TO: Honorable Mayor and City Councilmembers
THRU: Amy Nilsen, City Manager
FROM: Katey Schmidt, Senior Planner
SUBJECT: Authorization to File the Kenmar Properties LLC Major Subdivision Final Tract Map, and Accept the Dedications, Easements, and Improvements; Resolution 2025-26
STAFF RECOMMENDATION:

Adopt Resolution 2025-26, authorizing City staff to file the Kenmar Properties LLC major subdivision final tract map and accept the dedications, easements, and improvements.

DISCUSSION
On August 7, 2023, by Resolution 2023-23, the City Council approved a tentative map for a major subdivision of a 1.43-acre and 8,031-square-foot parcel, resulting in nine residential parcels ranging in size from 6,014 square feet to 14,646 square feet, and a 1.77-acre remainder vacant residential parcel. The subject parcels are located on the eastern side of Kenmar Road near Shields Lane in an established residential neighborhood of single-family homes. This project is phase 2 of a planned 3-phase subdivision. Phase 1, completed in August 2021, subdivided a 3.7-acre parcel into one developed single-family parcel and a remainder parcel. Following recordation of phase 2, phase 3 will subdivide this remainder parcel to complete the subdivision.

Fortuna Municipal Code Sections 16.04.030 and 16.16.160, and the Subdivision Map Act Section 66458 require City Council authorization to record the final tract map and City Council acceptance of dedications, easements, and public improvements.

The City Surveyor has reviewed the final tract map for conformance with the approved tentative parcel map, survey analysis, title details, compliance with the California Subdivision Map Act, Resolution 2023-23 conditions, and city ordinances. Following minor corrections, the final map will be subject to final review by the City Surveyor, City Planner, and City Engineer prior to recordation.

Public improvement installation is complete, including a new public road, sidewalk, underground utilities, and storm drainage improvements. The City Engineer has examined the improvement plan record drawings and found them to be in conformance with the requirements of the City of Fortuna improvement standards, in substantial compliance with the City’s standards and specifications, local ordinances, and project conditions of approval as specified in Resolution 2023-23. All improvements have been constructed by the developer as shown on the approved record drawings and have been inspected and accepted for public use and maintenance on behalf Consent Item 3c
of the City of Fortuna by the City Engineer as shown in Attachment B. Pursuant to Section

16.16.100 of the Fortuna Municipal Code, the applicant will enter into a subdivision maintenance agreement, in which all public improvements will be covered by a one-year warranty guaranteed with a security bond in the amount of 10% of the cost of the improvements. The cost of the improvements is $363,938; the warranty bond to be held by the city will be $36,394.

Following acceptance and authorization by the City Council and upon final City staff approval, the final tract map may be recorded once the warranty bond is posted, all required signatures are completed, City and Recorder’s fees are paid, and compliance with all conditions of Council Resolution 2023-23 is confirmed.

FISCAL IMPACT:

There is no fiscal impact to City general fund as a result of the approval of the final map and acceptance of improvements and easements. The city will be responsible for maintenance of the public improvements after release of the one-year warranty bond. Additional maintenance costs resulting from long-term maintenance of the new road and improvements will be allocated as appropriate to the City’s Road maintenance funds. Due to the small number of lots and relatively short road length, City Road maintenance cost can be absorbed into the City’s Road maintenance fund with no significant impact.

ENVIRONMENTAL REVIEW:

The approval of the final parcel map is categorically exempt from CEQA (California Environmental Quality Act) under CEQA Guidelines Title 14, Section 15268 (b) (3), Ministerial Projects, which expressly applies to approval of final parcel maps.

RECOMMENDED COUNCIL ACTION:

Motion to adopt Resolution 2025-26, A Resolution of the City Council of the City of Fortuna Authorizing Recordation of the Final Map and Acceptance of the Dedications and Improvements for Phase 2 of the Kenmar Properties LLC Subdivision. Consent Agenda vote.
