SUBJECT: Finance Department Monthly Report for October 2024 STAFF RECOMMENDATION:
Receive report as an informational item.
EXECUTIVE SUMMARY:
Training Opportunities:
Finance staff have had the opportunity to attend a number of valuable training opportunities over the last couple of months. The Finance Director and Payroll and Benefits Administrator attended the CalPERS Educational Forum. The seminar topics included, Pension Prefunding Trusts, Reporting Compliant Compensation, Understanding your Actuarial Valuation Report, State and Federal Update – Critical Issues You Need to Know, and many more.
The Payroll and Benefits Administrator was also able to attend CalPELRA. This is an annual conference that offers a wide variety of labor, human resources, and employment training sessions, including educational and skill-building presentations that discuss new and critical issues and that encourage audience interaction and participation. These trainings are particularly important as we transition from an employee who has been with the City for over 25 years and is retiring from the Payroll and Benefits Administrator position to an employee new to the role.
Sales Tax Update:
Finance staff continue to closely monitor the City’s sales tax revenue streams. Sales tax revenue is the largest General Fund revenue source for the City and as such fluctuations in sales tax have the largest impact on the City’s finances.
For sales tax receipts between April and June 2024 the City of Fortuna actual receipts, excluding reporting aberrations, were up 0.2% as compared to April to June 2023. For comparison the County realized a 1.9% decrease and the State of California realized a 0.6% decrease.
For fiscal year 2023-24 general sales tax and Measure E transaction and use tax totaled $4,145,631.
The City budgeted conservatively for the year at a combined $4,063,000 which resulted in a budget surplus of approximately $80,000.
However, for comparison fiscal year 2021-22 combined sales tax and Measure transaction and use tax was $4,339,191. Fiscal year 2023-24 revenue fell by nearly 4.5% compared to fiscal year 2021- Consent Calendar Item 4
22. The declines can be primarily attributed to declines in the fuel and service stations and general consumer goods categories.
Additional information about how the City’s sales tax performed will be presented with the MidYear budget presentation scheduled for the beginning of February.
Measure E Update:
The Measure E committee’s next regularly scheduled meeting is set for January 22, 2025 at 5:30pm in the Council Chambers.
The primary purpose of this meeting will be to solicit project ideas and funding input from the public. This is a great place for the public to be heard on how they want their sales and use tax monies to be spent within the City of Fortuna. The City has historically received valuable input and project ideas, which City staff would not have been aware of, from the public during these annual public solicitation meetings.
List of Measure E items funded this month:
• (2) Police Detective Positions
• Police Community Services Officer Position
• Police Records Clerk Position
• Parks and Recreation Director Position
• Recreation Program Supervisor Position
• Transit Trips to Eureka for Seniors

remained stable. State-county pools,
the City’s largest income category, had
exceptional gains with 14.3% returns.
The restaurant-hotel sector showed weak
profits at quick service establishments
primarily due to higher menu prices
implemented to offset the increased
minimum wage requirement. Likewise,
the autos-transportation group saw soft
profits from automotive supply stores as
owner’s delayed maintenance on their
vehicles.
General consumer goods had meager
proceeds at electronic-appliance and
second-hand stores as consumers
limited their purchases while they still
have concerns about the direction the
economy is going.
The voter-approved transaction tax,
Measure E, experienced positive
collections of 6.1%.
Net of aberrations, taxable sales for all of
Humboldt County declined 1.9% over the
comparable time period; the Far North
region was down 0.3%.

2Q 2024 CITY OF FORTUNA SALES TAX UPDATE
STATEWIDE RESULTS
California’s local one cent sales and use
tax receipts during the months of April
through June were 0.6% lower than the
same quarter one year ago after adjusting
for accounting anomalies. The calendar
year second quarter is traditionally the
beginning of the summer spending season;
however, returns were relatively flat when
compared to a year ago. For many California
agencies, this also marks the end of the
2023-24 fiscal year, where statewide sales
tax revenues were down 1.3% from the
2022-23 fiscal year.
Consistent with recent trends, autotransportation receipts fell 6.2% - the largest sector decline this quarter.
Sustained high interest rates, tightened
credit standards, and increased cost of
insurance all converged to impact returns.
While inventory-levels for many dealerships
have rebounded, it’s only proving to create
downward pressure on prices, further
constraining receipts.
Summer weather usually marks fruitful
periods for building-construction, however
as property owners struggle to access
equity for improvements, year-over-year
receipts declined. The price of lumber and
other materials are now more affordable,
but new projects have been sidelined by
developers until financing and mortgage
costs drop further.
Similarly, as the price of consumer goods
has cooled with moderate inflation rates,
returns from multiple merchants have
curtailed. Men’s and women’s apparel,
home furnishings, electronic-appliance
and specialty stores could not escape the
change in shopper’s preferences for lower
priced items from large brick-and-mortar
retailers like discount department stores.
Restaurants experienced only a modest
gain of 0.7%. As AB 1228 is enacted –
state law increasing California’s minimum
wage at designated eateries – third party
data reports that foot traffic to all such
establishments decreased during this same
time period. Not only are diners selecting
less expensive places to eat, but many may
have been pushed to limit their frequency to
dine out.
Multiple of sectors experienced mild growth
including allocations from the countywide
use tax pool and the business-industrial
group, both benefiting from online shopping,
and fuel-service stations as drivers continue
to hit the road even as gas prices remain
elevated.
Halfway through the current calendar year,
revenue trends remain slightly lower than
a year ago overall. Although the Federal
Reserve recently reduced the Fed Funds
Rate helping temper the cost of financing,
personal consumption forecasts remain
insipid through the remainder of 2024.
Consumers are more likely to wait for greater
improvement of household economic
conditions before extending themselves
again, inspiring the next sales tax growth
cycle.

Monday Club Chimney
DCI Builders mobilized to the site in late October to begin the project. Within a week’s time, the entire old chimney was demolished, and the new wooden framing was completed. Now the contractor is awaiting the brick order, which in the quantity specified is a special order with a few weeks lead time. Staff are still hopeful the repair will be fully complete by the end of November.
Additionally, during the demolition activities it became clear that the brick on the inside of the chimney did not need to be removed, as the interior features were supported by their own foundation. Therefore the planned demolition and reconstruction of the interior is not required, and staff will be able to deduct the cost of that work from the contract.
Storm Damage Bank Repairs
As noted in the previous monthly report, Mobley Construction completed the bank repair behind the Cook Shack in Rohner Park last month. Since that time, Mercer Fraser completed another creek bank repair, this one along South
Loop Road near Rancheria Road.
With that, all damage work
associated with the heavy rains
last winter has been addressed.
Main Street Gateway Project
In October the contractor began
the Gateway Project on Main
Street. To date the new water line
for irrigation has been installed,
along with most of the new
concrete curb and sign
foundation. The project is still
scheduled for completion in
December.

STAFF REPORT
City Council Consent Item
DATE: November 18th, 2024
TO: Honorable Mayor and Council Members
FROM: Mat Nyberg, Deputy City Engineer
Katey Schmidt, Planner II
THROUGH: Amy Nilsen, City Manager
SUBJECT: Review and Accept Completion of the Community Development Block Grant (CDBG) Barrier Removal Project (CIP 9977)
STAFF RECOMMENDATION:
Review and accept completion of the CDBG Barrier Removal Project (CIP 9977), direct staff to submit final reports and closeout package to the California Department of Housing and Community Development (HCD), and disencumber remaining funds.
EXECUTIVE SUMMARY:
The Community Development Block Grant (CDBG) program provides annual grants on a formula basis to states, cities, and counties. These grants serve to develop viable urban communities by providing decent housing and a suitable living environment, and by expanding economic opportunities, principally for low- and moderate-income (LMI) persons. The program is authorized under Title 1 of the Housing and Community Development Act of 1974, Public Law 93-383, as amended 42 U.S.C. 5301 et seq.
The City of Fortuna has participated in various CDBG programs dating back to the 1980s including housing rehabilitation and construction loans. The funds generated by the payback of these loans are categorized as “CDBG Program Income (CDBG PI).” These funds are intended to be redistributed back into the community and are subject to the same eligibility requirements as CDBG grant funds. The CDBG program requires that each funded activity meets one of the three National Objectives by either principally benefiting low-and moderate-income (LMI) persons, aids in the prevention or elimination of slums or blight, or meets a community development need having a particular urgency. LMI Limited Clientele (LMC), as defined by income limits or presumed benefit refers to persons who earn 80 percent or less of HUD Adjusted Median Family Income (HAMFI) for the county of residence. At least 70 percent of the funds awarded must benefit LMI individuals or households.
On April 5, 2021 staff presented the “City of Fortuna PI Only ADA Barrier Removal Project” for consideration. Sidewalk improvement is an approved CDBG activity and meets the State Objective for LMI person area benefit as at least 51.9 percent of the activity’s beneficiaries are low and moderate-income persons. Areas were targeted that would improve access to public facilities including access to the Library, City Hall, Rodeo Grounds, and the Bike Park in Newburg Park.
Consent Item 4j
After review by the California Department of Housing and Community Development, it was determined that several locations would not fit within the scope of CDBG funding and these locations were removed from the budget. The City withdrew the Rodeo Grounds, Newburg Bike Park, and other locations from the application; while access improvements to the Fortuna Library, Downtown areas, and other high-need locations were retained. The final location and budget were approved by HCD and the City issued a Notice Inviting Bids on February 20, 2024.
On April 1, 2024 Fortuna City Council authorized the City Manager to award the CDBG Barrier Removal Project (CIP 9977) to RAO Construction and established a maximum contract amount of $430,000. RAO began construction on May 28th and work was accepted as complete on July
24. The final contract amount, including two change orders, was $397,246, under budget by 7.5%.
Subsequently, staff began completing CDBG Grant Closeout Documentation which includes this Staff Report to the City Council on the project’s accomplishments and success.
The objective of this project was to provide improvements that would further the City’s goal to achieve an accessible community as well as help address the findings of the County Accessibility Audit in 2018. Work involved the reconstruction of sidewalks, driveways, street corners and crosswalks that had accessibility issues in areas on N Street from 11th to 14th Street, around the intersection of 6th and Main Streets, along a section of South 12th Street at Rohner Creek and a corner ramp on David Way.
The outcome of the project is a complete success. All targeted areas were successfully brought up to accessibility standards including an additional location at 14th and N St. identified during construction. The most challenging aspect of infill accessibility projects is conforming new facilities to existing facilities such that the result is a contiguous accessible path. Staff was able to successfully coordinate with the contractor, making numerous adjustments during construction to achieve this goal throughout.
The following will highlight locations of some of the project achievements:

STAFF REPORT
City Council Consent Item
DATE: November 18, 2024
TO: Honorable Mayor and Council Members
FROM: Shari Meads, Community Development Director
THROUGH: Amy Nilsen, City Manager
SUBJECT: Approve a $53,032 Supplemental Budget Request and Execute a Contract Amendment with Planwest Partners for Continued Professional Planning Services for the Mill District Specific Plan.
STAFF RECOMMENDATION:
The Community Development Department recommends that the City Council approve a Supplemental Budget Request for $53,032 and authorize the City Manager to execute a contract amendment with Planwest Partners to continue providing professional planning services related to the Mill District Specific Plan.
EXECUTIVE SUMMARY:
The Mill District Specific Plan project is well underway, with adoption and Supplemental Environmental Impact Report certification anticipated for early 2025. While we are approaching the finish line for this vital project, significant work remains. This includes finalizing the Mill District Specific Plan (MDSP), amendments to the General Plan Land Use Element and Diagram, implementing Zoning Text and Map amendments, Design Guidelines, and the Supplemental Environmental Impact Report (SEIR). Additionally, a series of public review meetings are scheduled for the adoption and certification process.
During the SEIR public comment period, an environmental justice advocacy group challenged the SEIR’s adequacy. This has required the City to engage in ongoing (and costly) consultation with California Environmental Quality Act (CEQA) expert attorneys to ensure the City’s responses to said comments and overall approach to environmental review satisfy all legal requirements. This additional SEIR review and corresponding new MDSP mitigation measures has led to MDSP unbudgeted expenses for work completed by Planwest Partners and also a delay in the project approval timeline from December 2024 to early 2025.
This Supplemental Budget Request will fund continued professional planning services with Planwest Partners to ensure this important work is completed thoroughly and on schedule. Staff would like to note that Planwest has provided excellent professional planning services thus far, and the need for additional funds is related to the additional review, analysis, public hearings, and time requirements of this comprehensive, complex, and important project.
The attached Memorandum, dated November 6, 2024, provides additional detail on the foreseeable Planwest support needed.
Business Item 5a
FISCAL IMPACT:
The total estimated project cost increase related to Planwest Partners’ continued services is $62,722.26, with a not to exceed amount of $63,000. Headwaters Grant funds will cover $9,968 of this amount, leaving a $53,032 funding gap as requested in the attached Supplemental Budget Request. An additional Supplemental Budget Request may be brought to Council for legal review and consultation costs at a future date and in an amount to be determined.
RECOMMENDED COUNCIL ACTION:
1. Receive staff report and review questions with staff
2. Open Public Comment
3. Close Public Comment
4. Motion to approve a $53,032 Supplemental Budget Request and authorize the City Manager to execute a contract amendment with Planwest Partners to continue providing professional planning services related to the Mill District Specific Plan. Voice vote.

STAFF REPORT
City Council Business Item
DATE: November 18, 2024
TO: Honorable Mayor and Council Members
FROM: Amy Nilsen, City Manager
SUBJECT: Authorize the City Manager to Execute a Contract for Professional Services Agreement with CSG Consulting for SB 1383 Compliance and Franchise Agreement Development
STAFF RECOMMENDATION:
Authorize the City Manager to execute a Professional Services Contract with CSG Consultants to continue to assist the City with SB 1383 compliance and the development of an updated franchise agreement.
EXECUTIVE SUMMARY:
State mandate, Senate Bill (SB) 1383, requires significant changes to solid waste management by requiring the diversion of organics from landfills and includes mandatory residential and commercial organics collection programs, mandatory route audits, mandatory outreach/education, enforcement, procurement, reporting to Cal Recycle, etc. Cities are responsible for complying by updating franchise agreements/amendments with waste haulers.
Below is a visual summary of the City’s requirements under SB 1383.
Fortuna’s current franchise agreement and subsequent amendments are outdated and without provisions to meet SB 1383 or previous mandates, e.g., AB 341, SB 1826, and lack rate setting and transparency requirements for Recology. Fortuna joined Arcata, Eureka, and the County of Business Item 5b
Humboldt (Jurisdictions), to hire consultant CSG to develop a new SB 1383-compliant franchise agreement and provide technical assistance for sole source negotiations with Recology.
Process to Date:
• On March 15, 2024 the council approved an agreement with CSG consultants to assist the City with SB 1383 compliance and franchise agreement development. An agreement with CSG Consultants was also approved on June 20, 2023. Negotiations with the current waste hauler, Recology, have taken additional time.
• CSG developed a new franchise agreement with Fortuna to:
o Include SB 1383 requirements, contractor performance requirements, current industry standards, and reporting compliance requirements to replace outdated current agreement
o Provide cost-effective programs/services to limit rate impact on ratepayers o Ensure the contractor provides a detailed rate-setting process and has a profit margin consistent with other jurisdictions
o Ensure Recology leverages its significant resources from other regions for Fortuna. (Recology Inc. has $1 Billion in revenue, 40 operating companies in CA, Oregon, Washington, and 3,700 staff)
• The City is working to comply with the provisions of SB 1383 and CalRecycle has issued a Corrective Action Plan (CAP) with specific tasks and completion dates for the steps necessary for the City to comply with SB 1383. Many of the tasks required of the City will become the responsibility of Recology once the Franchise Agreement is executed. • The Jurisdictions have worked to negotiate in good faith to complete a franchise agreement that is fair and reasonable for both parties, however, Recology has often delayed communication with the Jurisdictions. CSG and the Jurisdictions have completed several negotiation provisions with Recology, but two significant items remain, profit margin and term of agreement.
• As part of sole source negotiations to extend the agreements with Recology, the Jurisdictions agreed on a 12% profit margin because three jurisdictions do not have an approved profit margin for Recology, Fortuna is one of those jurisdictions. This profit margin is supported by a 2023 survey of more than 30 California jurisdictions showing average profit margin of 11%. Lastly, on Aug. 2, 2023 Recology emailed Fortuna their draft franchise agreement which included a 12% profit margin. Since this time data has been requested from Recology on Sept. 5 and Oct. 10 of this year to provide the following:
Recology to provide data using Section 11 of the redlined franchise agreement to present current City’s revenues, costs, calculation of profit margin.
A. Revenue from collection services
B. (Less Pass-Through Costs, Section 11A to11E, page 29) Please detail related party costs, sections 11A to 11E detail the pass-through costs, and 11D states Business Item 5b
additional details for related party transactions may be required, which in Fortuna is the transfer station and the MRF
C. Cost of Goods Sold in the net of Revenue less Pass-Through Costs D. Allowable Costs by type, Section 11, pages 29 to 31
E. (Less any Unallowable Costs included in Allowable Costs, Section 11, page 31) F. Total Allowable Costs / (1 – 12% Profit Margin) yields an 88% Operating Ratio • The City Manager along with CSG met with Recology on Oct. 30th in person and again, requested the above data. Recology stated they would provide the data on Nov. 13.
Recology provided data on Nov. 11. An additional in-person meeting is scheduled with Recology for Nov. 20 to review the data they provided.
Based on the incomplete state of the franchise negotiations, additional effort is necessary to complete the negotiations with Recology or go out to request for proposal (RFP). Approving this contract with CSG will provide the necessary effort to update the franchise agreement or go out to RFP and remain in compliance with the CAP.
FINANCIAL IMPACT:
The cost for the services from CSG Consultants would be for an amount not to exceed $24,800.
The cost of the agreement was included into the City’s fiscal year 2024-25 budget under Fund 210, Solid Waste Fund, so no Supplemental Budget Request is necessary. Additionally, the City was notified on 2/26/24 that it received a second Cal Recycle Local Assistance Grant, this time in the amount of $75,000, that could potentially go towards funding this effort and other SB 1383 compliance activities.

Any available insurance proceeds in excess of the specified minimum limits of insurance and coverage shall be available to the Entity.
Other Insurance Provisions
The insurance policies are to contain, or be endorsed to contain, the following provisions:
Additional Insured Status The CITY, its officers, officials, employees, and volunteers are to be covered as additional insureds on the auto policy with respect to liability arising out of automobiles owned, leased, hired or borrowed by or on behalf of the CONSULTANT; and on the CGL policy with respect to liability arising out of work or operations performed by or on behalf of the CONSULTANT including materials, parts, or equipment furnished in connection with such work or operations. Any insurance or self-insurance maintained by the CITY, its officers, officials, employees, or volunteers shall be in excess of the CONSULTANT’s insurance and shall not contribute to it.
Notice of Cancellation Each insurance policy required above shall state that coverage shall not be canceled, except with notice to the Entity.
Waiver of Subrogation CONSULTANT hereby grants to CITY a waiver of any right to subrogation which any insurer of said CONSULTANT may acquire against the CITY by virtue of the payment of any loss under such insurance. CONSULTANT agrees to obtain any endorsement that may be necessary to effect this waiver of subrogation, but this provision applies regardless of whether or not the CITY has received a waiver of subrogation endorsement from the insurer.
Deductibles and Self-Insured Retentions Any deductibles or self-insured retentions must be declared to and approved by the CITY. The CITY may require the CONSULTANT to provide proof of ability to pay losses and related investigations, claim administration, and defense expenses within the retention.

2. Insurance must be maintained, and evidence of insurance must be provided for at leastfive (5) years after completion of the contract of work.
3. If coverage is canceled or non-renewed, and not replaced with another claims-made policy form with a Retroactive Date prior to the contract effective date, the CONSULTANT must purchase “extended reporting” coverage for a minimum of five (5) years after completion of contract work.
Verification of Coverage CONSULTANT shall furnish the CITY with original certificates and amendatory endorsements or copies of the applicable policy language effecting coverage required by this clause. All certificates and endorsements are to be received and approved by the CITY before work commences. However, failure to obtain the required documents prior to the work beginning shall not waive the CONSULTANT’s obligation to provide them. The CITY reserves the right to require complete, certified copies of all required insurance policies, including endorsements required by these specifications, at any time.
Subcontractors CONSULTANT shall require and verify that all subcontractors maintain insurance meeting all the requirements stated herein, and CONSULTANT shall ensure that CITY is an additional insured on insurance required from subcontractors.
Special Risks or Circumstances CITY reserves the right to modify these requirements, including limits, based on the nature of the risk, prior experience, insurer, coverage, or other special circumstances.

STAFF RECOMMENDATION:
Open and conduct a public hearing to receive all written and verbal testimony regarding the approval of a Memorandum of Understanding (MOU) between the County of Humboldt (County) and the City of Fortuna (City) to continue providing Housing Program Administration and Related Services for the City, by approving Resolution 2024-36
EXECUTIVE SUMMARY:
The City of Fortuna, by Resolution 2013-09 adopted in April of 2013, entered into an MOU with the County to provide Housing Program Services and Administration. By adopting Resolution 2024-36, the City will renew the MOU to continue the services currently provided by the County.
The City has demands for these services, such as current loan recipients who have had a change in income, family members who wish to assume the loan, or if the loan recipient passes away. The City has also had several members of our community inquire about what housing-related programs the City offers, but Finance does not have the staff to perform the needed qualification and background checks.
FINANCIAL IMPACT:
The financial impact of this MOU will depend on the amount of service provided by the County of Humboldt in support of the City’s housing programs.
RECOMMENDED COUNCIL ACTION:
1. Receive staff report and review questions with staff
2. Open Public Comment
3. Close Public Comment
4. Motion to Adopt Resolution 2024-36, and read by title only. Roll call vote.
