STAFF REPORT
Council Consent Item
DATE: September 2, 2025
TO: Honorable Mayor and Council Members
FROM: Matthew A. Eberhardt, Interim Chief of Police
THROUGH: Amy Nilsen, City Manager
SUBJECT: Humboldt Ducks Unlimited – Bingo Permit Application STAFF RECOMMENDATION:

Receive report for approval.

EXECUTIVE SUMMARY:

Humboldt Ducks Unlimited is seeking a permit to operate “Charitable Bingo Games” at the River Lodge Conference Center. Melita Evans with Humboldt Ducks Unlimited, contacted the City of Fortuna to see what steps were needed to conduct Bingo games for their fundraising event.

The Fortuna Municipal Code allows Charitable Bingo Games in accordance Chapter 5.16. Melita Evans submitted an application to the city, which was reviewed by Interim Police Chief Eberhardt.

The application contained all of the required information, and it appears to be consistent with the requirements. A complete copy of the application is attached. The applicant was provided Fortuna Municipal Code Section 5.16 and made aware of all pertinent requirements and conditions. The following is a summary of the primary conditions:
• The games will be run by Humboldt Ducks Unlimited
• The games will be open to the public
• The games will be held within the City of Fortuna
• The games will not take place outside the hours of noon to midnight • The maximum prize limit per game will not exceed $250 Humboldt Ducks Unlimited acknowledged these primary conditions and the complete conditions outlined in Fortuna Municipal Code 5.16. Their event is scheduled to take place on September 12, 2025, at Fortuna River Lodge from 5pm to 11pm.

The municipal code gives the chief of police the authority to inspect the premises in order to ensure that the operation of bingo games at the premises does not constitute a violation of any state or federal law and to inspect the records and special bank accounts containing profits derived from bingo games of any organization conducting bingo games whenever deemed reasonable and appropriate to ensure compliance with municipal code.

There is no established fee in the fee schedule for this activity. Staff are not recommending that a fee be charged for this application at this time. Any other applicants that wish to obtain a permit for a Bingo gaming operation will be required to follow the application process and requirements and seek separate Council approval.

STAFF REPORT
City Council Discussion Item
DATE: September 2, 2025
TO: Honorable Mayor and City Council Members
FROM: Aaron Felmlee, Finance Director
THROUGH: Amy Nilsen, City Manager
SUBJECT: Revenue Generation Ad Hoc Committee Update
STAFF RECOMMENDATION:

1. Receive the staff report from the Revenue Generation Ad Hoc Committee; and

2. Provide direction to staff on the preferred option for the River Lodge Conference Center DISCUSSION:

On April 21st the City Council heard a presentation on the City’s budget outlook and this included:
limited investment in vital services, particularly City wages, a review of wages across local jurisdictions; climbing city-wide turnover percentage; potential revenue generation options; and creation of a Revenue Generation Ad Hoc Committee.

The April 21st staff report also contained information on the City’s budget and how limited investment in vital services has impacted wages across the City organization compared with other local cities.

Fortuna’s salaries when compared with Eureka and Arcata were 27% to 25% lower for a Police Officer, 28% to 20% lower for a Police Sergeant, 12% to 24% lower for a Utility Worker II, and 11% to 18% lower for a Treatment Plant Operator II. The City of Rio Dell’s salaries are currently within competitive range with Fortuna. Competitive range is around 10 percent.

In response the City Council created the Revenue Generation Ad Hoc Committee comprised of Mayor Johnson, Mayor Pro-Tem Trent, City Manager, Finance Director, and representatives from the Fortuna Police Employees Association, Fortuna Employees Association and Unrepresented employees at the April 21st Council Meeting.

On April 30th the Ad Hoc Committee for the first time met to review one of the options presented in the April 21st staff report, “General Fund and Reduced City Services” to determine what percentage and what City services would need to be reduced to invest in vital city services.

On May 19th the City Council heard a presentation from that Ad Hoc Committee meeting on the General Fund and reduced City services. The information included that if the General Fund were to provide a 20 percent pay increase, to come within the competitive range of other cities, that would include approximately $810,000 in salary and $190,000 in benefit costs for a total of $1,000,000. The City does not currently have a $1,000,000 in available funding to provide this level of investment in vital services. Therefore, a decrease to General Fund services would be needed to make $1,000,000 in funding available. The pie chart below represents one option for General Fund service reductions.

Discussion Item 3a

Page 2 of 4 ends

The Ad Hoc Committee’s recommendation was that investing in vital services by reducing other General Fund Services is not practical for the long-term viability and operation of the City. Therefore, the Ad Hoc Committee recommended pursuing a sales tax measure in November 2026, and further discuss options for a general or dedicated sales tax measure.

On May 19th the City Council approved investment in public opinion research to gauge the feasibility of and inform a potential sales tax measure in November 2026. In addition, a City Council Member expressed interest in learning more about the River Lodge and why it costs the General Fund to operate.

On August 18th the Ad Hoc Committee met to review an in-depth analysis of the River Lodge and its revenue and expenses from the last 5 years.

River Lodge Analysis
The chart below shows the revenue for the River Lodge by category for fiscal years (FY) 21-22 through 25-26.

Discussion Item 3a

Page 3 of 4 ends

FY 21-22 revenue was low due to the pandemic social distancing requirements. FY 22-23 revenue was elevated due to several events that had been scheduled during the pandemic being rescheduled once the River Lodge was fully opened during FY 22-23. FY 24-25 Revenue increased significantly from FY 23-24 revenue due to fee schedule alterations. The fee schedule changes are displayed below and typically take at least a year to see the impact due to events being charged the fee amount at the time they are scheduled as opposed to when the event happens.

Fee Schedule Increases:
• FY 25-26 - ~2% increase to rental fees
• FY 24-25 – No increase in fees
• FY 23-24 – altered rate structure and increased fees between 20-30% • FY 22-23 - ~10% increase to rental fees
• FY 21-22 – No increase in fees
The FY 25-26 Budget for revenue was prepared using the FY 23-24 activity data. As it turned out FY 24-25 had more wedding events than expected and if that carries forward, FY 25-26 could see an additional ~20k in revenue than what is shown above.

The below chart shows both the revenue and expenses for the River Lodge for fiscal years (FY) 21- 22 through 25-26 as well as the amount of funds required by the General Fund.

The FY 25-26 Expense budget increased due to the following reasons. • Park Workers pay distributions changed to account for the added time spent at the River Lodge maintaining the facility and setting up for events (~20k) • Budget includes more for building repairs and maintenance as the facility ages (~20k) • Wages and Benefits increased due to negotiations / stipends (~25k) • Utilities, Liability Insurance, and other inflation increases (~25k) The overall impact is that expenses came in at nearly $1,000,000 more than revenues for the 5 years shown above.

Discussion Item 3a

Page 4 of 4 ends

Ad Hoc Committee Options
Based on the analysis the Ad Hoc Committee came up with three options for Council consideration. • Stay the course and continue to utilize General Fund dollars to fund the River Lodge . • Infuse additional funds into the River Lodge to make it a top-of-the-line facility and increase advertising effort/funds. This could entail updating the sound system, minor remodeling, and paving the parking lot.
• Lease the River Lodge to a 3rd party. This could entail releasing a request for proposal (RFP) and/or talking with local external organizations. In this scenario the General Fund would no longer provide any financial support.

FISCAL IMPACT:

No fiscal impact associated with providing direction to staff on the preferred River Lodge option.

Future fiscal impacts will be determined by the option the Council chooses to move forward with and depending on the option chosen future items will be brought forward for Council approval.

RECOMMENDED COUNCIL ACTION:

1. Receive staff presentation and review Council questions with staff;

2. Receive public comment; and

3. Provide direction to staff on the preferred option for the River Lodge Conference Center.

STAFF REPORT
Council Business Item
DATE: September 2, 2025
TO: Honorable Mayor and Council Members
FROM: Brian Issa, Public Works Director
THROUGH: Amy Nilsen, City Manager
SUBJECT: Authorize the City Manager to award the River Lodge Exterior Staining Project (CIP 9130) to Hamanaka Painting Co. and Establish a Maximum Contract Amount of $158,000
STAFF RECOMMENDATION:

Authorize the City Manager to award the River Lodge Exterior Staining Project (CIP 9130) to Hamanaka Painting Co. and establish a maximum contract amount of $158,000.

EXECUTIVE SUMMARY:

The River Lodge was built in 1998 and since then, the elements have taken a toll on the exterior of the structure. The redwood siding and doors have faded significantly, and the surfaces are no longer sealed from moisture, particularly on the east, west and south sides. Staining and sealing the exterior of the River Lodge is maintenance that will preserve the longevity of the structure and help prevent costly repairs arising from dry rot and mold. Further, the River Lodge is a soughtafter venue for various large events, so the aesthetics are important and will be significantly improved as a result of this project.

The need for River Lodge Exterior Staining Project was first identified in 2021 when it was adopted as part of the City’s Capital Improvement Plan (CIP). The staining project was part of the CIP every year from 2021 through 2025 all of which were reviewed and approved by both Planning Commission and Council vote. Staff have actively pursued the completion of this project since early 2025 and the timeline of recent actions is as follows:
• Measure E Committee approved budget for $190,000 on March 18, 2025 • Planning Commission approved CIP on May 13, 2025
• City Council approved CIP on June 2, 2025
• City Council approved the Fiscal Year 25/26 budget which included this project for $190,000 on June 16, 2025
The River Lodge Exterior Staining Project bid package was released and publicly advertised on June 30th, 2025. The bid period ended on July 23, 2025, at 2:00 p.m. at which time the City received two responsive bids shown in the table below:

Bidder Base Bid Total
Business Item 4a

Page 2 of 3 ends

Color New Corp. $91,000 withdrawn
Hamanaka Painting Co. $158,000
The apparent low bid was submitted by Color New Corp. with a total bid price of $91,000.

However, upon notification of the low bid, Color New Corp. requested a bid withdrawal due to an accounting error that drastically underestimated the cost of the project. With that, City staff notified Hamanaka Painting Co. and confirmed that the bid received from Hamanaka Painting Co. for $158K was fully responsive and that they have active licenses and Department of Industrial Relations registration paid for and pending.

Staff find the $158K cost of the project reasonable and appropriate given the following considerations:

1. A typical 2000sqft single family home currently costs around $25K to have professionally painted. This works out to around $12/sqft. The River Lodge is approximately 16,000sqft so painting would be expected to cost around $192K.

Thus, the current budget appropriation of $190K.

2. Staining is more difficult to apply that paint, so this job was expected to cost more than a similarly sized paint job

3. The structure is much taller than a typical single story building so $192K would probably be an underestimate as it’s based on the relationship between floor area and surface area.

4. There is significant preparation work needed that if not done correctly would show through the stain as stain doesn’t hide defects the way paint does

5. The contractor was required to work in sections and work around scheduled events. Breaking up a job like this makes the job less profitable and more difficult to schedule as opposed to doing it all at once.

If the project is awarded, staff anticipate being under contract later in August. Mobilization and construction is anticipated to begin shortly thereafter. The draft Notice of Potential Award is included as Attachment A.

Due to ongoing public usage of the River Lodge, careful coordination with the contractor has been necessary to complete the project before it starts raining this fall. This has included the contractor moving and/or declining other work to accommodate the City’s needs. Failure to approve the project at this time will result in the project being delayed until next summer. Should the Council choose to move forward at that time, it’s likely the project will need to be rebid and the City should expect a total project cost increase of approximately 3-5%.

FINANCIAL IMPACT:

The project is funded through the Measure E Funds (Fund 101). The current fiscal year funding is $190,000. The not to exceed costs to complete the project are shown in the table below:

Dear Mr Hamanaka:

I am pleased to inform you of the intent to recommend that the City Council or its authorized designee award the Contract for the above-referenced Project (“Project”) to Color New Corp (“Contractor”) for the Contract Price of $158,000, based on Contractor’s Bid Proposal submitted on July 23, 2025.

A copy of the Contract accompanies this Notice. Contractor must execute 2 copies of the enclosed Contract and return the wet-inked copies to my attention, accompanied by the required Payment Bond and Performance Bond, insurance certificates and endorsements, and valid Certificates of Reported Compliance for its fleet and its listed Subcontractors, as required under the California Air Resources Board’s In-Use Off-Road Diesel-Fueled Fleets Regulation (13 CCR § 2449 et seq.), if applicable, no later than ten days from the date of this Notice of Potential Award, above.

Failure to execute and return the enclosed Contract and required bonds, insurance documentation, and valid Certificates of Reported Compliance within the specified time could result in forfeiture of Contractor’s bid security. STAFF REPORT
Council Study Session
DATE: September 2, 2025
TO: Honorable Mayor and Council Members
FROM: Amy Nilsen, City Manager
SUBJECT: Overview of Cannabis Regulatory Environment in the State of California from HdL Companies
STAFF RECOMMENDATION:

Receive and file the presentation from HdL Companies regarding cannabis regulations and consider whether to maintain the current prohibition on commercial cannabis or to develop a program that permits and regulates commercial cannabis businesses.

BACKGROUND:
• February 3, 2025 – Under Future Agenda Items, the City Council requested a discussion on a cannabis ordinance.
• February 18, 2025 – City staff presented on prioritizing ordinance development and longrange planning activities. The City Council directed staff to prioritize development of a cannabis ordinance.
• April 21, 2025 – City staff initiated a discussion on the City’s budget outlook and potential revenue generation options. Retail cannabis was identified as one possible source of additional general fund revenue.
• May 5, 2025 – City staff requested a supplemental budget of $49,750 to prepare a commercial cannabis program and ordinance. The City Council did not approve the request. Staff then proposed a more cost-effective educational approach at $9,600, which did not require a supplemental budget.
• August 25, 2025 – Today’s presentation by HdL Companies marks the first step in a study session aimed at informing the discussion and development of a potential cannabis ordinance and regulatory program.

HdL Companies operates a dedicated Cannabis Division that has served hundreds of cities across California. This division assists municipalities in navigating the regulatory landscape and is recognized as a leading authority in cannabis policy development. Mark Lovelace, Senior Policy Advisor, will provide an overview of the cannabis industry and will be available to answer questions.
