A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FORTUNA AUTHORIZING
RECORDATION OF THE FINAL MAP AND ACCEPTANCE OF THE DEDICATIONS, EASEMENTS, AND IMPROVEMENTS FOR PHASE 2 OF THE KENMAR PROPERTIES
LLC SUBDIVISION
WHEREAS, the City Council adopted Resolution 2023-23 approving the Kenmar Properties LLC with condition of approval; and
WHEREAS, the City Engineer has approved the Improvement Plans and found them to be in conformance with the requirements of the City of Fortuna improvement standards, in substantial compliance with the City’s standards and specifications, local ordinances, and project conditions of approval as specified in Resolution 2023-23; and
WHEREAS, the public improvements have been constructed by the developer as shown on the approved record drawings and have been inspected and accepted for public use and maintenance on behalf of the City of Fortuna by the City Engineer; and WHEREAS, a maintenance security bond has been posted with the city in the amount of $36,394 to guarantee public improvements for a one-year warranty period; and WHEREAS, as the lead agency under the California Environmental Quality Act Public Resources Code Section 21000 et seq. (“CEQA”) the City finds and determines the approvals granted through this Resolution are categorically exempt under CEQA Guidelines Title 14, Section 15268 (b) (3), Ministerial Projects, which expressly applies to approval of final parcel maps.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Fortuna as follows:
1. The City Council hereby authorizes City staff file the Kenmar Properties LLC Major Subdivision Final Tract Map
2. The City Council hereby authorizes the City Clerk to accept the dedications of rightsof-way, easements, and improvements required by Resolution 2023-23 when the City Surveyor, City Planner, and City Engineer have approved the final subdivision map.
