DATE: December 4, 2023
TO: Honorable Mayor and Council Members
FROM: Merritt Perry, City Manager
SUBJECT: Public Hearing: Second Reading and Adoption of Ordinance No. 2023-764 Amending Chapters 17.03, 17.06, and 17.08 of the Fortuna Municipal Code for Consistency with the Adopted Multifamily Design Standards STAFF RECOMMENDATION:
Adopt the proposed amendments to the Zoning Code to be consistent with the Multifamily Design Standards and to allow agricultural employee housing consistent with state law by adopting Ordinance 2023-764.
EXECUTIVE SUMMARY:
In 2019 the City of Fortuna received a grant from the California Department of Housing and Community Development (HCD) SB2 Planning Grant Program to streamline planning and permitting processes, update ordinances, and implement other activities that facilitate housing production. As part of this grant-funded work, the City has adopted an updated accessory dwelling unit ordinance and new Multifamily Design Standards. The City now needs to amend the Zoning Code to be consistent with the Multifamily Design Standards and to allow agricultural employee housing consistent with state law.
Zoning Code Amendments for Multifamily Design Standards On September 5, 2023 the Fortuna City Council adopted, by resolution, the Multifamily Design Standards, which established new objective standards for multifamily and mixed-use residential development. The Multifamily Design Standards allow by-right approval (without a Design Review or a Conditional Use Permit) for multifamily and mixed-use residential projects that comply with the standards.
Currently, the Zoning Code requires a Design Review for all multifamily development. The Zoning Code also requires a Conditional Use Permit for multifamily projects with six or more units in the Multifamily Residential (R-M) zoning district and for all multifamily projects in the Neighborhood Commercial (N-C) and Retail Commercial (R-C) zoning districts.
To resolve this conflict between the Multifamily Design Standards and Zoning Code, the following Zoning Code Amendments are proposed:
17.03.012 (Multifamily Residential Zoning District): Removes Conditional Use Permit requirement for multifamily projects with six or more units and removes Design Review requirement for multifamily projects that are consistent with the adopted Multifamily Design Standards.
Business Item 5a
17.03.020 (Neighborhood Commercial Zoning District): Adds multifamily dwelling units consistent with the Multifamily Design Standard as a permitted use, removes Conditional Use Permit requirement for all residential uses, adds Conditional Use Permit requirement for single-family dwellings.
17.03.021 (Retail Commercial Zoning District): Adds multifamily dwelling units consistent with the Multifamily Design Standard as a permitted use, removes Conditional Use Permit requirement for all residential uses, adds Conditional Use Permit requirement for single-family dwellings.
17.06.130 (Multifamily Dwellings): Creates new section for multifamily dwellings that requires compliance with the Multifamily Design Standards, allows projects by-right if consistent with standards, and allows deviations from standards with Design Review.
Agricultural Employee Housing
Program H-24 of the Fortuna General Plan Housing Element is as follows:
“To comply with Health and Safety Code Sections 17021.5 and 17021.6 the City will review and revise the zoning code. For the purpose of all local ordinances, employee housing shall not be deemed a use that implies that the employee housing is an activity that differs in any other way from an agricultural use. No conditional use permit, zoning variance, or other zoning clearance shall be required of this employee housing that is not required of any other agricultural activity in the same zone. The permitted occupancy in employee housing in an agricultural zone shall include agricultural employees who do not work on the property where the employee housing is located.”
This program is based on requirements in the California Employee Housing Act (California Health and Safety Code 17000 – 17062.5), which prohibits cities and counties from requiring a Conditional Use Permit or other discretionary approval for agricultural employee housing when such a requirement is not required of other agricultural activity in the same zone.
Zoning Code Section 17.03.040.D currently requires a Use Permit for all labor camps and labor supply camps in the Agriculture Exclusive (AE) zoning district. Other agricultural uses in the AE zoning district are permitted use, allowed without a Use Permit. To resolve this conflict between the Zoning Code and the California Employee Housing Act, the following Zoning Code Amendments are proposed:
17.03.040 (Agriculture Exclusive Zoning District): Adds agricultural employee housing as a permitted use. Adds requirement for evidence of valid HCD permit, deed restriction for permanent or seasonal employee housing, and affidavit for temporary employee housing.
17.08.050 (Agricultural Employee Housing): Adds new definition of agricultural employee housing.
Agricultural employee housing allowed by right would be limited to housing with no more than 36 beds in group quarters or 12 units or spaces designed for use by a single family or household, or that is approved pursuant to Section 17021.8 of the Health and Safety Code. Section 17021.8 requires ministerial approval of agricultural employee housing with 36 units or less that meets specified eligibility criteria and is operated by an affordable housing organization.
Business Item 5a
With the proposed Zoning Code Amendments, other types of employee housing that are not regulated under the Employee Housing Act would be classified as Labor Camps and Labor Supply Camps. These uses would continue to be allowed in the AE zoning district with a Use Permit ENVIRONMENTAL ASSESSMENT:
The proposal is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3), the “General Rule”, which states that a project is exempt from CEQA where it can be seen with certainty that there is no possibility that the project would have a significant effect on the environment.
RECOMMENDED COUNCIL ACTION:
1. Receive staff presentation and review questions with staff
2. Open public comment
3. Close public comment
4. Motion to hold the second reading and adopt Ordinance 2023-764, read by title only. Roll Call vote.

WHEREAS, on October 19 2023, a notice was published in the Times Standard and notices were posted in conspicuous locations including City Hall and the City website, specifying the availability of the Ordinance, and the date, time, and location of the public hearing for this Ordinance; and
WHEREAS, all legal prerequisites to the adoption of the Ordinance have occurred.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF FORTUNA DOES ORDAIN AS FOLLOWS:
SECTION 1. Recitals. The above recitals are each incorporated by reference and adopted as findings by the City Council.
SECTION 2. CEQA. Adoption of this Ordinance is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3), the “General Rule”, which states that a project is exempt from CEQA where it can be seen with certainty that there is no possibility that the project would have a significant effect on the environment. The City Council hereby directs staff to prepare, execute, and file with the Humboldt County Clerk a notice of exemption within five (5) working days of the adoption of this Ordinance.
SECTION 3. General Plan. Based on the entire record before the City Council, and all written and oral evidence presented, the City Council hereby finds that this Ordinance’s amendments to the Fortuna Municipal Code are consistent with the City’s adopted General Plan for the reasons set forth below:
H‐1.1: Continue to encourage the development and provision of a variety of housing choices, including residential types, tenancies, sizes, locations, and prices, for all economic groups.
The Multifamily Design Standards encourage and promote diverse housing opportunities by providing a pathway for streamlined, by-right approval for multifamily and mixed-use residential projects that comply with established standards.
H-24 (Employee Housing): To comply with Health and Safety Code Sections 17021.5 and 17021.6 the City will review and revise the zoning code. The permitted occupancy in employee housing in an agricultural zone shall include agricultural employees who do not work on the property where the employee housing is located. The Ordinance establishes a basis for broader housing opportunities for agricultural employees and implements General Plan Policy H-24 by principally permitting agricultural employee housing in the AE zone consistent with State law (California Health and Safety Code 17000 – 17062.5) and the established criteria.
LU-1.6 (Infill Development): The City shall encourage infill development on vacant sites and reuse of underutilized parcels to minimize outward growth and reduce the cost of providing public services and facilities. The Multifamily Design Standards encourage infill housing consistent with existing residential areas and supports a diverse range of housing types. Many existing multifamily sites in the city are infill sites that have access to nearby public services and facilities.
SECTION 4. Zoning Regulations Amendment. The below referenced Sections of Chapter
17.03 – Regulations That Apply in Principal Zoning Districts — of the Fortuna Zoning Regulations (Title 17 of the Municipal Code) are hereby amended as set forth in Exhibit “A”, attached hereto and incorporated herein by reference. SUBJECT: Supplemental Budget Request for the Carson Woods Waterline Replacement Project (CIP 9124)
STAFF RECOMMENDATION:
Receive staff presentation and approve a supplemental budget request for the Carson Woods Waterline Replacement Project.
EXECUTIVE SUMMARY:
The City provides water to the county-side of Carson Woods Road, which serves 25 domestic water connections with a one-inch mainline pipe. This one-inch mainline alternates between steel, PVC, thin black poly pipe, and CTS (copper tube size) poly pipe, all of various conditions and installation years. This mainline is severely undersized for the amount of connections it is serves and is prone to leaks due to age and condition. Additionally, the City is unable to connect any new services or install fire hydrants on that line as there is not adequate capacity.
During the December 2022 earthquake, the steel section towards the end of the line failed in multiple locations causing a water outage to the last six houses on the street. The outage lasted 35 hours, until the utility crew was able to find, dig up and repair four sections of this mainline.
The 2023-24 Capital Improvement Program includes the use of water capital reserves to complete the project in Fiscal Year 26-27 and 27-28. The construction estimate for the project assumed the project would be completed as a bid project and was estimated using prevailing wage rates, and not estimated as a project that would be completed by city forces. In order to provide a service on a shorter timeline, staff currently is proposing to use city forces to complete the work and complete the project in the current fiscal year. The City’s utility crew has the expertise to complete the work and newer members of the crew would benefit from the experience of installing a waterline.
Typically, our crews repair leaks and do small maintenance projects and not main-line replacements. Engineering staff have modeled the proposed waterline extension and will complete the design of the project soon.
Business Agenda Item 5b
Completing the project this fiscal year will allow the City to provide more reliable service to its existing customers and improve fire protection capability by the addition of new hydrants where there currently offer none. It may also be possible to add services for homeowners in extenuating circumstances that currently do not have water service from the City.
The project is proposed to be divided into at least two phases, with only the first phase proposed to be completed this fiscal year. The first phase will include the replacement of 1750 feet of existing one-inch waterline with a new 8-inch waterline, the replacement of sixteen existing service connections, the installation of three fire hydrants and necessary valves and fittings.
Future phases will include a 50-foot bridge crossing and the replacement of the remaining 700 feet of one-inch waterline, the replacement of nine existing service laterals, and the installation of one fire hydrant. Staff will seek approval for subsequent phases in the future, and only approval of the first phase is being requested at this time.
FINANCIAL IMPACT:
A cost estimate for the materials and equipment needed for the project is shown below:
Materials and equipment are expected to cost $132,500. No staff time is included in the project, as staff time is already accounted for in the current Fiscal Year 2023-2024 Budget. The funds for the waterline replacement are proposed to come from Fund 510, Water Treatment and Distribution Reserves. A copy of the Supplemental Budget Request is included as Attachment A.
RECOMMENDED COUNCIL ACTION:
1. Receive staff presentation and review Council questions with staff
2. Open Public Comment
3. Close Public Comment
4. Motion to approve a supplemental budget request for the Carson Woods Waterline Replacement Project.
