Notices Posted (Public Hearing, Agenda, Ordinance, etc.) 7 On April 25th, Clerk staff participated in the City Clerk’s Association of California’s (CCAC) Regional Committee meeting. The purpose of the meeting was to discuss the regional mapping.
The current regions were created by using the same map Cal Cities uses. The concern is that there are 16 regions, but not all regions have the same level of participation by clerks. The discussion involved potentially redistricting and expanding the number of representatives from one to two clerks for each region. Regional representation is in place to provide a liaison between the CCAC Board of Directors and the regions and for each region to organize and communicate networking opportunities and educational sessions. This level of networking and professional development benefits all participants and their agencies.
The City is preparing candidate information for the upcoming November election. There are two (2) Fortuna City Council Seats open. If you are interested in running for office or would like more information about the general election or candidate information, please visit the City’s website www.friendlyfortuna.com, send e-mail to the Deputy City Clerk at [email protected], or call 707-725-7600.

This has become a vital strategy for the City to maintain and upgrade aging equipment and continue to offer the services to the community that they have become accustomed to. Most recently the Body Worn Camera grant was submitted for reimbursement with the Department of Agriculture which would provide $50,000 for the necessary upgrade of equipment within the Police Department.
Staff have also completed the annual registration for the City to be active within the U.S. federal government’s System for Award Management (SAM.gov). Registration through this system is the only way the City is able to obtain federally funded grants.
Measure E Update:
The Measure E committee’s next regularly scheduled meeting is set for September 17, 2024 at 5:30pm. The primary purpose of this meeting will be for Staff to review with the Committee the list of Measure E funded projects that were included in the Council Adopted Budget for fiscal year 2024-25.

Classes, Rentals and Sports
For the month of April, the Pavilion was rented on a weekly basis for skate parties. It also gets used regularly for Pickleball from 9-12 on Mondays, Wednesday, and Fridays. Pickleball is a $3 drop-in program that is open to anyone 18 and up. Results Fit Camp also holds classes in the Pavilion four times a week on Tuesdays and Thursdays. The Rohner Recreation Hall was utilized for several user group meetings, as well as, AARP tax help for seniors. We also used the Rec Hall for our Spring Break Camp and it was rented five times in April for non-regular private events.
The Adult Basketball League finished off the last of its games towards the end of April. This 2024 season we had 224 adults that participated. We received a lot of good feedback from this season, and are already excited for the 2025 season when it gets here! Recreation Programs
The Fortuna Parks and Recreation Playgroup, in partnership with First 5 Humboldt, was held on Thursdays and Fridays from 10-12pm at the Monday Club. The program is available for ages 0-5 and their caregivers to attend to socialize, receive support, and to be involved with the community.
We had been working very hard to transition our Playgroup from the Firemen’s Pavilion to the Monday Club. For the month of April, we held eight playgroups, we had a total attendance of 146. 79 of those being children from ages 0-5. Being held in the Firemen’s Pavilion is our Drop-in volleyball program. Throughout April we held 4 drop-in volleyball nights with a total attendance of 32 participants. We are looking to start our Drop-in basketball program up again soon now that the adult league season has concluded. During the month of April, we hosted our Spring Break camp from April 15th- 18th, that served 147 children from ages 5-12. We averaged about 29 campers per day, and employed six of our part-time staff members working throughout the week of camp. The camp was focused around Earth Day, so our arts and crafts, cooking projects, and other activities, stuck to that theme. The weather was great too, so when the campers were not skating in the rink we had them outside playing on the playground, in the field or basketball court playing games, or on a hike! We finished the week with water balloon fun which cooled everyone down, but kept the excitement for hot Summer FUN on all our minds.
Roller Skating
The Fortuna Skating Rink offered Public Skate on Fridays, Saturdays and Sundays all through April with a total of 12 Public Skate Events. Of those 12 events we had a total attendance of 578 public served. The Fortuna Skating Rink also hosts Private Skate Parties, mainly taking place on Fridays through Sundays, but we have been hosting a lot of school field trips now that it’s getting towards the end of the school year. In April we hosted 19 Private Skate parties serving 438 community members.

Public Works Director/City Engineer
Police Facility Remodel Project
The construction contract with Sequoia is substantially completed, and the only remaining items of work are those on the punchlist. The City and contractor are working through those items as quickly as possible, and hope to have all items completed by the end of May. The final major item of the construction contract that was completed last month were the automatic gates to the secured parking facility, and the installation of the PV solar panel system on the roof facing Rohnerville Road. The City is still awaiting permission to operate (PTO) of the solar panel system by PG&E.
Over the past month, the primary effort at the facility has been outside of the construction contract.
In April, Silke Communications mobilized to the site, installed the antennas on the radio tower, and installed the interior radio infrastructure on the dispatch desks and in the server room. The City’s IT consultant, Nylex, has installed all exterior security cameras, and completed a significant portion of the wiring for the main server system. AT&T’s 911 system technician has also been a regular, getting the wiring and infrastructure set up in preparation for the dispatch move later in June. Overall, staff anticipate that by mid-June, all contractors will complete most of the facility work, and the last few weeks of June will be preparing for and performing the final dispatch/server room transfer and the phone system transfer.
Water and Wastewater Rate Study
Since the regular Council Meeting on May 6th, staff have been working to finalize the rate study mailers and to complete the information webpage on the City’s website. The website will have the rate study, the mailers, and the frequently asked question (FAQ) material for the public to review.
Currently, staff are anticipating that the mailers will go out to the public on May 17th, and that the Prop 218 hearing for the proposed rates will take place on July 1st. There is a chance that the mailers could be delayed a few days given limitations and changes at the publishing company, in which case staff would likely move the 218 hearing to the second meeting in July (the 15th).
CDBG Barrier Removal Project
Over the past month staff have been working with RAO construction to get under contract for the CDBG barrier removal project, which will make various ADA improvements to the pedestrian Consent Item 4i
facilities along N Street. Staff and our engineering consultants are currently preparing for a preconstruction meeting on May 16th, and staff are currently anticipating the contractor will mobilize to the site in late May or early June. During the past month, staff have also been coordinating with utility companies (PG&E, AT&T, and Optimum), HTA, and the affected public on various items of coordination or notification.
Mill Creek Habitat Connectivity Project
Over the past month the City’s engineering consultant has continued with performing various field surveys and studies to support the engineering design process for the four crossings along Mill Creek associated with the project. During the field surveys, a fifth crossing was found on private property, which was also determined to be a fish barrier. Recognizing the importance of addressing all barriers, given that full connectivity is what will make future grant applications for construction more competitive, staff immediately began identifying resources to fund the analysis and design of a fifth crossing (previously unbudgeted).
Fortunately, the City’s current funder, the Wildlife Conservation Board (WCB), approved a funding augmentation for the project of $107,000, which will cover the additional work associated with the new crossing. Staff are working with the WCB currently on the grant agreement amendment, and staff anticipated brining a contract change order with GHD to the first meeting in June to add the additional funds to their professional services contract with the City.
Water Leak on Fortuna Boulevard
Early in the morning on May 10th City public works staff responded to a reported water leak on South Fortuna Boulevard, just north of Redwood Way. Working through the morning to identify the issue, it was found to be a break on the City’s main 12-inch transmission line which pumps water from the City’s wells on Eel River Drive, to Stewart Street tank north of Main Street.
Unfortunately, this section of main line has a number of un-valved interconnection, or interconnections with ‘leaky’ valves (valves that operate but not to full-closure), and therefore getting a sufficient water shutoff to address the problem was difficult. Eventually, it required that staff move outwards into the system to Newburg Road in the north, Strongs Creek Plaza in the south, Springville Avenue in the east, and 12th Street in the west. By the end of the day the leak was contained and water service was restored. Given the emergency nature of the break in the line, and the need to contain, staff was not able to provide the usual notifications to customers and businesses regarding the shutoff.
Unfortunately, when staff visited the site on Saturday to inspect the repair, it was found to be leaking. As such, staff conducted a similar system shutdown and completed a second repair. After further reviewing the issue, staff have determined that a more comprehensive repair will be necessary to ensure the long term efficacy of that section of pipe. To that end, staff have engaged Mercer Fraser and have planned another shutdown from 2 – 9 pm on May 15th to address the issue.
As this will be a planned shutoff, staff were able to provide notices to all businesses anticipated to be affected, and issued press releases on City social media pages. Staff can provide further information on this item on the day of the Council Meeting.

The utilities team installed two new services in the month of April. In the month of April the utilities team changed out 16 dead water meters. Continued to check service lines for lead, we are 95% completed with that effort which has a regulatory compliance completion date in October.
Replaced six bad angle valves.
The utilities team did several unsuccessful attempts at shutting down the 12’’ fire line running into the Mill Site lot from the Boulevard for a contractor. During the emergency water shutoffs noted in the Public Works Director report above, staff believe we have identified the way to shut the line off, and the contractor is tentatively planning on performing the service interconnection on May 21st.

Staff removed secondary clarifier 4 from service due to summer flows and scheduled service and inspection.
Staff pumped out the percolation ponds, which filled in over the winter with rainfall and river-flow. This important task will enable the contractor to rehabilitate the ponds in early May—an annual requirement before staff can divert the effluent to the ponds. The Water Boards stipulate that effluent cease flowing to Strong’s Creek (and thus into the percolation ponds) by May 15th each year. The project was completed on May 10th, and staff switched the discharge to the ponds on May 14th.
Staff performed maintenance on the polymer feed system: replaced mixer motor, impeller seal, all hose and two valves.
Staff replaced belts on headwork’s biofilter fan, replaced oil in aeration basin blower, and performed routine maintenance on chemical analyzers at effluent.

EXECUTIVE SUMMARY:
The River Lodge and Monday Club held a total of 35 events in the month of April.
There were two Chamber luncheons held at the Monday Club, three baby showers and one memorial. April was the beginning of the First 5 Playgroup at the Monday Club. The playgroup will take place on Thursday and Friday of each week.
CalFire held a two-day training at River Lodge for unit chiefs in the Northern California and Southern Oregon areas. CalFire is so appreciative of the space here at River Lodge. The event even made the evening news. There was a vendor present who had a drone that was capable of dropping dragon eggs, or fire balls into an area, to start back fires. CC Catering catered a dinner on the first day of the training.
Fortuna Sunrise Rotary held their annual Rotary Dinner and Auction with 280 attendees. Our community was very generous with donations this year, making the event extremely successful.
The group has already set aside a date for next year.
The Buckeye Conservancy held their annual fundraiser event. This also serves as a meeting for their new members. They had a good turnout with 200 attendees. The Buckeye was formed in 2000 by a group of landowners. The group has a goal to promote good stewardship of working lands while raising awareness of the pressures forcing families off the land. With an open and inclusive approach, The Buckeye seeks common sense solutions that will strengthen the economic and ecological sustainability of working landscapes.

For many years, River Lodge has been the location for the Fortuna High School prom. The students always have an incredible time and this year was no different.
Sally Frey is one of three women who do quilting retreats here at River Lodge. Two out of three quilters have done them annually and we are looking forward to a new quilter having her retreat in May. The quilting retreats are 3 days of sewing, food and fun. There is even a fabric shop, Stitch from Ferndale, who sets up fabric and sewing notions for sale, on the stage area. There is always a good turnout, anywhere from 40-60 women come and enjoy themselves at the River Lodge.
Massages are available to quilters while they are here.
Soroptimists International of the Eel River Valley, or SIERV, held their annual Tea Party and Fashion Show at River Lodge. SIERV contributes to awards and scholarships for women and girls. The goal is to provide access to education and training that women need to achieve economic empowerment. (pictured below)
Fortuna Union High School held the third annual Bridging Connections Career Day. This gives students a chance to participate in a mock job interview with local business owners and county employees. The students then receive feedback on how they performed.
The FUHS Safer and Sober committee held a dinner and auction at River Lodge. Proceeds go towards an after graduation party at the Bear River Recreation Center.
Kathi Wingo of Humboldt Travelers was back at River Lodge. Kathi holds three meetings a year at River Lodge, showcasing travel packages all over the world for people who are interested.

STAFF REPORT
City Council Business Item
DATE: May 20, 2024
TO: Honorable Mayor and City Council Members
FROM: Merritt Perry, City Manager
SUBJECT: Transactions and Use Tax Measure, Resolution 2024-11 STAFF RECOMMENDATION:
Staff recommends that the Council:
1. Receive a report from staff regarding a proposed ballot measure to increase the existing transactions and use tax within the City from 0.75% to 1.5% to continue funding essential services
2. Take public comment
3. Council discussion
4. Introduce, on first reading by title only, and submit to the voters Ordinance No. 769, an Ordinance of the City of Fortuna to increase the existing City of Fortuna transactions and use tax to be administered by the California Department of Tax and Fee Administration, subject to approval of a majority of the electors voting on the tax measure at the general municipal election to be held on Tuesday, November 5, 2024 (Two-thirds vote required)
5. Adopt Resolution No.2024-11, which:
a. Submits Ordinance No. 769 to the qualified voters at the November 5, 2024 general municipal election;
b. Requests the election on the ordinance be consolidated with the Statewide General Election;
c. Sets dates for submission of arguments for and against the proposed tax measure; d. Sets dates for submission of rebuttal arguments;
e. Authorizes the Mayor to submit a written argument in favor of the measure on behalf of the Council;
f. Requests the City Attorney prepare an impartial analysis of the measure; and g. Agrees to reimburse the County for the costs of conducting the election on the measure.
EXECUTIVE SUMMARY:
In November 2016, a majority of voters approved a local 0.75 percent transactions and use tax (Measure E) with the intention of funding previous cuts to public safety and to help maintain and enhance public safety services, support local businesses, provide essential services, and stabilize the City budget. The tax was originally set to expire on March 31, 2025; however, in November 2020, a majority of voters approved an extension of the tax through March 31, 2033.
Business Item 5a
Measure E revenues are essential for the City to maintain and continue to improve certain essential City services and to maintain a balanced budget. However, as discussed in more detail below, the City has experienced a significant increase in the cost of providing essential services since 2016 and additional funds are necessary to meet current and projected costs.
Over the long term, costs to provide services that depend on the general fund including police, general services, and parks and recreation will continue to increase and ultimately require nearly all of the funding generated by Measure E. In Fiscal Year 2022/2023, the amount of funding in excess of that needed by the departments normal operation that could be used for special projects was at a high of $785,000. With the escalation of costs for items such as health care, fuel, wages, equipment and materials increasing over 9% in one year, the amount available for special projects has diminished to $375,000, a decrease of over $400,000 in just two years. Additionally, the City’s compensation of employees generally runs lower than other Humboldt County Cities and the County and this makes it difficult for the City to recruit and retain quality employees. For example, Eureka and Arcata offer a $50,000 hiring bonus for lateral transfers for police and offer higher paying salaries (in excess of 10%). Those cities continue to increase its salaries above what the City of Fortuna can offer. Eureka has a 1.5% transaction and use tax compared to the City of Fortuna’s 0.75% and a higher proportion of retail sales that puts Fortuna at a disadvantage.
At a study session held on April 1, 2024, the City Council expressed its desire to amend Chapter 3.13 of the Fortuna Municipal Code to increase the current rate of the tax from 0.75% to 1.5%.
At the regular meeting held on April 15, 2024, the Council reviewed the proposed ordinance and resolution.
At a special meeting held on May 2, 2024, the Council reviewed and provided direction to staff as to the ballot title and question. The draft resolution incorporates the Council’s revisions, as follows:
Essential Services Supplemental Funding Measure
To improve and maintain essential services, including police services; nuisance abatement; streets, sidewalks, and drainage; park improvement; and programs for youth and seniors; shall the measure to increase the existing transactions and use tax from 0.75% to 1.5% through March 31, 2033 (unless sooner repealed), providing an additional $1.8 million in annual revenue, requiring an independent audit, and community oversight by the Measure E Committee, with all funds remaining in Fortuna, be adopted?
Yes
No
Included with this Staff Report are two attachments:
Attachment A is the final proposed ordinance that, among other things:
o Authorizes an increase of the existing transaction and use tax from 0.75% up to and including 1.5%;
o Maintains all other provisions of the existing transaction and use tax, including maintaining the March 31, 2033, expiration date; maintaining the independent audit requirement; maintaining the oversight committee; and maintaining the rights of the voters or future City Councils to repeal the measure. Attachment B is the final proposed resolution that, among other things:
o Submits the ordinance (Attachment A) to the qualified voters at the November 5, 2024, general municipal election;
Business Item 5a
o Requests the election on the ordinance be consolidated with the Statewide General Election;
o Designates the ballot title and question;
o Sets dates for submission of arguments for and against the proposed tax measure;
o Sets dates for submission of rebuttal arguments;
o Authorizes the Mayor to submit a written argument in favor of the measure on behalf of the Council;
o Requests the City Attorney prepare an impartial analysis of the measure; and o Agrees to reimburse the County for the costs of conducting the election on the measure.
Increasing the City’s transaction and use tax will allow the City to continue to have more competitive salaries and fund special programs beyond normal operation. Should the city choose, they could also identify other public safety priorities for funding such as fire protection services. Not pursuing additional tax revenue will make it harder for the City to recruit and retain employees and limit the ability to do special projects. It is important to note, that while the sales tax would be administered by the California Department of Tax And Fee Administration (“CDTFA”), the revenues are earmarked exclusively for use by and within the City – the State would not be able to take or borrow these funds.
If the increase is approved by voters, a 1.5% local sales tax would provide approximately $3,690,000 for essential City services.
FISCAL IMPACT:
Without an increase of 0.75-cents to the existing 0.75-cent transaction and use tax, over time, the City would return continue to lose the ability to fund all but the necessary projects and would struggle to retain staff by paying competitive salaries. If the tax is not increased in 2024 then the City would look to work toward balancing future budgets by reducing services and staffing. In addition, the following essential services would be at risk for elimination or reduction:
Capital Improvement Projects (CIP) that are scheduled for the repair and/or replacement of deteriorated City infrastructure will continue to be postponed and/or cancelled Funding and Staff time in support of local events such as the Fortuna Rodeo and AutoXpo will be reduced or eliminated
Fewer maintenance projects for city streets
Fewer repair projects for city drainage facilities
Fewer expansion or improvement of city parks
RECOMMENDED COUNCIL ACTION:
1. Receive a report from staff regarding a proposed ballot measure
2. Take public comment
3. Council discussion
4. Move to introduce, on first reading by title only, and submit to the voters Ordinance No. 769 (Two-thirds vote required)
5. By way of a separate motion, move to adopt Resolution No.2024-11 Business Item 5a

The transactions and use tax enacted by this Ordinance is a general tax that can be used for any legitimate governmental purpose; it is not a commitment to any particular action. As such, under CEQA Guidelines section 15378(b)(4), the tax is not a project within the meaning of CEQA because it creates a government funding mechanism that does not involve any commitment to any specific project that may result in a potentially significant physical impact on the DRAFT
environment. If revenue from the tax were used for a purpose that would have either such effect, the city would undertake the required CEQA review for that particular project. Therefore, pursuant to CEQA Guidelines section 15060 CEQA analysis is not required.

If revenue from the tax were used for a purpose that would have either such effect, the city would undertake the required CEQA review for that particular project. Therefore, pursuant to CEQA Guidelines section 15060 CEQA analysis is not required.
NOW, THEREFORE, BE IT FURTHER RESOLVED the City Clerk is hereby directed to file a certified copy of this resolution with the Board of Supervisors and the Humboldt County Registrar of Voters.

BUDGET SUMMARY:
The FBID Advisory Committee reviewed and recommended that the council accept the annual report and budget for FBID on March 26, 2024. The proposed budget for the next fiscal year will be approved with the City’s annual budget. The total expenditures for Fiscal Year 2023-2024 was $47,871. The FBID assessment generated approximately $65,000 and the City Council budgeted a contribution of $50,000 to so the total revenue generated was $115,000. The total surplus for Fiscal Year 2023-2024 was 67,726. The unused funds ($50,000) designated by the City for FBID will be returned to the City’s General Fund. The proceeds from the FBID assessment in the amount of $17,726 will be retained in the FBID fund dedicated for FBID purposes.
LEVY OF ASSESSMENT
The FBID Advisory Committee met on April 17th and April 23rd where the committee considered multiple options for how the assessment should be renewed for Fiscal Year 2024-2025. Going to a simplified assessment model with a flat rate fee would be desired by the City to simplify the business license process. Currently the assessment structure is complicated geographically based, and revenue based, forcing businesses to apply for their business licenses in person. Many businesses complain about the FBID fee and likely underreport gross revenue to avoid paying FBID fees.
Business Item 5b
A majority of businesses do not perceive the benefit for the assessment BID and many businesses express their displeasure when obtaining business licenses. The Downtown Merchants use their assessment to pay for fees and other expenses for their events, but generally don’t appreciate the efforts of the BID to host other events downtown. Generally, many of the activities/events of the BID were challenging to put on and may not have provided a benefit valued by those assessed.
Some events, such as the Al Gray lighted parade, that are appreciated by the community, may be better to be handled as a tourism and marketing effort with Measure W funds. The amount of funding for the Redwood Village and Strongs Creek Core areas, returned to those core areas, is not enough to justify organizing a non-profit and having regular meetings (for example $5k for Strongs Creek Core Area). There has been little to no participation to host events in Redwood Village Core Area and it was difficult for FBID to host events without volunteers from the core area. The input from businesses in the Downtown Core Area were mixed, with some expressing need for the assessment funding, and others wishing it to be discontinued. Doug Strehl shared his opinion of how FBID functioned in the past as an entity that provided “seed” money to group hosting events or performing activities, rather than taking on responsibilities for those activities by the BID staff.
Following the discussion, the committee discussed three basic options for levying the assessment moving forward including:
Keep the assessment as-is
Discontinue the assessment and FBID
Assess a flat rate to all businesses citywide and eliminate core areas There was general consensus from the committee that the FBID assessment should not be kept as it currently is established, primarily because of the perceived limited benefit to the businesses assessed, and the general consensus that the BID was not recognized for being effective to provide benefits to the entire city. It was also noted that the time and effort to manage the Redwood Village and Strongs Creek core areas would take more effort than there would be benefit. So keeping the assessment as is, was not recommended by the committee, and is not supported by staff.
The amount currently assessed and distributed to the core areas is shown in the table below:
Core Area Assessment Distribution to Core
Area (62%)
Citywide Share
(38%)
Citywide $35,000 $0 $35,000
Downtown $13,000 $8,060 $4,940
Redwood Village $10,000 $6,200 $3,800
Strongs Creek $5,000 $3,100 $1,900
Total $63,000 $17,360 $45,640
Although there was not great support to keep the FBID, the committee was reluctant to recommend discontinuing the assessment altogether, as representatives from the Downtown Core area Business Item 5b
expressed the desire to keep the funding to pay for costs associated with events put on by in the Downtown area.
It was the consensus of the committee that the assessment should be on a flat rate basis and be the same for all areas within the City, and the core areas eliminated. The primary reasons being that it would simplify the process for obtaining business licenses, and provide funding for some of the ongoing events put on in the Downtown Area as well as more popular events such as the Al Gray Lighted Parade. The recommended assessment proposed by the advisory committee was $100 per business regardless of revenue. However, the advisory committee was not presented with any data regarding the number of businesses, how much each paid, and how the proposed flat rate would be perceived by majority of business that pay the lowest amount, and now could pay a significant increase. Had the committee had the information on how many businesses are assessed and at what rate, would likely have changed their opinion on the flat rate of $100 being proposed, and they would have proposed a lesser amount.

Business Item 5b
As can be seen in the table above, the highest percentage of businesses are assessed the minimum assessment of $11 at 24%. The next five highest percentages of businesses are charged, $16.50 (9.2%), $24.75(10.3%), $35.75 (10.6%) and $46.75 (7.7%), and $88 (6.4%), with the corresponding percent of businesses paying that fee shown in parentheses. Currently approximately 76% of businesses pay an assessed amount of $90.75 or less. Approximately 24% of businesses pay $120.75 or more. A $100 flat fee would result in $66,000 in revenue being generated annually. It is likely that a flat fee of this rate would be opposed by many of the businesses currently paying significantly less. and supported by the businesses paying more than $100 now (24% of businesses).
Given the low level of support for the BID in the community, it is the opinion of staff that the City should reduce its efforts and not hire staff for the express purpose of FBID, and that the Council either assess businesses a lower flat rate of $25 or less, and eliminate the core areas, or not levy an assessment at all.
If the assessment is reduced to a $25 flat fee and the core areas are removed, approximately $16,500 would be generated annually. This would cover “seed” money for events, or could be used to cover some of the costs to the Downtown Merchants to pay for event insurance, storage or other low cost projects. Additionally, other groups could request funding for new events or financial support for other activities consistent with the City’s municipal code. Under this model, the city would not have a staff person, and would not organize events using funds from the FBID assessment. The city could use the funds that had historically been allocated from the General Fund to match FBID funding, for other community promotion and beautification activities. If there is a strong demand for assessment funds in the future, the City could incrementally increase the assessment in future years.
A change in the amount of the assessment and the elimination of the core areas would need to be memorialized in the Council’s annual resolution declaring its intention to levy the assessment and the resolution (following a public hearing) adopting the levy for the next fiscal year. Staff is seeking direction on the proposed levy from the Council to be able to bring this forward at the upcoming Council meetings.
For the foregoing reasons, it is the recommendation of the FBID Advisory Committee and staff that the Council make the following changes:
1. That, without changing the overall boundaries of the District, the Council dedesignate the core areas within the District; and Revise the basis and method of collection of the assessment to a flat rate of $25 per business.
FINANCIAL IMPACT:
No fiscal impact.

The method of the assessment is consistent with the method specified within the Fortuna Municipal Code and is shown below.
5.40.030 Benefit assessment.
All businesses, trades and professions located within the boundaries shown on Exhibit A attached to the ordinance codified in this chapter and found on file in the office of the city clerk, shall, commencing July 1, 1990, pay a benefit assessment in addition to the city business license fee, in the amounts identified in Exhibit B as amended on March 18, 2002, and attached to the ordinance codified in this chapter and found on file in the office of the city clerk.
The benefit assessment shall be payable annually during each fiscal year, as provided in FMC 5.40.080. (Ord. 2002-636 § 2; Ord. 94-595 § 2; Ord. 90-550 § 1(B)).

This obligation shall be enforced by the city, pursuant to the provisions of Chapter 1.08 FMC. (Ord. 2003-640 § 1; Ord. 2002-636 § 2; Ord. 90-550 § 2).

Exhibit A
5. Amount of Any Surplus or Deficit Revenues to be Carried Over from Previous Fiscal Year.
The amount of money generated by the FBID Assessment to be carried over from the previous fiscal year is $17,726. The contribution from the City was unused primarily due to savings recognized by lower than expected personnel costs.
The contribution from the City that is remaining after all FBID activities and expenditures to operate have been completed for the year are to return to the City’s General Fund account. If any monies are remaining from the Fortuna business assessments the funds will remain in the FBID account for the next fiscal year’s activities and expenditures. The assessment funds are to be used only for FBID budget, as they are not a tax and cannot be used for general City purposes.

6. Amount of any Contributions to be Made from Sources Other than Assessments Levied The events FBID hosts are open to collecting participation fees, such as booth fees for a marketplace event and entry fees to participate in the Al Gray Lighted Parade, to name a couple possible revenue building streams. These contributions from vendors assist with offsetting the cost of the event, but the amounts collected do not completely cover the cost of the event. The City contribution of $50,000 each fiscal year covers FBID activities and events that are not accomplished with the assessment fees alone and was available for use for FBID activities.
