Notices Posted (Public Hearing, Agenda, Ordinance, etc.) 6 On January 7, 2026, Clerk staff attended a Cal Cities education workshop “2025 Legislative Recap & Legal Recap” for Municipal Clerks. As previously reported to Council, due to Fortuna and the County not meeting the required population thresholds, many of the new Brown Act requirements under SB 707, will not have to be implemented.

However, there are several other legislative acts that will have an impact. Some of the key takeaways include Assembly Bill (AB) 538, which impacts how local agencies respond to Public Record Act Requests (PRA). AB 538 will require local agencies to obtain certified payroll records from contractors and sub-contractors. While this will result in an increased administrative burden on staff responsive to PRA’s, it is helpful that penalties could be applied if the local agency is not getting cooperation in obtaining payroll records from contractors.

With the impending election this November, it’s also important to understand Senate Bill (SB) 482, which will require that within 120 days of the general election, local agencies have to send an updated roster of elected officials to the Secretary of State to ensure meeting the requirements to aid in publishing the California Roster.

Ethics training and new fiscal and financial training requirements under SB 827 were also included in this training and important to learn about. Under SB 827 there will be a new 2-hour, biennial learning requirement for certain staff and elected officials, covering financial and administrative planning, budgeting and reporting, capital financing and debt management, prudent investing, ethics with public resources, and pensions, cash management and procurement.

RISK MANAGEMENT / HUMAN RESOURCES DIVISION
Staff are no longer meeting weekly with NeoGov representatives, as the training platform for the Perform module is technically complete. Staff continue to make changes within the Perform module to the employee lists and evaluation programs for miscellaneous and safety employees.

Once the employee lists and final changes to the evaluation programs are complete, staff will run a trial period to assess and obtain feedback from a small group of test supervisors and employees.

After any issues are worked out, staff will work on City wide training and final implementation of Perform, which should streamline the evaluation process and digitize what is currently a relatively cumbersome paper process.

The City of Fortuna participates in an Employment Relations Consortium (ERC) through the law firm Liebert Cassidy Whitmore (LCW). An ERC is a number of local agencies (cities, counties Consent Agenda Item 3b

Page 3 of 5 ends

and special districts), in a geographic area joining together for the purpose of bringing quality employment relations training, consultation and informational services to their employees.

This is a great opportunity for City employees to attend in person or webinar-based platforms to expand professional and personal education and skill sets. Last week, LCW published the upcoming 2026 ERC schedule and “Employment Relations Certificate Program”. Some of the upcoming trainings will take place in Fortuna at the River Lodge and include topics such as:
“Workers Compensation: Managing Employee Injuries, Disability and Occupational Safety”, “Labor Code 101 for Public Agencies”, “Employees and Driving”, “Case Study for Managing Illness or Injuries”, and more. Training courses are available to all employees as applicable to their positions.

Risk Management
There were no new Worker’s Compensation claims as of December 1, 2025, and no (0) new tort claims. City staff continue to work closely with LWP for Worker’s Compensation and George Hills, the City’s third-party claims administrator to bring claims to settlement or closure.

Date of Claim Type of Claim Status
09/18/2025 Property Claim In Progress
10/28/2025 Property Claim In Progress
In December, Risk staff completed the required application, Aboveground/Underground Storage Tank and Non-vacant/vacant land listing worksheets required for the PRISM Pollution Legal Liability Program for July 1, 2026, policy term. This program provides coverage for first-party remediation and third-party bodily injury and property damage arising out of pollution conditions occurring at, or migrating from, member-owned or leased locations, as well as pollution resulting from member-contracted operations.

Risk staff are also currently working on updating calendars and sending reminder notices out to employees, supervisory employees and elected and appointed officials regarding mandatory training and evidence of compliance with harassment, discrimination and retaliation, pursuant to Government Code Section 12950.1 and SB 778 and as required under AB 1825 and SB 1343. If you think you are due for any of these trainings, you probably are, but again, staff will send out updates and reminders.

Human Resources
Assembly Bill (AB) 2561, signed into law on September 22, 2024, and effective January 1, 2025, amended the Meyers-Milias- Brown Act (MMBA) to require public agencies to present on the status of vacancies, recruitment, and retention efforts during a public hearing at least once per fiscal year, preferably before the final budget adoption. To meet the requirements of AB 2561 (Government Code Section 3502.3), this report will be agendized at an upcoming meeting and will provide the Council and public with information on current staffing levels, recruitment and retention activities, demonstrating the City’s commitment to transparency and sound government.

Human Resources staff continue to administer recruitments for non-general fund full-time positions, police officer and sergeant and part-time recreation positions, as needed.

Computer/Network
At the end of December, Nylex contacted IT staff because in the last two months, due to production, supply chain, and political factors, the prices of computer memory have increased by Consent Agenda Item 3b

Page 5 of 5 ends

300%. Currently RAM (memory) is in short supply and very expensive. The two major manufacturers, Crucial and Micron, have stopped selling RAM directly to end users and only supply the Original Equipment Manufacturers (OEM) like HPE, Dell, and Lenovo. This essentially obfuscates the impact of high RAM prices by including it in the overall cost of the computer or server. In the last few weeks, Nylex observed desktop and server prices increasing by 15% to 30%.

Many in the market have responded by keeping or selling old RAM at current higher prices.

Considering the current trend, Nylex recommended that the City either buy as quickly as possible or wait till the end of the first quarter of 2026 to order new computers and servers, if needed. After consideration and more discussion with Nylex, the City will not purchase any RAM or new computers in the first and possibly second quarter of the year, unless absolutely necessary, depending on how the trend continues.

Last week, the City Server, which hosts the City’s main shared drive, was still running an end-oflife operating system. On January 9, 2026, Nylex moved the end-of-life server to one of the new servers and upgraded it. There was already space on the new server and licensing available to accommodate this upgrade, so nothing needed to be purchased, and the upgrade was successful.

IT support staff continues to work collaboratively with Nylex to meet the City’s ongoing technical needs.

TO: Honorable Mayor and Council Members
FROM: Aaron Felmlee, Finance Director
THROUGH: Amy Nilsen, City Manager
SUBJECT: Finance Department Monthly Report
STAFF RECOMMENDATION:

Receive report as an informational item.

EXECUTIVE SUMMARY:

Recognized Obligation Payment Schedule (ROPS):

The City of Fortuna became the Successor Agency to the Former Fortuna Redevelopment Agency after the State dissolved all Redevelopment Agencies back in 2012. As such, the City, as the Successor Agency, must submit an annual Recognized Obligation Payment Schedule (ROPS) to the State Department of Finance in order to receive funds to pay down the Former Fortuna Redevelopment Agency’s outstanding obligations.

The ROPS is due by February 1 of each year. This will be the eighth year that staff will be required to get the ROPS approved by the Humboldt County Redevelopment Oversight Board before submitting the ROPS to the State Department of Finance. Staff have prepared all staff reports and attachments and will provide them to County Staff upon the selection of a meeting date and time by the members of the Oversight Board.

State Controller’s Office Annual Financial Transactions Reporting:

At the conclusion of each fiscal year each city and special district is mandated by the California Government Code to submit Financial Transaction Reports to the State Controller’s Office. These reports are due by the end of January each year. Staff are working on submitting these reports for the City of Fortuna, the Fortuna Public Financing Authority, the Rohner Recreation and Park District, and the Fortuna Specialized Service Transit System. The State posts these reports from all the Special Districts, Cities, Transit Systems and Counties online. The detailed information provided in these reports are used by the State Legislature as well as the taxpayers to make comprehensive decisions.

Measure E Update:

The Measure E committee’s next regularly scheduled meeting is set for January 21, 2026, at 5:30pm in the Council Chambers.

The primary purpose of this meeting will be to solicit project ideas and funding input from the public. This is a great place for the public to be heard on how they want their sales and use tax Consent Agenda Item 3d

TO: Honorable Mayor and Council Members
FROM: Kaylyn Stainbrook, Parks and Recreation Director
THROUGH: Amy Nilsen, City Manager
SUBJECT: Approve a $12,000 Supplemental Budget Request to Allocate Recreation Camp Program Overages to the Parks and Recreation Budget
STAFF RECOMMENDATION:

Approve a Supplemental Budget Request in the amount of $12,000 for recreational programming, recreation facility improvements, and/or staff training.

EXECUTIVE SUMMARY:

The Recreation Division hosts four school break camps throughout the year as well as a 12-week Summer Fun program.

The Parks and Recreation Department accepts Changing Tides Family Services (a program which subsidizes childcare for qualifying families) and private pay.

If a family is enrolled with Changing Tides and registers a child for a Fortuna Parks and Recreation camp program, Changing Tides requires attendance paperwork to be completed and submitted by the Recreation Program Supervisor.

Typically, once a month, Changing Tides reconciles accounts with City of Fortuna - providing payment to the Parks and Recreation Department. Changing Tides calculates childcare payments based on family size and household income, not necessarily on advertised camp registration costs.

Additionally, for the last couple of years, Changing Tides provided extra funds to the City for being a childcare provider.

Annually, the Parks and Recreation Department receives approximately $12,000 in extra funds from Changing Tides. Therefore, staff is submitting a Supplemental Budget Request in order to recognize these revenue funds and allocate them to the appropriate budget accounts.

It is staff’s intention to utilize these funds for the purposes of recreational programming, recreation facility improvements, and/or staff training.

FINANCIAL IMPACT:

No overall impact as the additional recreational programming, facility improvement, and staff training expenses are offset by the additional and unanticipated extra funds from Changing Tides.

SUBJECT: Approve Renewal of a Memorandum of Understanding with the Fortuna Garden Club
STAFF RECOMMENDATION:

Approve the renewal of the Fortuna Garden Club Memorandum of Understanding.

EXECUTIVE SUMMARY:

Fortuna Garden Club is requesting to renew a Memorandum of Understanding (MOU) to utilize City of Fortuna rental facilities at no charge.

Fortuna Garden Club has assisted the City of Fortuna with civic beautification for several years.

In exchange, the City has provided, at no charge, various locations for the Garden Club to meet regularly and host a handful of annual events.

Historically, City Staff have performed table and chair set-up for the group at no charge.

In consideration of the current economy, the renewal reintroduces a previously removed annual contribution of $500 from the Fortuna Garden Club to the City, which will be used towards facility maintenance/improvements. Additionally, the renewal includes nominal introductory fees for table/chair set-up.

FISCAL IMPACT:

The City provides facilities and rentals at an approximate value of $8,500 per year. Parks and Rec staff do not have the capacity to maintain the various locations that the Garden Club currently maintain. The beautification would decrease and/or the City would need to hire additional staff at a cost greater than the $8,500 in support being provided to the Garden Club if they stopped their beautification efforts. An additional $750 contribution will be received annually from Fortuna Garden Club as compared to last year.

RECOMMENDED COUNCIL ACTION:

Approve the renewal of the Fortuna Garden Club MOU. Consent Agenda vote.

Other Insurance Provisions
The general liability policies are to contain, or be endorsed to contain, the following provisions:

1. The CITY, its officers, officials, employees and volunteers are to be covered as insureds with respect to liability arising out of work or operations performed by or on behalf of the CLUB including materials, parts or equipment furnished in connection with such work or operations.

2. For any claims related to this project, the CLUB’s insurance coverage shall be primary insurance as respects the CITY, its officers, officials, employees, and volunteers. STAFF REPORT
Consent Agenda Item
DATE: January 20, 2026
TO: Honorable Mayor and Council Members
FROM: Brian Issa, Public Works Director
THROUGH: Amy Nilsen, City Manager
SUBJECT: Approve a $12,000 Supplemental Budget Request and Authorize the City Manager to Execute a Professional Services Agreement with Freshwater Environmental Services to Prepare an Update of the City’s Urban Water Management Plan
STAFF RECOMMENDATION:

The Public Works Department recommends that the City Council approve a $12,000 Supplemental Budget Request and authorize the City Manager to execute a professional services agreement with Freshwater Environmental Service to prepare an updated Urban Water Management Plan and ordinance.

EXECUTIVE SUMMARY:

The City of Fortuna is required to prepare an Urban Water Management Plan (UWMP) in compliance with the requirements of the California Department of Water Resources (DWR) pursuant to the Urban Water Management Act (UWM Act) and the Water Conservation Bill of 2009. The UWMP Act requires urban water suppliers with 3,000 or more service connections or supplying 3,000 or more acre-feet of water per year are to prepare a UWMP every five years (the previous plan was adopted by Resolution in 2021).

The UWM Act (California Water Code §10610 et seq.) requires urban water suppliers to report, describe, and evaluate the following four areas:
• Water deliveries and uses;
• Water supply sources;
• Efficient water uses; and
• Demand Management Measures (DMMs), including implementation strategy and schedule.

The purpose of the UWMP Act is to direct water agencies in carrying out their long-term resource planning responsibilities to ensure adequate water supplies are available to meet existing and future demands. In addition to acting as a planning tool, UWMP is required for an urban water supplier to be eligible for water management grants or loans administered by Department of Water Resources and State Water Resources Control Board (State Water Board), both of which have been key funding sources for City water, wastewater, and stormwater projects. Our last update in 2021 Consent Agenda Item 3k

Page 2 of 2 ends

was conducted by Freshwater Environmental and they have completed UWMPs for most jurisdictions in Humboldt County since the requirement was created in 2009. The City anticipates considerable savings by utilizing the same consultant for this update.

FINANCIAL IMPACT:

The funds for the supplemental budget request in the amount of $12,000 will be paid for with water rate revenue reserve funds as Professional Services through an additional appropriation to account 500-6025-6000.

RECOMMENDED COUNCIL ACTION:

Approve a $12,000 Supplemental Budget Request and authorize the City Manager to execute a professional services agreement with Freshwater Environmental Service to prepare an updated Urban Water Management Plan and ordinance. Consent Agenda vote.

ALTERNATIVE TO STAFF RECOMMENDATION:

1. No Action. Update of the UWMP is non-discretionary, and failure to adopt and updated plan could result in state sanction including withholding of grant funds or inability to apply for state loans/grants

2. Alternative procurement. Staff could release an RFP for this work and rank proposals received.

3. Complete the update in-house. Completing the project in-house would not be the most efficient use of City funds. Getting up to speed on the requirements and completing the project would require delaying or suspending other planned work. Hiring consultants with extensive experience with state reporting means we can take advantage of cost savings using templates and processes that apply broadly to multiple jurisdictions.

SUBJECT: Public Hearing and First Reading for the Adoption of Amendments to the Zoning Map

STAFF RECOMMENDATION
Introduce and conduct a first reading of Ordinance 2026-781 – Amending Section 17.02.030 of the Municipal Code (Zoning Map) to implement and ensure consistency with the Fortuna General Plan Land Use Element amendments and the Mill District Specific Plan as adopted in February 2025.

PROJECT INFORMATION:

Project: Adoption of amendments to the Zoning Map to implement the Fortuna General Plan Land Use Element amendments and the Mill District Specific Plan
Applicant: City of Fortuna
Project Sites: Assessor Parcel Numbers: 200-363-008, 200-381-008, 202-021-004, 202-021-008, 202-021-012, and 202-022-011
Zoning District: Varies: see Table 1 below

Use:

Varies: see Table 1 below

EXECUTIVE SUMMARY
The proposed Zoning Map amendments were analyzed for approval as part of the General Plan amendments, Mill District Specific Plan (MDSP), and certification of the Final Supplemental Environmental Impact Report (FSEIR) that were adopted on February 18, 2025 by Resolution 2025-03 (for the FSEIR), and Resolution 2025-04 (for the General Plan amendments and MDSP).

For parcels inside the MDSP area, the General Plan land use designations and General Plan policies and programs were updated. At the same time, the land use designations were updated or corrected for a few parcels located outside the MDSP area and near (or adjacent) the MDSP.

Concurrently, Ordinance 2025-773 was adopted to update the zoning for most parcels inside the MDSP area to ensure implementation of the MDSP. However, the zoning for a few parcels inside the MDSP and the parcels outside the MDSP area was not updated. This means the zoning classifications of the six parcels identified in Table 1 are currently inconsistent with the land use designations adopted as part of the amendments to the General Plan Land Use Element and the MDSP.

The proposed amendments described in this report and draft Ordinance 2026-781 will remedy the zoning inconsistencies with the General Plan Land Use Element designations. Adoption of the proposed amendments will also satisfy the legal requirements that zoning ordinances be consistent with a city’s adopted General Plan, and the timely completion of zoning ordinance amendments when a zoning ordinance becomes inconsistent with a general plan or any of its elements due to an amendment to the general plan (Reference: Gov’t Code Sections 65860(a) and 65860(c)).

Therefore, adoption of the Zoning Map amendments proposed in this report will remedy the current inconsistencies and will ensure the zoning for these parcels is consistent with both the General Plan Land Use Element and the MDSP.1

ZONING MAP AMENDMENTS
One type of substantive amendment to a zoning ordinance involves reclassification of the zoning that applies to a specific property, designating a change from one zoning district to another without any change to the text of the zoning ordinance. This type of zoning change is also referred to as a zoning map amendment or a rezoning of property. The proposed amendments discussed in this report involve changes only to Fortuna’s Zoning Map. The proposed Zoning Map amendments complete the General Plan Land Use Element amendments and MDSP by rezoning the properties presented in Table 1 to be consistent with land use designation changes adopted in February 2025 by the City Council.

Zoning Change Id. # 1, # 2, # 3, and # 4
These parcels, APNs 200-363-008, 200-381-008, 202-021-008, and 202-022-011, are the Northwestern Pacific Railroad Co.–Great Redwood Trail Agency right-of-way corridor that traverses through the MDSP area as shown on the corresponding maps in Exhibit A. The February 2025 MDSP and the General Plan Land Use Element amendments included changes to facilitate the future development of a Class I trail through the Mill District as part of the Great Redwood Trail and/or Strongs Creek Trail to provide a continuous active transportation corridor between Fortuna Boulevard and Newburg Road/12th Street. The proposed zoning change for these parcels from un-zoned to Public Facility (PF) will facilitate the future development of the trail network.

Zoning Change Id. # 5
This parcel, APN 202-021-004, which is located at 1098 Fortuna Boulevard, is currently developed with an unoccupied detached single-family residence. This parcel had been inadvertently planned MD – Mill District when the General Plan was adopted in 2010. In February 2025, this error was corrected by adopting a land use designation change from MD to Corridor Mixed Use (CMU). The CMU land use designation is applied to areas oriented towards Fortuna Boulevard, and …provides for single‐use and vertical and horizontal mixed‐use development oriented toward Fortuna Boulevard. Uses may include retail and service establishments, restaurants, entertainment uses, professional and administrative offices, residential units, public and quasi‐public uses, and similar and compatible uses. The mixed-use development FAR shall not exceed 2.0. The nonresidential use 1 For the record, in November 2025, the City withdrew and removed the proposed rezone of APN 200-362-005.

Business Agenda Item 4a

Page 4 of 9 ends

FAR shall not exceed 0.8. Residential densities shall be in the range of 12.0 to 29.0 units per gross acre. (Fortuna General Plan 2030, pg. 1–6) While the rezoning of this parcel was not completed as part of the February 2025 amendments to the Land Use Element and MDSP, the zoning change from Heavy Industrial (M-2) to Commercial Thoroughfare with Emergency Shelter combining zone (C-T/E-S) is mentioned in the February 18, 2025, City Council staff report.2
It is the Contract Planner’s assessment that changing the principal zone of this parcel from M-2 to C-T implements, and is consistent with the CMU land use designation. Table 2 contains the purpose statements of the C-T and M-2 zoning districts. The nature of the land uses described in the C-T zone’s purpose statement below is a better match to the primary and compatible uses described for the CMU land use designation above: the C-T zone intends to allow a range of uses, including by-right visitor-serving uses, at varying intensities. Many of the permitted uses in the CT zone traditionally seek proximity to a well-developed roadway network and pedestrian corridors.

In contrast, the M-2 zone does not provide for visitor-serving uses either by-right or on a conditional basis. The range of potential usesin the M-2 zone is heavy commercial, manufacturing, and industrial, with priority given for sites that are located to avoid the creation of nuisances or deleterious effects upon neighboring properties.

Table 2: Purpose Statements of the C-T and M-2 Zoning Districts

17.03.022 Commercial thoroughfare (C-T). 17.03.031 Heavy industrial zoning district (M-2).

A. Purpose. The purpose of the C-T district is to provide for retail, wholesale, highway, and heavy commercial
uses, along with amusement, transient residential,
warehousing and distribution, maintenance, repair, and
servicing activities. C-T districts are to be established in zones of two acres or larger and shall be located only in the immediate vicinity of arterial streets, freeways, or the service/frontage drives thereof.

A. Purpose. The purpose of the M-2
district is to provide appropriate
sites for manufacturing and
processing uses that, by their nature,
require locations buffered from
other uses so as not to create
nuisances or have deleterious effects
upon neighboring properties.

In addition to changing the principal zone from M-2 to C-T, the February 2025 staff report for the adoption of Land Use Element amendments and the MDSP also considered extending the Emergency Shelter combining zone (-ES) to this parcel as well.3 As depicted in Figure 1, applying the -ES combining zone to this parcel will extend the same -ES combining zone that applies to the other C-T parcels along the west side of the Fortuna Boulevard corridor.

In conclusion, changing the zoning of APN 202-021-004 from M-2 to C-T/ES will allow for a variety of commercial uses and also residential uses that are compatible with and will implement 2 See first paragraph under the header Proposed Amendments to the General Plan Land Use Diagram on page 3 of the February 18, 2025 City Council staff report https://towncloud-core-prod.s3.us-west2.amazonaws.com/uploads/fortuna-ca/meetings/item_attachment/attachment/2635/5a._MDSP_Staff_Report.pdf 3 See footnote 1.

Zoning Change Id. # 6
As indicated in Table 1, the Zoning Map amendments propose to change the principal zone of this parcel, APN 202-021-012, from Commercial Thoroughfare (C-T) to Public Facility (PF). The parcel is owned by the City of Fortuna, and it contains City wastewater infrastructure, specifically a sewer lift station.

These conditions support changing this parcel’s principal zone from the C-T zone to PF because the purpose of the PF zone is to provide a procedure for the orderly establishment of public, quasi-public, or private facilities, their operations, or a change in the use of lands owned by governmental agencies.

The parcel’s existing -ES combining zone was established by Ordinance 2018-732. The City established the -ES combining zone and applied it to several areas throughout the City for compliance with the requirements of Senate Bill 2 (2007). Senate Bill 2 (SB 2) mandates that all cities and counties are responsible for planning and identifying appropriate areas for emergency shelters. The -ES combining zone satisfies this mandate by allowing emergency shelters that meet the standards FMC 17.06.045 by-right on sites with the -ES combining zone.

For ongoing SB 2 compliance, Housing Element Program H-11 commits the City to monitoring its designated emergency shelter sites to ensure there is sufficient capacity and that the sites are appropriate and suitable for an emergency shelter. This means a Zoning Map change to remove an -ES combining zone would trigger additional analysis to comply with Housing Element Program H-11. Because emergency shelter zoning regulations of cities and counties are subject to State oversight (through the California Department of Housing and Community Development or “HCD”), the Contract Planner anticipates that a no-net loss analysis would be necessary to adequately assess that a zoning change to remove the -ES combining zone would not decrease the City’s existing emergency shelter capacity. A no-net loss analysis would entail a comprehensive evaluation of the status, suitability, and capacity of all of the City’s designated emergency shelter sites. Therefore, it is recommended that the parcel’s existing -ES combining zone not be modified or removed at this time.

It is the Contract Planner’s assessment that the next housing element would be a more appropriate time to evaluate the application of the -ES combining zone to this parcel, if necessary. A Zoning Map amendment to change only the principal zone from C-T to PF would not modify, diminish, or nullify the existing -ES combining zone. Because changing the principal zone from C-T to PF would not alter the existing by-right allowance for emergency shelters, further analysis per Program H-11 would not be triggered. Therefore, it is recommended that the existing -ES combining zone for APN 202-021-012 be retained, and only the principal zone be changed.

GENERAL PLAN CONSISTENCY ANALYSIS
All of the proposed Zoning Map amendments are consistent with General Plan 2030’s Administrative and Implementation Program AI‐4: “The City shall review and amend, as necessary, applicable ordinances and regulations referenced herein to ensure consistency with the General Plan. These shall include the following: Zoning Ordinance, Subdivision Ordinance, Business Agenda Item 4a

Page 7 of 9 ends

Building Code, and Development Standards”. The following table analyzes the consistency of the proposed Zoning Map changes with the City’s General Plan.

Proposed Amendments to the Zoning
Regulations General Plan Consistency Analysis
Existing Zoning Regulations:

APNs 200-363-008, 200-381-008, 202-021-
008, and 202-022-011 are currently unzoned, meaning they have not been zoned.

These parcels comprise a linear corridor
traversing through the MDSP Area that is a
segment of the Northwestern Pacific
Railroad Co.–Great Redwood Trail Agency
right of way (Table 1 Id. #1–4). All parcels
have the Mill District (MD) land use
designation.

Proposed Zoning Regulations:

The parcels are proposed to be zoned Public
Facility (PF).

The proposed zoning changes for the referenced
parcels are consistent with the MDSP because
they will facilitate the implementation of
General Plan 2030 and MDSP policies to
promote active transportation, the development
of a pedestrian and bicyclist transportation
corridor to improve connectivity throughout the
City, and facilitate the implementation of
policies for the Strongs Creek Trail and
connections to the Great Redwood Trail to
increase pedestrian and bicycle paths. See
relevant General Plan Policies LU-14.7, TC4.7, TC-5.8, TC-5.14, TC-5.15.

Existing Zoning Regulations:

The parcel of land is located at 1098
Fortuna Blvd. and also referred to as APN
202-021-004 (Table 1 Id. #5). It is currently
zoned Heavy Industrial (M-2). The parcel is
developed with an unoccupied single family
residence.

Proposed Zoning Regulations:

Changing the zoning to Commercial
Thoroughfare with Emergency Shelter
combining zone (C-T/ES).

The parcel is designated Corridor Mixed Use
(CMU). The proposed zoning change is
consistent with the General Plan because the
types of development and land uses of the C-T
zone (the proposed principal zone) better match
the primary and compatible uses described for
the CMU land use designation, as discussed
above. Additionally, the proposed zoning
change is consistent with General Plan 2030’s
Goal for the enhancement of Fortuna Boulevard
as a pedestrian-oriented local destination for
shopping and living: see Policies LU-10.1, LU10.2, and LU-10.3. Retaining the current M-2 zoning would create confusion and uncertainty
because the types of development permitted by
the M-2 zone are generally inconsistent with the
CMU’s primary and compatible uses.

Applying the -ES combining zone to the parcel
is consistent with the CMU land use
designation, which is evidenced by the -ES
combining zone being applied to adjoining C-T
zoned parcels to the north that also front
Fortuna Boulevard.

Proposed Amendments to
the Zoning Regulations General Plan Consistency Analysis Existing Zoning
Regulations:

APN 202-021-012 (Table 1
Id. #6) is currently zoned
Commercial Thoroughfare
with Emergency Shelter
combining zone (C-T/ES).

Proposed Zoning
Regulations:

Public Facility with
Emergency Shelter combining
zone (PF/ES)
The parcel is owned by the City and is improved with the City’s South Fortuna Boulevard sewer lift station. Given the ownership and presence of City infrastructure, the proposed Zoning Map amendment is consistent with General Plan
because the Public (PUD) General Plan land use designation “…provides for public facilities such as schools, hospitals, sanitariums, penal institutions, libraries, museums,
government offices and courts, churches, meeting halls, cemeteries and mausoleums, public facilities, and similar and compatible uses” (emphasis added; Fortuna General Plan
2030, pg. 1-7). Moreover, reclassifying the parcel’s zoning to PF reinforces the City’s intent for the application of the PUD land use designation.

The existing Emergency Shelter combining zone (-ES) will not be altered. Because this site is City-owned and is
developed with critical City infrastructure, the proposed change to the principal zone will not diminish or modify the site’s capacity or suitability as SB 2 (2007).

PUBLIC HEARING NOTICE
Public notice of this hearing and first reading was given in accordance with Fortuna Municipal Code Section 17.07.200(C) and Government Code Section 65854. Staff published a public hearing notice in the December 25, 2025, edition of the North Coast Journal, posted notice in the designated public places, and posted notice on the City’s website. On December 30, 2025, public hearing notices were mailed to the owners of property affected by the proposed Zoning Map amendments.

ENVIRONMENTAL REVIEW
The Supplemental Environmental Impact Report (SEIR) prepared and certified for the General Plan Land Use Amendments and the MDSP also analyzed the Zoning Map amendments for the six parcels in Table 1. This means the City has already complied with the requirements of the California Environmental Quality Act for the Zoning Map amendments.

SECTION 1. Recitals. The above and foregoing recitals are true and correct, and each is incorporated in full herein by reference.

SECTION 2. Public hearing notices and public participation. All necessary public hearings and opportunities for public testimony and comment have been conducted in compliance with state law.

SECTION 3. Findings. That all of the following findings are hereby made:

California Environmental Quality Act (CEQA).

A. The adoption of Zoning Map amendments complies with the California Environmental Quality Act pursuant to City Council Resolution 2025-03 whereby the City Council adopted Findings of Fact, Statement of Overriding Considerations, and the Mitigation Monitoring and Reporting Program, and certifying the Final Supplemental Environmental Impact Report (SEIR) prepared for the General Plan Land Use Element amendments and the Mill District Specific Plan. As part of adopting Resolution 2025-03, the City Council found that the processing and approval of the amendments to the Land Use Element, adoption of the Mill District Specific Plan and implementing Q-Qualified Zone and Design Guidelines in compliance with the requirements of the California Environmental Quality Act (CEQA). The MDSP SEIR also analyzed Zoning Map amendments for the parcels of land identified in Exhibit A. More specifically, the SEIR prepared and certified for the General Plan Land Use Element amendments and the Mill District Specific Plan includes the following Zoning Map amendments:

1. Mill District Specific Planning Area Creek Riparian and Trails Sub Area which includes the Northwestern Pacific Railroad Co.–Great Redwood Trail Agency right-of-way corridor that is comprised of APNs 200-363-008, 200-381-008, 202-021-008, and 202- 022-011, being the same geographic area identified in Section 2.7 as Area #2, in Figure 3: “Land Use and Zoning Change Areas within and Outside the MDSP”, Table 4:
“Existing and Proposed General Plan Land Use Designations Within MDSP Boundary”, and Table 6: “Existing and Proposed Zoning Classifications Within MDSP Boundary” of the certified SEIR adopted for the General Plan Land Use Element amendments, and the MDSP.

2. Being the same geographic area identified in Section 2.7 as Area #13, in Figure 3: “Land Use and Zoning Change Areas within and Outside the MDSP”, Table 5: “Existing and Proposed General Plan Land Use Designations Outside MDSP Boundary”, and Table 7 “Existing and Proposed Zoning Classifications Outside MDSP Boundary” of the certified SEIR adopted for the General Plan Land Use Element amendments, and the MDSP.

3. Being the same geographic area identified in Section 2.7 as Area #14, in Table 5:
“Existing and Proposed General Plan Land Use Designations Outside MDSP Boundary”, and Table 7: “Existing and Proposed Zoning Classifications Outside MDSP Boundary”, and identified as Area #15 in Figure 3: “Land Use and Zoning Change Areas within and Outside the MDSP”.

B. Therefore, the City has already complied with the requirements of CEQA for the Zoning Map amendments.

Consistency with the Fortuna General Plan
C. The proposed amendments to the Zoning Map for the Northwestern Pacific Railroad Co.–Great Redwood Trail Agency right-of-way corridor within the MDSP that is comprised of APNs 200-363-008, 200-381-008, 202-021-008, and 202-022-011 will facilitate the implementation of policies and standards for the development of a Class I trail through the Mill District as part of the Great Redwood Trail and/or Strongs Creek Trail to provide a continuous active transportation corridor between Fortuna Boulevard and Newburg Road/12th Street.

D. The proposed amendments to the Zoning Map for the parcels of known as APN 202-021-021 and APN 202-021-012 will address existing inconsistencies with the Land Use Element of the General Plan because the proposed ordinance will amend the Zoning Map, as set forth in Exhibit A, for the two parcels to change from a zone that is inconsistent with the General Plan and MDSP land use designations to zones that are consistent with General Plan and MDSP land use designations.

Public Interest
E. The proposed amendments to the Zoning Map are in the public interest because the amendments promote the orderly and efficient development of land within the City, and will correct inconsistencies, clarifying and reinforcing the City’s intent for certain General Plan land use designations, guiding development within the City to achieve goals and policies of the General Plan 2030 and the Mill District Specific Plan.
