STAFF REPORT
Consent Agenda Item
DATE: June 17, 2024
TO: Honorable Mayor and Council Members
FROM: Aaron Felmlee, Finance Director
THROUGH: Merritt Perry, City Manager
SUBJECT: Finance Department Monthly Report
STAFF RECOMMENDATION:

Receive report as an informational item.

EXECUTIVE SUMMARY:

Transit Fare Ratio:

The City of Fortuna operates a specialized transit service in which it receives funding through the Transportation Development Act (TDA). In order to be in compliance with the TDA and continue to receive funding the City’s transit system must maintain a ratio of fare revenues to operating costs of at least 10 percent per Section 6633.5 of the TDA code.

The last two years the City has not met the 10 percent threshold with 2023’s ratio ending at only 6%. However, the compliance requirements for 2023 were waived under the provisions of AB-90 due to COVID. With that being said it is important for the City to continue to monitor the City’s Fare Box ratio in order to get back to the required 10% ratio. As of the end of May 2024, 2024’s fare box ratio was 7%, short about $5,000 in fare revenue.

New Fiscal Year:

With the close of fiscal year 2023-24 at the end of the month, Finance staff are working diligently on both closing out fiscal year 2023-24 and preparing to open up next fiscal year 2024-25. The year-end process entails running numerous reports, making audit adjustment entries, reconciling accounts, and ensuring all invoices for the 2023-24 year are paid timely. The new fiscal year entails uploading the new budget, issuing open purchase orders, and updating payroll numbers to reflect the fiscal year 2024-25 rates for wages, Cal-PERS pension plans, Health, and other benefits.

Measure E Update:

The Measure E committee’s next regularly scheduled meeting is set for September 17, 2024 at 5:30pm. The primary purpose of this meeting will be for Staff to review with the Committee the list of Measure E funded projects that were included in the Council Adopted Budget for fiscal year 2024-25.

EXECUTIVE SUMMARY:

Public Works Director/City Engineer
Police Facility Remodel Project
Over the past month, staff have been working with the contractor to finalize the construction punch list for the Police Facility Remodel. To date, the punchlist is approximately 95% complete, with only a few items awaiting parts to arrive to be resolved. It is likely that by late June or early July these items will be completed, and none of the remaining items will impact the City’s ability to staff the facility by the end of June.

Staff’s biggest effort over the past month has been coordinating the IT stakeholders, including Nylex (City IT), Silke Communications (Radio), AT&T and Synergem (911 Systems), and Infinite (phone systems). At this point staff feel confident that each stakeholder is on track to complete their areas of work this month, culminating in a facility switchover during the final week in June.

CDBG Barrier Removal Project
The contractor mobilized to the site on May 28th and has begun work on the project. To date, the contractor has completed the majority of the sidewalk improvements on the south side of N Street in between 11th and 14th. Based on their current progress, staff are hopeful that the project should be completed prior to the July special events.

During the project so far, staff have been heavily involved in daily inspections, decision making including design revisions, and property owner outreach/coordination.

Storm Drain Repair at Elizabeth Barcus
During the first week of June the City had Wendt Construction mobilize to perform a stormdrain repair on Elizabeth Barcus Way. The project included replacing approximately 105-feet of 24” stormdrain, and rehabilitating a pipe outlet energy dissipater. Currently staff are working on schedule the concrete and pavement rehabilitation work at the site.

May at River Lodge began with a dinner hosted by a local beef supplier. Distributors of the beef were invited to tour a local ranch and ended the day with dinner at River Lodge.

Another quilt retreat was held in May. The three-day retreat included food and evening entertainment. The entertainment was by a musician from out of town. He sang rock from the 1980’s and played the keyboard. It was very enjoyable!
The District One Dairy Princess annual dinner was also held in May. Every year, the Milk Advisory Board hosts the competition. There were three contestants this year vying for the title.

Grace Scilacci of Fortuna was the winner. The dinner was well attended.

The Redwood Memorial Foundation hosted their annual awards luncheon at River Lodge. The group gives out scholarships to Redwood Memorial Hospital employees, high school seniors or community members in our area. The recipients have to be pursuing careers in nursing, medicine, pharmacy or physical therapy.

Child Abuse Prevention Coordinating Council of Humboldt (CAPCC), held their 2024 round table at River Lodge. This organization strives to promote safe, healthy, resilient children and families in Humboldt County. There were 22 vendors present, representing children’s health and family wellness programs.

The three-day tournament, was played by 16 players who had traveled from British Columbia, Salt Lake City, and the Bay Area. For many of the participants, this was their first time to Fortuna and to see the redwoods. They thoroughly enjoyed our little town and the view at River Lodge.

The Department of Health and Human Services (DHHS), held a cultural and linguistic competency training for behavioral health professionals. The goal of the training was to increase the quality of care provided to clients from diverse backgrounds.

River Lodge was the location for two end of the year school functions. Academy of the Redwoods held their annual prom and Redwood Preparatory School had both, Kindergarten and 8th Grade graduations.

There was one very large college graduation party at River Lodge in May and CALFIRE closed out the month with a meeting.

There were two Chamber luncheons held at the Monday Club, a baby shower and a First Communion celebration. The First 5 Playgroup continues to happen each Thursday and Friday at the Monday Club.

An exciting event that happened at the Monday Club was a live performance for some local youth.

The Scotia Band played for a silent movie on Friday, before the Concert Series held the same performance on Saturday evening. This was a truly unique experience for these local students! RECOMMENDED COUNCIL ACTION:

STAFF REPORT
City Council Consent Item
____________________________________________________________________________________________ DATE: June 17, 2024
TO: Honorable Mayor and Council Members
FROM: Merritt Perry, City Manager
SUBJECT: Consideration of Fee Waiver for Jaripeo Ranchero Event at Rohner Park Rodeo Grounds
STAFF RECOMMENDATION:

Approve request from Mickey & Sons Promotions to waive the fees for the proposed Jaripeo Ranchero event at Rohner Park, and accept donation of labor and materials to improve Rohner Park Rodeo Grounds.

BACKGROUND
Mickey & Sons is a local promoter of concerts and events in the community such as Jaripeo Ranchero, which is a Mexican rodeo that includes horse riding, bull riding, dancing, music.

Mickey & Sons have hosted concerts at Bear River Casino and a Jaripeo Ranchero at the Redwood Acres Fairgrounds in Eureka.

They are excited to bring the event to Fortuna to enjoy the beauty of Rohner Park and to provide entertainment for the community. This event would be first of its type in the City, and would support a tradition that is rooted in the Latinx culture and would benefit the community as a whole. Staff supports this event and will provide conditions for safety, security, site access and control as it normally would for special events (including fees for consumables). Staff are excited for this event to be held in the City and its potential to attract tourists and locals.

Staff is recommending that the fee be waived to encourage this event, as it is the first year and has the potential to be a widely enjoyed and could continue into the future. If the Jaripeo Ranchero is successful, it will have the potential to generate revenue that can be used for park maintenance and staffing. There is not currently a fee for the Fortuna Rodeo, which has been held for over 100 years, but the Fortuna Rodeo Association funds projects in Rohner Park.

Mickey & Sons has offered to donate labor and materials to make needed repairs to the rodeo grounds including repairing the entrance booths, repairing the beer booths, replacing the entry fence, repairing the ticket booths and other needed maintenance to the announcers’ booth. The proposed work was reviewed by representatives of the Fortuna Rodeo and our General Services Superintendent, all agree that these repairs are necessary and would be a welcomed donation to the City.

A copy of the event proposal from Mickey & Sons including the proposed repair and maintenance work is attached to this staff report.

STAFF REPORT
City Council Consent Item
DATE: June 17, 2024
TO: Honorable Mayor and Council Members
FROM: Andrew S. Bowles, Chief Plant Operator
SUBJECT: 2024 Water Supply and Demand Assessment
STAFF RECOMMENDATION:

Receive Assessment as an informational item.

EXECUTIVE SUMMARY:

In 2021 the State Water Resources Control Board (SWRCB) issued a requirement for all public water systems to submit an annual assessment of their potable water supply versus demand for the upcoming year (code section 10632(a) (2)). The City owns and operates a public water system and must comply with this requirement. Staff retained Freshwater Environmental Services to complete the assessment. A summary of the method and results are presented below.

To perform the water supply assessment, staff examines the annual rainfall as measured at the Woodley Island weather station (Eureka) and the groundwater levels at various wells in the Eel River basin. The current annual values for rainfall and groundwater levels are compared to data collected from previous years in order to make a determination on the availability of groundwater in the Eel River aquifer. This past year total annual rainfall was approximately 20% above normal, and therefore staff anticipate that sufficient supply will be available within the groundwater basin.

Staff would also like to note that even during past successive years of drought, the reduced rainfall did not appear to impact seasonally low groundwater, and therefore even if the coming winter brings less than normal rainfall, supply would still be anticipated to exceed demand. To quantify demand, staff considers demands trends from recent years, and projects for growth based on the anticipated development activity within the City. In the coming year staff anticipate demand to remain relatively unchanged from recent previous years.

After consideration of the supply and demand data, staff anticipates that there is sufficient groundwater supply to cover municipal water demand over the coming year. A copy of the full assessment completed by Freshwater Environmental Services has been included as Attachment A.

RECOMMENDED COUNCIL ACTION:

Staff recommends that Council approve the City’s Assessment; By Consent Agenda Vote.

1.0 INTRODUCTION
The City of Fortuna’s (City's) 2024 Annual Water Supply and Demand Assessment is intended to meet the requirements established in Water Code Section 10632(a)(2) which includes the following minimum procedures:
• The written decision-making process that an urban water supplier will use each year to determine its water supply reliability. • The key data inputs and assessment methodology used to evaluate the urban water supplier’s water supply reliability for the current year and one dry year, including all of the following:
o (i) Current year unconstrained demand, considering weather, growth, and other influencing factors, such as policies to manage current supplies to meet demand objectives in future years, as applicable.
o (ii) Current year available supply, considering hydrological and regulatory conditions in the current year and one dry year. The annual supply and demand assessment may consider more than one dry year solely at the discretion of the urban water supplier. o (iii) Existing infrastructure capabilities and plausible constraints. o (iv) A defined set of locally applicable evaluation criteria that are consistently relied upon for each annual water supply and demand assessment.
o (v) A description and quantification of each source of water supply. Water Code Section 10632.1

1.1 Decision Making Process
The City's Annual Water Supply and Demand Assessment follows the methodology provided in the City of Fortuna Water Shortage Contingency Plan (FES, June 2021).

The approximate schedule for the assessment is listed below:
• Second week of May – Data collection, precipitation data, groundwater elevation data from CASGEM wells, and groundwater elevation data from City wells.
• Third week of May – Data evaluation. Determine current year unconstrained demand, current year available supply, identify existing infrastructure capabilities and plausible constraints, and generate the Draft-Annual Water Supply and Demand Assessment.
• Fourth week of May – Annual Water Supply and Demand Assessment reviewed by Public Works Director and City Manager and finalized. • First week in June – Notice of public meeting.
• Third week in June – Report presented to City Council for approval. 2024 Annual Water Supply and Demand Assessment 2 May 2024 The City of Fortuna, Fortuna, California Freshwater Environmental Services • July 1 - Annual Water Supply and Demand Assessment to the Department of Water Resources.

1.2 Data and Methodologies
Fortuna has prepared the 2024 Annual Water Supply and Demand Assessments utilizing the following data:
• Precipitation data from the National Weather Service Woodley Island Station;
• Groundwater elevation data from CASGEM wells within the Eel River Valley Groundwater Basin;
• Projected current year unconstrained demand; and
• Projected current year available supply.

The above data was evaluated with similar methodologies and added to the analysis of water supply reliability contained in the Fortuna Water Shortage Contingency Plan (FES, June 2021).

2024 Annual Water Supply and Demand Assessment 7 May 2024 The City of Fortuna, Fortuna, California Freshwater Environmental Services Groundwater elevation observations from the CASGEM wells indicate that groundwater levels are generally stable over the observation period and dry season groundwater elevations are generally not responsive to the periods of historic drought.

The Sustainable Groundwater Management Act (SGMA) requires the Department of Water Resources to prioritize each of California’s 515 groundwater basins and subbasins based on eight components. Basin prioritization is a technical process that utilizes the best available data and information to classify groundwater basins into one of four categories high-, medium-, low-, or very low-priority. The technical process is based on eight components that are identified in the California Water Code Section 10933(b). (1) The population overlying the basin or subbasin.
(2) The rate of current and projected growth of the population overlying the basin or subbasin.
(3) The number of public supply wells that draw from the basin or subbasin. (4) The total number of wells that draw from the basin or subbasin. (5) The irrigated acreage overlying the basin or subbasin. (6) The degree to which persons overlying the basin or subbasin rely on groundwater as their primary source of water.
(7) Any documented impacts on the groundwater within the basin or subbasin, including overdraft, subsidence, saline intrusion, and other water quality degradation.
(8) Any other information determined to be relevant by the department, including adverse impacts on local habitat and local streamflows.

According to the Eel River Valley Groundwater Sustainability Plan, 2022:
“The groundwater sustainability plan alternative (GSP Alternative) submitted to the Department of Water Resources (DWR) in December 2016 (SHN, 2016) showed that groundwater levels within the Eel River Valley Groundwater Basin (Basin) have a relatively narrow range of fluctuation and have remained generally stable over time, including during the droughts of 1976-1977, 1987-1992, and the most recent drought of 2013-2015. Groundwater elevation measurements collected over the course of the 2019 WY indicate that water levels are consistent with historical fluctuations observed in wells associated with the California Statewide Groundwater Elevation Monitoring (CASGEM) program.“

Conclusions regarding water source reliability include:
• Periods of dry weather appear to have an impact on the seasonally high groundwater elevations in the Eel River Valley Groundwater Basin; • Periods of dry weather appear to have an impact on the seasonally low groundwater elevation trends in the Eel River Valley Groundwater Basin; and • The Fortuna water supply has been reliable even during periods of record low precipitation.
2024 Annual Water Supply and Demand Assessment 11 May 2024 The City of Fortuna, Fortuna, California Freshwater Environmental Services

5.0 INFRASTRUCTURE CAPABILITIES AND PLAUSIBLE CONSTRAINTS The City of Fortuna relies on four groundwater wells within the Eel River groundwater basin to supply potable water to the community. This City exercises the pumps in the four wells by using them in a sequence. One plausible constraint is that well casings within the wells can become fouled and reduce their efficiency.

In that case, the City is capable of supplying the ongoing water demand of the community by using only one or two of the groundwater wells. This allows for one or two of the wells to be removed from service for maintenance when necessary The City is in the process of replacing Well # 5 which will further increase the resilience of the Fortuna water distribution system.

6.0 PROJECTED WATER DEMAND AND SUPPLY
Projected water demand for the next 24 months is based on the demand in the previous 12 months (2023-2024) as shown below. Population is not projected to increase, and demand is anticipated to remain steady reflecting the seasonal trends as shown below:

Based on historical conditions and our understanding of the Eel River Groundwater Basin, water demand is not anticipated to exceed supply over the next 24 months even if historic drought conditions occur over the next 24 months. 20 25

7.0 CONCLUSIONS
This Section describes the conclusion of the 2024 Annual Water Demand and Supply Analysis.

Based on the analysis of local precipitation trends, groundwater elevation trends, observations from the City’s Wells, and documented sustainability of the Eel River Groundwater Basin, the water supply will most likely meet the projected demand over the next 24 months even if precipitation in next the 24 months is equal to historic lows.

 Draft Resolution 2024-17; Resolution Of The City Of Fortuna Establishing A Schedule Of Fees And Charges For Building, Community Development, and Water & Wastewater, Within The City Of Fortuna For Fiscal Year 2024-2025
RESOLUTION 2024-17

RESOLUTION OF THE CITY OF FORTUNA ESTABLISHING A SCHEDULE OF FEES AND

CHARGES FOR BUILDING, COMMUNITY DEVELOPMENT, AND WATER & WASTEWATER, WITHIN THE CITY OF FORTUNA FOR FISCAL YEAR 2024-2025 WHEREAS, the City Council desires to establish a policy of recovering the costs reasonably borne of providing special services of a voluntary and limited nature, such that general taxes are not diverted from general services to the public as a whole and thereby utilized to inequitably subsidize such special services; and,
WHEREAS, a schedule of fees and charges to be paid by those requesting such special services must be adopted by the City Council in order to effect this policy; and, WHEREAS, the City Council wishes to comply with both the letter and the spirit of Article XIIIB of the California Constitution and limit the growth of taxes; and, WHEREAS, pursuant to Government Code Section 66016 the specific fees to be charged for special services must be adopted by the City Council by Ordinance or Resolution, after providing notice and holding a public hearing; and,
WHEREAS, notice of public hearing has been provided by City staff per California Government Code Section 6062a, oral and written presentations made and received, and the required public hearing held; and, WHEREAS, pursuant to California Government Code Section 6062a a general explanation of the Schedule of Fees and Charges in Exhibit A, has been available for public review as required; and, WHEREAS, a public hearing was held on June 3, 2024 by the Fortuna City Council to present the Schedule of Fees and Charges for Building, Community Development, and Water & Wastewater fees in Exhibit A, and receive public comment.

NOW, THEREFORE, BE IT RESOLVED,

1. Pursuant to California Government Code Sections 66013 and 50076, the fees adopted by this Resolution do not exceed the estimated reasonable cost of providing the service for which the fee or charge is imposed and are not “special taxes”; and

2. The Council hereby adopts, approves and incorporates herein the Schedule of Fees and Charges in Exhibit A, following a public hearing on the matter; and,

3. Pursuant to California Government Code Section 66017, the fees adopted by this Resolution shall be in full force and effect and shall be collected beginning on the 1 st day of July 2024.

4. Any judicial action or proceeding to attack, review, set aside or annul this Resolution shall be brought within 120 days of its adoption; and

5. If any portion of this Resolution is declared invalid or unconstitutional, then it is the intention of the City Council that all other sections of this Resolution shall remain in full force and effect; and

6. The City Manager shall have the authority to adjust the aforementioned fees when special circumstances indicate that the fee charged according to this Resolution is clearly inappropriate. In addition, the City Manager shall have the authority to determine the fee amount for a City service that is not addressed in this Resolution based upon the actual cost of providing the service and / or the actual cost for the City to issue a permit.

STAFF REPORT
City Council Business Item
DATE: June 17 2024
TO: Honorable Mayor and Council Members
FROM: Casey J. Day, Chief of Police
THROUGH: Merritt Perry, City Manager
SUBJECT: Supplemental Budget Request and Authorization for the Over Hire of One Police Officer
STAFF RECOMMENDATION:

Authorize a Supplemental Budget Request (SBR) approving the over hire of one Fortuna Police Officer.

EXECUTIVE SUMMARY:

The Fortuna Police Department (FPD) is currently facing a critical staffing challenge that necessitates immediate action to ensure the continued continuity of operations as well as the safety and well-being of our community. Staff is currently seeking authorization from the City Council for an over hire of one additional sworn police officer. This request is being made in anticipation of potential staffing shortages. Currently, three sworn Fortuna Police Officers are seeking employment with outside agencies. All three officers have started the employment process with other agencies and should they be successful, their departure could create immediate vacancies, which will significantly and negatively impact the departments operational capabilities. In addition, two additional officers are scheduled to be placed on long-term rehabilitation and/or medical leave due to scheduled upcoming medical procedures.

OPERATIONAL IMPACT:

The City of Fortuna’s event season is rapidly approaching, bringing with it a series of highattendance community events such as the Fortuna Fireworks Festival, Fortuna Rodeo Round-Up, Fortuna Rodeo, Redwood AutoXpo, Hops in Humboldt and more. These events necessitate a substantial police presence to ensure public safety, manage crowds, manage traffic, and coordination with event organizers. During event season, the demand for police services spikes significantly. Ensuring adequate staffing during this period is paramount to maintaining order and providing timely responses to incidents.

A shortage of officers compromises our ability to respond effectively to emergencies and routine calls, posing a risk to public safety and the community’s well-being. Additionally, overworked officers are more susceptible to stress and fatigue, which can affect their performance, decisionmaking, and overall health. The visibility and accessibility of our officers are key to maintaining strong community relations. Insufficient staffing can undermine public trust and diminish our capacity for community engagement.

Business Item 5b

Page 2 of 2 ends

OVERHIRE SOLUTION:

In order to proactively address these challenges, the Chief of Police is requesting Council authorization to over hire one additional police officer. This will ensure continuous coverage and maintain our current level of service despite potential staffing disruptions. Adequate staffing is essential to managing the increased demands of the upcoming event season, ensuring public safety, and effective event management. The ability to over hire provides the department with the flexibility needed to adapt to unforeseen circumstances without compromising service quality.

FINANCIAL/FISCAL IMPACT:

A full-time Police Officer can cost up to $175,000 a year in wages and benefits for a full year. This cost would be partially offset by avoided overtime costs estimated at $60,000 - $85,000 for a full year. While the SBR is for the over hire to be in place for the entirety of next fiscal year (FY 24- 25) the more likely scenario is that it will only be in place for six months or less. The over hire would remain in effect until a current officer leaves and the over hired officer can take the spot of one of the regular positions. If the over hire is in place for six months the total estimated cost required to come from reserves would be $50,000.

RECOMMENDED COUNCIL ACTION:

The authorization for an over hire is a strategic and proactive measure to address anticipated staffing challenges and ensure the Fortuna Police Department remains fully operational during critical periods. I strongly recommend that the City Council approve the over hire of one additional police officer and the necessary budget adjustments to support this action.

STAFF REPORT
City Council Business Item
DATE: June 17, 2024
TO: Honorable Mayor and Council Members
FROM: Brendan Byrd, Public Works Director/City Engineer THROUGH: Merritt Perry, City Manager
SUBJECT: Supplemental Budget Request and Professional Services Contract Amendment with GHD for Design and Environmental Services for the Mill Creek Habitat Connectivity Project (CIP#9123)
STAFF RECOMMENDATION:

Receive staff presentation and recommendation to authorize the City Manager to execute a professional services contract amendment with GHD for design and environmental services for the Mill Creek Habitat Connectivity Project (CIP#9123) and authorize a supplemental budget request in the amount $107,000.

EXECUTIVE SUMMARY:

As the Council is aware, staff have been working with engineering consultants GHD on the Mill Creek Habitat Connectivity Project, which includes developing engineering designs and permitting packages for four culvert crossings along Mill Creek in Fortuna. Over the past several months, GHD has been active completing field surveys and walking the extents of the creek to identify existing conditions. During these field surveys, an additional privately-owned culvert crossing was discovered in between Mill Street and Rohnerville Road. This crossing is also a fish passage barrier, and would require replacement in order to achieve full habitat connectivity along this section of Mill Creek.

Given the location of the private culvert, and the fact that future construction funding grant opportunities would rely heavily on providing for full creek habitat connectivity, staff recommend that a new fish passage friendly design be developed for the private crossing as part of the City’s current project. Staff would like to note that developing the design as part of the City’s project would not result in the City inheriting responsibility of the crossing, nor would it require that the City fund its replacement in the future. Staff have been working with the property owner on the concept of including crossing improvements in the City’s project, and they are fulling willing to participate and allow for access.

To fund the design and environmental work for the additional crossing, staff reached out to the City’s grant manager with the Wildlife Conversation Board (WCB), who indicated that they had additional funding that could be obligated under a grant amendment. Staff worked with GHD to develop the additional fee required to augment each existing task from the original scope (Attachment A), after which staff formally made a funding request to the WCB for $107,000. The WCB staff approved the funding request, and City staff are currently working to finalize the grant Business Item 5c

Page 2 of 2 ends

agreement amendment and funding augmentation with the WCB. A draft of the grant has been included as Attachment B.

With the council’s approval, staff would work to finalize the amendment with the WCB for the above-mentioned amount, and once completed execute a contract amendment with GHD adding the additional funding to the contract to complete the design work for the additional culvert.

FINANCIAL IMPACT:

As noted above, the additional project work would be fully funded under a grant from the WCB, in the amount of $107,000. This would augment the City’s existing grant agreement of $966,000 and increase it to a new total amount of $1,083,000. The City has committed as part of the initial agreement $10,000 worth of staff time as a match over the course of the project, however, no additional staff time match is required in securing the additional funding.

The new funding amount of $107,000 would be added to next fiscal year’s budget, which already was approved by the Council (along with the City’s Capital Improvement Program) at the June 3rd meeting. A draft Supplemental Budget Request augmenting next year’s approved budget for the project has been developed for the funding augmentation and is included as Attachment C.

1. Receive staff presentation and review Council questions with staff

2. Open Public Comment

3. Close Public Comment;

4. Motion to Authorize the City Manager to execute professional services contract amendment with GHD for engineering and environmental services for the Mill Creek Habitat Connectivity Project (CIP#9123) and authorize a supplemental budget request in the amount $107,000, voice vote
