STAFF REPORT
Consent Agenda Item
DATE: July 21, 2025
TO: Honorable Mayor and Council Members
FROM: Aaron Felmlee, Finance Director
THROUGH: Amy Nilsen, City Manager
SUBJECT: Finance Department Monthly Report
STAFF RECOMMENDATION:

Receive report as an informational item.

EXECUTIVE SUMMARY:

Community Development Block Grant (CDBG) / HOME Investment Partnerships Program:

Staff have been working with the County to ensure our fiscal year end 2025 Annual Monitoring Reports for the Fortuna Family Apartments are completed and submitted to the State. This project was originally funded by a grant the City received through the HOME Investment Partnerships Program that is run by the California Department of Housing and Community Development (HCD). Each year the City is required to obtain a clearance letter from HCD which certifies the City is in compliance with all conditions placed upon the project at the time the grant funds were given to the City. Getting clearance from the State allows the City to stay in good standing with HCD and continue to be eligible for grant funds. We do not anticipate any issues with receiving clearance for fiscal year end 2024.

Fiscal Year 2024-25 Financial Statement Audit:

July 1 signaled the start of a new fiscal year for the City. As such, staff is working on closing the previous fiscal year and preparing for the City’s annual financial statement audit. The Cities auditor will be Michael O’Connor from O’Connor and Company. Michael performed last year’s audit for the City as well. Michael and his staff are planning to come on site for a week to conduct interim audit work during either the month of August or September.

Finance staff will be preparing for this interim audit work by preparing the necessary reconciliations, reports, adjustments and backup information that is required during the audit process. Having these documents ready prior to the auditors’ arrival has provided for a smooth audit process in past years.

Measure E Update:

The Measure E committee’s next regularly scheduled meeting is set for September 16, 2025 at 5:30pm. The primary purpose of this meeting will be for Staff to review with the Committee the list of Measure E funded projects that were included in the Council Adopted Budget for fiscal year 2025-26.

STAFF REPORT
City Council Consent Item
DATE: July 21, 2025
TO: Honorable Mayor and Council Members
FROM: Matthew A. Eberhardt, Interim Chief of Police
THROUGH: Amy Nilsen, City Manager
SUBJECT: Police Department Monthly Report for June 2025 STAFF RECOMMENDATION:

Receive report as an informational item.

Patrol Statistics:

During the month of May 2025, the Fortuna Police handled 1,245 calls for service. 48 arrests were made including 8 felony arrests and 40 misdemeanor arrests. A total of 40 citations were issued for traffic offenses or other miscellaneous violations. Crime statistics and information on calls for service are available at forpd.crimegraphics.com.

Staffing:
• Recruitment Update: A lateral retired annuitant reserve law enforcement officer with local area experience is progressing through the pre-employment background investigation process.
• Academy Training: Two Police Officer Trainees are currently enrolled at the College of the Redwoods Police Academy, with an expected graduation in July. • Staffing and Recruitment: The department currently has three vacant sworn officer positions and is actively recruiting to fill these roles. • Operational Impact: Due to ongoing training requirements for Police Officer Trainees, existing sworn officer vacancies, and two employees on unanticipated leave, the department is operating with seven fewer sworn patrol officers than authorized staffing levels. In response to this significant shortfall, I formally declared a staffing crisis and implemented mandatory weekly overtime for sworn personnel to ensure continued patrol coverage and maintain public safety.

Enforcement/Community Engagement:
• Management coordinated with many of the organizations that put on our summer events to ensure proper planning.
• Officers investigated numerous crimes, notably, one Officer initiated a vehicle pursuit involving a stolen vehicle but discontinuing the pursuit due to safety concerns. Continued investigation led to the recovery of the stolen vehicle and arrest of the suspect.

Miscellaneous Tasks
• The Utilities division continues to add to our GIS database, such as water meters with pictures for reference, existing backflow devices missing from our testing database, and water line sizes and locations as new information is field verified. • Mike McGinnis and Troy Hubner completed a week-long backflow testers certification class; this certification is crucial for ensuring safe drinking water in the distribution system. These devices prevent contaminants from flowing backward into the clean water supply under certain conditions; the annual testing of these devices is essential to confirm the device is working properly, as well as identify when maintenance or replacement is necessary.

City Council Consent Item
DATE: July 21, 2025

THROUGH: Amy Nilsen, City Manager
SUBJECT: 2025 Water Supply and Demand Assessment
STAFF RECOMMENDATION:

Review the City of Fortuna’s 2025 Water Supply and Demand Assessment as an informational item only.

EXECUTIVE SUMMARY:

In 2021 the State Water Resources Control Board issued a requirement for all public water systems to annually submit an assessment of their potable water supply in relation to their potable water demand for the upcoming year (water code section 10632(a) (2)) by July 1st. Because the City of Fortuna owns and operates a public water system CA121006 we must comply with this requirement.

To meet this requirement, staff look at the annual rainfall as measured at the National Oceanic and Atmospheric Administration (NOAA) site in Scotia, the ground water levels at the California Statewide Groundwater Elevation Monitoring (CASGEM) wells and the City’s wells. Staff also consider the projected current year demand and supply. Staff then compare this data with past years including one or more dry years. After consideration of the data staff believe that even if the 2025-26 year is extremely dry the City’s supply will exceed the demand. The required assessment is attached to this staff report.

Reporting Tables

1.0 INTRODUCTION
The City of Fortuna’s (City's) 2025 Annual Water Supply and Demand Assessment is intended to meet the requirements established in Water Code Section 10632(a)(2) which includes the following minimum procedures:
• The written decision-making process that an urban water supplier will use each year to determine its water supply reliability. • The key data inputs and assessment methodology used to evaluate the urban water supplier’s water supply reliability for the current year and one dry year, including all of the following:
o (i) Current year unconstrained demand, considering weather, growth, and other influencing factors, such as policies to manage current supplies to meet demand objectives in future years, as applicable.
o (ii) Current year available supply, considering hydrological and regulatory conditions in the current year and one dry year. The annual supply and demand assessment may consider more than one dry year solely at the discretion of the urban water supplier. o (iii) Existing infrastructure capabilities and plausible constraints. o (iv) A defined set of locally applicable evaluation criteria that are consistently relied upon for each annual water supply and demand assessment.
o (v) A description and quantification of each source of water supply. Water Code Section 10632.1

1.1 Decision Making Process
The City's Annual Water Supply and Demand Assessment follows the methodology provided in the City of Fortuna Water Shortage Contingency Plan (FES, June 2021).

1.2 Data and Methodologies
Fortuna has prepared the 2025 Annual Water Supply and Demand Assessments utilizing the following data:
• Precipitation data from the National Weather Service Scotia Station; • Groundwater elevation data from CASGEM wells within the Eel River Valley Groundwater Basin;
• Projected current year unconstrained demand; and
• Projected current year available supply.

The above data was evaluated with similar methodologies and added to the analysis of water supply reliability contained in the Fortuna Water Shortage Contingency Plan (FES, June 2021).

2.0 PRECIPITATION
The City of Fortuna performed an analysis of annual precipitation totals from the nearest weather station with a near continuous historic record (1926-2025), Scotia, California.

Precipitation % of

June 2024 -
May 2025 Previous 12 Months 59.84 128%
The lowest annual (calendar year) precipitation occurred in 2013 (16.62 inches). The highest annual precipitation occurred in 1998 (73.96 inches). In the previous 12 months the precipitation total is 128% (59.84 inches) of the average annual total. Total annual (calendar year) data is shown below. It is important to note that the precipitation in the past 12 months represents 128% of normal annual rainfall.

3.0 GROUNDWATER BASIN
Groundwater elevations from monitoring wells in the Eel River Valley Groundwater Basin for the annual wettest month (highest) and driest months (lowest) were plotted against annual total precipitation as seen in the examples below:

Groundwater elevation observations from the CASGEM wells indicate that groundwater levels are generally stable over the observation period and dry season groundwater elevations are generally not responsive to the periods of historic drought.

The Sustainable Groundwater Management Act (SGMA) requires the Department of Water Resources to prioritize each of California’s 515 groundwater basins and subbasins based on eight components. Basin prioritization is a technical process that utilizes the best available data and information to classify groundwater basins into one of four categories high-, medium-, low-, or very low-priority. The technical process is based on eight components that are identified in the California Water Code Section 10933(b). (1) The population overlying the basin or subbasin.
(2) The rate of current and projected growth of the population overlying the basin or subbasin.
(3) The number of public supply wells that draw from the basin or subbasin. (4) The total number of wells that draw from the basin or subbasin. (5) The irrigated acreage overlying the basin or subbasin. (6) The degree to which persons overlying the basin or subbasin rely on groundwater as their primary source of water.
(7) Any documented impacts on the groundwater within the basin or subbasin, including overdraft, subsidence, saline intrusion, and other water quality degradation.
(8) Any other information determined to be relevant by the department, including adverse impacts on local habitat and local streamflows.

According to the Eel River Valley Groundwater Sustainability Plan, 2022:
“The groundwater sustainability plan alternative (GSP Alternative) submitted to the Department of Water Resources (DWR) in December 2016 (SHN, 2016) showed that groundwater levels within the Eel River Valley Groundwater Basin (Basin) have a relatively narrow range of fluctuation and have remained generally stable over time, including during the droughts of 1976-1977, 1987-1992, and the most recent drought of 2013-2015. Groundwater elevation measurements collected over the course of the 2019 WY indicate that water levels are consistent with historical fluctuations observed in wells associated with the California Statewide Groundwater Elevation Monitoring (CASGEM) program. “

4.0 MUNICIPAL WELL OBSERVATIONS
Annual average static and pumping groundwater elevations from the City of Fortuna wells in the Eel River Valley Groundwater Basin were plotted showing the single driest year, the driest 3 years, and the well bottom as shown below.

All four wells have had damages screens which were corrected after 2002 and fefore 2014 resulting in pumping elevations being much lower than static water levels. Work on City Well # 5 continues and well # 5 is being replaced with a new well.

Observations regarding the above graphs are included in the table below:

Conclusions regarding water source reliability include:
• Periods of dry weather appear to have an impact on the seasonally high groundwater elevations in the Eel River Valley Groundwater Basin. • Periods of dry weather appear to have a minimal impact on the seasonally low groundwater elevation trends in the Eel River Valley Groundwater Basin; and • The Fortuna water supply has been reliable even during periods of record low precipitation.

5.0 INFRASTRUCTURE CAPABILITIES AND PLAUSIBLE CONSTRAINTS The City of Fortuna relies on four groundwater wells within the Eel River groundwater basin to supply potable water to the community. This City exercises the pumps in the four wells by using them in a sequence. One plausible constraint is that well casings within the wells can become fouled and reduce their efficiency.

In that case, the City can supply the ongoing water demand of the community by using only one or two of the groundwater wells. This allows for one or two of the wells to be removed from service for maintenance when necessary, The City is in the process of replacing Well # 5 which will further increase the resilience of the Fortuna water distribution system.

6.0 PROJECTED WATER DEMAND AND SUPPLY
Projected water demand for the next 24 months is based on the demand in the previous 12 months (2024-2025) as shown below. Population is not projected to increase, and demand is expected to remain steady reflecting the seasonal trends as shown below:

Based on historical conditions and our understanding of the Eel River Groundwater Basin, water demand is not anticipated to exceed supply over the next 24 months even if historic drought conditions occur over the next 24 months.

7.0 CONCLUSIONS
This Section describes the conclusion of the 2025 Annual Water Demand and Supply Analysis.

Based on the analysis of local precipitation trends, groundwater elevation trends, observations from the City’s Wells, and documented sustainability of the Eel River Groundwater Basin, the water supply will most likely meet the projected demand over the next 24 months even if precipitation in the next 24 months is equal to historic lows.

SUBJECT: Annual Property Tax Assessment for Kenwood Meadows Sewer Maintenance District
STAFF RECOMMENDATION:

Approve the 2025-26 Property Tax Assessment for the Kenwood Meadows Sewer Maintenance District.

EXECUTIVE SUMMARY:

The Kenwood Meadows Sewer Maintenance District was formed by Council Resolution 97-12 in June of 1997 to support the annual operations and maintenance of the Sewer Lift Station and Sewer Pressure Main. The maintenance district serves Lots 20 through 38 of Phase 2 and Lots 39 through 51 of Phase 3 of Kenwood Meadows Subdivision. Per the original resolution, the costs of operating and maintaining the lift station and pressure main will be borne by the developed parcels within the subdivision. At this time, there are 30 parcels that are either developed or currently being developed, 19 in Phase 2 and 11 in Phase 3.

Staff has estimated that the assessment for the 2025-26 fiscal year should be $156.87 per parcel which represents a decrease of $41.50 from last year’s assessment. Up until FY 2021-22 the per parcel charge was around $270. The decrease over the last few years is due to the full depreciation of Kenwood Meadows assets. As these items are replaced in current and future years the depreciation of those assets will start again and will subsequently increase the assessment back to those historic levels.

SUBJECT: Authorize Staff to Submit a Grant Application for the Mill Creek Habitat Connectivity Project, Resolution 2025-21
STAFF RECOMMENDATION:

Authorize staff to submit a grant application to the Wildlife Conservation Board (WCB) for implementation funding for the Mill Creek Habitat Connectivity Project, Capital Improvement Project (CIP) #9123, by approving Resolution 2025-21.

EXECUTIVE SUMMARY:

In August of 2023, the City was awarded grant funding for the design and permitting of the Mill Creek Habitat Connectivity Project. This project involves the replacement of five failing road crossings along Mill Creek spanning from Weber Street to Mountain View Road to restore the full habitat connectivity of Mill Creek. Since then, staff have been working with engineering consultants, GHD, on design and it is currently at 90% completion and permitting applications have been submitted to regulatory agencies.

The construction estimate is approximately 20 million dollars and staff have begun to seek out potential funding sources. Having previously funded similar projects, the WCB, have invited the City to submit an application including City Council approval by the attached Resolution. This is an excellent funding opportunity that could potentially cover all costs for construction. Staff anticipate this project will break ground in Spring/Summer of 2026.

FINANCIAL IMPACT:

There are no significant financial impacts to the City associated with the submittal of the grant application.

RECOMMENDED COUNCIL ACTION:

Motion to approve Resolution 2025-21 and authorize staff to submit a grant application to the Wildlife Conservation Board (WCB) for the Mill Creek Habitat Connectivity Project. Consent Agenda vote.

TO: Honorable Mayor and Council Members
FROM: Mat Nyberg, Deputy City Engineer
THROUGH: Amy Nilsen, City Manager
SUBJECT: Authorize the City Manager to Negotiate a Contract for the Digester Rehabilitation Project, Resolution 2025-22
STAFF RECOMMENDATION:

Authorize the City Manager to negotiate a construction contract with Sequoia Specialties, Inc. for the Digester Rehabilitation Project, by adopting Resolution 2025-22.

EXECUTIVE SUMMARY:

On December 5, 2024 the City experienced a large earthquake that resulted in damage to the digester at the wastewater treatment plant. The digester is an integral and essential component of the City’s wastewater treatment process and without it the City would not achieve regulatory treatment standards.

Staff publicly noticed this project on May 15, 2025 and received a sole bid from Sequoia Specialties on June 6, 2025. The bid exceeded the budgeted amount for the project, so staff met with Sequoia Specialties for a breakdown of costs. Sequoia Specialties acknowledged some assumptions, including a lid adjustment bid item, that significantly impacted their bid. After further review, Sequoia Specialties requested a bid modification, which staff agreed to on the basis of a sole bidder and that the modification was a reduction. Subsequently, staff received an informal bid that fell within the allocated budget.

This type of contract award is allowable as set forth in Fortuna Municipal Code Section 2.50.070 (D), when it is found by council resolution that direct negotiations best serve the City. A copy of the resolution drafted by staff, and reviewed by the City Attorney, has been included as Attachment A. Sequoia Specialties is a licensed and qualified local contractor in this type of construction, and they have successfully performed many tasks for the City, including the new police facility and they were subcontractors in the original construction of the digester completed in 2006.

Upon approval of a contract award via direct negotiations, staff would finalize a contract with Sequoia Specialties and anticipate work commencing within a month.

FINANCIAL IMPACT:

Sequoia Specialties quote for the repairs is $46,115. Staff are seeking authorization to negotiate and execute a contract for this amount, and establish a contract not to exceed$75,000, which would allow for the lid adjustment to be reintroduced in the event it is deemed necessary after repairs are Consent Agenda Item (4u)

completed. The cost for these repairs will come from the Sewer Reserve Fund 560, which has $100,000 allocated for this project.

AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A

CONSTRUCTION CONTRACT FOR THE DIGESTER REHABILITATION PROJECT WHEREAS, the City’s wastewater treatment plant digester sustained damage in the December 5th, 2024 earthquake;
WHEREAS, it is critical to repair the damage because further damage from another earthquake could render the digester nonfunctional;
WHEREAS, the City developed and advertised a bid package to repair the digester; WHEREAS, the City received one bid to perform the project outlined in the bid documents; WHEREAS, staff met with the bidding contractor for project clarification resulting in a bid reduction request putting the project at a competitive price and assuring completion before the upcoming winter rains;
WHEREAS, formally bidding the project again would likely result in the inability to complete the required improvements before the winter rains;
WHEREAS, pursuant to section 2.50.70(D) of the Fortuna Municipal Code, the Council may elect to dispense with formal competitive bidding for the procurement of contractor services and may instead authorize the City Manager to negotiate directly with the contractor if the Council finds it to be in the public interest;
WHEREAS, pursuant to Public Contract Code section 20161(c), work involving the repair and/or maintenance of streets and sewers is exempt from the formal bidding requirements of the Public Contract Code, and the Council finds that the subject project is therefore exempt.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Fortuna hereby:

1. Finds and declares that it is in the public interest to dispense with the formal competitive bidding requirements set forth in Section 2.50.040 of Chapter 2.50 of the Fortuna Municipal Code for the completion of the Digester Rehabilitation Project; and

2. The City has identified a contractor available to perform the work before the winter season; and

3. The City Manager is authorized to negotiate a construction contract with Sequoia Specialties, Inc, for a not to exceed amount of $75,000; and

4. The City Manager is further authorized to execute and submit all documents including, but not limited to applications, purchase agreements, which may be necessary for the completion of the aforementioned project.

STAFF REPORT
City Council Business Item
DATE: July 21, 2025
TO: Honorable Mayor and Council Members
FROM: Shari Meads, Community Development Director
THROUGH: Amy Nilsen, City Manager
SUBJECT: Conduct Second Reading and Adopt the Fire Hazard Severity Zone Map, Ordinance 2025-775
STAFF RECOMMENDATION:

Hold a public hearing to conduct second reading and adopt Ordinance 2025-775, to adopt the updated Fire Hazard Severity Zone Map from the Office of the State Fire Marshal and find the Ordinance to be exempt from the California Environmental Quality Act (CEQA).

EXECUTIVE SUMMARY:

Public Resource Code 4202 mandates that the Office of the State Fire Marshal classify lands into fire hazard severity zones (FHSZs). The California Department of Forestry and Fire Protection (CAL FIRE) develops and publishes FHSZ maps that delineate zones of Very High, High, and Moderate fire hazard (fire likelihood) rather than risk (actual vulnerability). The City can increase, but not decrease, a parcel’s fire hazard severity level. The recent FHSZ map designates 1,935 parcels within Fortuna as having a Moderate FHSZ rating. In contrast, the previous (2007-2011) FHSZ map showed no fire hazard zones within the City.

The City of Fortuna must adopt the updated FHSZ map by ordinance and send a copy of said ordinance to the State Fire Marshal within 30 days of adoption.

PRIOR ACTIONS
• On April 14, 2025, the Fortuna Fire Protection District adopted the Fire Hazard Severity Map
• On June 16, 2025, the City Council conducted the first reading of Ordinance 2025-775

ENVIRONMENTAL IMPACT
This Ordinance is exempt under CEQA Guidelines Section 15061(b)(3) in that the project has no potential to cause a significant effect on the environment and Section 15002(i)(1), in that adoption of the FHSZs and map is required by Government Code.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FORTUNA TO ADOPT

THE FIRE HAZARD SEVERITY ZONE MAP FROM THE OFFICE OF THE STATE

FIRE MARSHAL, AND FIND THE ORDINANCE TO BE EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA).

WHEREAS, the Office of the State Fire Marshal (State Fire Marshal) is mandated by Government Code Section 51178 to identify levels of fire hazard in the Local Responsibility Area (LRA) based on consistent statewide criteria and the expected severity of fire hazards; and
WHEREAS, Government Code Section 51179 requires the State Fire Marshal to make recommendations of fire hazard severity zones (FHSZ) to local agencies (Section 51177(e)), for city and county designation and adoption by ordinance; and State law requires the Office of the State Fire Marshal (OSFM) to identify lands within State Responsibility Areas for potential Wildfire Hazards; and
WHEREAS, the California Department of Forestry and Fire Protection (CAL FIRE) creates FHSZ maps and publicly publishes them for city officials to identify their Local Responsibility Areas, which helps inform decisions related to land use planning, building codes, and community wildfire preparedness; and
WHEREAS, FHSZ maps can be viewed on the CAL FIRE FHSZ Viewer at https://experience.arcgis.com/experience/6a9cb66bb1824cd98756812af41292a0; and WHEREAS, CAL FIRE developed the recommended FHSZ map using a scientific model that assesses fire probability and behavior based on factors like fire history, vegetation, terrain, and weather conditions. These maps indicate hazard (fire likelihood) rather than risk (actual vulnerability); and
WHEREAS, the City of Fortuna FHSZ map was released on February 24, 2025; and WHEREAS, between April 14, 2025 and June 2, 2025, the City of Fortuna included the FHSZ map and invitation for public comment in a prominent position on the homepage of the City’s website but no public comments were received; and
WHEREAS, on April 14, 2025, the Fortuna Fire Protection District adopted Ordinance 2024/2025-1, an Ordinance Designating FHSZ within the Fortuna Fire Protection District; and
WHEREAS, notice of the City Council public hearing was posted in the North Coast Journal on June 5, 2025, posted 72 hours before the meeting on the City's website and the City’s community bulletin board located in front of City Hall 72 hours before the meeting; and WHEREAS, the City Council of the City of Fortuna has reviewed the staff report, all supporting documents, public comments, and all relevant information submitted with this Ordinance; and WHEREAS, adoption of this Ordinance is exempt from the California Environmental Quality Act as outlined in SECTION 5 herein.

WHEREAS, all legal prerequisites to the adoption of the Ordinance have occurred.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FORTUNA DOES HEREBY ORDAIN AS FOLLOWS:

SECTION 1. Recitals. The above and foregoing recitals are each incorporated by reference and adopted as findings by the City of Fortuna City Council.

SECTION 2. Moderate FHSZs. The City of Fortuna hereby designates areas identified as Moderate FHSZs by the State Fire Marshal as Moderate FHSZs; and SECTION 3. Approval of Map. The map, approved by the City of Fortuna, is hereby incorporated by reference as Exhibit A, and entitled “City of Fortuna Local Responsibility Area Fire Hazard Severity Zones,” dated February 24, 2025.

SECTION 4.Interpretation of FHSZ ratings. For purposes of this ordinance and any regulations or requirements that rely on FHSZ designations, the following methodology shall apply when interpreting parcels that contain more than one FHSZ rating: In instances where a single parcel of land includes area(s) not designated a Moderate Fire Hazard Safety Zone and area(s) that are designated Moderate Fire Hazard Safety Zone, the entire parcel shall be considered as falling within the Moderate Fire Hazard Safety Zone. All development standards, building code requirements, defensible space regulations, or other obligations tied to Moderate FHSZ classification shall be applied to the entire parcel.

Mapping Determination: The official FHSZ maps, as adopted or referenced by the jurisdiction, shall be used to determine zone boundaries and classifications. Parcel-level determinations shall be made by overlaying the official FHSZ map onto parcel boundaries.

Application of Standards: All development standards, building code requirements, defensible space regulations, or other obligations tied to FHSZ classification shall be applied to the entire parcel based on the highest severity zone present.

SECTION 5. CEQA. This Ordinance has been evaluated for conformance with CEQA, the State CEQA Guidelines, and City regulations. City Planning Staff has determined that the adoption and implementation of the Ordinance is exempt from further environmental review under the general rule in California Environmental Quality Act (CEQA) Guidelines Section 15061(b)(3) in that CEQA only applies to projects that have the potential for causing a significant effect on the environment.

The Ordinance also qualifies for an exemption under State CEQA Guidelines section 15002(i)(1), in that adoption of the FHSZs and map is required by Government Code section 51179(a). It does not involve a commitment to any specific project that may result in a potentially significant physical impact on the environment. Staff will file a Notice of Exemption with the State Clearinghouse and the County Clerk of the County of Humboldt per CEQA Guidelines.

SECTION 6. Effective Date. The effective date of this ordinance is thirty (30) days after adoption by the City Council of the City of Fortuna.

SECTION 7. Severability. If any provision of this ordinance is determined to be invalid, such invalidity does not affect the remaining provisions or applications of the ordinance that can be given effect without the invalid provision or application, and to this extent, the provisions of this resolution are severable. The City Council of the City of Fortuna declares that it would have adopted this Ordinance irrespective of the invalidity of any portion thereof.

SECTION 8. Limited Repeal. Any provision of the City of Fortuna Municipal Code or appendices to it that are inconsistent with the requirements of this ordinance, to the extent of such inconsistencies and no further, is hereby repealed or modified to that extent necessary to effect the provisions of this ordinance.
