In Recognition and Support of
American Red Cross Month
March, 2024
WHEREAS, During American Red Cross Month in March, we recognize the compassion of people in Fortuna and reaffirm our commitment to care for one another in times of crisis; and WHEREAS, This generous spirit is woven into the fabric of our community and advances the humanitarian legacy of American Red Cross founder Clara Barton — one of the most honored women in our country’s history — who nobly dedicated herself to alleviating suffering; and WHEREAS, Today, kindhearted individuals in our community exemplify Barton’s commitment as they step up through the Red Cross in the California Gold Country Region to provide a beacon of hope for our neighbors in need; and
WHEREAS, Through their voluntary and selfless contributions, they make a lifesaving difference in people’s darkest hours — whether it’s delivering shelter, food and comfort during disasters; providing critical blood donations for hospital patients; supporting military families, veterans and caregivers through the unique challenges of service; saving lives with first aid, CPR and other skills; or delivering aid and reconnecting loved ones separated by global crises; and.
WHEREAS, We hereby recognize this month of March in honor of all those who lead with their hearts to serve people in need, and we ask everyone to join in this commitment to strengthen our community.
NOW, THEREFORE, BE IT RESOLVED, I, Tami Trent, by virtue of the authority vested in me by the laws of Fortuna and California, do hereby proclaim March 2024 as Red Cross Month. I encourage all citizens of Fortuna to reach out and support its humanitarian mission.
SIGNED this 18th day of March 2024 at the City of Fortuna, in the State of California, and in witness thereof, the seal of Fortuna.

3. DISCUSSION ITEM
a. Mark Thurmond - Measure A
Minutes:
Mark Thurmond provided a presentation in support of Measure A. PUBLIC COMMENTS:
Ross Gordon, Policy Director for Humboldt Grower’s Alliance - explained there was a diverse coalition against measure A – spoke about the elected officials in support of No on Measure A. Commented that legal growers are already highly regulated by various government and oversight agencies. This is about setting a precedent for land use. Spoke in opposition to Measure A.
Dillon Mattole – Farmer from Honeydew – President of Humboldt Grower’s Alliance – commented on how frustrating it is to listen to proponents of Measure A as if they have an understanding. They speak to the land use ordinance only as the guiding document but there are various agencies that come out and inspect no less than twice year. Spoke in opposition of Measure A.
Andy Griggs – small grower - spoke in opposition of Measure A.
Walt Wilson – Fortuna resident – stated him and his wife have been trying to figure out how to vote on Measure A and stated the questions, how can Mr. Thurmond be a proponent if the Sheriff is not in support? He also stated that he and his wife have to vote against it if they can’t understand it.
Craig Johnson – Farm and Homestead Owner – stated that proponents might have had good intentions, but this is not relevant. Maybe it would have been 10 years ago. This is our life and jobs we’re fighting for. He showed a map with green dots, used as part of the Measure E campaign, to demonstrate that there are not really as many farms as Measure A would have us believe. Not good policy moving forward. Would appreciate a No on Measure A. Spoke in opposition of Measure A.
Nik Erikson – Full Moon Farms, Owner –Local Fire Department volunteer and Board Member of Humboldt Grower’s Alliance – Purchased land to help preserve the Mattole water shed. Stated there’s a reason there are so many against Measure A and that approval of Measure A would have a direct hit on local economy and tax base, and negatively affect future land use and property rights. He commented that any landowner should be concerned about this type of land use policy and requested the Council stand with their community and county and formally oppose Measure A. Spoke in opposition of Measure A.
Polly Kinsinger – Resident and owner of a permitted cannabis farm along Highway 36 on Buck Mountain – informed the Council her family have been on their 80-acre parcel for 111 years. Her family has cleaned up trespass grows out there and then used proceeds to purchase adjacent properties to restore them to their pre-grow glory. She stated there is an ordinance in the County that works. Adding more regulation in an already highly regulated process, will not bring positive change. Many cultivators are gone; the green rush is over.
She implored the Council to help those of us who are left to stay and continue to live in and support local economy and continue to provide environmental stewardship. Spoke in opposition of Measure A.
Natalynne Delapp, Executive Director of the Humboldt County Grower’s Alliance – Told the Council she realized their time was valuable, and if the Council desired, they could skip on the presentation at the upcoming Council meeting on February 20, 2024, and they could make a motion tonight in opposition of Measure A.
Cody King – Fortuna Resident- Grower – 2016 was a turning point and come out of the shadows and make a career what we’ve been doing for years. He informed the Council he has a mega-grow. He stated he was frustrated hearing Mr. Thurmond and that some of the comments were not true. He explained that they use rain catchment devices, and none of their spill or runoff goes back into the ground. He claimed that not only are they taking care of the land their five-year plan includes expansion –a 10,000 square foot canopy is not fair to those trying to build a brand to get shelf space. He requested the Council vote no on Measure A. Spoke in opposition of Measure A.
Jeanna McClendon – Fortuna Resident, Business Owner – Thanked all of the legal business owners and thanked the Vote Yes group for their input and thought both groups deserved recognition. She commented that ordinances should be flexible and easily adaptable and that rigid regulatory framework hinders the ability to respond to the industry effectively. She spoke in opposition of Measure A.
Nicole Genaro – Hydesville Resident – Fortuna business owner for over 20 years.
Commented that she felt it was most important to think about the impact in the economy. – to take the money away from the one industry we have in Humboldt County right now would be a huge disservice. She spoke in opposition of Measure A.
Micheal (Zoom Attendee) – Small Farm Owner in Southern Humboldt County – Commented that is was frustrating listening to the proponents and they were not there to sign his permit, that John Ford did, and that’s who he answers to. He explained what he couldn’t stand were the proponents trying to manipulate people as a means to reach their goals. He thought it was disingenuous to say you support small farms and a few moments later compare it to leprosy. Spoke in opposition to Measure A.
Michelle Bushnell – 2nd District Supervisor – Explained to the Council she had met with Natalie Arroyo, Mark and Betsy on an ad hoc committee to try and work with and address the issues. She explained there was lots of conversation and yet were unable to come to and understanding that was satisfactory. She urged the Council to go to a cultivation site and urged them to seek out the agencies that regulate the permitted grows. She urged the Council to do their own investigations – contact agencies and question Measure A. Spoke in opposition of Measure A.
Rex Bohn – 3rd District Supervisor –Commented that there’s subliminal part of this proposition that is so encompassing, its why there’s 38 pages, and that that is not where it’s going to stop. He felt it would 1encompass timber, other agriculture and that commented dairies kept coming up. He explained that 38 pages seems to indicate there is more than just cannabis and commented on the proposition being difficult to understand. Felt this would drive a lot of now legally permitted grows back the other way. Spoke in opposition of Measure A.
Betsy - Measure A Proponent – Commented that she wanted to address what Measure A really was and explained that it protected the vested rights of the farmers that exist now.
She also explained that their proposition had to be “added” to the pre-existing ordinance that is why it is 38 pages. The existing ordinance is the basis of Measure A, they just added the consensus they found in the 2017 DIR comments, many of which came from Fortuna.
She continued to explained the Measure was intended to stop the next green rush and that the 2017 ordinance did not have teeth in it and the Measure gives it some teeth by not allowing grows to expand beyond 10,000 square feet, basically a ¼ acre and that that is appropriate for our local eco-system. She finished by explaining they didn’t make this stuff up… just took it from the pre-existing EIR and ordinance. She spoke in support of Measure A.

On March 4, 2024, risk staff met with our Third Party Administrator for Worker’s Compensation Claims and reviewed all of the City’s open claims. I’m happy to report that in the last 12 months, the City only had one claim, which was medical only and is now closed. Topics included updating emergency evacuation plans and procedures, providing Federal Emergency Management Agency (FEMA) trainings for employees. In addition, the newly updated Injury, Illness Prevention Program was provided for all employees and each department will be responsible for their employees reviewing and completing an acknowledgement form. The group reviewed the platform for the City’s online Safety Data Sheet management system. EXECUTIVE SUMMARY:
Fiscal Year 2024-25 Budget:
Staff presented the mid-year budget review at the January 29th council meeting. Conducting this review is the first step in preparing the FY 2024-25 budget. The next steps include staff compiling preliminary revenue estimates and soliciting each departments FY 2024-25 budget requests.
Part of the solicitation of department requests will be a separate list of items each department is requesting to be funded from the City’s transaction and use tax, Measure E. These lists will be presented to the Measure E committee on March 19th. The committee then has a follow up meeting scheduled for April 2 to discuss which of those items presented to them will be included in the committee’s recommendation to the City Council. Once staff has compiled this information, a special budget workshop will be scheduled where it will be presented and discussed with the Council. Staff is targeting the beginning of May for the first special budget workshop with Council.
Tax Reporting:
Tax reporting for 2023 was the first year that electronic filing was mandated for the City. Staff worked extensively to create online accounts and receive the proper access to the applicable electronic filing databases. W-2’s and 1099’s were due to be filed by January 31, and 1098’s and 1094-C’s were due to be filed by March 31. All forms were filed before the deadline despite some unanticipated roadblocks in filing for the first time, all members of the Finance Department should be commended as this was a team effort.
Measure E Update:
The Measure E committee’s next regularly scheduled meeting is set for March 19, 2024 at 5:30pm.
The primary purpose of this meeting will be for the committee to receive funding proposals from City Departments.

Police Facility Remodel Project
The project is continuing to progress on schedule. The interior of the facility is largely completed, with only the IT room and other minor punch list items remaining for completion. The project exterior work has been somewhat delayed due to the weather, however, there appears to be a coming weather window in March which should allow for the paving to be completed. To date, all concrete work on the project is completed. Once paving has been finished, the primary remaining project items will include landscaping, fencing, the solar installation, the covered parking structure, and parking lot striping.
Water and Sewer Rate Study
As previously reported in the past several months, the City is currently conducting a water and sewer rate study, which will inform planned adjustments to water and sewer rates over the next five years. This upcoming rate adjustment, which staff will bring to the Council for approval, will be the City’s first adjustment since 2012.
Currently, staff are working with our rate study consultant to converge on a recommended fiveyear rate adjustment strategy. The adjustments will take into account current and future operating expenditures, capital improvement and maintenance projects, and staffing costs. Staff anticipate bringing a recommended rate adjustment strategy to the Council at the April 15th meeting.
Mill Creek Habitat Connectivity Project
Over the past several months, staff have been active on this project clearing vegetation near the culvert crossings to accommodate the project topographic surveys, all of which have been completed. Additionally, the geotechnical borings have been performed for each site, this effort characterizes the soils in the area and the information is used to inform the design of new culvert crossings. The only remaining field work efforts are the biological and geomorphic assessments, which are scheduled to take place over the next month or so. Once all field work is completed, the engineering design phase of the project will begin.

ADA Barrier Removal Project
The ADA barrier removal project, which will include new sidewalk improvements along N Street, a new bulb-out crosswalk at 6th and Main, and various minor concrete improvements along 12th Street, was advertised for bidding in late February. The bid opening is March 15th. Should bids come in at budget, staff plan to bring the project for an award recommendation in early April.
Rohner Creek Flood Control Project
Although all phases of this project have been completed for a number of years, staff have continued to put effort into the long-term monitoring and maintenance that were required in order to obtain permits for the project from the resource agencies (i.e. CDFW, the Water Board, etc.). The primary permit conditions which the City has been working to achieve are the establishment of new 3- parameter wetlands, the establishment of native vegetation, and the minimization of target invasive species (primarily ivy and blackberry). Annually since the first years of construction, City crews have removed invasive vegetation, and planted supplemental vegetation in areas that needed it.
It is currently the fifth year of monitoring for the Phase A and B area of the project, which includes all Rohner Creek improvements in between 12th Street and Main Street, including the flood control swale. The City was recently notified by the resource agencies that the permit conditions noted above have been achieved, and therefore the City is no longer required to monitor or maintain these areas for vegetation or wetlands creation. In addition to this, staff have agreed to an action plan for Phases 3 and 4 of the project, which includes Hillside Creek and the 12th Street fish passage project, where those permit conditions will be accepted by the end of 2024. In summary, by the end of the year the project will now ‘officially’ have come to a close, and the City will no longer be required to complete the additional annual efforts noted above.
Kenmar Interchange Improvement Project
As noted in last month’s staff report the PA&ED phase of the project is complete. On February 28th, staff also finalized and submitted a Rebuilding American Infrastructure with Sustainability and Equity (RAISE) Grant for the project, where the City is requesting $25 million of grant funding in order to complete the construction phase of the interchange project, and Phase I of the Strongs Creek Trail. Awards for the grant will be announced in the early summer of 2024.

General Services and Streets - General Services Superintendent The following is a list of scheduled assignments completed by the General Services staff in February:
Staff removed a debris dam in Rohner Creek that was
located behind the main cook shack. The debris dam and
high water level caused the bank to erode off the corner of the cook shack, threatening the structure. A larger project will unfold later in the year to fix the erosion of the bank (see photo inset left).
Staff responded to an after-hour callout to remove
debris from Hillside Drive. The debris was from a previous fallen tree top that slid off the embankment and closed the road during a heavy winter storm. Staff placed erosion
control mat to cover the exposed ground on the embankment.
Staff also responded to a hill slide on Ninth Street Extension.
The slide encroached onto the single lane. Mercer Fraser later responded with K rails to keep continued debris flows off of the road and staff placed a culvert in the ditch to keep the storm water flowing.
Staff restored three large areas with hot mix asphalt on Kenmar Road and Fortuna Boulevard.
Staff prepared for heavy winter storm events. Staff refilled the sand pile for the public to use at Rohner Park. Staff used the vacuum truck to clear drainage inlets and culverts. Staff removed debris and material on the shoulder of South Loop Road. City carpenter and staff built new large parade barricades for the new season of special events. EXECUTIVE SUMMARY:
The River Lodge and Monday Club held a total of 22 events in the month of February.
February started off with the annual Fortuna Volunteer Fire Department dinner being held at River Lodge.
For the third year in a row, Native Sons of the Golden West held a two-day event. It started off on Friday night with a mixer. The group brings their own large barbeque trailer for the weekend.
There were two very large memorials held at River Lodge. Both had more than 250 people in attendance.
Lifeline Screening was at the Monday Club again in February. They provide a valuable service of health screenings and tests at an affordable price.
In addition, there were birthday parties and baby showers at both facilities.
February was a little quiet at both the Monday Club and River Lodge. This made it possible for Sequoia Drywall to get started on the long awaited earthquake repairs at River Lodge. As most of you are aware, the damage were all cosmetic and needed to be done.

STAFF REPORT
City Council Consent Item
DATE: March 18, 2024
TO: Honorable Mayor and Council Members
FROM: Shari Meads, Community Development Director
THROUGH: Merritt Perry, City Manager
SUBJECT: 2023 General Plan Annual Report
STAFF RECOMMENDATION:
Accept the 2023 General Plan Annual Report and direct staff to submit the report to the California Department of Housing and Community Development and Governor’s Office of Planning and Research.
EXECUTIVE SUMMARY:
A general plan is each local government’s blueprint for meeting the community’s long-term vision for the future. The City of Fortuna General Plan (hereafter referenced as General Plan), adopted by Council on October 26, 2010, formalizes policies, standards, and programs to guide day-to day decisions concerning the City’s growth and change through the year 2030.
Each year staff is required to prepare a General Plan Annual Report to provide the public and City decision-makers with information on the City’s progress toward achieving General Plan goals during the prior calendar year. Additionally, pursuant to Government Code Sections 65400 and 65700, the General Plan Annual Report must be submitted to the California Department of Housing and Community Development (HCD) and Governor’s Office of Planning and Research (OPR) prior to April 1st of each year. This General Plan Annual Report summarizes the City’s General Plan implementation progress for calendar year 2023.
GENERAL PLAN AMENDMENTS:
California Code Section 65358 allows a legislative body to amend all or part of an adopted general plan as many as four times per calendar year with additional general plan amendments allowed to accommodate residential development meeting certain requirements. A general plan amendment may be initiated by a jurisdiction, or by a member of the public. General Plan amendments requires public hearings before the Planning Commission and the City Council.
There were no City-initiated or public applications for General Plan Amendments in 2023.
Consent Item 4l
GENERAL PLAN IMPLEMENTATION:
The General Plan is the City’s highest level policy document. Like a book, the General Plan consists of chapters, which HCD calls “elements.” Each element covers a different aspect of the urban environment, such as land use, housing, open space, or conservation. The City’s General Plan consists of nine elements that address both state‐mandated subject matter and optional topics of concern to Fortuna.
Land Use Element (Chapter One):
The Land Use Element outlines proposed land use patterns, policies and standards for future development and redevelopment. City progress toward Land Use Element goals, policies, and programs includes:
Implementation of OpenGov online permitting software on July 5, 2023 to streamline building and planning permit submittal, review, and tracking. Additionally, staff continues to utilize ParcelQuest for real-time ownership, boundary, and graphic layer information to assist property owners in developing compliant and complete applications. Evaluating all proposed projects for General Plan consistency including land use designation, use type, and density or floor-area ratio (FAR) where applicable. Continued participation in local and regional planning and land use efforts to achieve maximum jurisdictional and agency coordination including the Humboldt County Association of Governments, and various regional planning roundtables. Continued to make progress on the Mill District Specific Plan project including drafting infrastructure and phased development plans, design and development standards, and progress on environmental review. The Mill District Specific Plan includes the transformation of an approximately 73-acre vacant former lumber mill site with a broad range of land uses including retail, office, service, commercial, industrial, recreation, and medium and high-density residential. The Mill District Specific Plan also includes adjacent currently developed parcels.
Economic Development Element (Chapter Two):
The Economic Development element provides goals, policy guidance, and implementation measures to promote long‐term job creation, business opportunities, and prosperity. The City implements Economic Development Element goals, policies, and programs by:
Continuing to promote business growth and diversification, a conducive business climate and a supportive economic foundation.
Continuing to work closely with, and provide support to the Chamber of Commerce. Participating in Redwood Region Economic Development Commission meetings The City’s Business Improvement District (FBID) continued to promote public events in 2023 including coordinating the Shop Fortuna program, Al Gray Lighted Holiday Parade, Kids Holiday Movie, and annual Wedding Show which showcased local vendors.
Consent Item 4l
Housing Element (Chapter Three):
The Housing Element identifies demographic information, existing and projected housing needs, and establishes goals, policies, standards, and implementation measures for the preservation, improvement, and development of housing in the City of Fortuna. The Housing Element must include a residential land inventory and identify ways the City will meet its share of regional housing needs at all affordability levels. The Housing Element must be updated and certified by the State every eight years. Fortuna’s Housing Element covers the period of 2019 through 2027.
The following three sections provide information related to Housing Element components. A separate Housing Element Annual Progress Report is required by HCD and will be provided as a separate item.
Population
The California Department of Finance (DOF) estimates that Fortuna had 12,256 residents as of January 1, 2023, representing a 0.7 percent decrease from the 2022 population of 12,339.
Residential Growth and Development
The City of Fortuna continues to encourage development of a variety of housing choices, including diverse residential types, tenancies, sizes, locations, and prices. In 2023, 25 building permits were issued for 25 new residential units. Of the 25 issued building permits:
Twenty-one permits are for new single family dwellings including both attached and detached units.
Four permits are for accessory dwelling units and junior accessory dwelling units (ADUs and JADUs)
No building permits were issued for manufactured homes or multi-family dwellings Housing Needs and Affordability
The City reviews and maintains an inventory of sites zoned to allow multi-family residential housing which per market analysis tends to support lower rental prices. In 2023, entitlements were approved for 70 multi-family units designated for moderateincome households. On December 4, 2023, the Council adopted Ordinance 2023-764 to amend Fortuna Municipal Code Chapters 17.03, 17.06, and 17.08 to enact multifamily design standards and to allow agricultural employee housing.
Transportation & Circulation Element (Chapter Four):
The Transportation & Circulation Element is divided into two major sections. The first section, Circulation Diagram & Standards, describes the Circulation Diagram and the roadway classification system and standards. The second section includes the goals, policies, and implementation programs related to the various forms of transportation. City progress implementing Transportation & Circulation Element goals, policies, and programs includes:
Upgrading and enhancing transportation and infrastructure facilities within the City that are necessary for facilitating economic growth and development. Implementing circulation improvements for existing streets and new development.
Consent Item 4l
Ensuring that proposed parking lots of 10 spaces or more are visually buffered from any existing or proposed residential uses by trees and vegetation, and that proposed parking lots of 20 spaces or more include islands with tree plantings (at least one tree for every 20 parking spaces) to reduce visual impacts and solar radiation.
Natural & Cultural Resources Element (Chapter Five):
This element addresses the City’s natural and cultural resources, including mineral, energy conservation, agricultural, biological, historical, archaeological, and tribal cultural resources. The General Plan must ensure that long-term growth is compatible with these resources.
Implementation of Natural & Cultural Resources Element goals, policies, and programs includes:
Maintaining and repairing streams with high sedimentation by installing habitat restoration and fish passage structures, restoring gravel beds, and creating deep ponds. Codification of a Water Efficiency Landscaping Ordinance Codification of a Construction and Demolition Debris Diversion Ordinance. Maintaining relationships, consultations, and exchange of information with nearby Tribal Entities and Tribal leaders including the Bear River Band of the Rohnerville Rancheria and the Wiyot Tribe.
Parks, Recreation, & Open Space Element (Chapter Six):
Fortuna has a large, multifaceted system of parks, recreational facilities, and open space. Parks provide venues for Fortuna’s annual festivals, and the recreational facilities and open space corridors allow for active and passive uses by community members and visitors. The Parks, Recreation, & Open Space chapter provides goals, policies, and programs to ensure that Fortuna’s parkland, recreational facility, and open space provisions match future growth. City progress toward meeting Parks, Recreation, & Open Space Element goals, policies, and programs includes:
Expansion and renovation of Rohner Park basketball courts to add an additional court and pickelball striping.
Acquisition of 2.66 acres of land to expand Newburg Park. Continuing to work with the Rohner Community Recreation and Parks District to develop funding for and construction of a Community Pool.
Public Services & Facilities Element (Chapter Seven):
The City is responsible for the development and day-to-day operations of public services and facilities. The Public Facilities & Services Element describes the City’s existing and planned public facilities and services and details emergency response capabilities. The City implements Public Services & Facilities Element goals, policies, and programs by:
Preparing and annually reviewing public facility master plans (e.g., water, wastewater, drainage).
Updating public facility master plans every five years to ensure compliance with appropriate State and Federal laws, use of modern and cost‐ effective technologies, and compatibility with current land use policy.
Consent Item 4l
Monitoring water, wastewater and storm drain system capacities on an annual basis, and making needed capacity improvements.

Community Design Element (Chapter Nine):
The Community Design Element provides goals, policies, and programs to ensure all stakeholders (e.g., developers, the City, community members) share a common understanding of what constitutes good design in Fortuna and includes requirements that individual project design is evaluated for consistency with community character as a whole. Progress toward implementing Community Design Element goals, policies, and programs includes:
Continuing to encourage new development along major corridors to comply with the following minimum standards:
o All outdoor storage of goods, materials, and equipment and loading dock areas shall be screened from major roadways;
o Developments with multiple buildings should have a uniform design theme and sign program;

City Council Consent Item
DATE: March 18, 2024
TO: Honorable Mayor and Council Members
FROM: Shari Meads, Community Development Director
THRU: Merritt Perry, City Manager
SUBJECT: 2023 Housing Element Annual Progress Report
STAFF RECOMMENDATION:
Approve the 2023 Housing Element Annual Progress Report and direct staff to submit the report to the California Department of Housing and Community Development and Governor’s Office of Planning and Research.
EXECUTIVE SUMMARY:
California Government Code Section 65400 requires each jurisdiction to prepare a Housing Element Annual Report (APR) on progress implementing its housing element and toward achieving the Regional Housing Needs Allocation (RHNA). RHNA is the number of market rate and affordable housing units the California Department of Housing and Community Development (HCD) determines is necessary for a jurisdiction to build its housing needs over an 8-year period.
APR content is directed by State housing law, and HCD provides reporting forms which must be submitted by April 1st each year.
BACKGROUND:
The City’s Housing Element covers the 2019-2027 planning period and was adopted by the Council on August 19, 2019. The Housing Element was certified by HCD on September 16, 2019 which indicates its compliance with State Housing Element Law. Having a certified Housing Element is required for participation in some grant programs.
The Housing Element includes programs to promote the development of housing for all; including across income and age levels and access and functional needs. While the City is not responsible for constructing residential units, all California jurisdictions must provide a regulatory environment that promotes housing development.
Consent Item 4m
DISCUSSION:
Highlights from the City’s 2023 APR are included below and the complete APR is included as an attachment to this staff report.
Table A documents all submitted building permit applications by unit type, project type, tenure, and affordability.
o In 2023, building permit applications were submitted for 10 residential units. Three of the 10 units are ADUs which, based on market research, the City classifies as being for moderate-income households. Seven of the units are single-family residences which are classified in the above moderate-income category. None of the building permits utilized streamlining provisions or qualified for incentives, or concessions. Table A2 compiles all approved entitlements, issued building permits and certificates of occupancy, and the number of units demolished/destroyed in 2023. Projects are broken down further by unit type, project type, tenure, and affordability level. Additional information tracked on table A2 includes infill units and special programs. o Four entitlements were approved in 2023 representing 82 units. Building permits were issued for 25 residential units and 17 units were issued Certificates of Occupancy. One residential unit was reported as demolished/destroyed.
Table B reports the City’s progress towards meeting the 2019-2027 RHNA. Table B includes Fortuna’s total RHNA requirement and the number of housing units that have been credited toward the RHNA since 2019 (the start of the current eight-year) planning period.
o The City will need to issue building permits for 150 additional new housing units by the year 2027 to meet the remaining RHNA requirement. Of the 150 units: 73 must be intended for very-low income households; 38 for low income households; and the remaining 39 units can be for above moderate income households. Table C is for sites the City rezoned to meet a shortfall of parcels available for residential development. The City has no identified shortfall of residentially developable land. Table D lists each Housing Element program and its implementation status. Table E is the State’s Commercial Development Bonus (partnered commercial/affordable housing), which is not applicable to the City.
Table F is for units listed in the Housing Element that have been rehabilitated, preserved, or acquired as “alternative adequate sites.” No such sites are identified in the City’s Housing Element.
Table G and H is to report any City-owned sites included in the Housing Element that were sold, leased, or otherwise disposed of during the prior year. No City-owned sites included in the Housing Element were sold, leased, or otherwise disposed of in 2023.

STAFF RECOMMENDATION:
Authorize the City Manager to execute a Professional Services Contract CSG Consultants to continue to assist the City with SB 1383 compliance and development of an updated franchise agreement.
EXECUTIVE SUMMARY:
On June 20, 2023, the council approved an agreement with CSG consultants to assist the city with the development of a franchise agreement to comply with the requirements of SB 1383. The negotiations have been taken more time than expected with Recology, the City’s solid waste hauler. Additional effort is necessary to complete the following tasks:
Development and negotiation of the agreement
Analysis of Cost proposal and rates
Analysis of proposed franchise fee for SB 1383 services Provide a Presentation to the City Council
The City of Fortuna currently is working to comply with the provisions of SB 1383 and CalRecycle has issued a Corrective Action Plan (CAP) with specific tasks and completion dates for the steps necessary for the City to comply with SB 1383. Many of the tasks required of the city will become the responsibility of the Recology once the Franchise Agreement is executed.
Approving this contract with CSG will provide the necessary effort to update the Franchise agreement and remain in compliance with the CAP.
FINANCIAL IMPACT:
The proposed cost for the services from CSG Consultants is $12,980. The City was notified on 2/26/24 that it received a $75,000 Cal Recycle Local Assistance Grant to fund this effort and other SB 1383 compliance activities.

Business Item 5b
STAFF REPORT
City Council Business Item
DATE: March 18, 2024
TO: Honorable Mayor and Council Members
FROM: Merritt Perry, City Manager
SUBJECT: Initiative No. 21-0042A1, The Taxpayer Protection and Government Accountability Act
STAFF RECOMMENDATION:
Staff recommends Council adopt Resolution 2024-06 opposing Initiative No. 21-0042A1, the Taxpayer Protection and Government Accountability Act.
EXECUTIVE SUMMARY:
The Taxpayer Protection and Government Accountability Act would revise the California Constitution with provisions that limit voters’ authority and input, adopt new and stricter rules for raising taxes and fees, and may make it more difficult to impose fines and penalties for violation of state and local laws. The measure puts billions of local government tax and fee revenues at risk statewide with related core public service impacts. The measure could have significant negative impacts on City of Fortuna operations and core service delivery. The California Business Roundtable sponsors the proposed constitutional initiative.
MAJOR PROVISIONS
Fees and Charges
Except for licensing and other regulatory fees, fees and charges may not exceed the “actual cost” of providing the product or service for which the fee is charged. “Actual cost” is the “minimum amount necessary.” The burden to prove the fee or charge does not exceed “actual cost” is changed to “clear and convincing” evidence. Requires fees and charges paid for the use of local and state government property and the amount paid to purchase or rent government property to be “reasonable.” These fees and charges are currently allowed to be market-based. Whether the amount is “reasonable” (introducing a new legal standard aiming to force below market fee and charge amounts) must be proved by “clear and convincing evidence.” The standard may significantly reduce the amount large companies (e.g., oil, utilities, gas, railroads, garbage/refuse, cable, and other corporations) will pay for the use of local public property.
Prohibits fees on new development based on vehicle miles traveled.
Taxes
Taxes and fees adopted after Jan. 1, 2022, that do not comply with the new rules, are void unless reenacted.
Business Item 5b
Invalidates Upland decision that allows a majority of local voters to pass special taxes.
The measure specifies that taxes proposed by the initiative are subject to the same rules as taxes placed on the ballot by a city council.
Expressly prohibits local advisory measures which allow local voters to express a preference for how local general tax dollars should be spent. Requires voter approval to expand existing taxes (e.g., Utility, Transient Occupancy) to new territory (e.g., annexations) or to expand the tax base (e.g., new utility service) New taxes can only be imposed for a specific time period. City charters may not be amended to include a tax or fee. All state taxes require majority voter approval.
Fines and Penalties
May require voter approval of fines, penalties, and levies for corporations and property owners that violate state and local laws unless a new, undefined adjudicatory process is used to impose the fines and penalties.
DISCUSSION/ADDITIONAL BACKGROUND
On Jan. 4, 2022, the California Business Roundtable filed the “Taxpayer Protection and Government Accountability Act” or AG# 21-0042A1. On Feb. 1, 2023, the measure qualified for the November 2024 ballot.
The League of California Cities, along with a broad coalition of local governments, labor and public safety leaders, infrastructure advocates, and businesses, strongly opposes this initiative.
Local government revenue-raising authority is currently substantially restricted by state statute and constitutional provisions, including the voter approved provisions of Proposition 13 of 1978, Proposition 218 of 1996, and Proposition 26 of 2010. The Taxpayer Protection and Government Accountability Act adds and expands restrictions on voters and local government tax and fee authority.
Fees and Taxes
Local governments levy a variety of fees and other charges to provide core public services.
Major examples of affected fees and charges are:
Nuisance abatement charges, such as for weeds, rubbish, and general nuisance abatement to fund community safety, code enforcement, and neighborhood cleanup programs.
Commercial franchise fees.
Emergency response fees, such as in connection with DUI. Advanced Life Support (ALS) transport charges.
Document processing and duplication fees.
Transit fees, tolls, parking fees, and public airport and harbor use fees. Facility use charges, fees for parks and recreation services, garbage disposal tipping fees.
Virtually every city, county, and special district must regularly (e.g., annually) adopt increases to fee rates and charges and revise rate schedules to accommodate new users and activities. Most of these would be subject to new standards and limitations under threat of legal challenge. Based on the current volume of fees and charges imposed by local agencies, including council-adopted increases to simply accommodate inflation, Cal Cities estimates the amount of local government Business Item 5b
fee and charge revenue at risk is approximately $2 billion per year including those adopted since Jan. 1, 2022. Over ten years, $20 billion of local government fee and charge revenues will be at heightened legal peril.
Hundreds of local tax measures were approved in 2022 that likely do not comply with the provisions of the initiative. Nearly $2 billion of annual revenues from these voter-approved measures will cease a year after the effective date of the measure, reducing the local public services funded by these measures, unless the tax is re-submitted for voter approval.
Reductions on local government tax revenues have impacts on core services and infrastructure including fire and emergency response, law enforcement, streets and roads, drinking water, sewer sanitation, parks, libraries, affordable housing, homelessness prevention, and mental health services.
The City of Fortuna currently does not have any revenue measures affected by the proposed ballot measure, however if the City puts a tax measure on the 2024 ballot, it would be subject to the provisions of the measure. This could limit the City’s ability to specify what general tax funds could be spent on such as public safety, fire services, etc.
Fines and Penalties
Under existing law, cities are required to provide due process before imposing a penalty or fine for violation of its municipal code:
1. A local agency must adopt administrative procedures that govern imposing fines and penalties, including providing a reasonable period of time for a person responsible for a continuing violation to correct or remedy the violation [Gov't Code 53069.4].
2. Notice must be given to the violating party before imposing the penalty; and give the party an opportunity to be heard and present any facts or arguments [Merco Construction Engineers v. Los Angeles Unified School District (1969) 274 CA 2d 154, 166].
3. The fine may not be "excessive" [U.S. Constitution amendments VIII and XIV].
The initiative converts administratively-imposed fines and penalties into taxes unless a new, undefined, and ambiguous “adjudicatory due process” is followed. This provision may put at risk authority to impose fines and penalties for violations of state and local law.
FISCAL IMPACT:
The Taxpayer Protection and Government Accountability Act will take billions of dollars away from local government services statewide.

Business Item 5ba
RESOLUTION NO. 2024-06
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF FORTUNA OPPOSING INITIATIVE NO. 21-0042A1,
THE TAXPAYER ACCOUNTABILLITY ACT
WHEREAS, an association representing California’s wealthiest corporations is spending tens of millions of dollars to promote a deceptive ballot measure currently eligible for the November 2024 statewide ballot; and
WHEREAS, the measure creates constitutional loopholes that allow corporations to pay far less than their fair share for the impacts they have on our communities, which could force residents and taxpayers to pay more to maintain services; and
WHEREAS, the measure threatens billions of dollars every year in local government funding for services like fire and emergency response, law enforcement, affordable housing, services to support homeless residents, mental health services, and more; and WHEREAS, the measure is an attack on voters’ rights, containing undemocratic provisions that would make it more difficult for local voters to pass measures to fund services, provisions that retroactively cancel measures recently passed by voters, and provisions that prevent voters from passing advisory measures that provide direction on how they want their local tax dollars spent; and
WHEREAS, the measure contains intentionally restrictive language that will encourage hundreds of frivolous lawsuits against cities and local governments – costing taxpayers many millions and stopping investments in vital local services; and
WHEREAS, the measure would make it much more difficult for state and local regulators to issue fines and levies on corporations that violate laws intended to protect our environment, public health and safety, and our neighborhoods; and
WHEREAS, the measure is opposed by hundreds of local governments, teachers, firefighters, working families and local elected officials.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FORTUNA DOES HEREBY RESOLVE AS FOLLOWS: that the City of Fortuna opposes Initiative #21- 0042A1;
BE IT FURTHER RESOLVED, that the City of Fortuna will join the “Stop the Taxpayer Deception Act” coalition, a growing coalition of public safety, education, labor, local government, and infrastructure groups throughout the state.
We direct staff to email a copy of this adopted resolution to the League of California Cities at [email protected].
