not received) $37,500
FY 23-24 Estimated ending fund balance $2,115,557
The Council approved use of $825,000 of Measure E funds for the POD Project as recommended by the Measure E Committee. At the time the Measure E Committee agreed that having $2,000,000 in reserves was a sufficient amount and any amounts above that threshold should be allocated to one time projects. Thankfully, Measure Z picked up the DTF officer position which freed up about $170,000 from what the committee would have otherwise spent from reserves. Additionally, staff removed the budgeted item for a new Boom Mower from the Measure E budget, as the City did not receive a grant to pay for a portion of that purchase as expected. Unfortunately, Measure E revenues came in under budget for FY 22-23 so that shortfall will need to be picked up by Measure E reserves in the amount of $82,807. After those adjustments, staff project the Measure E ending fund balance at the end of FY 23-24 to be $2,115,557. Staff is recommending taking the additional $430,000 needed to complete the Police Facility Project (including solar) from Measure E reserves which would leave reserves at an estimated $1,778,557.

Measure E Reserves Amount
FY 23-24 Estimated ending fund balance $2,115,557
Updated Project Estimate Costs $(318,000)
Solar Project $(112,000)
FY 23-24 Estimated ending fund balance w/ POD SBR $1,685,557 Although this brings the Measure E reserves below the stated goal of $2,000,000 in reserves it is still above the 180 days of operating expenditures that staff typically follow as a baseline for how much should be in reserves. 180 days of operating reserves in the Measure E fund would equate to about $1,000,000. Staff and the Measure E Committee will work on getting reserves back up to $2,000,000 in the Measure E fund as part of the next budget cycle should that be a stated goal of the Measure E Committee and City Council.

City Council Business Agenda Item
DATE: October 16th 2023
TO: Honorable Mayor and Council Members

THRU: Merritt Perry, City Manager
SUBJECT: Approve a Supplemental Budget Request for the Purchase of a new Records Iinformation Management System Server
STAFF RECOMMENDATION:

Approve a Supplemental Budget Request (SBR) for the procurement of a new Records Information Management System (RIMS) server. Funding for this purchase will be allocated from three sources: AB 109, existing dispatch contract revenue, and the City's General Fund Reserves.

BACKGROUND:

The current RIMS server, branded as Sun Ridge System, was procured and activated on March 20th 2015, running Microsoft 2012 software. Standard industry practice suggests replacing servers every five (5) years. Remarkably, the current server has exceeded this standard, functioning efficiently without any issues. Initially, staff recommended postponing its replacement until the police department transitioned to its new facility on Newburg Road. However, a recent development has necessitated immediate action.

Effective October 10th, 2023, Microsoft Corporation will discontinue support and updates for our current server due to its age and outdated operating system. Unfortunately, no extensions are available for this deadline.

To ensure compliance with California Department of Justice (CA DOJ) requirements and continued access to DOJ databases, the police department must upgrade to newer server equipment and operating systems to retain Microsoft support.

Additionally, as part of the Fortuna Police Department's existing dispatch agreements with external agencies, these memorandums of agreements (MOUs) require them to contribute approximately twenty (20) percent of the costs associated with RIMS server replacement every five (5) years.

The Fortuna Police Department currently holds MOUs for dispatch services with the Rio Dell Police, Ferndale Police, and the Fortuna Volunteer Fire Department.

EXECUTIVE SUMMARY:

On July 26th, 2023, the Fortuna Police Department received cost estimates from two providers, Nylex and Sun Ridge Inc. for the acquisition of the new RIMS server. The total estimated costs for the project are as follows:

Business Calendar Item 5b

Page 2 of 2 ends

Acquisition of the new RIMS server: $39,667.12
Associated licenses: $7,888.00
RIMS integration costs: $11,500.00
Additionally, staff recommends approval for a contingency budget not exceeding $5,000.00 for this project which will be returned if unused.

As the City's primary IT consultant, Nylex holds a contract to meet the City's IT needs and possesses intimate knowledge of the City's IT infrastructure, thereby reducing project completion times and/or project complications. Sun Ridge (RIMS) is the exclusive provider and contractor used by the police department for computer-aided dispatch and records information management systems. Consequently, conducting a competitive bidding process for this project will not serve the best interests of the City.

The Fortuna Municipal Code (FMC) §§ 2.50.080 allows the City to obtain goods through a negotiated contract without a competitive procurement process when the Council determines that competitive procurement is not in the City's best interests or will not result in the lowest price, or when competitive procurement is impractical. Staff recommends that the Council determine that a competitive bidding process is impractical.

FISCAL IMPACT:

The purchase of the new RIMS server will require a total expenditure of $65,000.00. Staff recommends allocating funding as follows:
 $13,750.00 from AB 109
 $10,800.00 from revenue generated through outside agency agreements for dispatch services
 $44,550.00 from the General Fund Reserves (100-8000-2000).

1. Receive staff presentation and review Council questions

2. Open Public Comment

3. Close Public Comment

4. Motion to Approve a Supplemental Budget Request for the Purchase of a new RIMS server.
