SUBJECT: Correction and Modification to the Selection and Appointment of the City Council Vacancy
STAFF RECOMMENDATION:
The Fortuna City Council approve and ratify the below modified schedule to fill the vacancy on the Fortuna City Council:
a. Filing deadline for City Council applications Noon (12 pm) on Friday, April 18, 2025; and
b. Special Public Meeting to conduct City Council interviews & selection Monday, April 21, 2025 at 3 pm.
EXECUTIVE SUMMARY:
On March 12th, Jerry King submitted his resignation from the Fortuna City Council effective immediately. His term would have expired at the end of 2028. Per California Government Code Section 36512 the person appointed to the City Council will hold the City Council seat until the next General Election in November 2026, not November 2028 as stated in the March 17 staff report. Because Mr. King’s resignation came early in the term, the seat will then be up for election again in 2028 in compliance with state law.
After the March 17 City Council Meeting it came to the attention of the City Manager that not every Council Member was available on April 28 to select and appoint a new City Council Member to the vacant seat. Therefore, the selection and appointment process has been moved to a date and time that all currently seated City Council Members can attend. That date and time is Monday, April 21 at 3 pm.
This staff report is intended to provide ample and clear notification of the term of the vacant seat and the modified date of the selection and appointment special meeting to fill the City Council vacancy.
FINANCIAL IMPACT:
The financial impact is not direct, however, there has been and will be considerable staff time in responding to and preparing for the City Council vacancy to be filled.

1. Receive staff presentation and review questions with staff.
2. Open public comment.
3. Close public comment.
4. Motion to approve and ratify City Council application deadline to Noon (12 pm) on Friday, April 18; and notice and hold a Special Public Meeting to conduct interviews & selection on Monday, April 21, 2025 at 3 pm.
