In Recognition and Support of
National Mentoring Month
January 2025
WHEREAS, this year Big Brothers Big Sisters of the North Coast, CASA of Humboldt, and Boys and Girls Club of the Redwoods, celebrate the 140 combined years of service to the youth in Humboldt County.

Big Brothers Big Sisters of the North Coast recognizes that the future of Humboldt County rests on the success of its youth; and
WHEREAS, a mentor is a caring, consistent presence who devotes time to help a young person develop personal strength and achieve their potential through a structured and trusting relationship. Quality mentoring encourages positive choices, promotes self-esteem, supports academic achievement and introduces young people to new ideas; and
WHEREAS, research shows that young people matched with a caring adult through a quality mentoring program are 55 percent more likely to be enrolled in college, 92 percent more likely to report participating regularly in extracurricular activities and sports, 78 percent more likely to volunteer and twice as likely to say they held a leadership position than those who did not have a mentor; and WHEREAS, youth development experts agree that mentoring is critical to the social, emotional and cognitive development of youth, helping them navigate the path to adulthood more successfully; and WHEREAS, our community has a number of community volunteers, teachers and many others who support the mentoring movement and work selflessly to improve our children’s odds for success; and WHEREAS, the future of Fortuna rests on the success of its children and youth.

NOW, THEREFORE, I, Mike Johnson, by virtue of the authority vested in me as Mayor of the City of Fortuna proclaim that January 2025 is National Mentoring Month in the City of Fortuna and thank all of our local heroes who participate in quality mentoring programs to equip our youth with the tools to lead healthy and productive lives. The City Council also calls on residents to help close the gap between the availability of mentors and the number of children facing challenging circumstances who would love to spend time with a Big Brother, Big Sister, CASA Advocate, or Boys and Girls Club of the Redwoods Mentor. It takes Little to be BIG for National Mentoring Month.

SIGNED this 6th day of January, 2025 at the City of Fortuna, in the State of California, and in witness thereof, the seal of Fortuna.

STAFF REPORT
City Council Business Item
DATE: January 6, 2025
TO: Honorable Mayor and City Councilmembers
FROM: Shari Meads, Community Development Director
THRU: Amy Nilsen, City Manager
SUBJECT: Second Reading and Adoption of Ordinance 2024-769, Amending the Fortuna Municipal Code Title 17 (Zoning Regulations) to Add Chapter 17.10, Reasonable Accomodations Policy and Procedures and Find the Amendments to be Exempt from CEQA.

STAFF RECOMMENDATION
The Community Development Department recommends that the City Council hold a public hearing to conduct the second reading and adopt Ordinance 2024-769 to amend Fortuna Municipal Code Title 17, Zoning Regulations, to add Chapter 17-10, Reasonable Accommodations Policy and Procedures (Amendment), and find the Amendment exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Sections 15162 and 15061(b)3.

DISCUSSION
The City’s General Plan Housing Element (6th Cycle, 2019-2027) (Housing Element) was adopted by the City Council on August 7, 2019. The Housing Element fulfills State of California requirements to provide for a variety of housing types, including multifamily rental housing, factory-built housing, mobile homes, housing for agricultural employees, supportive housing, single-room occupancy units, emergency shelters, and transitional housing (Government Code Sections 65583 and 65583.2).

The California Department of Housing and Community Development (HCD) enforces Housing Element Implementation. While the City has made some progress toward implementing the General Plan and Housing Element, it is delinquent on many measures. HCD has contacted City staff in what could be considered an audit process to verify implementation statuses. If a City is deemed noncompliant, its Housing Element can be decertified. If a City’s Housing Element is decertified, significant monthly monetary penalties may be assessed, and Grant funds and opportunities can be lost.

In addition, developers can exploit the “builder’s remedy law,” essentially bypassing all City zoning requirements and development standards if a project includes 20% or more residential units set aside for lower-income residents. This could result in the construction of large, dense developments in areas with limited infrastructure among other issues.

For this report, staff focused on implementing Housing Element Program H-18, the Reasonable Accommodation Procedure, which directs the City to develop and formalize a process for Business Item 5a

providing individuals with disabilities reasonable accommodation in rules, policies, practices, and procedures. This ensures equal access to housing and facilitates the development of housing for individuals with disabilities.

Federal and State Fair Housing Laws
The federal Fair Housing Amendments Act of 1988 and California’s Fair Employment and Housing Act prohibit discrimination against individuals with disabilities in housing and require that jurisdictions take affirmative action to eliminate regulations and practices that deny housing opportunities to individuals with disabilities. More specifically, fair housing laws require that jurisdictions provide individuals with disabilities or developers of housing for people with disabilities, flexibility in the application of land use and zoning and building regulations, practices and procedures.

Local jurisdictions must even waive certain requirements when it is necessary to eliminate barriers to housing opportunities. For example, people with mobility disabilities may need to install exterior ramps, which might normally violate zoning setbacks, placement, or site coverage requirements. People with intellectual or mental health disabilities may need a higher fence than usually allowed to offer more privacy and reduce anxiety.

Staff recommends adopting the proposed Amendment to allow flexibility in the application of zoning and land use regulations and procedures to ensure people with disabilities have equal access to housing. The specific text of the proposed Amendment is provided in Exhibit A which is attached to the draft ordinance provided for consideration.

REGULATORY CONTEXT
Fortuna Municipal Code Section 17.07.200 outlines the Zoning Regulations amendment process.

Pursuant to Section 17.07.200(B), the Planning Commission must hold a public hearing and consider public comment on any such ordinance or amendment. Section 17.07.200(D) further mandates that following the public hearing, the Planning Commission provide a written recommendation to the City Council. Planning Commission Resolution (P-2024-3120), included as Attachment 2 to this report, implements this requirement.

PUBLIC NOTICE

ENVIRONMENTAL REVIEW
Pursuant to CEQA Guidelines Section 15162, the Housing Element (including Program H-18) was analyzed in the City’s certified General Plan Program Environmental Impact Report. (PEIR), and no substantial changes or new information merit subsequent analysis of the Amendments. Before Housing Element adoption, the applicable housing element policies and programs were analyzed for potential environmental impacts and were found not to have a significant impact on the environment.

To the extent the Amendment is a separate project for the purposes of CEQA, it is exempt under CEQA Guidelines Section 15061(b)(3), which exempts projects where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment. The Amendment aligns the FMC with General Plan Housing Element policies, programs, and State regulations.

Staff will file a Notice of Exemption upon adoption per CEQA guidelines.

RECOMMENDED COUNCIL ACTION

1. Open the Public Hearing

2. Receive staff presentation and review draft ordinance with staff.

3. Open public comment.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FORTUNA TO AMEND FORTUNA MUNICIPAL CODE TITLE 17, ZONING REGULATIONS TO ADD CHAPTER 17.10, REASONABLE ACCOMMODATIONS POLICY AND

PROCEDURES, AND FIND THE AMENDMENT TO BE EXEMPT FROM

ADDITIONAL CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) REVIEW UNDER CEQA GUIDELINES SECTION 15162, AND 15061(B)(3).

WHEREAS, on August 7, 2019, the City Council, by Resolution 2019-21, adopted the 6th Cycle Housing Element covering the planning period of 2019-2027 ("Housing Element"); and WHEREAS, the Housing Element includes programs to implement the goals and policies contained therein; and
WHEREAS, Housing Element Program H-18 directs the City to develop a process for Reasonable Accommodation Requests pursuant to state law; and
WHEREAS, the City of Fortuna wishes to provide flexibility in the application of the Zoning Regulations for individuals with a disability, when flexibility is necessary to eliminate barriers to housing opportunities; and
WHEREAS, Section 3604(f)(3)(b) of Title 42 of the United States Code (the "Fair Housing Act") and Section 12955 et seq. of the California Government Code (the "California Fair Employment and Housing Act") prohibit local government from refusing to make reasonable accommodations in policies and practices when these accommodations are necessary to afford persons with disabilities equal opportunity to use and enjoy a dwelling; and WHEREAS, the draft Housing Element is within the scope of the City’s General Plan Program Environmental Impact Report (PEIR), certified and adopted by the City Council on October 26, 2010, by Resolution 2020-45 and therefore, no further environmental review is required; and WHEREAS, the Fortuna Planning Commission held a duly noticed public hearing on December 10, 2024, to consider and receive public testimony on the Amendment and associated CEQA recommendation; and
WHEREAS, on December 10, 2024, the Planning Commission unanimously adopted Resolution No. 2024-3120 recommending to the Fortuna City Council approval of the Amendment to add Chapter 17.10, Reasonable Accommodations Policy and Procedures to Title 17, zoning Regulations, and find the Amendment to be exempt from additional environmental review pursuant to CEQA Guidelines Sections 15162 and 1506l(b)(3); and WHEREAS, a public hearing notice describing the Fortuna City Council's public hearing on the Amendment and recommended CEQA determination was published in the North Coast Journal on December 5, 2024; and
WHEREAS, Staff recommends the Fortuna Municipal Code (FMC) be amended as set forth in Exhibit A, attached hereto and incorporated herein by reference, to implement the abovereferenced Housing Element program; and WHEREAS, the Fortuna City Council held a duly noticed public hearing on December 16 2024, to consider the Amendment and recommended CEQA determination.

NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF FORTUNA
DOES ORDAIN AS FOLLOWS:

SECTION 1. Recitals. The above and foregoing recitals are each incorporated by reference and adopted as findings by the City of Fortuna City Council.

SECTION 2. CEQA. Pursuant to CEQA Guidelines Section 15162, the Housing Element, including Program H-18 addressed in the Amendment, was analyzed in the City’s certified General Plan Program Environmental Impact Report. (PEIR). Addendum to the General Plan 2035 Final Environmental Impact Report (FEIR) entitled the "2023-2031 Housing Element Update General Plan EIR Addendum" certified and adopted certified and adopted by the City Council on October 26, 2010, by Resolution 2020-45, and no substantial changes or new information merits subsequent analysis of the Amendments.

Additionally, or alternatively, the proposed Amendment is exempt as a “common sense” exemption under CEQA Guidelines Section 15061(b)(3) because it implements a Housing Element program to promote fair and equal housing opportunities but does not involve any physical changes with the potential to create an adverse effect on the environment. It can be seen with certainty that there is no possibility that the Amendment may have a significant effect on the environment. The Amendment will align the FMC with General Plan Housing Element policies and programs and State law. Prior to adoption of the Housing Element, the applicable housing element policies and programs were analyzed for potential environmental impacts and were found to not have a significant impact on the environment. Upon adoption of the Amendment, Staff will file a Notice of Exemption as required by CEQA.

SECTION 3. Municipal Code Amendment. Chapter 17.10, Reasonable Accommodations Policy and Procedures, is hereby added to FMC Title 17, Zoning Regulations in the form and substance set forth in “Exhibit A” attached hereto and incorporated by reference. Following approval of this Ordinance, without modifying the substance, the City Clerk shall cause the Fortuna Municipal Code amendment to be consistent in form and style with Title 17 of the Fortuna Municipal Code.

SECTION 4. Effective Date. The effective date of this ordinance is thirty (30) days after adoption by the City Council of the City of Fortuna.

SECTION 5. Severability. If any provision of this ordinance is determined to be invalid, such invalidity does not affect the remaining provisions or applications of the ordinance that can be given effect without the invalid provision or application, and to this extent, the provisions of this resolution are severable. The City Council of the City of Fortuna declares that it would have adopted this Ordinance irrespective of the invalidity of any portion thereof.

SECTION 6. Limited Repeal. Any provision of the City of Fortuna Municipal Code or appendices to it that are inconsistent with the requirements of this ordinance, to the extent of such inconsistencies and no further, is hereby repealed or modified to that extent necessary to effect the provisions of this ordinance.

Exhibit A
Title 17. Zoning regulations
Chapter 17.10

REASONABLE ACCOMMODATIONS POLICY AND PROCEDURES

17.10.010 – Intent and purpose.

A. Intent. The intent of this Chapter is to provide flexibility in the application of the Zoning regulations for individuals with a disability, when flexibility is necessary to eliminate barriers to housing opportunities. This Chapter will facilitate compliance with federal and state fair housing laws, and promote housing opportunities for Fortuna residents.

B. Purpose. The purpose of this Chapter is to establish a procedure for persons with disabilities seeking fair access to housing to make requests for reasonable accommodation in the application of Fortuna's zoning laws, rules, policies, practices and procedures pursuant to Section 3604(f)(3)(b) of Title 42 of the United States Code (the "Fair Housing Act") and Section 12955 et seq. of the California Government Code (the "California Fair Employment and Housing Act"), which prohibit local government from refusing to make reasonable accommodations in policies and practices when these accommodations are necessary to afford persons with disabilities equal opportunity to use and enjoy a dwelling.

17.10.020 – Applicability.

A. A request for reasonable accommodation may be made by any person with a disability as defined herein, their representative or any entity, when the application of a zoning law or other land use regulation, policy or practice acts as a barrier to fair housing opportunities. This Chapter is intended to apply to those persons who are defined as disabled under the Acts as defined herein.

B. A request for reasonable accommodation may include a modification or exception to the rules, standards and practices for the siting, development and use of housing or housing-related facilities that would eliminate regulatory barriers and provide a person with a disability equal opportunity to housing of their choice. A request for reasonable accommodation shall comply with Section 17.10.040 (Application Requirements).

17.10.030 – Definitions.
"Acts" means the "Fair Housing Act" (Section 3601 et seq. of Title 42 of the United States Code) and the "California Fair Employment and Housing Act" (Section 12955 et seq. of the California Government Code).
"Person with a Disability" is any person who has a physical or mental impairment that limits one or more major life activities; anyone who is regarded as having such impairment; or anyone who has a record of such impairment, as further defined and amended in the Fair Employment and Housing Act (FEHA) of California Government Code Section 12926(i)(1), (2), and (m)(1), (2).

Federal and State fair housing laws do not protect an individual's current unlawful use of controlled substances or other drugs, unless that individual has a separate disability. "Request for Reasonable Accommodation" means a request to modify land use, zoning and building regulations, policies, practices, or procedures in order to give people with disabilities an equal opportunity to use and enjoy a dwelling.

17.10.040 – Application requirements.

A. Application. A written request for reasonable accommodation shall be submitted to the Community Development Director and must include the following information:

1. The applicant's name, address and telephone number;

2. Address of the property for which the request is being made;

3. The current actual use of the property;

4. The basis for the claim that the individual is considered disabled under the Acts;

5. The Zoning Code provision, regulation or policy from which reasonable accommodation is being requested; and

6. Why the reasonable accommodation is necessary to make the specific property accessible to the individual.

B. Review with other land use or design review applications. If the project for which the request is being made also requires one or more unrelated discretionary approvals (including, but not limited to, design review, conditional use permit, variance or subdivision), then the application for reasonable accommodation shall whenever feasible be submitted with the application for said permit(s).

C. An applicant may request City staff assistance to complete the request for reasonable accommodation.

17.10.050 – Application review and procedures.

A. Authority. The Community Development Director shall have the authority to consider and act on requests for reasonable accommodation and shall make reasonable accommodations in rules, policies, practices, or services when those accommodations may be necessary to afford persons with disabilities equal opportunities to use and enjoy the dwelling.

1. The Community Development Director shall issue a written determination no later than thirty (30) days after the receipt of a complete request for reasonable accommodation and may: (1) grant the accommodation request; (2) grant the accommodation request with specified nondiscriminatory conditions of approval; or (3) deny the request, pursuant to Section 17.10.050 (Findings and decision). All written determinations shall give notice of the right to appeal, if any, as specified in Section 17.010.070. The notice of determination shall be sent to the applicant by first class mail or in a format requested by the applicant.

2. Requests for reasonable accommodations that include unrelated discretionary approvals, shall be processed and considered separately from any discretionary elements of the same proposal. The Community Development Director, or their designee, shall act on the request for reasonable accommodation within a timely manner but no later than thirty (30) days of the date of a complete request pursuant to Section 17.10.040; however, if the request for a reasonable accommodation cannot be effectuated until a final decision is rendered on the related discretionary approvals, a "provisional approval" can be granted within the 30 day time frame allowing the reasonable accommodation request to be implemented, or modified as needed to obtain the same goal, at the time of the final discretionary approval, and shall become final at the same time. The applications for discretionary approval shall be separately considered and shall be subject to the procedures for consideration specified in the applicable Zoning regulations, depending on the type of application. The appropriate decision-making body shall act on all discretionary permits, but not the reasonable accommodation request.

B. While a request for reasonable accommodation is pending, all laws and regulations otherwise applicable to the property that is the subject of the request shall remain in full force and effect.

17.010.060 – Decision.

A. The Community Development Director’s written decision to grant or deny a request for reasonable accommodation will be consistent with the Acts and shall be based on consideration of the following factors:

1. Whether the housing, which is the subject of the request, will be used by an individual disabled under the Acts;

2. Whether the request for reasonable accommodation is necessary to make specific housing available to an individual with a disability under the Acts;

3. Whether the requested reasonable accommodation would impose an undue financial or administrative burden on the City;

4. Whether the requested reasonable accommodation would require a fundamental alteration in the nature of a City program or law, including but not limited to land use and zoning; and

5. Other reasonable accommodations that may provide an equivalent level of benefit.

B. Conditions of approval. In granting a request for reasonable accommodation, the Community Development Director may impose any conditions of approval deemed reasonable and necessary to ensure that the reasonable accommodation would comply with the findings required by Section 17.010.060(A). Conditions may be imposed to ensure that any removable structures or physical design features that are constructed or installed in association with the reasonable accommodation be removed once those structures or physical design features are unnecessary to provide access to the dwelling unit for the current occupants.

None of the findings of this Section are intended to supersede any other findings which might also be required for a discretionary permit that is reviewed concurrently with the request for accommodation.

17.010.070 – Appeal of adverse decision.

A. Within thirty (30) days of the date of the reviewing authority’s written decision, an applicant may submit a written appeal of an adverse decision.

B. An individual may request City staff assistance in filing an appeal of an adverse decision.

C. All appeals shall include a statement of the grounds for the appeal. Any information identified by an applicant as confidential shall be retained in a manner so as to respect the privacy rights of the applicant and shall not be made available for public inspection.

D. Nothing in this procedure shall preclude an aggrieved individual from seeking any other state or federal remedy available.

17.010.080 – Notice of availability.

A. Notice of the City of Fortuna's Reasonable Accommodations Policy and Procedures shall be displayed at public information counters in the City’s planning and building offices.

STAFF REPORT
City Council Business Item
DATE: January 6, 2025
TO: Honorable Mayor and City Councilmembers
FROM: Shari Meads, Community Development Director
THROUGH: Amy Nilsen, City Manager
SUBJECT: Second Reading and Adoption of Ordinance 2024-772, Amending the Fortuna Municipal Code Title 17, Zoning Regulations, Regarding Single-Room Occupancy Facilities and Finding the Amendments to be Exempt From CEQA.

STAFF RECOMMENDATION
City Council to hold a public hearing to introduce and conduct the first reading of Ordinance 2024-772 approving amendments to Fortuna Municipal Code Title 17, Zoning Regulations, regarding Single-Room Occupancy Facilities (Amendments) and finding the Amendments to be exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Sections 15162 and 15061(b)3.

In addition, developers can exploit the “builder’s remedy law,” to essentially bypass all City zoning requirements and development standards if a project includes 20% or more residential units set aside for lower-income residents. This could result in the construction of large, dense developments in areas with limited infrastructure among other issues.

For this report, Staff has focused on implementing Housing Element Program H-15, Housing for Extremely Low-Income Households, as part of this first phase of Fortuna Municipal Code (FMC) amendments. This program directs the City to amend the FMC to allow for single-room occupancy (SRO) facilities in compliance with State law.

Business Item 5b

Page 2 of 3 ends

SROs provide one of the least expensive forms of non-subsidized rental housing and can especially benefit seniors, persons with disabilities, and extremely low-income individuals. The proposed FMC amendments (Amendments) explicitly allow SRO Facilities compliant with appropriate parking, development, management and other standards in the R-M, N-C, and R-C zoning districts and with a conditional use permit in the C-T, M-1, and M-2 zoning districts. The specific text of the proposed Amendments is provided in Exhibits A-G attached to the draft ordinance provided for consideration.

REGULATORY CONTEXT
Fortuna Municipal Code Section 17.07.200 outlines the Zoning Regulations amendment process.

Pursuant to Section 17.07.200(B), the Planning Commission shall hold a public hearing and consider public comment on any such ordinance or amendment. Section 17.07.200(D) mandates that following the public hearing, the Planning Commission provide a written recommendation to the City Council. The attached Resolution (P-2024-3119), implements this requirement.

PUBLIC NOTICE
This item was noticed in compliance with Section 17.07.200(C) which outlines the City’s Zoning Amendments noticing procedure. Notice of the City Council hearing was published in the North Coast Journal on Thursday, December 5, 2024, including a general explanation of the hearing and the time, date, and location. The agenda was also posted 72 hours in advance of the meeting on the community bulletin board located in front of City Hall (621 11th Street).

FISCAL IMPACT
The Community Development Department’s annual budget allocation and the City’s annual legal assistance budget cover the cost of preparing the draft ordinance.

ENVIRONMENTAL REVIEW
Pursuant to CEQA Guidelines Section 15162, the Housing Element (including Program H-15) was analyzed in the City’s certified General Plan Program Environmental Impact Report. (PEIR), and no substantial changes or new information merit subsequent analysis of the Amendments. Before Housing Element adoption, the applicable housing element policies and programs were analyzed for potential environmental impacts and were found not to have a significant impact on the environment.

To the extent the Amendments are a separate project for the purposes of CEQA, they are exempt under CEQA Guidelines Section 15061(b)(3), which exempts projects where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment. The Amendments align the FMC with General Plan Housing Element policies, programs, and State regulations.

Staff will file a Notice of Exemption upon adoption as required by CEQA.

Based on the Record as described above and all matters deemed material and relevant prior to adopting this ordinance, the City Council finds the Amendments to be exempt from the requirements of CEQA pursuant to CEQA Guidelines Sections 15162 and 15061(b)(3) based on the following findings.

Pursuant to CEQA Guidelines Section 15162, the Housing Element, including Program H-15 addressed in the Amendments, was analyzed in the City’s certified General Plan Program Environmental Impact Report. STAFF REPORT
City Council Business Item
DATE: January 6, 2025
TO: Honorable Mayor and Council Members
FROM: Mat Nyberg, Deputy City Engineer
THROUGH: Amy Nilsen, City Manager
SUBJECT: Introduction and First Reading of Organic Waste Disposal Ordinance 2024- 770 Amendment
STAFF RECOMMENDATION:

Staff recommends that the Council hold a public hearing and conduct a first reading of amended Ordinance 2024-770, revising Chapter 8.14.070 of the Fortuna organic waste disposal reduction regulationsthatimplement and enforce CalRecycle organicsregulations and SB 1383 compliance.

EXECUTIVE SUMMARY:

The Organic Reduction and Recycling Ordinance 2024-770 was adopted by the City Council on August 5, 2024. The ordinance amended Title 8 (Health and Safety) of the Fortuna Municipal Code to include Chapter 8.14, Organic Reduction and Recycling. Chapter Section 8.14.070 defines requirements for commercial edible food generators and has been found to be incomplete upon development of the Commercial Edible Food Recovery Program by Abound Food Care.

The program requires that commercial edible food generator facilities under contract with food recovery organizations must be inspected annually and the Ordinance currently does not address that language.

The Humboldt County Department of Environmental Health (DEH) has served as the City of Fortuna Health Officer since 1977 per Ordinance 77-370. Given this historic relationship for health-related regulation and oversight, the City has requested that DEH perform commercial edible food generator facility inspections. DEH has obliged and requested that the City enforce the same requirements that they have for generators in their jurisdiction. Those requirements include registration with DEH, fee payment and annual inspections. In order to achieve that objective, staff have added the following language to Ordinance 2024-770:

8.14.070(c)(9) Register with the County of Humboldt Division of Environmental Health as an Edible Food Generator. Commercial Edible Food Generator Registration will require an annual fee in an amount to cover costs, as set by resolution or ordinance of the Humboldt County Board of Supervisors. No part of the registration fee shall be refundable.

8.14.070(c)(10) Submit to annual inspection by the County of Humboldt Division of Environmental Health for compliance with this Section.

Business Item 5c

Page 2 of 2 ends

During the editing process, staff also added clarifying language to 8.14.070(c)(7)(D) in bold below.

If it has not entered into a contract or written agreement with Food Recovery Organizations or Food Recovery Services pursuant to subsection (c)(2) above, a Commercial Edible Food Generator shall maintain a record that describes (i) its direct donation of Edible Food to end recipients (including employees) and/or (ii) its food waste prevention practices that result in it generating no surplus Edible Food that it can donate.

FINANCIAL IMPACT:

To date, the County has not established the fee for registration and inspection of facilities.

However, all proposed fees shall be paid by the commercial edible food generators and the City shall incur no budgetary impact.

RECOMMENDED COUNCIL ACTION:

1. Open the Public Hearing

2. Receive staff presentation and review Council questions with staff

3. Open Public Comment

4. Close Public Comment

5. Motion to introduce and conduct a first reading, by title only, of amendments to Ordinance 2024-770 and continue the public hearing to January 21, 2025. Roll call vote.

SUBJECT: City Council Appointments to Various Boards and Commissions STAFF RECOMMENDATION:

Staff recommends Council discuss appointments to various Boards and Commissions and upon consensus approve Mayor’s appointments.

EXECUTIVE SUMMARY:

During election years, at the last Council meeting of the year or the first meeting of the New Year, Council members discuss available seats and appointments to outside boards and commissions. Upon consensus, appointments are made by the Mayor with the approval of the Council. Attachment “A” is a list of current appointments for review.

Some of the agencies, like Local Area Formation Commission (LAFCo), Humboldt County Redevelopment Agency (RDA) Oversight Board and the Access Humboldt Board are seats that are appointed by the Mayor City Select Committee. Fortuna will have opportunities in the future to apply for seats on those governing bodies upon the expiration of current terms.

If a Council member currently has a seat on an outside board or commission they don’t think is a good fit, this agenda item is the opportunity to discuss making future changes or re-assign the seats. Council members are not “bound” to the boards and commission they are currently serving on.

RECOMMENDED COUNCIL ACTION:

1. Council discussion and consensus on Board and Commission appointments.

2. Open Public Comment.

3. Close Public Comment.

4. Motion to approve appointments as proposed. Roll call vote.
