STAFF REPORT
City Council Discussion Item
DATE: May 6, 2024
TO: Honorable Mayor and Council Members
FROM: Brendan Byrd, Public Works Director/City Engineer Aaron Felmlee, Finance Director
THROUGH: Merritt Perry, City Manager
SUBJECT: Updated Draft Proposed Water and Wastewater 5-year Rate Adjustments STAFF RECOMMENDATION:

Receive updated draft recommended water and wastewater 5-year rate adjustments and seek council direction prior to beginning Proposition 218 noticing.

EXECUTIVE SUMMARY:

At the April 15th regular City Council meeting staff presented a draft approach to adjusting water and wastewater user rates over the next five years, beginning July 1, 2024. The initial approach was developed focusing on larger initial year increases, largely to play ‘catch up’ due to the lack of rate adjustments over the past 13 years, with smaller inflationary-level adjustments in the later years.

Among other criteria, the approach focused on maintaining $3- and $5-million dollars in the water and wastewater capital reserve funds, funds that could be used for unforeseen capital improvement needs over the planning timeline. The rate increase percentages presented at the April 15th meeting are shown in the Table below.

Table 1. Proposed rate increases presented at April 15th Council meeting.

Year % Water Increase % Sewer Increase
FY 24-25 60% 40%
FY 25-26 5% 25%
FY 26-27 5% 10%
FY 27-28 3% 3%
FY 28-29 3% 3%
After much discussion on the rates and the financial model assumptions, the Council directed staff to review the proposed rate adjustments and determine if a rate adjustment approach could be developed that distributed the cost increases more evenly over the five year planning timeline.

Based on that direction, the resulting modified proposed rate increase percentages are shown in the Table below.

Discussion Item 3a

Page 2 of 4 ends

Table 2. Updated proposed rate increases.

Year % Water Increase % Sewer Increase
FY 24-25 20% 30%
FY 25-26 20% 22.5%
FY 26-27 20% 22.5%
FY 27-28 15% 10%
FY 28-29 5% 4%
As shown above, while not fully evenly distributed throughout the years, staff were able to spread the cost somewhat evenly through years 1-4. In the fifth year, planned projects have been completed or financed and the capital reserve targets are being met, so there is not a projected need or reason to spread the increases into year 5. To achieve the increases as shown above, staff made the following adjustments to the financial model:

1. Reduce the capital reserve target in water and wastewater from $3- and $5-million to $2- and $4-million, respectively;

2. Defer larger water system capital improvements projects by one year, including the 12th Street, Downtown, and Drake Hill water main replacement projects;

3. Defer the CCF Electrical and Meadow Lane water main replacement projects by two years.

It should be noted that the only mechanism that could be used at this point to further spread out the cost increases would be to further reduce the capital reserve fund target amounts, to remove projects from the City’s Capital Improvement Program (or further delay projects), or to debt-finance more projects. At this time, staff does not recommend any of these approaches.

Shown below are Figures 1 and 2, which depict current-year average and minimum monthly water and wastewater rates, in addition to the rates resulting from the proposed increases in Table 2.

Figure 2. Average and minimum project monthly wastewater bills.

Table 3 below shows the average total user bill in the current year, and over the next 5 years of the proposed adjustments. Overall, as per the Council’s direction the annual increases are uniform, and continue further into the planning period.

Table 3. Updated average monthly user bills for water and wastewater.

Year Average Water Bill Average Wastewater

Average Total Bill
Current $28.74 $47.36 $76.10
FY 24-25 $34.49 $61.57 $96.06
FY 25-26 $41.39 $75.42 $116.81
FY 26-27 $49.66 $92.39 $142.05
FY 27-28 $57.11 $101.63 $158.74
FY 28-29 $59.97 $105.69 $166.66
The other item that staff received direction from the Council on were the proposed increases to the water and wastewater capital connection fees. As presented at the April 15th meeting, staff proposed to adjust both the water and wastewater capital connection fees by the cumulative California Construction Cost Index since 2012, which would have been a 70% increase to connection fees.

Staff also proposed to update the Living Unit Equivalent (LUE) values used by the City in the past, to better align with current American Waterworks Association (AWWA) standards. With the updated direction from Council, staff are now proposing to take the proposed total increase for each connection, and evenly phase in the increase annually over the five-year planning period. Tables 4 and 5 below shows the updated proposed connection fees.

With this updated analysis, staff are seeking concurrence or further comments from the Council on how to move forward. If the Council concurs with the updated approach, staff would proceed to have Jacobs update and finalize the Rate Study, and produce the informational mailers that will be sent to residents and property owners as per the prop 218 process. With concurrence from the Council, staff believes that the mailers could be issued by mid-May, and staff could conduct the 218 hearing on July 1st. Should the Council have further comment requiring revisions to the proposed rate adjustments, the prop 218 hearing process would be further delayed into the coming fiscal year.

RECOMMENDED COUNCIL ACTION:

1. Receive staff presentation and review Council questions with staff

2. Open Public Comment

3. Close Public Comment

4. Provide direction to staff to finalize the Water and Wastewater rate study with updated rate increase structure and perform the prop 218 process

b. Presentation of Draft Proposed Water and Wastewater 5-year Rate Adjustments (Encl.) Minutes:

Public Works Director Brendan Byrd and Kurt Playstead with Jacobs Engineering, provided a presentation on the proposed Water and Wastewater 5-year rate adjustments.

PUBLIC COMMENTS: Sue Long - Fortuna Business Owner - Thought the proposed water rate increase could not come at a worse time based on the current economy. She commented on the proposed cost increase from three quarter inch water line to one inch was a very large increase and maybe the council could consider an increase over five years, instead of all at once. She included that add all of the costs at one time just makes things harder. She provided the example of a seven person family currently paying $234, and stated if a family has to pay more for sewer, they will spend less money non-essential goods which will have a negative impact on local businesses. Abigail (?) - Fortuna Resident - Explained she had just moved here and she was shocked at the water/sewer rates. She expressed interest in the calculation of rates v. winter rates in regards to average consumption and was trying to understand necessary costs associated with water. She did not think the increase to rates would be easy and that she was renting so she has little control over where her water comes from. Michelle Bushnell - Humboldt County 2nd District Supervisor- Commented on PG&E rates increasing and that the County will have another tax measure on the upcoming ballot. She also explained that connection fees for water/sewer could not be included in construction loans. She also urged the Council to consider spreading the proposed increase over a five year period and that it would be better due to all of the other increases. Brian ($) - Fortuna Resident - Explained this was his first time speaking at a Council meeting, but he has been watching national events closely over the past five years. He felt that such a significant increase right now would be devastating.

He said everyone has to pay, but everything all at once will crush people. He urged the Council to take time to consider small increments.
c. Initial Review of Proposed Ordinance and Resolution Seeking Consolidation (Encl.) Minutes:

City Attorney Ryan Plotz and City Manager Merritt Perry provided a presentation on the proposed Ordinance and Resolution seeking Consolidation for a Tax Measure to be put on the November 2024 ballot.

PUBLIC COMMENT: Sue Long - Fortuna Business Owner - Commented o being in unchartered territory when beginning discussions regarding including funding for the fire department from city tax revenues. She stated it wouldn't be enough for new equipment or fire truck. She cautioned the Council about co-mingling funds.

There being no additional public comment, Mayor Trent closed the public comments. d. Police Department Plaque
Minutes:

City Manager Merritt Perry provided information regarding the potential Police Department Plaque.

PUBLIC COMMENT: Sue Long - Fortuna Business Owner - Expressed concern over the current City Council members excluding the names of previous City Council Members from the new Police facility plaque, when those previous members played an important role in the decision making process, which progressed the new Police Department facility to where it is today.

STAFF REPORT
City Council Business Agenda Item
DATE: May 6, 2024
TO: Honorable Mayor and Council Members
FROM: Mat Nyberg, Public Works Project Manager
THROUGH: Merritt Perry, City Manager
SUBJECT: Authorize the City Manager to Award a Construction Contract for the ‘P’ Street Sewer Replacement Project (CIP 9121) to Mercer Fraser Company and establish a maximum contract amount of $135,000
STAFF RECOMMENDATION:

Authorize the City Manager to award the ‘P’ Street Sewer Replacement Project (CIP 9121) to Mercer Fraser and establish a maximum contract amount of $135,000.

EXECUTIVE SUMMARY:

In some areas of the City, namely in the vicinity of downtown, wastewater collection pipes are old and some have begun to fail. Many of the old lines were constructed from clay pipe which was assembled in three-foot sections sealed with cord material pushed into each joint. Over time the cord material has deteriorated resulting in significant inflow from ground water and in some cases like ‘P’ Street, roots from vegetation. City utility crews have been deployed several times over the past few years for stoppages at this location as a result. The ‘P’ Street Sewer Replacement Project is part of a program that the City has undertaken to inspect and assess its wastewater collection system to identify failing components for repair. This program is ongoing and is a resultant of an agreement entered into by the City and California River Watch in lieu of a law suit initiated by them in 2016, and since that time the City has been regularly video inspecting sanitary sewer lines to find defective assets. The replacement of this section of mainline and the four associated private laterals within the right of way will eliminate groundwater inflow in this section of mainline and provide better function and maintenance access for utility crews via lateral cleanouts.

The ‘P’ Street Sewer Replacement Project bid package was released and publically advertised on March 22
th, 2024. The bid period ended on April 19th, 2024, at which time the City received four responsive bids. The bid totals are shown in the table below:

Business Item 6a

Page 2 of 3 ends

Name of Contractor Base Bid Amount
Mercer Fraser $115,000.00
Mobley Construction $118,500.00
Kelco Construction $119,603.00
GR Sundberg $470,106.00
The apparent low bid was submitted by Mercer Fraser Company with a total bid price of $115,000 which is within the total established City construction budget of $150,000. The Engineers Bid Estimate for the total project was approximately $120,000.

City staff have confirmed that the bid received from Mercer Fraser Company was fully responsive and that they have active licenses and registrations. Staff recommend awarding the contract to Mercer Fraser Company.

If the project is awarded, staff anticipate being under contract in May. Mobilization and construction is anticipated to take approximately one-week, and is scheduled to be completed by September 2024. The draft Notice of Potential Award is included as Attachment A.

FINANCIAL IMPACT:

This project is funded by wastewater Capital Reserve Funds. See the table below for a breakdown of project funding.

Funding Source Sewer Capital
Reserve Funds
City Fund Number 560
Funding Amount $150,000
As shown above, the total available funding for the project is $150,000. Staff propose to award the project to Mercer Fraser Company and enter into a contract for $115,000 (the bid total), and to establish a maximum contract amount of $135,000. The $20,000 difference between the bid total and the maximum contract amount would be reserved as a construction contingency to cover any unforeseen costs that arise during the project. The contingency would be approximately 17% of the total project value, which is a bit higher than typical due to potential challenges or unknowns that tend to arise when constructing underground utilities. This amount is well within the fiscal year allocation for this project.

SUBJECT: Authorize Renaming Newburg Park Field 1 in Honor of Odell Shelton, including a Memorial Plaque
STAFF RECOMMENDATION:

Approve renaming Newburg Park Field 1 in honor of Odell Shelton for his lifelong dedication, contributions and commitment to baseball in the Fortuna community. Direct staff to work with the Parks and Recreation Commission to design and implement memorial plaque, ribbon cutting and dedication ceremony.

EXECUTIVE SUMMARY:

At the April 8, 2024 Parks and Recreation Commission meeting, commissioners received letters and testimonials from community members regarding Odell Shelton’s lifelong dedication, passion and commitment to Fortuna baseball. The commission voted unanimously to recommend renaming Newburg Park Field 1 to Odell Shelton, Jr. Memorial Field.

Once the sign is designed, a ribbon cutting and dedication ceremony at a future date would be determined so that family, friends, community members, Parks and Recreation Commissioners, City Council, and staff may be present for the dedication.

FINANCIAL IMPACT:

The cost to memorialize the renaming of Newburg Park Field 1 will be determined following City Council approval. The American Legion has volunteered to assist with plaque expenses.

STAFF REPORT
City Council Business Item
DATE: May 6, 2024
TO: Honorable Mayor and Council Members
FROM: Brendan Byrd, Public Works Director/City Engineer THROUGH: Merritt Perry, City Manager
SUBJECT: Approve a Supplemental Budget Request for a new Caterpillar Loader for $220,000
STAFF RECOMMENDATION:

Approve a Supplemental Budget Request of $220,000 for a new Caterpillar Loader at the Wastewater Treatment Plant.

EXECUTIVE SUMMARY:

The City of Fortuna operates a wastewater treatment plant (WWTP) located at 180 Dinsmore Drive in Fortuna. At the WWTP, the City uses a Caterpillar loader as the primary piece of equipment in the City’s composting operation, which is how the City manages and ultimately disposes of the solids separated from the wastewater stream. The loader is a critical piece of equipment, and is used daily to turn, transport and process compost piles.

Due to the heavy daily usage, the existing loader was near the end of its serviceable life, and as such over the past year staff have begun to plan for its replacement. The current loader is a model year 2008, and in recent years has had a number of issues requiring expensive repairs and regular down time. Initially, staff planned to include the cost of the loader in the upcoming fiscal year budget (FY 24-25), however, in the last week of April, the loader experienced a significant failure during normal operations. After an assessment of the damage, and given the issues the loader has had beforehand, staff have deemed it necessary to advance the procurement timeline and purchase the new loader this fiscal year, which is the purpose of this supplemental budget request (SBR).

Fortunately, as this was a previously planned expenditure for the upcoming fiscal year staff had already been in conversations with Caterpillar (CAT) about a suitable replacement, and already had the quote on-hand. With the change in timeline, CAT was able to find an available loader in Oregon that, with budgetary approval from the Council, could be shipped immediately. The quote provided by CAT included as Attachment B, with a total delivered cost of approximately $215,000. The quote includes the Sourcewell government pricing, which is a contracted bid with the State and offers the lowest pricing available to local agencies for such purchases. Purchases of this magnitude are permissible by the City’s procurement policy pursuant to Section 2.50.070 (C) of the Municipal Code. Staff recommend that the Council authorize the additional budget, which would allow staff to immediately move out with replacing this key piece of equipment.

Business Item 6c

Page 2 of 2 ends

FINANCIAL IMPACT:

The loader would be purchased as a capital outlay item and paid for from Fund 550 (wastewater operating reserve). As noted above, the delivered cost of the loader is quoted at approximately $215,000, and staff are requesting a total budget request amount of $220,000. The additional cost requested in the SBR would provide staff some flexibility to outfit the loader with minor equipment needs specific to the City. The current balance of the wastewater reserve fund is approximately $11 million. The SBR is included as Attachment A.

Staff would like to note that cost recovery of the loader has already been factored into the City’s current proposal for water and wastewater rate increases, and therefore although this purchase would result in the reserve balance temporarily deceasing, the cost of the loader will be recovered through rates in the coming years if the rate adjustments as proposed are approved.

RECOMMENDED COUNCIL ACTION:

1. Receive staff presentation and review Council questions with staff

2. Open Public Comment

3. Close Public Comment

4. Motion to Approve a Supplemental Budget Request for $220,000 for a new Caterpillar Loader. Voice vote.
