STAFF REPORT
Consent Agenda Item
DATE: February 20, 2024
TO: Honorable Mayor and Council Members
FROM: Aaron Felmlee, Finance Director
THROUGH: Merritt Perry, City Manager
SUBJECT: Finance Department Monthly Report
STAFF RECOMMENDATION:

Receive report as an informational item.

EXECUTIVE SUMMARY:

Recognized Obligation Payment Schedule (ROPS):

The City of Fortuna became the Successor Agency to the Former Fortuna Redevelopment Agency after the State dissolved all Redevelopment Agencies back in 2012. The City, as the Successor Agency, must submit an annual Recognized Obligation Payment Schedule (ROPS) to the State Department of Finance to receive funds to pay down the Former Fortuna Redevelopment Agency’s outstanding obligations.

The ROPS was successfully submitted to the Department of Finance (DOF) on January 9. The DOF requested supporting documentation, which staff provided to the DOF on January 26, to certify the amounts being claimed and will send a final funding determination letter to the City by April. The final funding determination will be incorporated into the annual City Budget and discussed with the Council during the City’s special budget workshops.

Fiscal Year (FY) 2024-25 Budget:

Staff presented the mid-year budget review at the January 29 Special Budget Workshop.

Conducting this review is the first step in preparing the FY 2024-25 budget. The next steps include staff compiling preliminary revenue estimates and soliciting each departments FY 2024-25 budget requests.

Part of the solicitation of department requests will be a separate list of items each department is requesting to be funded from the City’s transaction and use tax, Measure E. These lists will be presented to the Measure E committee on March 19. The committee then has a follow up meeting scheduled for April 2 to discuss which of those items presented to them will be included in the committee’s recommendation to the City Council. Once staff has compiled this information, a special budget workshop will be scheduled where it will be presented and discussed with the Council. Staff is targeting the beginning of May for the first special budget workshop with Council.

EXECUTIVE SUMMARY:

Public Works Director/City Engineer
Police Facility Remodel Project
The police facility project continues to progress on schedule, with a completion date anticipated for late March. The contractor has installed the flooring and ceiling tiles, the built-in desks and cabinetry, and the finished plumbing and electrical components. Staff anticipates the building will also have full electrical power by February 20th. The primary work remaining is the exterior site work, including further concrete, paving, fencing, and landscaping. This work continues to progress as the weather allows.

Kenmar Interchange Improvement Project
In mid-February, the final project deliverable for the current work phase of this project was completed, and with that the Project Allocation and Environmental Document (PA&ED) phase of this project is complete. Staff will be working on completing the final project invoicing and closing out the funding paperwork for the project. Staff has also been working on securing funding for the upcoming engineering design and right-of-way phase of work, and the $2.6M of State Transportation Improvement Program (STIP) funding that the region has recommended will be going to the CTC for approval in March. If approved by the California Transportation Commission, staff anticipate putting out a Request for Proposals for engineering design work later this spring.

Over the past month, staff have been working on submitting another grant application to fund construction implementation for this project. This particular program is the Rebuilding American Infrastructure with Sustainability and Equity (RAISE). Staff have been working collaboratively with Caltrans to complete the grant package, and have been able to repackage a lot of the material that was recently developed for the federal and state reconnecting communities grants the City developed last year for the same project.

Water System Emergency Generators Project
The Kenmar Water Booster Pump Station is complete. Staff filed the notice of completion for this project, and both generators are fully operational at their respective sites (Drake Hill and Consent Item 4f

Kenmar Booster Stations). Over the next several months staff will be working to close out the grant with Cal OES.

Recent Storm Damages
With the recent heavy and sustained rains, staff has been working to address fallen trees, debris in creeks, and some slides that have occurred. The most notable slide was on private property near the intersection of 9th Street and Picnic Avenue, which resulted in debris falling onto 9th St.

Staff responded to clean and clear the road, as well as installed remedial measures to manage the debris that is continuing to migrate down.

Utilities Division- Utility Lead
Service Call Summary
 In the month of January the utilities division completed 72 service calls by operators.

Figure 1 below shows the distribution of service calls by type.  Underground Service Alert (USA) has changed their format and the utilities crew can no longer track how many mark and locates have been completed. There were zero missmarked lines, resulting in zero broken utilities.

Figure 1. Utility division service calls by type in January.

Water Distribution System
 Read water meters and completed meter worksheet.
 The crew began flushing hydrants this month and have put most of our time into this annual maintenance activity. The crew flushed 151 hydrants in January, flushing approximately 3,020,000 gallons.
 Performed 23 water shut offs for non-payments.
 The utilities team installed no new services in the month of January. 0 5

 In the month of January the utilities team changed out 10 dead water meters.
 Continued to check service lines for lead. The crew
continued to make great progress this month.
 In January there was one water leak. This leak was on a 1¼ steel line that feeds Carson Woods Rd. The pipe
runs along the creek bed and broke due to the creek
walls sliding in. The estimated water loss was 60,000
gallons (photo inset right). This line is the same one
that is planned for upsizing and improvements as part
of the Carson Woods Waterline Replacement Project.
 Replaced two bad angle valves.

Table 1. Water leak rate and water loss estimates for 2024.

Wastewater Collections System
 Utilities cleaned 15,000 feet of sewer main.
 We had one sewer plug in the month of January resulting in no spills or overflows.  There was one sanitary sewer overflow (SSO) in January due to heavy rains on Martin Luther King Jr. weekend. The spill did not come into contact with the public, and staff documented and reported to issue to Cal OES and the Regional Water Quality Control Board.

Miscellaneous Tasks
 The utilities division performed monthly maintenance on the division’s heavy equipment, including greasing and checking all fluids.
 Two utility staff went to a two day re-certification class for their backflow tester certifications.

Storm Flow Response: Significant rainfall fell during this month. This rapidly increased wastewater flow into the treatment plant in the form of inflow and infiltration (I&I, stormwater runoff and groundwater entering the sanitary sewer system). Staff managed to operate and maintain the system through various process adjustments, succeeding in treating the increased flow without any effluent violations.

Wastewater Treatment/Wastewater Events & Maintenance Tasks Completed:
 Staff assisted the Lab and Engineering with sampling monitoring wells for the treatment system upgrade project.
 During large storm events when plant inflow increases beyond our treatment capacity, excess flow is routed to the City’s overflow storage ponds. In January staff returned approximately 4 million gallons of storm produced I&I through the plant.  Staff finalized and submitted reports to State and Federal agencies this month including the 2023 4th Quarter Wastewater Report.
 Staff replaced electrical contacts at the Rancho Buena Vista sewer lift station.

Water Treatment/Water Events & Maintenance Tasks Completed:
 Staff replaced electrical contacts at the Drake hill pump station.  Staff responded to a leak alarm at the Corrosion Control Facility (CCF) well site. A small leak was found and safely contained until the Humboldt County Hazmat response team could respond and assist with readying the faulty cylinder for transport to Thatcher chemical for repair (see photos inset below).

General Services and Streets - General Services Superintendent The following is a list of tasks completed by the General Services staff in January:
 Staff prepared for inclement weather. Staff checked
or vacuumed drainage inlets, and trimmed any low
hanging limbs. Staff checked culverts that have flap
gates that prevent creek water from surging back into
the streets. Staff added sand to the existing stock pile in Rohner Park. Staff responded to on duty and after
hour callouts from citizens. During the storm over
MLK weekend, the Rohner Creek overflow weir was
used for the first time (photo inset right).
 Staff replaced the pedestrian post at Newburg and
Fortuna Boulevard. Staff also repaired the pedestrian
sign at Rohnerville and School Street due to high
winds.
 Wendt Construction was hired to place a junction box
on a failing culvert on Elizabeth Barcus.
 Staff filled potholes in roads that formed due to the wet weather.  Staff assisted the Parks Maintenance staff with painting in the pavilion.  Staff removed cut limbs and vegetation that was accumulated from a recent cleanup along the creeks. The task was completed for the topographic survey portion of the Mill Creek Habitat Connectivity Project.
 Staff removed the Christmas banners.
 Staff pulled the material that was accumulated on the shoulder of Dinsmore Drive for draining the surface water during storms.
 Grave; was placed in the alley in between Main and N Streets.  In addition to the special tasks noted above, staff also engaged in the following regular routine maintenance activities including marking utilities for construction, street sweeping, recycling and trash management, collect batteries at City Hall, road maintenance, Dog Park maintenance, vegetation management including sniping of curbs, and safety training and inspections.

Four years have passed since a Bridal Fair was held at the River Lodge. River Lodge staff partnered with the Fortuna Chamber of Commerce, to bring it back this year. Staff are pleased that the “Before I Do” wedding show was a huge success! There were 38 vendors consisting of caterers, photographers, food trucks, jewelry sales, wedding coordinators, event rentals & decor, formal wear, disc jockeys, bartenders, venues, and bakery chefs. Gift bags were handed out to the first 100 attendees. Staff looks forward to having another show next year while implementing a few changes and improvements. Staff would like to recognize Felicia Thomsson with the Chamber of Commerce for bringing our ideas to fruition. Below are some photos from the event.

Another informational and enjoyable State of the City breakfast was held at River Lodge. Guest speakers shared the achievements and prosperous developments that Fortuna is working on.

Sunrise Rotary held its annual Seafood Boil Fundraiser. The Seafood Boil is an impressive event with traditional southern Cajun style. The food is cooked under the portico out in front of the River Lodge and guests dine on a meal dumped right in the middle of their table. This event was sold out.

STAFF REPORT
City Council Consent Item
DATE: February 20, 2024
TO: Honorable Mayor and Council Members
FROM: Bob Natt, General Services Superintendent
SUBJECT: Approval of a Contract with Specialized Pavement Marking for Minor Street Striping Maintenance and Repair Project: Resolution 2024-03 STAFF RECOMMENDATION:

Adopt Resolution 2024-03 approving a Contract for Minor Street Striping Project with Specialized Pavement Marking.

EXECUTIVE SUMMARY:

The purpose of the Contract for Minor Street Striping Project (“Contract”) is to contract with a qualified contractor to provide routine minor striping for City streets, on an on-call basis, for an amount not to exceed $60,000.00 (sixty thousand dollars) for the one-year term of the Contract.

Section 2.50.070.D of the Fortuna Municipal Code provides that formal bidding is not required when the City Council finds that a negotiated contract best serves the City due to the nature of the contractual service. A standard public bidding process would not be appropriate for this Contract due to the on-call nature of the Contract and the importance of selecting a contractor who has the qualifications, equipment, crew, and availability to respond promptly to requests and to perform the work expeditiously, economically, effectively and safely.

Staff requested informal proposals from two qualified striping contractors and received one proposal response. Staff have confirmed that the single proposing contractor, Specialized Pavement Marking (SPM), can meet the City’s needs for this project and is qualified to provide the on-call Striping services for the City based upon overall qualifications, unit pricing, equipment, and availability.

FINANCIAL IMPACT:

The Contract is not to exceed $60,000.00 (sixty thousand dollars) during the one-year term unless authorized in writing. The actual cost will depend on how much work is required during the oneyear term. The actual cost could be less than the not-to-exceed amount depending on the need for services, or higher than the not-to-exceed amount if authorized due to the need for services. The City budget for Fiscal Year 2024-2025 has $22,000 (twenty-two thousand dollars) in its street repairs section (fund 260) toward this project, and the remaining available $38,000 (thirty-eight thousand dollars) will provide striping for the annual paving contract projects if necessary.

WHEREAS, a standard public bidding process for the Services would not be appropriate due to the on-call nature of the Services, and the importance of selecting a contractor who has the qualifications, equipment, crew and the availability to respond promptly to requests for the Services, and to perform the Services expeditiously, economically, effectively and safely; and WHEREAS, Section 2.50.070.D of the Fortuna Municipal Code provides that formal bidding is not required when the City Council finds that a negotiated contract best serves the City due to the nature of the contractual service; and
WHEREAS, City staff requested informal proposals from 2 striping contractors with the requisite qualifications to determine which contractor would best meet the City’s needs for providing the Services; and
WHEREAS, City staff determined that Specialized Pavement Marking, is the best qualified to provide the Services on an on-call basis based upon its overall qualifications, unit pricing, equipment, and availability.

SUBJECT: Approval of a Contract with GR Sundberg Inc. for a Minor Concrete Maintenance and Repair Project; Resolution 2024-04
STAFF RECOMMENDATION:

Adopt Resolution 2024-04 approving a Contract for a Minor Concrete Maintenance and Repair Project with GR Sundberg Inc.

EXECUTIVE SUMMARY:

The purpose of the Contract for Minor Concrete Maintenance and Repair Project (“Contract”) is to contract with a qualified paving contractor to provide routine minor repairs and maintenance for City streets, gutters, and sidewalks on an on-call basis, for an amount not to exceed $100,000.00 (one hundred thousand dollars) for the one-year term of the Contract.

Section 2.50.070.D of the Fortuna Municipal Code provides that formal bidding is not required for individual on-call projects when the City Council finds that a negotiated contract best serves the City due to the nature of the contractual service. A standard public bidding process would not be appropriate for this Contract due to the on-call nature of the Contract and the importance of selecting a contractor who has the qualifications, equipment, crew, and availability to respond promptly to requests and to perform the work expeditiously, economically, effectively and safely.

Staff requested informal proposals from four concrete contractors and received three proposals, one from GR Sundberg Inc., one from Mercer Fraser Company, and one from RAO Construction. After a review of the unit pricing for both bids, staff has selected to negotiate a Contract with GR Sundberg Inc. to provide the on-call maintenance and repair services for the City. Specifically GR Sundberg Inc. was determined to bid the lowest pricing for curb and gutter, corner ramps, and driveway approaches, which are the work items staff, plan to complete most often in this year’s contract task orders.

FINANCIAL IMPACT:

The Contract is not to exceed $100,000.00 (one hundred thousand dollars) during the one-year term unless authorized in writing. The actual cost will depend on how much work is required during the one-year term. The actual cost could be less than the not-to-exceed amount depending on the need for services, or higher than the not-to-exceed amount if authorized due to the need for services. The City Budget for Fiscal Year 2024-2025 includes $50,000 (fifty thousand dollars) in the Annual Concrete Project CIP 9073 (fund 275), and $15,000 (fifteen thousand dollars) in ADA parking Consent Item 4j

STAFF REPORT
City Council Business Item
DATE: February 20, 2024
TO: Honorable Mayor and Council Members
FROM: Matthew A. Eberhardt, Acting Chief of Police
THROUGH: Merritt Perry, City Manager
SUBJECT: Approve a Supplemental Budget Request for the Transfer of Funds Within the Police Department Fiscal Year (FY) 23-24 Approved Budget to Expense the Cost of the Department’s Unmanned Aerial Vehicle (UAV).

STAFF RECOMMENDATION:

Approve a Supplemental Budget Request for the transfer of funds within the police department FY 23-24 approved budget to expense the cost of the department’s Unmanned Aerial Vehicle (UAV).

EXECUTIVE SUMMARY:

On December 5, 2022, City Council approved Resolution 2022-35, authorizing the Chief of Police to purchase an UAV, utilizing funds from the National Opioid Settlement. The department purchased an $8,000.00 UAV and submitted the reimbursement request. Ultimately, the reimbursement request was denied as an ineligible expenditure. It should be noted that prior to the original resolution being submitted to council on December 5, 2022 the Chief of Police and City Attorney did their due diligence and all indications were that the purchase of an UAV was an eligible expenditure of the National Opioid Settlement funds. The department has been successfully utilizing the UAV and have trained certified UAV pilots.

The department is requesting the approval of this supplemental budget request, authorizing the transfer of $6,000.00 from fund 100-5515-2000 (Ammunition/Range Supplies) and $2,000.00 from fund 100-7415-2000 (SCOP Volunteers) into fund 100-8000-2000 (Capital Outlay). The $8,000.00 in the Capital Outlay fund would allow the department to expense the cost of the UAV within the police department FY 23-24 approved budget.

The department is continuing to explore options for utilizing the National Opioid Settlement Funds.

FINANCIAL IMPACT:

No financial impact, all funds expensed will be within the police department’s approved FY 23-24 budget. The department has made internal adjustments to planned purchases from the aforementioned funds being utilized. With these adjustments, the department will be able to continue to provide services with no impact.

SUBJECT: Letter of Opposition to AT&T California’s Request for Relief From Carrier of Last Resort Obligation to the California Public Utilities Commission.

STAFF RECOMMENDATION:

Authorize Staff to submit a letter of opposition to AT&T California application A.23.03.003 for relief from Carrier of Last Resort (COLR) obligation to the California Public Utilities Commission (CPUC).

EXECUTIVE SUMMARY:

AT&T California (AT&T) has submitted an application to the CPUC for relief of Carrier of Last Resort (COLR) designation. As the COLR for a large part of rural California, AT&T must provide “Plain Old Telephone Service,” also known as POTS or landline phone service upon request.

Across California local governments, advocacy groups, emergency service providers, and residents are voicing opposition to AT&T’s application. The Council, recognizing the importance of POTS, directed staff to prepare a letter of opposition to AT&T’s application, which is included as Attachment A to this staff report. A map identifying areas within Humboldt County where AT&T seeks to withdraw COLR designation is included as Attachment B:

If the CPUC approves AT&T’s application:
 There would be no telephone provider obligated to provide service in AT&T’s local service area, even where cell coverage is inadequate.
 AT&T could decide to not provide landline service to customers as soon as six months after the application is granted.
 Customers could be required to pay more for telephone service, buy phone service as part of an expensive “bundle,” receive lower quality service, or depend on cell service (which is not reliable or available in some areas).
 Customers could lose the ability to maintain a landline due to inadequate cell service, or for use as emergency backup when there are cell phone network outages due to winter storms, wildfires, or other severe weather events or natural disasters.  LifeLine or Deaf and Disabled Telecommunications (DDTP) customers may not be able to obtain those services. As a COLR, AT&T is legally required to provide low-cost telephone service to low-income households through the LifeLine program.

 If customers have special medical equipment or other technology (such as a fire alarm or security system), it may no longer function.

Dear CPUC President Busching Reynolds, and Commissioners Shiroma, Houck, Reynolds, and Douglas:

On behalf of the Fortuna City Council, I am writing to request that the CPUC reject AT&T’s application for relief of COLR obligations.

As a “Carrier of Last Resort,” AT&T must provide landline "Plain Old Telephone Service" or (POTS) upon request to all residential and business customers within its service territory. Carriers (such as AT&T) can opt out of COLR responsibilities when another COLR is providing service and assumes COLR service responsibilities. AT&T's application, however, requests COLR relief for over 99% of their service territory where AT&T determines an alternative voice provider exists but it does not require a replacement COLR.

AT&T's Application also requests expedited approval for future COLR relief through a CPUC Tier 1 Advice Letter process, which does not require CPUC approval. If approved by the CPUC, AT&T could cancel service to its POTS customers as early as six months after approval.

Rural customers have few market options to choose quality, affordable telecommunications services to suit the unique needs of our communities. Much of the rural community is still underrepresented and underserved lacking universal access to reliable, secure and open networks. Customers and first responders need reliable access to 9-1-1 and 2-1-1 service, including the ability to receive alerts and notifications during times of emergency, natural, disaster, or power outage, POTS is the most reliable communications tool in the safety net arsenal. COLR relief should not be granted without securing widespread alternatives with uniform, technologically neutral minimum service quality standards.

The Fortuna City Council respectfully and adamantly implores the CPUC to reject AT&T California’s application.

Sincerely,
Mayor, Tami Trent
Fortuna City Council

City Council Business Item
DATE:

FROM:

February 20, 2024
Honorable Mayor and Council Members
Merritt Perry, City Manager
THROUGH: Ryan Plotz, City Attorney
SUBJECT: Authorize the City Manager Execute All Documents Necessary Purchase Real Property at 624 Main Street and Accept Property and Approve Supplemental Budget Request; Resolution 2024-05
STAFF RECOMMENDATION:

Approve Resolution 2024-05 to authorize the City Manager to execute all documents necessary to purchase the property at 624 Main Street with Assessor’s Parcel Number 040-105-005, to accept the property on behalf of the City, and approve a supplemental budget request in the amount of $160,000 to fund the purchase of the parcel.

EXECUTIVE SUMMARY:

The City of Fortuna owns the Monday Club meeting facility at 611 Main Street in the City of Fortuna. The historic home adjacent to the Monday Club at 624 Main Street was burned in a fire approximately four years ago. The property owner of the parcel (Ray Chisum) approached the City with an offer to purchase the property in 2021, but that offer was not acted upon. Recently, the property owner received requests from multiple developers interested in purchasing the site, and again approached the City, as he felt strongly that the parcel provided a unique opportunity to complement the Monday Club and wanted the City to consider purchasing it.

The parcel is a 0.19 acre parcel that lies directly east of the Monday Club Parcel and has significant potential to improve the function and experience for users of the Monday Club. There is potential to create a courtyard for outdoor use, create parking spaces, improve accessibility and reduce maintenance by removing nuisance trees on the property line very close to the Monday Club building. The intended purchase of the parcel will be to compliment the existing uses of the Monday Club facility.

The council directed designated the City Manager as the negotiator on behalf of the City on January 16, 2024 and directed him to negotiate for the purchase of the property. A broker’s price opinion was requested for the subject parcel from John Egan, a local real estate broker and was received on January 22, 2024. The opinion of value for the lot included a range between $140,000 and $155,000.

On February 5th the Council authorized the City Manager to make an offer on the property in the amount of $147,500 with an even split of title and escrow fees. The property owner agreed to the purchase.

In order to complete the purchase, closing documents must be executed, a supplemental budget request identifying where the funds for the purchase will be taken from and authorization must be granted by the council to accept the parcel. The council must also find the project is exempt from the California Environmental Quality Act (CEQA).

Staff recommends that the council adopt Resolution 2024-05 to grant the City Manager the necessary authority to complete the transaction and accept the parcel and to find the project is exempt from CEQA. Additionally, the council is being requested to approve a supplemental budget request in the amount up to $160,000 to fund the acquisition of the project.

ENVIRONMENTAL REVIEW:

The project is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3), as it can be “seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment”. There are no plans for any physical changes to the parcels in conjunction with the change in ownership, and therefore it can be seen with certainty that the project will not result in any significant effects on the environment. Any future projects to improve the property may be subject to CEQA.

FINANCIAL IMPACT:

The funds used for the purchase will come from fund general fund reserves and be allocated to fund100-8000-5450, Parks and Recreation Capital Outlay.
