STAFF REPORT
City Council Consent Agenda Item
DATE: November 6, 2023
TO: Honorable Mayor and Council Members
FROM: Merritt Perry, City Manager
SUBJECT: Authorize the City Manager to Submit Individual Grant Applications for all CalRecycle Grant Programs for which the City of Fortuna is Eligible; Resolution 2023-32
STAFF RECOMMENDATION:
Authorize the City Manager to submit all grant applications for all State Department of Recycling and Resources Recovery (CalRecycle) Grant Programs for which the City of Fortuna is eligible by adopting Resolution 2023-32.
EXECUTIVE SUMMARY:
CalRecycle administers a non-competitive grant program to local jurisdictions to assist with the implementation of regulation requirements and programs associated with Senate Bill (SB) 1383 Organics Recycling.
In 2022, the City was awarded a one-time grant of $20,000 to assist with public outreach and education, enforcement, personnel costs and administrative costs for capacity planning, collection, edible food recovery, and record keeping.
The City currently utilizes SB 1383 Local Assistance Grant Program funding to host organic recycling training and kitchen collection bin giveaways, support local food recovery organizations, and supplement administrative duties such as inspections, enforcement, reporting, and record keeping. Furthermore, staff regularly conducts community outreach through print and digital advertising materials.
On July 18, 2023, SB 1383 Local Assistance Grant, Criteria Request for Approval was presented at the CalRecycle Monthly Public Meeting. This request proposed a 2nd round of grant funds for cities, counties, and other eligible applicants.
On November 15, 2023, staff anticipates submitting a grant application for $75,000 proposing additional implementation measures as required by SB 1383 including:
Edible Food Recovery
Procurement of Recycled Products
Education and Outreach

STAFF REPORT
City Council Consent Agenda Item
DATE: November 6, 2023
TO: Honorable Mayor and Council Members
FROM: Merritt Perry, City Manager
SUBJECT: Award Professional Services Contract to Allen Atelier Architects to Design the Repair of the Monday Club Chimney and Approve Supplemental Budget Request
STAFF RECOMMENDATION:
Authorize the City Manager to negotiate and execute a sole source contract for Professional Services Contract for designing and engineering repairs to the Monday Club Chimney.
EXECUTIVE SUMMARY:
The Monday Club sustained substantial damage from the two earthquakes in December 2022 and January 2023. The City filed a claim with CIRA, the City’s risk pool in January of 2023, and on October 11, 2023 received payment of $56,717.59.
The goal is to have the rebuilt chimney meet acceptable building code standards while maintaining some of the turn-of-the-last-century craftsman-style charm of the Monday Club, before the damage.
Staff anticipates replacing the brick chimney with a wood chase and stove pipe for the gas stove that is within the existing fireplace, and placing a brick façade around the chase to look as similar as possible to the previous brick chimney.
While the claim was being processed, staff sought firms to provide design and engineering services to begin repairs to the predominantly damaged chimney, however, we were unable to find a firm to complete the work. Many firms that have worked with the City in the past were unavailable or too busy to complete the work. Due to the scarcity of engineering and construction firms specializing in masonry, it was determined the City would find a qualified contractor to design a façade.
The City of Fortuna municipal code Section 2.50.060 allows for authorization of the hiring of services up to $10,000 for which standard specifications cannot be drawn, such as architectural services, and to solicit proposals from at least three firms. The City Council is required to approve any contracts over $10,000.
Proposals were requested from three architectural firms for this project including Allen-Atelier Architects, Garrett McSorley Architects, and Alameida Architects. Only Allen-Atelier Architects chose to submit a proposal and could complete the project and the City Attorney assisted with the development of a contract for the proposed work (see Attachment A). The proposed fee for the work is $7,500. It is also anticipated that some structural engineering work may be required and is not included in the scope of services and may cost up to $2,500. Staff would contract for that work separately or issue a contract change order with Allen-Atelier Architects to subcontract for the work.
Consent Item 4d
FINANCIAL IMPACT:
It is anticipated that the cost of the design of the Monday Club Chimney replacement will be approximately $10,000. The City has received a payment from CIRA, our risk pool for, $56,717.59 for the damage caused to the Monday Club. If $10,000 is used for design, $46,717.69 will remain to fund the construction of the repairs. It is unknown at this time what the cost of the repairs will be.
RECOMMENDED COUNCIL ACTION:
Motion to approve a supplemental budget request and authorize the City Manager to award a contract for professional services to Allen-Atelier Architects for design and engineering services for repairs to the Monday Club Chimney an amount not to exceed $10,000. Consent Agenda Vote.

PROFESSIONAL SERVICES AGREEMENT
this indemnity does not apply to liability for damages for bodily injury, property damage or other loss, arising from the City’s (or any of its officers, official employees, or volunteers) own negligent acts or omissions, recklessness, or willful misconduct. If it is finally adjudicated that liability is caused by the comparative fault of the City, then Architect’s indemnification and defense obligations shall be reduced in proportion to the established comparative liability of the City and shall not exceed the Architect’s proportionate percentage of fault, and the City shall promptly reimburse Architect for any amount paid as indemnification or defense of the City in excess of Architect’s proportionate percentage of fault.
As respects all acts or omissions which do not arise directly out of the performance of design professional services, including but not limited to those acts or omissions normally covered by general and automobile liability insurance, Architect agrees to indemnity and hold harmless the City, its officers officials, employees and volunteers for an against any claim, demands, losses, liability of any kind or nature arising out of or in connection with the Architect's performance or failure to perform under the terms of this contract, excepting those which arise out of the active negligence, sole negligence or willful misconduct of the City, its officers, officials, employees and volunteers.
This indemnification obligation is not limited by any limitation on the amount or type of damages available under any applicable insurance coverage and shall survive the expiration or early termination of this Agreement with respect to Liability arising during the term of the Agreement.
10. Insurance. Before providing any services under this Agreement, Architect shall be required to procure and provide proof of the insurance coverage required by this section in the form of certificates and endorsements. The required insurance must cover the activities of Architect and its employees, agents, or subcontractors relating to or arising from the performance of services under this Agreement, and must remain in full force and effect at all times during the term of the Agreement. Allrequired insurance must be issued by an insurer licensed to do business in the State of California, and each such insurer must have an A.M.
Best financial strength rating of “A” or better and a financial size rating of “VIII” or better. If Architect fails to provide any of the required coverage, City may, at its sole discretion, purchase such coverage at Architect’s expense and deduct the cost from payments due to Architect.
10.1 The following insurance policies and limits are required for this Agreement:
10.1.1 Commercial General Liability Insurance (“CGL”).

Business Agenda Item 5a
STAFF REPORT
City Council Business Item
DATE: November 6, 2023
TO: Honorable Mayor and Council Members
FROM: Brendan Byrd, Public Works Director/City Engineer THROUGH: Merritt Perry, City Manager
SUBJECT: Approve a Supplemental Budget Request and Professional Services Contract with GHD for Design and Environmental Services for the Mill Creek Habitat Connectivity Project (CIP#9123)
STAFF RECOMMENDATION:
Receive staff presentation and recommendation to authorize the City Manager to execute a professional services contract with GHD for design and environmental services for the Mill Creek Habitat Connectivity Project (CIP#9123) and authorize a supplemental budget request for $966,000.
EXECUTIVE SUMMARY:
Since the completion of the Jameson Creek Project in 2020, staff have been interested in pursuing further restoration grant funding for various culvert crossings along Mill Creek. Mill Creek is a productive stream for salmonids, adult steelhead, Coho and coastal cutthroat trout, which have been observed by the California Department of Fish and Wildlife (CDFW). The Weber Street crossing is the extent to which fish have been observed making it up the stream, as the crossing is a fish passage barrier. Additionally, the crossing is significantly undersized.
In 2022 funding became available for these types of planning projects through the Wildlife Conservation Board (WCB). The WCB is the agency that partially funded the Jameson Creek project. In response to the funding availability, staff began working with our consulting engineer to develop a planning project for the Weber Street culvert crossing, which would include 100% engineering plans, specifications, construction cost estimate, and permitting for the project.
However, after some initial discussions with the WCB it became clear that their program was seeking to fund larger projects, beyond the overall scope and scale of the City’s proposed single crossing, and therefore staff elected to include the next three upstream crossings along Mill Creek in the project. These three additional crossings are located at Rohnerville Road, Mill Street, and Mountain View Road, and each is at minimum a partial barrier to fish passage, and several of them are also in need to repair or reconfiguration.
Staff worked with the City’s on-call engineer for drainage and restoration work, GHD, to develop the grant application and project scope. At the July 17th Council meeting a resolution to authorize staff to submit the grant application was approved by the Council. In August, staff learned that the project had been approved and fully funded.
Business Agenda Item 5a
To begin project work the City will need to award the professional services contract. Unlike some projects which are awarded under the City’s on-call engineering services contract, or other procured through competitive proposals, staff are proposing to sole-source award this project to GHD. For the WCB grant program, the qualification of the project team (including design professionals) are taken into account, and therefore GHD and their subcontractors were written into the grant. As such, staff recommends that the Council approve a contract award to GHD as a sole source professional services contract, consistent with the City’s procurement/purchasing policy outlined in FMC 2.50.070. A copy of GHD’s proposed scope of work, which is consistent with the scope as outlined in the City’s grant agreement with WCB, is included as Attachment A. If approved, staff would immediately proceed with contracting, and project activities will begin in December of this year.
FINANCIAL IMPACT:
The project is fully funded through a grant with the WCB in the amount of $966,000. The City is required to provide staff time as a match to manage the project in the amount of $10,000 - there is no cash match required by the City. A supplemental budget request has been prepared and included as Attachment B.
The fee estimate for GHD to provide the services outlined in the attached scope of work is $966,000, and was developed as part of the project grant application. This fee will be covered entirely by the project grants.

2. Open Public Comment
3. Close Public Comment;
4. Motion to Authorize the City Manager to execute professional services contract with GHD for engineering and environmental services for the Mill Creek Habitat Connectivity Project (CIP#9123) and authorize a supplemental budget request for $966,000. Voice vote.

RE: Scope of Services for Mill Creek Restoration Design and Permitting Dear Mr. Byrd:
The following is our proposed scope of services for the Mill Creek Restoration Project (Project), funded by the Wildlife Conservation Board (WCB). This scope of services includes completion of topographic surveys, geotechnical, hydraulic, biological and cultural resources studies, development of 30%, 65% and final (100%) design plans and completion of CEQA and permit applications for replacement of four culvert crossings on Mill Creek at Weber Street, Rohnerville Road, Mill Street and Mountain View Road. Replacement of the crossings will increase access to upstream salmonid habitat and increase resiliency of the aging culvert crossings. GHD will contract directly with sub-consultants to complete the scope of services, collectively referred to as the Project Team, and includes Ontiveros & Associates (Topographic Survey), Crawford & Associates (Geotechnical Investigations), Michael Love & Associates (Fish Passage Analyses) and Jamie Roscoe & Associates (Cultural Resources).
Scope of Services
The tasks below define GHD’s scope of services.
Task 1 - Project Grant Management (City of Fortuna)
GHD is not providing any services under this task. This task has been included to align with the WCB Grant Agreement.
Task 2 - Supporting Technical Studies
Sub-Task 2.1 - Topographic Survey
GHD sub-consultant Ontiveros & Associates (O&A) will conduct a topographic survey of the Weber Street, Rohnerville Road, Mill Street and Mountain View Road crossings including:
1. Locating topographic features in the vicinity of the proposed project improvements, including all trees over 12” diameter at breast height (DBH), approximately 150 feet downstream and 100 feet upstream of the current culvert crossings.
11223481 | RE: Scope of Services for Mill Creek Restoration Design and Permitting 2
2. The Topographic Survey will be performed using the current CCS83 Zone 1 Epoch 2010.00 horizontal datum and NAVD88 vertical datum. All dimensions will be grid in terms of the U.S. Survey Foot. Sufficient control will be established for both this project and future monitoring.
3. Approximate property boundaries and ownership will be provided based on a records search.

STAFF REPORT
City Council Business item
DATE: November 6, 2023
TO: Honorable Mayor and Council Members
FROM: Merritt Perry, City Manager
SUBJECT: Public Hearing: Introduction and First Reading of Ordinance No. 2023-764 Amending Chapters 17.03, 17.06, and 17.08 of the Fortuna Municipal Code for Consistency with the Adopted Multifamily Design Standards STAFF RECOMMENDATION:
Hold the public hearing for introduction and first reading of Ordinance 2023-764 to amend the Zoning Code to be consistent with the Multifamily Design Standards and to allow agricultural employee housing consistent with state law, and continue the public hearing to November 20, 2023.
EXECUTIVE SUMMARY:
In 2019 the City of Fortuna received a grant from the California Department of Housing and Community Development (HCD) SB2 Planning Grant Program to streamline planning and permitting processes, update ordinances, and implement other activities that facilitate housing production. As part of this grant-funded work, the City has adopted an updated accessory dwelling unit ordinance and new Multifamily Design Standards. The City now needs to amend the Zoning Code to be consistent with the Multifamily Design Standards and to allow agricultural employee housing consistent with state law.
Zoning Code Amendments for Multifamily Design Standards On September 5, 2023 the Fortuna City Council adopted, by resolution, the Multifamily Design Standards, which established new objective standards for multifamily and mixed-use residential development. The Multifamily Design Standards allow by-right approval (without a Design Review or a Conditional Use Permit) for multifamily and mixed-use residential projects that comply with the standards.
Currently, the Zoning Code requires a Design Review for all multifamily development. The Zoning Code also requires a Conditional Use Permit for multifamily projects with six or more units in the Multifamily Residential (R-M) zoning district and for all multifamily projects in the Neighborhood Commercial (N-C) and Retail Commercial (R-C) zoning districts.
To resolve this conflict between the Multifamily Design Standards and Zoning Code, the following Zoning Code Amendments are proposed:
17.03.012 (Multifamily Residential Zoning District): Removes Conditional Use Permit requirement for multifamily projects with six or more units and removes Design Review requirement for multifamily projects that are consistent with the adopted Multifamily Design Standards.
Business Item 5b
17.03.020 (Neighborhood Commercial Zoning District): Adds multifamily dwelling units consistent with the Multifamily Design Standard as a permitted use, removes Conditional Use Permit requirement for all residential uses, adds Conditional Use Permit requirement for single-family dwellings.
17.03.021 (Retail Commercial Zoning District): Adds multifamily dwelling units consistent with the Multifamily Design Standard as a permitted use, removes Conditional Use Permit requirement for all residential uses, adds Conditional Use Permit requirement for single-family dwellings.
17.06.130 (Multifamily Dwellings): Creates new section for multifamily dwellings that requires compliance with the Multifamily Design Standards, allows projects by-right if consistent with standards, and allows deviations from standards with Design Review.
Agricultural Employee Housing
Program H-24 of the Fortuna General Plan Housing Element is as follows:
“To comply with Health and Safety Code Sections 17021.5 and 17021.6 the City will review and revise the zoning code. For the purpose of all local ordinances, employee housing shall not be deemed a use that implies that the employee housing is an activity that differs in any other way from an agricultural use. No conditional use permit, zoning variance, or other zoning clearance shall be required of this employee housing that is not required of any other agricultural activity in the same zone. The permitted occupancy in employee housing in an agricultural zone shall include agricultural employees who do not work on the property where the employee housing is located.”
This program is based on requirements in the California Employee Housing Act (California Health and Safety Code 17000 – 17062.5), which prohibits cities and counties from requiring a Conditional Use Permit or other discretionary approval for agricultural employee housing when such a requirement is not required of other agricultural activity in the same zone.
Zoning Code Section 17.03.040.D currently requires a Use Permit for all labor camps and labor supply camps in the Agriculture Exclusive (AE) zoning district. Other agricultural uses in the AE zoning district are permitted use, allowed without a Use Permit. To resolve this conflict between the Zoning Code and the California Employee Housing Act, the following Zoning Code Amendments are proposed:
17.03.040 (Agriculture Exclusive Zoning District): Adds agricultural employee housing as a permitted use. Adds requirement for evidence of valid HCD permit, deed restriction for permanent or seasonal employee housing, and affidavit for temporary employee housing.
17.08.050 (Agricultural Employee Housing): Adds new definition of agricultural employee housing.
Agricultural employee housing allowed by right would be limited to housing with no more than 36 beds in group quarters or 12 units or spaces designed for use by a single family or household, or that is approved pursuant to Section 17021.8 of the Health and Safety Code. Section 17021.8 requires ministerial approval of agricultural employee housing with 36 units or less that meets specified eligibility criteria and is operated by an affordable housing organization.
Business Item 5b
With the proposed Zoning Code Amendments, other types of employee housing that are not regulated under the Employee Housing Act would be classified as Labor Camps and Labor Supply Camps. These uses would continue to be allowed in the AE zoning district with a Use Permit ENVIRONMENTAL ASSESSMENT:
The proposal is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3), the “General Rule”, which states that a project is exempt from CEQA where it can be seen with certainty that there is no possibility that the project would have a significant effect on the environment.
RECOMMENDED COUNCIL ACTION:
1. Receive staff presentation and review questions with staff
2. Open public comment
3. Close public comment
4. Motion to hold first reading of Ordinance 2023-764, read by title only and continue the Public Hearing to Monday, November 20, 2023 for the second reading and adoption. Roll call vote.
