STAFF REPORT
City Council Consent Item _______________________________________________________________________ DATE: June 2, 2025
TO: Honorable Mayor and Council Members
FROM: Mat Nyberg, Deputy City Engineer
THROUGH: Amy Nilsen, City Manager
SUBJECT: Approve the Fiscal Year (FY) 2025-26 Five-Year Capital Improvement Program (CIP)
STAFF RECOMMENDATION:
Approval of the City of Fortuna 2025-26 Five-Year Capital Improvement Program, and appropriate funding and inclusion of FY 2025-26 projects into the 25-26 overall budget.
EXECUTIVE SUMMARY:
Attached is the 2025-2026 Five-Year Capital Improvement Program (CIP). Each year, the CIP is updated and used to identify necessary infrastructure improvement projects as well as to coordinate the financing and timing of those projects in a way that maximizes the return to the public. The program is a guide for identifying and estimating current and future fiscal year projects necessary to maintain the City’s infrastructure, such as roads, sidewalks, streetlights, sewer and water mains, pipes and manholes, parks, community centers, and city buildings, which lists Capital Improvement Five-Year Program Expenditures.
The first year of the CIP is considered the Capital Budget. Each year, the City Council appropriates funding for the Capital Budget only, and years two through five are approved on a planning basis only.
A workshop with the City Council was held on May 5, 2025. At that meeting, staff provided a summary of the various projects, and answered questions presented by the Council. A presentation was also made to the Planning Commission at its regular meeting on May 13, 2025, at which time the commission found the plan to be consistent with the current General Plan.
Staff update the Five-Year CIP document annually by removing projects which are expected to be complete, or which no longer have funding. A complete sheet for each project is also included that provides more detail including a brief description of the project, justification for the project, funding source, as well as pictures and comments from staff.
Consent Item 4c
FINANCIAL IMPACT:
Once approved, the 2025-2026 fiscal year projects will be funded as part of the overall fiscal year 2025-26 budget.
RECOMMENDED COUNCIL ACTION:
Adopt the FY 2025-26 Five-Year Capital Improvement Program, and appropriate funding and inclusion of FY 2025-26 projects into the 2025-26 overall budget. Consent Agenda Vote.

Introduction 1
Introduction
Fortuna, known as “The Friendly City,” was incorporated in 1906 and is a small, rural community of just over 12,000 residents and covering an area of 5.1 square miles. The City of Fortuna is governed by a Council/Manager form of government. The City Council consists of five members, elected from the City at large, who serve four-year terms. The Mayor and the Mayor Pro Tem are elected biannually by the City Council from amongst its members. The City Manager works under the direction of the City Council and is responsible for supporting the policies enacted by the City Council, as well as managing the day-to-day operations of the City.
The City of Fortuna’s mission is “To be worthy of the public trust by providing timely, efficient, well-planned, and dependable services to the community.” Part of the City’s commitment to this mission is through a well-planned Five-Year Capital Improvement Program that works to maintain and replace aging facilities as well as construct new infrastructure, as it is needed.
What is a Capital Improvement Program? A Five-Year Capital Improvement Program (CIP) is a multi-year planning instrument used to identify needed capital improvement projects and to coordinate the financing and timing of improvements. The primary purpose of the CIP is to assist in the orderly implementation of the broad and comprehensive goals of the adopted General Plan and for the maintenance and replacement of the City’s infrastructure by establishing an orderly basis to guide local officials in making sound budget decisions and by focusing attention on community goals, needs, and capabilities to maximize the benefit of public expenditures.
Projects may include land and buildings, park and recreation facilities, street and storm drain facilities, wastewater collection and treatment facilities, and water treatment and distribution facilities.
An effective Capital Improvement Program:
1. Identifies specific public improvement projects by location, size, function, and cost (although some types of projects, such as street resurfacing and maintenance of water and sewer facilities may be shown on an annual allocation basis).
2. Establishes the timing for funding of major cost elements related to each project, such as right-of-way acquisitions, design, construction, etc.; for large projects, these may be spread over several years, while for smaller projects, only a single budget year is involved.
3. Proposes specific revenue sources for each project.
4. Facilitates priority setting where funds are insufficient to cover all desired projects.
5. Enhances coordination of separate but interrelated projects, whether internal or involving other agencies.
6. Gives other affected agencies, such as utilities, an opportunity to develop long-range programming.
7. Tends to discourage inefficient and frequent changes in allocation of capital resources.
8. Permits an educated approach to staffing for engineering, operation, and maintenance.
City of Fortuna 2025-2026 CIP
Introduction 2
For most cities, a five-year CIP period appears to be workable and realistic. Under this guideline, it is common for the first year of the CIP to be combined into the annual budget process. In all cases, the CIP would be flexible enough to make the inevitable adjustments for unanticipated cost changes, urgent projects, or other factors. In addition, the City will be able to more clearly identify and discuss the consequences of a delay in timely project commencement due to such factors.
How are projects funded? Funding for projects is usually derived from special source funds including gas tax, water reserves, sewer reserves, remaining balances of the General Fund, or state, federal, and other grants.
Gas tax, water, and sewer fund revenues are budgeted only for capital projects in the categories appropriate to their sources.
The General Fund’s ability to make significant contributions to the CIP has been declining over the last several years by a combination of factors. The City’s General Fund has had its revenues reduced by the State budget crisis. The General Fund currently does not have the ability to finance capital improvement projects in the same way that is has done in the past.
Federal, state, and other grant funds may only be used for the purpose for which the funds were received.
Although this CIP falls short of funding the optimum level of infrastructure improvements, it does represent an effort to use all available funding sources for the most vital projects.
Project priorities should be established by:
1. Projects with a clear issue of public health and safety.
2. Projects which trigger irreversible or serious long-range consequences.
3. Projects that eliminate liabilities experienced in the past.
4. Projects mandated by county, state and/or federal laws, the public and other agencies.
5. Projects directly related to established goals or objectives.
6. Projects directly affecting the quality of life for residents of the City of Fortuna.
Every effort is made to ensure that all projects are described accurately and have sound cost estimates. Some projects are conceptual in nature and these cost estimates are difficult to generate and should be considered flexible.
Estimates are initially made for every project in 2025 dollars. As priorities for construction are assigned for each project, the dollar amount is updated to more accurately reflect costs within the proposed year of construction. The estimates are general with the intent that they should be revised as they are brought into the annual budget process.
The projects identified in this 2025-2030 CIP are considered essential to implement goals, protect public property from deterioration and extending its useful life, and preserve the City’s prior infrastructure investments.

Water Meter and Radio Changeout Project CIP# 9129
Description
Replace old “SR1” style radios with newer “SR2” style
radios.
Justification
When reading meters the SR1 radios require a closer
approach to the equipment than the newer SR2 radios. This requires the operator to drive slowly up each alley in the city, adding several hours to the meter reading process. The older radios are also reaching the end of life, and some are requiring multiple attempts to read.
Studies and Reports
Identified by the Utilities Crew.
Funding Sources

Comments
The replacement of these radios will also make it easier for the city to move eventually towards being able read meters from City Hall and eliminate the need to do drive-by reading entirely.

CCF Piping & Well Replacement Project CIP# 9066
Description
Replacement of the underground source
main pipes at the Corrosion Control
Facility. Construction of a new shallow well
in place of previously drilled Well 5b.
Addition of various electronic and metering
equipment for the new well.
Justification
Current piping configuration results in
pump inefficiencies from the water wells.
The updated pipe configuration will create
the most efficient operation for each well
pump. Well 5 was previously
underperforming, and the new Well 5b was
found to have levels of manganese that
require robust and expensive treatment to
bring the well online.

Generators for Park 5, Firemen’s Pavilion and Museum Project CIP# TBD Description
A generator that would have the ability to
power the Firemen’s Pavilion, the Rohner
Rec Hall, the Parks & Recreation Office,

have identified a generator that is no longer
in use in the City’s water system, and are
planning to determine what steps are
required to connect this generator at the
parks facilities.
Justification
Currently, if a power-outage occurs, all
electrical to these facilities ceases to be available. This makes it difficult for, not only City staff to be able to work efficiently on projects that require electricity, but for facility renters and park users who have access to these facilities,
which can result in lost staff time, and lost
revenue from facilities having to be closed due to no power.

STAFF REPORT
City Council Consent Item
DATE: June 2, 2025
TO: Honorable Mayor and Council Members
FROM: Amy Nilsen, City Manager
SUBJECT: Approve Appointment of Public Works Director and Advance Salary Step STAFF RECOMMENDATION:
Approve the appointment of Brian Issa as the Public Works Director and an advance salary step 4 as detailed in the 2024-25 and 2025-26 full-time pay rate schedule.
EXECUTIVE SUMMARY:
The Fortuna Municipal Code (FMC) identifies the Public Works Director as the Department Head for the Public Works Department with the main purpose of operating and maintain the city’s streets, drainage system, buildings, utility system, vehicles, and equipment. The Public Works Director position has been vacant since April 8 and filled by an interim appointment. The position is an unrepresented at-will position under the supervision of the City Manager. The position has been a contract position in the past and is not presently a contract position.
The City actively recruited for several months and conducted interviews of qualified applicants for the position. The recruitment process was difficult because public works professionals are in very high demand. The City was fortunate to receive an application from a highly qualified candidate for the position named Brian Issa. Mr. Issa was interviewed by a panel that included the Interim Public Works Director, City Manager and Former Public Works Director. Mr. Issa then met with four other City Department Heads.
Mr. Issa has a bachelor’s degree from Utah State in Biology and Chemistry, and a Master’s Degree in Community and Regional Planning. Most recently, Mr. Issa worked for the City of Eureka as a Deputy Public Works Director and was responsible for oversight and management of water distribution, wastewater collection, streets, equipment operations, and code enforcement. Mr. Issa has also managed a number of projects such as: implementation of telematics across a fleet of more than 150 vehicles; replacement of 10,000 water meters; responsible for overseeing the transition to OpenGov permitting and licensing software; start up and management of a new fueling station, overseeing the streets, water and wastewater crews; and managed transition to customer ownership of all sewer laterals.
The Council has reviewed with the City Manager Mr. Issa’s application and resume in closed session and reviewed compensation at step 4 of the pay rate schedule for that position, and the accumulation of 40 hours of sick and 68 hours of vacation leave. Mr. Issa has accepted the offer and has cleared the necessary physical and background required to be appointed for the position and is expected to start work on June 16, 2025.

FISCAL IMPACT:
The total pay and benefits cost of the Public Works Director is budgeted in the Fiscal Year 2024- 2025 and 2025-2026 budgets.

City Council Consent Item
DATE: June 2, 2025
TO: Honorable Mayor and Council Members
FROM: Mat Nyberg, Deputy City Engineer
THROUGH: Amy Nilsen, City Manager
SUBJECT: Authorize the City Manager to award the Annual Water Valve Replacement Project (CIP 9990) to Wendt Construction and establish a maximum contract amount of $97,601
STAFF RECOMMENDATION:
Authorize the City Manager to award the Annual Water Valve Replacement Project (CIP 9990) to Wendt Construction and establish a maximum contract amount of $97,601.
EXECUTIVE SUMMARY:
Periodically, the City’s utilities staff are required to make repairs or add services to the City’s domestic water distribution network. When doing so, staff utilize shut-off valves to isolate the portion of the network where work needs to be performed in such a way that as few people as possible are impacted. In some areas of the City however, some older valves do not fully shut off and staff are forced to move to the next valve back in order to accomplish a full shut-off so pipes can be depressurized and worked on; often affecting many more citizens. Another impact is that such situations create more work and result in longer shut down times. In an effort to address these issues, staff have identified various locations around the City where valves have failed and organized them by priority.
The first area selected for this long-term project is located on Newburg Road spanning from Sunnybrook Drive to South 15th Street. In total, there will be 11 valves replaced at five locations ranging from six to 12-inches in size. Currently, in order to do work on South 15th Street, staff are required to use the valve at Meadowbrook Lane to achieve a full shut-off, which means everyone on Sunnybrook Drive, Randolph Way and South 15th Street is impacted, instead of only South 15th Street. This project will resolve this problem at each of those intersections.
The Annual Water Valve Replacement Project bid package was released and publicly advertised on May 15th, 2025. The bid period ended on May 28th, 2025, at 2:00 p.m. at which time the City received four responsive bids shown in the table below:
Consent Item 4e
Bidder Base Bid Total
Wendt Const. $97,601
G.R. Sundberg $166,750
Mercer Fraser $172,000
Wahlund Const. $176,800
The apparent low bid was submitted by Wendt Constructionwith a total bid price of $97,601. City staff have confirmed that the bid received from Wendt Construction was fully responsive and that they have active licenses and registrations
If the project is awarded, staff anticipate being under contract by mid-June. Mobilization and construction are anticipated to begin in early July. The draft Notice of Potential Award is included as Attachment A.
FINANCIAL IMPACT:
The project is funded through the City Water Capital Reserve Funds (Fund 510) with fiscal year funding of $300,000. The total anticipated costs to complete this project are shown in the table below and the remaining budgeted funds will be utilized for the next prioritized valve replacement project:
Item Cost
Contract Wendt Const. $97,601
Construction Contingency (20%) $19,399
Total $117,000
RECOMMENDED COUNCIL ACTION:
Authorize the City Manager to award the Annual Water Valve Replacement Project (CIP 9990) to Wendt Construction and establish a maximum contract amount of $117,000. Consent agenda vote.

the activities of PG&E and PG&E's Representatives pursuant to this License Agreement are referred to herein as "PG&E's Activities."
2. Use of License Area and Interior Common Areas of the Property. During Use Days (as defined in Section 5 below), PG&E and PG&E's Representatives and customers shall have the exclusive right to use the License Area as a Community Resource Center. Services to be provided in the License Area may include, among other things, providing PG&E customers with water and snacks and the ability to charge phones. PG&E and PG&E's Representatives shall have the right to set up tables and chairs in the License Area. In addition to the exclusive use of the License Area, PG&E and PG&E's Representatives and customers shall have the non-exclusive right, during Use Days, to use lobbies, hallways, stairways, elevators (if operational), restrooms, and other interior common areas of the Property. PG&E and PG&E's Representatives shall also have the right to install temporary directional signage in the common areas of the Property.
3. Staging Area; Parking.
(a) Staging Area. During Use Days, PG&E and PG&E's Representatives shall have the exclusive right to use the exterior area of the Property shown on EXHIBIT A (the "Staging Area") to support the operation of an indoor customer resource center in the case of an Emergency Event. PG&E and PG&E's Representatives shall have the right to set up tents, install trailers, portable toilets, fencing, and temporary signage, park mobile vehicle units and other vehicles, and deliver and stage equipment, supplies and materials in the Staging Area. (b) Parking. PG&E and PG&E's Representatives and customers shall have the non-exclusive right to park vehicles in portions of the Parking Lot shown on EXHIBIT A during Use Days.
(c) Personnel. During Use Days PG&E shall have the non-exclusive right to use the License Area, up to twenty-four (24) hours per day. Hours for use to PG&E customers shall be from 8:00 am to 10:00 pm. On Use Days, the License Area shall be fully staffed by PG&E and its representatives, at PG&E’s sole cost and expense. PG&E may provide uniformed unarmed security at its cost and expense to ensure the protection of its equipment, the safety of the public and to prevent any damage to the Property.
4. Generator. Subject to the terms and conditions of this Section 4, LICENSOR grants PG&E and PG&E's Representatives a license to install, maintain, operate, repair, and replace a portable generator and related equipment (collectively, the "Generator") in the exterior area of the Property shown on EXHIBIT A attached hereto (the "Generator Site"). At PG&E's option, PG&E or PG&E's Representatives may install temporary fencing, bollards, or other barriers around the Generator Site. LICENSOR grants to PG&E and PG&E's Representatives exclusive use of the Generator Site. For PSPS Event use, PG&E anticipates that the Generator may remain in place during wildfire season from approximately June 1 until December 31 of each year. For Emergency Event use, PG&E anticipates that the Generator may remain in place during Emergency Event use and approximately one week before and one week after an Emergency Event. PG&E and PG&E's Representatives shall have the right, without prior notice to LICENSOR, to enter the Property at all times to access the Generator. PG&E, at its expense, shall be responsible for obtaining all required permits for the Generator and complying with all laws 16213.106 4849-6712-2099.4 3 of 10

relating to the Generator. Notwithstanding the definition of PG&E's Activities, the presence of the Generator on the Property and activities related to the Generator shall not be considered PG&E's Activities for purposes of determining Use Days, and PG&E shall not be required to pay any additional license fees or other sum in connection with the Generator. The Generator is solely for the benefit of PG&E and PG&E's customers. PG&E shall, at its sole cost and expense, have the exclusive responsibility to maintain and secure the Generator while on the Property and shall use, operate and maintain the Generator in a reasonable manner and in accordance with the manufacturer’s recommendations. LICENSOR shall have no obligations or liability to PG&E with respect to the Generator, including but not limited to any obligation (i) to maintain, operate, replace or repair the Generator and (ii) to secure or otherwise take any act, whether affirmative or passive, to protect the Generator from theft or damage. PG&E expressly and irrevocably releases LICENSOR from any liability for any malfunctioning, damage, or other injury to the Generator, except to the extent caused by the negligence or willful misconduct of LICENSOR, its officers, agents or employees. Promptly after the expiration of the term of this License Agreement, PG&E or PG&E's Representatives shall remove the Generator and any barriers installed by PG&E or PG&E's Representatives.
5. LICENSOR’S Use of Automatic Transfer Switch. PG&E does not grant [hereby grants to] LICENSOR the right to connect its own generator (“Licensor’s Generator”) to the Automatic Transfer Switch (“ATS”). [and to use the ATS, provided that LICENSOR shall at all times comply with the following requirements:
(a) In order to reduce the risk of fire, in no event shall Licensor’s Generator have a rating greater than 400 amps.
(b) LICENSOR shall give PG&E at least 2 days’ written notice following each time LICENSOR connects or disconnects Licensor’s Generator to the ATS, which notice shall specify the date and approximate time LICENSOR has connected or disconnected Licensor’s Generator to the ATS. Said notice shall also specify the anticipated period of time that Licensor’s Generator will remain connected to the ATS if disconnect has not taken place. (c) Only a licensed electrician or properly trained staff may connect or disconnect Licensor’s Generator to the ATS.
(d) If LICENSOR experiences a problem with the ATS, LICENSOR shall promptly contact PG&E. In no event shall LICENSOR attempt to make any repairs or modifications to the ATS.
(e) LICENSOR shall exercise due care not to damage the ATS. LICENSOR shall promptly report to PG&E any damage to the ATS caused by LICENSOR, its employees, agents, or contractors (collectively, including LICENSOR, “Licensor Parties”). LICENSOR shall reimburse PG&E for PG&E’s cost to repair or replace the ATS as a result of the acts or omissions of Licensor Parties within thirty (30) days after written request accompanied by reasonable supporting documentation.
(f) Licensor Parties shall not act in any manner or indicate to any third party that they are acting as an agent of PG&E.

(g) PG&E makes no representations or warranties of any kind or nature to LICENSOR regarding the ATS, including, but not limited to, the operation, capacity or condition of the ATS. LICENSOR expressly accepts and assumes all risk associated with its use of the ATS, and PG&E shall have no liability to LICENSOR in connection with any failure or malfunction of the ATS.
(h) LICENSOR shall indemnify, defend and hold harmless PG&E and its officers, agents, and employees from and against all Claims caused by or arising, in whole or in part, in connection with use of the ATS by Licensor Parties.
The provisions of Sections 2(e), 2(f), 2(g), and 2(h) shall survive the expiration or earlier termination of the License Agreement.
6. Default by LICENSOR. If LICENSOR shall breach any of its obligations under Section 5 above, PG&E shall have the right, in addition to any other remedies that may be available at law or in equity, to terminate LICENSOR’s right to use the ATS effective immediately upon notice to LICENSOR.
7. Term. Unless sooner terminated in accordance with Section 15, below, this License Agreement shall be for a term of five (5) years, commencing on June 6, 2025 (the "Commencement Date"), and expiring on June 6, 2030 (the "Termination Date").
Notwithstanding the term of this License Agreement, PG&E anticipates that it will use the License Area and the Staging Area on an occasional basis, if at all, for periods of approximately two (2) to ten (10) days at a time. The days (including any partial days) during which any of PG&E's Activities are occurring in or on the License Area or the Staging Area are referred to herein as "Use Days." During Use Days, PG&E shall have the exclusive right to use the License Area and the Staging Area from 7:00am until 11:00pm. This License Agreement may be amended by written agreement executed by both parties.
8. License Fee. PG&E shall pay a license fee ("License Fee") of Five Hundred and Fifty Dollars ($550.00) per day for each Use Day.
9. Emergency Event or PSPS Notice. PG&E shall give LICENSOR at least eight (8) hours' prior notice (the "Emergency Event or PSPS Notice") of the dates and times that PG&E desires to access and use the Property in connection with an Emergency or PSPS Event. Within four (4) hours after receipt of an Emergency Event or PSPS Notice, LICENSOR shall confirm receipt of the Emergency Event or PSPS Notice. PG&E's use of the Property in connection with an Emergency Event or PSPS Event shall take priority over other uses and events. If another use or event is scheduled at the Property that would conflict with PG&E's use of the Property during the dates and times specified in the Emergency Event or PSPS Notice, LICENSOR shall cancel such event and indemnify and defend PG&E from any and all Claims related to such cancellation.
LICENSOR acknowledges that PG&E may give LICENSOR multiple Emergency Event or PSPS Notices during any calendar year.
10. Use of License Area and Staging Area.
(a) As Is. To LICENSOR'S current actual knowledge, the Property complies with all laws, including the Americans with Disabilities Act and other accessibility laws. PG&E 16213.106 4849-6712-2099.4 5 of 10

accepts the License Area and the Staging Area "AS-IS," "WHERE-IS" and "WITH ALLFAULTS," subject to all applicable zoning, municipal, county and state laws, ordinances, and regulations governing and regulating the use of the License Area and the Staging Area. PG&E may request LICENSOR to perform alterations, repairs, or improvements to the License Area and the Staging Area, but PG&E understands and agrees that LICENSOR shall not be obligated to make any such alterations, repairs or improvements at any time. Except in the event of an emergency, PG&E shall not make any alterations, repairs, or improvements to the Property without the prior written consent of LICENSOR, which consent shall not be unreasonably withheld, conditioned, or delayed.
(b) Use. PG&E shall exercise reasonable care in the conduct of PG&E's Activities in the License Area and the Staging Area. Without limiting the generality of the preceding sentence, PG&E shall maintain the License Area and the Staging Area in reasonably neat and orderly condition during Use Days; provided, however, that LICENSOR, as part of the License Fee and without additional compensation, shall provide all necessary janitorial services to the License Area and common areas during Use Days, including, but not limited to, removing trash and stocking restrooms with supplies. PG&E shall not use the License Area or the Staging Area or permit anything to be done in or about the License Area or the Staging Area during Use Days that will in any way conflict with any law, statute, zoning restriction, ordinance or governmental rule or regulation or requirement relating to the use or occupancy of the License Area or the Staging Area. During Use Days, PG&E shall not allow the License Area or the Staging Area to be used for any unlawful or objectionable purpose, nor shall PG&E cause, maintain or permit any nuisance in, on or about the License Area or the Staging Area. (c) Mechanic's Liens. PG&E shall keep the Property free and clear of all mechanic's liens arising, or alleged to arise, in connection with any work performed, labor or materials supplied or delivered, or similar activities performed by PG&E or at PG&E's request or for PG&E's benefit. If any mechanic's liens are placed on the Property in connection with PG&E's use or PG&E's Activities, PG&E shall diligently pursue all necessary actions to remove such liens from title, either by payment or by recording a lien release bond in the manner specified in California Civil Code Section 8424 or any successor statute. (d) Restoration. Upon PG&E's ceasing to use the License Area and the Staging Area in connection with a particular Emergency or PSPS Event, PG&E shall remove all personal property of PG&E from the License Area, remove all vehicles, personal property, debris and waste material of PG&E and PG&E's Representatives from the Staging Area, and repair and restore the License Area and the Staging Area as nearly as reasonably possible to the condition that existed prior to PG&E's entry hereunder.

In addition, LICENSOR will provide PG&E with telephone or cellphone numbers of staff in calling order to contact in an emergency as set forth in EXHIBIT B. EXHIBIT B shall be updated as needed to reflect current names and contact information.
12. Indemnity. Except to the extent caused by the negligence or willful misconduct of LICENSOR, its officers, agents, or employees, PG&E shall indemnify, defend and hold harmless 16213.106 4849-6712-2099.4 6 of 10
