In Recognition of
National Public Safety Telecommunications Week
April 14th – 20th, 2024
WHEREAS, emergencies can occur at anytime that require police, fire or emergency medical services and Public Safety Dispatchers are the first and most critical contact our citizens have with emergency services; and
WHEREAS, Public Safety Dispatchers are the single vital link for our police officers and firefighters by monitoring their activities by radio, providing them information and insuring their safety; and WHEREAS, the safety of our police officers and firefighters is dependent upon the quality and accuracy of information obtained from citizens who telephone the Fortuna Police Department communications center; and
WHEREAS, the City of Fortuna is served by a group of men and women working as public safety dispatchers for the law enforcement, fire, rescue and medical emergency response agencies in this community; and
WHEREAS, these dedicated individuals work tirelessly to answer our citizens’ calls for help, and dispatch the first responders to the scene of those emergencies; and WHEREAS, these public safety dispatchers have demonstrated loyalty, commitment and dedication in the performance of their duties; and
NOW, THEREFORE BE IT RESOLVED that the Public Safety Dispatchers working in the City of Fortuna are a valuable asset to our community at large. These professionals who toil, with little recognition, twenty-four hours a day, seven days a week, to save lives and provide assistance are unsung heroes.
BE IT FURTHER RESOLVED it is for these reasons that the City Council of the City of Fortuna wishes to honor them and proclaim April 14th- 20th, 2024 as “National Public Safety Telecommunications Week” in the City of Fortuna. The City Council of the City of Fortuna appreciates their commitment and dedication to their profession, and congratulates them on a “job well done.” SIGNED this 1st day of April 2024 at the City of Fortuna, in the State of California, and in witness thereof, the seal of Fortuna.

STAFF REPORT
City Council Consent Item
DATE: April 1, 2024
TO: Honorable Mayor and City Council
FROM: Heather Leigh Stevens, Parks and Recreation Director THROUGH: Merritt Perry, City Manager
SUBJECT: Approve Allocation of One (1) Seasonal Part-time Parks Maintenance Worker I Position
STAFF RECOMMENDATION:
Approve the allocation of one seasonal Parks Maintenance Worker I position.
EXECUTIVE SUMMARY:
Currently there are two (2) Parks Maintenance I regular part-time positions allocated in the budget and identified on the organizational chart. Due to increased requests for facility use and expansion of special events, as well as the seasonal nature of both field use and special events, the parks division does not have enough employees to complete the parks and facilities seasonal maintenance needs.
FISCAL IMPACT:
For the remainder of Fiscal Year 2023-24 the budget for this seasonal position will be covered by the unused salary budgeted for the two Parks Maintenance I regular part time positions. As a seasonal position it will be limited to 1000 hours of seasonal work throughout a full year. The department will work within the budget process for Fiscal Year 2024-25 to include this new seasonal position within next years adopted budget.
RECOMMENDED COUNCIL ACTION:
Approve the allocation of one seasonal Parks Maintenance Worker I position. Consent agenda vote.
Business Item 5a
STAFF REPORT
City Council Business Item
DATE: April 1, 2024
TO: Honorable Mayor and Council Members
FROM: Mat Nyberg, Public Works Project Manager
THROUGH: Merritt Perry, City Manager
SUBJECT: Approve the CDBG Barrier Removal Project (CIP 9977) and Award a Construction Contract to RAO Construction in the Amount of $427,716.
STAFF RECOMMENDATION:
Approve the project plans and Authorize the City Manager to award the CDBG Barrier Removal Project (CIP 9977) to RAO Construction and establish a maximum contract amount of $430,000.
EXECUTIVE SUMMARY:
In early 2021 staff began the application process for a Community Development Block Grant (CBDG) from the State Department of Housing and Community Development, the same agency funding that was utilized for improved ADA accessibility around City Hall in 2019. Since August of 2021, staff have been working with GHD Inc. developing and refining plans for the CBDG Barrier Removal Project (CIP 9977). The plan set and front-end documents finalized in late February 2024.
The final design features accessibility improvements on N Street from 11th to 14th Street, around the intersection of 6
th and Main Streets, along a section of South 12th Street at Rohner Creek and a corner ramp on David Way. Work will involve the reconstruction of sidewalks, driveways, street corners and crosswalks that have accessibility issues in these areas. The end result of these improvements will further the City’s goal to achieve an accessible community, and will help address the findings of a County Accessibility Audit in 2018.
The CDBG Barrier Removal bid package was released and publically advertised on February 22nd, 2024. The bid period ended on March 15
th, at which time the City received three bids. The bid totals are shown in the table below, and the total base bid amount was the basis for awarding the project.
Bid Schedule
Bidders
RAO Construction Hooven and
Company GR Sundberg
Total Base Bid $390,246 $449,603 $535,542
Business Item 5a
The apparent low bid was submitted by RAO construction with a total bid price of $390,246. City staff have confirmed that the bid received from RAO Construction was fully responsive and that they and their sub-contractors have active licenses and registrations. RAO has successfully completed a number of projects throughout the City in recent years, including the Walker Elementary Sate Routes to School project, portions of the Jameson Creek Barrier Removal and Rohnerville Road STIP projects, and most recently, the 12th Street Integrated Stormwater Project.
Staff are confident that they can successfully complete all portions of this project.
If the project is awarded, staff anticipate being under contract by mid-April. Mobilization and construction is anticipated to begin in late April or early May. The draft Notice of Potential Award is included as Attachment A.
FINANCIAL IMPACT:
As noted above, the project is funded by a CDBG through the State Department of Housing and Community Development, awarded in 2021. The total available construction budget is shown in the table below.
Fund Budget Amount

STAFF REPORT
City Council Business Item

TO: Honorable Mayor and Council Members
FROM: Mat Nyberg, Public Works Project Manager
THROUGH: Merritt Perry, City Manager
SUBJECT: Authorization to Award the Contract for the Wastewater Treatment Plant Percolation Pond Rehabilitation Project 2024.
STAFF RECOMMENDATION:
Authorize the City Manager to award the Annual Wastewater Treatment Plant Percolation Pond Project to Wendt Construction Co., Inc. and establish a maximum contract amount of $114,000.
EXECUTIVE SUMMARY:
The Percolation Pond Rehabilitation Project is an annual maintenance activity at the Wastewater Treatment Plant (WWTP), which includes the removal of depleted material, rehabilitation of the pond subgrade, and placement of clean imported permeable drain rock. This annual project is critical for the performance of the City’s treatment facility, given the regulatory mandate that the City not discharge directly treated effluent to surface water in between May 15 – September 30.
Bids for the Wastewater Treatment Plant Annual Percolation Pond Rehabilitation Project 2024 were opened on March 15th, 2024. Two bids were received and the bid results are shown in the table below.
Bid Schedule
Bidders
Wendt Construction William Gray Construction
Total Base Bid $110,115 $115,800
The apparent low bidder is Wendt Construction, and their bid was found to be responsive and responsible and they are capable of meeting the project regulatory deadline of May 15th. It is customary in contract administration to include a contingency amount with the authorized contract amount, in order to accommodate unforeseen conditions or changes that may become apparent during the course of construction. Due to the well-defined nature of this project, staff propose approximately $3,000, which is the remaining annual budget for the project beyond the bid amount, and accounting for other incurred project costs. With this, staff plan to award the contract with Wendt Construction for the amount listed above, and establish a maximum contract not to exceed amount of $114,000.
Business Item 5b
If approved, staff anticipatee a work-commencement timeline of approximately mid-April, depending on weather and the conditions of the river.
FINANCIAL IMPACT:
The City budgets for this annual maintenance activity in the annual operating budget for Wastewater Treatment (Department 6600, Fund 550). There is currently $115,000 budgeted for this project, which would cover the cost of the project unless unforeseen change orders are required.
Staff recommends that Council authorize the City Manager to enter into a contract with Wendt Construction in the amount of $110,115, and establish contingency funds as noted above for a total contract not to exceed amount of $114,000.
RECOMMENDED COUNCIL ACTION:
1. Receive staff presentation and review Council questions with staff
2. Open Public Comment
3. Close Public Comment
4. Motion to award the contract to Wendt Construction for $110,115 and establish a maximum contract amount of $114,000, and authorize City Manager to execute the contract and other related documents. Voice vote.

SUBJECT: Revise Measure E Committee Bylaws - Meeting Date Schedule, Resolution 2024-07
STAFF RECOMMENDATION:
Adopt Resolution 2024-07; Establishing the Duties, Responsibilities, and Terms of the Measure “E” Independent Community Oversight Committee, including an amended meeting schedule.
EXECUTIVE SUMMARY
On March 20, 2017, the City Council adopted a resolution outlining the duties and responsibilities of the Measure E Committee, commonly known as the Measure E Committee Bylaws, and provided direction to staff as to the contents of the resolution.
At the Measure E meeting on March 19, 2024, the committee discussed and recommended staff make the following changes to the regular meeting dates of the committee moving forward:
- Eliminate the regular meeting scheduled for the third Tuesday in December.
The City has cancelled this meeting the last two years primarily due to the difficulty in getting a quorum with the proximity to Christmas. Additionally, with the Measure E committee having a regular meeting scheduled for January it is feasible for the City to combine the information and material from the December meeting into the January meeting without overloading the meeting agenda.

SUBJECT: Amend the City’s Annual Fee Schedule for Fiscal Year 2023-24 to Provide for Amended Fees in the Parks & Recreation and River Lodge Departments; Resolution 2024-08
STAFF RECOMMENDATION:
Adopt Resolution 2024-08, amending the City’s annual fee schedule for fiscal year 2023-2024 to provide for amended fees in the Parks & Recreation and River Lodge departments EXECUTIVE SUMMARY:
The Parks & Recreation Department, to enhance the full-day summer camps and create a new half-day summer camp, is proposing fee modifications before the summer camps starting in June. These changes will primarily affect the next fiscal year, but to advertise appropriately and provide a uniform fee throughout the summer program, staff are bringing forward these changes at this time.
The changes include combining the Summer Fun and Kiddie Kamp programs into one full-day camp fee, which will increase the Summer Fun weekly rate by $10 while lowering the Kiddie Kamp fee by $10 per week. We also propose to eliminate the payment plan option and reduce the full rate paid in advance to a 10% discount (previously it was over 20%).
The second major change is the creation of a half-day camp and setting of a new $ 80-a-week fee for that program. Both the full-day and half-day camps will also now have a non-resident rate charge of $10.
The final change to the Parks & Recreation fee schedule is to create a leader-in-training program with a weekly charge for those young teens looking to gain valuable training, real-life work experience, and leadership skills during the summer camps.
The River Lodge is proposing the creation of a new fee to capture the Fortuna Parks & Rec Playgroup that First 5 sponsors and would utilize the storage and main facility area two days a week. Staff is proposing a monthly charge of $400 to account for the use of the main facility and the associated loss of available rental slots.
Business Item 5d
For additional detail, we have attached Resolution 2024-xx with Exhibit “A” as well as a PDF of the Parks & Recreation and River Lodge Fee Schedule showing a column for proposed rate changes.
FISCAL IMPACT:
Fiscal Year 2023-24 Parks & Rec revenues will be higher than originally budgeted for by an estimated $2-3k. The impact these fee changes have on Fiscal Year 2024-25 will be included and presented as part of the budget process currently in process.
