EXECUTIVE SUMMARY:
Training Opportunities:
The Finance Office Supervisor was selected from several applicants to attend the Bay Cities Leadership Academy. This Academy meets once every few weeks for 6 sessions. Each session explores a theme of leadership development and includes a dynamic mix of expert-led instruction, facilitated practice, and peer discussion that will engage participants in applying teachings and techniques practically in their daily work and achieving their future leadership goals.
The Payroll and Benefits Administrator is attending CalPELRA this month. This is an annual conference that offers a wide variety of labor, human resources, and employment training sessions, including educational and skill-building presentations that discuss new and critical issues and that encourage audience interaction and participation. This training is particularly important as we transition from an employee who had been with the City for over 25 years and retired from the Payroll and Benefits Administrator position last year to an employee newer to the role.
Sales Tax Update:
Finance staff continue to closely monitor the City’s sales tax revenue streams. Sales tax revenue is the largest General Fund revenue source for the City and as such fluctuations in sales tax have the largest impact on the City’s finances.
For fiscal year 2024-25 general sales tax and Measure E transaction and use tax totaled $4,059,276.
The City budgeted for the year at a combined $4,133,000 which resulted in a budget deficit of approximately $73,000.
For comparison fiscal year 2021-22 combined sales tax and Measure E transaction and use tax was $4,339,191. Fiscal year 2024-25 revenue fell by nearly 6.5% compared to fiscal year 2021-22. The declines can be primarily attributed to declines in the fuel and service stations and general consumer goods categories.
Consent Item 3d
Additional information about how the City’s sales tax performed will be presented with the MidYear budget presentation scheduled for the beginning of February.
Measure E Update:
The Measure E committee’s next regularly scheduled meeting is set for January 21, 2026 at 5:30pm in the Council Chambers.
The primary purpose of this meeting will be to solicit project ideas and funding input from the public. This is a great place for the public to be heard on how they want their sales and use tax monies to be spent within the City of Fortuna. The City historically receives valuable input and project ideas from the public during these annual public solicitation meetings.
List of Measure E items funded this month:
• (2) Police Detective Positions
• Police Community Services Officer Position
• Police Records Clerk Position
• Parks and Recreation Director Position
• Recreation Program Supervisor Position

SUBJECT: Approve the Side Letter to the Memorandum of Understanding between the City of Fortuna and the Fortuna Police Employees Association for 2025-2027; and Authorize the City Manager to Execute
STAFF RECOMMENDATION:
Approve the side letter to the Memorandum of Understanding between the City of Fortuna and the Fortuna Police Employees Association for 2025-2027; and the Authorize the City Manager to Execute.
EXECUTIVE SUMMARY:
As of this writing, the Fortuna Police Department has 3 vacant Police Officer positions out of 13, which have been difficult to fill likely due to the significant wage disparity among neighboring jurisdictions, and as documented in an April 21, 2025 staff report. This leaves 16 sworn personnel available to provide 24/7 coverage, two of which are the Police Chief and Lieutenant who typically perform administrative assignments. Of the 10 filled Police Officer positions, one Police Officer is on long-term leave. The remaining 9 Police Officers and 4 Sergeants have to provide public safety coverage on a 24/7 basis. This has led to significant amounts of documented overtime, upwards of 77 plus hours of overtime in a pay period for a single officer.
In addition to the significant levels of overtime, the retention of long-term sworn public safety staff has reached a critical concern as seasoned staff have been approached by neighboring jurisdictions offering increased wages and less overtime. Losing long-term sworn staff leaves a substantial void in experience and increases concerns about Police Officer safety and the safety of the community at large.
As a result of the significant levels of overtime, Police Officer vacancies, and the retention concerns of long-term sworn staff, the City Council has authorized a side letter to the Fortuna Police Employee Association Memorandum of Understanding (MOU) to increase the wages of Police Officer and Sergeant positions as documented below, in order to improve recruitment and retention issues of sworn staff in the Fortuna Police Department.
BACKGROUND:
Police Officer and public safety are primary concerns when a city is confronted with recruitment and retention issues. An inability to recruit qualified sworn staff has led to exorbitant and unsustainable hours of overtime. It is imperative that sworn officers remain physically and mentally alert to make split second life or death decisions. Placing an overworked officer in a high- Consent Item 4i
risk situation without adequate sworn backup is dangerous for the officer and the public. This also increases municipal liability.
To provide context on Fortuna’s current sworn staffing level, the below table compares Fortuna's staffing ratio to neighboring communities based on 2020 U.S. Census data:
Community Population (2020) Sworn Officers Officers per 1,000 Residents Fortuna 12,516 19 1.52
Ferndale 1,398 5 3.58
Rio Dell 3,379 6 1.78
Additionally, a national benchmark, the Federal Bureau of Investigation (FBI) Uniform Crime Reporting Program reports that the nationwide average for sworn police officers is 2.4 per 1,000 residents. In order to meet the national average of 2.4 officers per 1,000, the Fortuna Police Department would require a sworn staff of 31 officers, 12 additional sworn positions beyond the current staffing level.
24/7 police service in Fortuna, due to its population size and call volume, is beyond the scale where it can stop providing 24/7 police services. The Fortuna Police Department, like the Ferndale Police Department, maintains 24/7 service, unlike the neighboring Rio Dell Police Department, which would require a significant increase in staff if it were to attempt 24/7 coverage.
Should Fortuna stop providing 24/7 police services, essential community engagement would be impacted with sworn staff constantly dedicated to minimum patrol coverage. The Police Department would also not have the capacity for proactive and preventative measures. A lack of proactive engagement limits crime prevention efforts. It also allows minor issues to fester into larger problems and weakens the vital relationship between the police and the community. In addition, negative economic impacts can occur through reduced proactive law enforcement efforts and high visibility patrols. These efforts help deter property crime, which is a key concern for local businesses and property owners. Last, administrative requirements increase from year to year as the department faces an increased workload due to new governmental reporting requirements, training regulations, and additional administrative duties. This mandates that more sworn staff time be diverted away from patrol to maintain compliance.
FINANCIAL IMPACT:
The total cost of these wage increases for the first year is $198,243. This will be partially offset by, and as approved by the City Council separately, a payment to CalPERS in the amount of $1,500,000 using funds in the General Reserve. The City has an unfunded liability (expected expenses are higher than expected revenues) for CalPERS pension benefits for employees. In order to reconcile the difference CalPERS mandates annual payments to reduce the unfunded liability.
This fiscal year the mandated payment was over $900,000. By making a one-time additional payment of $1,500,000 it will reduce the interest cost to the City by approximately $106,000 annually, leaving approximately $92,243 in salary savings needed.
Consent Item 4i
The total cost for wage increases in the second year is $376,566 and again offset by the interest savings from CalPERS of approximately $106,000, leaving approximately $270,566 in needed salary savings.
Total annual ongoing cost/salary savings needed is $362,809 unless/until additional revenue to the General Fund is recognized that can offset that additional cost. In the meantime, a hiring freeze for General Fund positions is recommended to the City Council to begin to realize salary savings.
RECOMMENDED COUNCIL ACTION:
Approve the side letter to the Memorandum of Understanding between the City of Fortuna and the Fortuna Police Employees Association for 2025-2027; and the Authorize the City Manager to Execute. Consent Agenda vote.
ALTERNATIVE TO STAFF RECOMMENDATIONS:
The City Council could choose not to approve side letter. This is not recommended as the City’s negotiator, the City Manager, was requested and authorized by the City Council to engage in negotiations with the Fortuna Police Employees Association.

SUBJECT: Establishment of a Hiring Freeze for Staff Positions Funded Through the General Fund
STAFF RECOMMENDATION:
1. Approve the establishment of a hiring freeze for staff funded through the General Fund;
2. Approve an automatic exception to the hiring freeze for Police Officer, Sergeant and parttime Parks and Recreation positions; and
3. Approve an exception to the hiring freeze for other essential and critical positions as approved by the City Council.
EXECUTIVE SUMMARY:
The Fortuna Police Department has 19 sworn staff as described below. • 1 Police Chief
• 1 Lieutenant
• 4 Sergeants
• 13 Police Officers
As of this writing, the Fortuna Police Department has 3 vacant Police Officer positions out of 13, which have been difficult to fill likely due to the significant wage disparity among neighboring jurisdictions, and as documented in a April 21, 2025, staff report. FPEA MOU - Side Letter Wage Increases
Police Officer Sergeant Cost
January 2026 9% 9% $198,243
January 2027 9% 6% $376,566
Total Cost $574,809
In order to pay for these wage increases, a hiring freeze is recommended for staff funded through the General Fund, with an automatic exception for Police Officers, Sergeants, and Parks and Recreation part-time positions in order to continue youth programs such as Hot Shots and youth break camps, as well as other critical and essential staff as approved by the City Council. This means departments whose positions are funded through the General Fund will need to seek approval from the City Council in order to fill future vacant positions. This hiring freeze will remain in place until ended by the City Council.
FISCAL IMPACT:
The total cost of these wage increases for the first year is $198,243. This will be partially offset by, and as approved by the City Council separately, a payment to CalPERS in the amount of $1,500,000 using funds in the General Reserve. RECOMMENDED COUNCIL ACTION:
1. Receive staff presentation and review Council questions
2. Open Public Comment
3. Close Public Comment
4. Motion to approve the following:
a. Establishment of a hiring freeze for staff funded through the General Fund; b. Automatic exception from the hiring freeze for Police Officer, Sergeant, and parttime Parks and Recreation positions; and c. Approve an exception to the hiring freeze for other essential and critical positions as approved by the City Council. Roll Call vote.
ALTERNATIVE TO STAFF RECOMMENDATIONS:
The City Council could choose not to approve the hiring freeze, this is not recommended as layoffs would need to occur in order to fund these salary increases. The use of a hiring freeze uses natural staff attrition to utilize salary savings to fund ongoing wage increases for Police Officers and Sergeants.

STAFF REPORT
City Council Business Item
DATE: November 17, 2025
TO: Honorable Mayor and City Council Members

SUBJECT: Consider Introducing Ordinance 2025-778, An Ordinance of the City Council of the City of Fortuna Adding Chapter 8.45 to Title 8, Making it Unlawful for Any Person in the City to Sell, Offer, Distribute, or Provide Nitrous Oxide to Any Person
STAFF RECOMMENDATION:
It is recommended that the Council introduce Ordinance 2025-778, An Ordinance of the City Council of the City of Fortuna Adding Chapter 8.45 to Title 8, Making it Unlawful for Any Person in the City to Sell, Offer, Distribute, or Provide Nitrous Oxide to Any Person; waive reading of the text and consent to read by title only.
INTRODUCTION:
Nitrous oxide, commonly used as a medical anesthetic and a propellant in whipped cream dispensers, is increasingly misused as a recreational inhalant. Its unregulated sale and misuse, particularly by youth, presents an urgent public health concern. This ordinance aims to address the availability and misuse of nitrous oxide by establishing comprehensive regulations for its sale, possession, and distribution in the City of Fortuna. This ordinance reinforces the City's commitment to protecting the health and safety of its residents by limiting access to substances known to cause harm when misused, while preserving access for legitimate purposes.
BACKGROUND:
Nitrous oxide, also known as "laughing gas," is a colorless, nonflammable gas that has both legitimate and illegitimate uses. While it is widely used in food preparation and medical or dental care, it has also gained popularity as a recreational inhalant. Despite existing state laws prohibiting inhalation for intoxication purposes and restricting sales to minors, the product remains easily accessible in large quantities and is frequently misused in unsupervised and unsafe ways. This has become a growing public health concern in the City of Fortuna, particularly among young people. The recreational use of nitrous oxide, particularly among adolescents, is linked to a range of severe health risks including nerve damage, cognitive impairments, psychosis, and in some cases, death. A 2025 study published in The Lancet found that youth as young as 14 can suffer irreversible neurological damage from recreational nitrous oxide use. In Humboldt County, the 2021–2023 California Healthy Kids Survey reported that 11% of 7th and 11th grade students had used inhalants, with evidence of initiation occurring as early as 5th grade. Nitrous oxide is often sold in small metal cylinders or “whip-its,” which are readily available in smoke shops and convenience stores, including near schools and public recreation areas. The lack of clear regulatory authority for local jurisdictions to manage retail sales of nitrous oxide has contributed to increased access and normalization of its recreational use.
Business Item 4b
The City Council received Nitrous Oxide presentations from the County of Humboldt Public Health staff on August 18 and again on October 6. The City Council directed staff to return with an ordinance banning the use of nitrous oxide.
At this time, the below is a list of actions taken by local jurisdictions. • County of Humboldt - Unincorporated County: Nitrous Oxide ordinance and TRL amendment (revocation of tobacco license for selling NO) were adopted on June 3, 2025, and took effect on July 3, 2025
• Arcata: Nitrous Oxide ordinance was adopted on June 4, 2025, and took effect in July • Rio Dell: Nitrous Oxide ordinance adopted on June 17, 2025, and took effect in July. • Ferndale: Nitrous Oxide ordinance adopted July 16, 2025, and took effect in August. • Eureka: Nitrous Oxide ordinance and Tobacco Retail Licensing (TRL) ordinance become effective January 1, 2026.
In addition, staff were also directed to return with a Tobacco Retail License Ordinance. Tobacco retail licenses are issued at the state level through the California Department of Tax and Fee Administration. Many counties and cities also have local ordinances requiring a license to sell tobacco products. In California, at least 219 cities and counties have local tobacco retail licensing ordinances.
These ordinances help to provide the local structure for enforcement, as well as funding for tobacco retailer education and compliance checks. This ordinance will be brought back at a later date.
DISCUSSION:
Ordinance No. 2025-778 seeks to close existing legal loopholes by establishing a local prohibition on the sale, offer, distribution, or provision of nitrous oxide and related devices, except in cases where the product is:
1. Contained in food products for use as a propellant.
2. Administered for legitimate medical or dental purposes under supervision of licensed practitioners.
3. Dispensed by a licensed pharmacy or pharmacist.
4. Distributed by a wholesaler or manufacturer regulated under specified NAICS codes.
Violations of the ordinance will be treated as misdemeanors, subject to penalties including fines or jail time, and may also be enforced through nuisance abatement or administrative citation processes already established in the Fortuna Municipal Code.
The ordinance is modeled on similar efforts in California cities and counties and is intended to protect community health without placing an undue burden on businesses engaged in lawful sales of unrelated products. If introduced, the Ordinance would be brought back for adoption by the Council at the next regular meeting. It would go into effect 30 days thereafter.
FISCAL IMPACT:
There is no anticipated significant fiscal impact associated with adoption of this ordinance.
Enforcement may be conducted within existing staffing and budgetary allocations.
Business Item 4b
ALTERNATIVE TO STAFF RECOMMENDATION:
City Council could chose not to introduce the ordinance. This is not recommended as Nitrous Oxide is a product that is used recreationally and causes severe neurological damage and is documented to be used recreationally by youth.
RECOMMENDED COUNCIL ACTION:
1. Open the Public Hearing.
2. Receive a staff report presentation and review questions with staff.
3. Open public comment.
4. Close public comment.
5. Motion to introduce Ordinance 2025-778; and read by title only. Roll Call vote.
