SUBJECT: Road Maintenance and Rehabilitation Account Project List; Resolution 2026- 14 STAFF RECOMMENDATION:
Adopt a Resolution of the City Council of the City of Fortuna designating projects to be funded by the Road Maintenance and Rehabilitation Account (RMRA) during Fiscal Year 2026-27.
EXECUTIVE SUMMARY:
To be eligible for funding from the passage of SB1, the City must formally adopt a list of projects to be completed and forward that list to the California Transportation Commission (CTC) by July 1 st each year. Staff has prepared a list of projects in a format acceptable to the CTC and included it as an attachment.
In order to ensure that RMRA funds are spent appropriately, the City must also report after the fact on which projects were ultimately completed. It is important to note that there is no requirement that the annual list of anticipated projects match the list of projects completed. In the event that additional funding becomes available or if emergency projects arise, the two lists may differ.
Additionally, if during the Cities budget process different projects are identified by the Council as a higher priority than the ones adopted with the attached resolution the City can change the projects with no repercussions.
FINANCIAL IMPACT:
The projects included on the attached list are identified in the draft 2026-27 fiscal year budget through the Capital Improvement Program. If not funded through RMRA these projects would either not be completed or would have to be funded through other funds and other projects would not be completed.
RECOMMENDED COUNCIL ACTION:
Motion to adopt Resolution 2026-14. Consent Agenda vote.

WHEREAS, Senate Bill 1 (SB 1), the Road Repair and Accountability Act of 2017 (Chapter 5, Statutes of 2017) was passed by the Legislature and Signed into law by the Governor in April 2017 in order to address the significant multi-modal transportation funding shortfalls statewide; and WHEREAS, SB 1 includes accountability and transparency provisions that will ensure the residents of our City are aware of the projects proposed for funding in our community and which projects have been completed each fiscal year; and
WHEREAS, the City of Fortuna must adopt by resolution a list of all projects proposed to receive funding from the Road Maintenance and Rehabilitation Account (RMRA), created by SB 1, which must include a description and the location of each proposed project, a proposed schedule for the project’s completion, and the estimated useful life of the improvement; and WHEREAS, the City, will receive an estimated $351,573 in RMRA funding in Fiscal Year 2026-27 from SB 1; and
WHEREAS, this is the tenth year in which the City of Fortuna is receiving SB 1 funding and will enable the City of Fortuna to continue essential road maintenance and rehabilitation projects, safety improvements, repairing and replacing aging bridges, and increasing access and mobility options for the traveling public that would not have otherwise been possible without SB 1; and
WHEREAS, the City of Fortuna has undergone a robust public process through its Capital Improvement Program to ensure public input into our community’s transportation priorities/the project list; and
WHEREAS, the City of Fortuna used a Pavement Management System to develop the SB 1 project list to ensure revenues are being used on the most high-priority and cost-effective projects that also meet the communities priorities for transportation investment; and WHEREAS, the funding from SB 1 will help the City of Fortuna maintain and rehabilitate roads that otherwise would not be maintained, add active transportation infrastructure throughout the City of Fortuna this year and hundreds of similar projects into the future; and WHEREAS, the 2020 California Statewide Local Streets and Roads Needs Assessment found that the City of Fortuna’s streets and roads are in an “at-risk” condition and this revenue will help us increase the overall quality of our road system; and WHEREAS, the SB 1 project list and overall investment in our local streets and roads infrastructure with a focus on basic maintenance and safety, investing in complete streets infrastructure, and using cutting-edge technology, materials and practices, will have significant positive co-benefits in the City of Fortuna.

TO: Honorable Mayor and Council Members
FROM: Amy Nilsen, City Manager
SUBJECT: Conduct Annual Public Hearing for the Fortuna Business Improvement District Assessment and consider adopting Resolution 2026-15 STAFF RECOMMENDATION:
Staff recommends that the Council conduct the annual Fortuna Business Improvement District public hearing and consider adopting Resolution 2026-15 authorizing the annual assessment for fiscal year 2026-27.
EXECUTIVE SUMMARY
At the April 6, 2026, Regular Meeting, the Council adopted a Resolution of Intention (the “Resolution of Intent”), a copy of which is attached hereto. The Resolution of Intent accomplished the following: (i) approved the FBID annual report as submitted on March 16, 2026; (ii) declared the Council’s intention to levy and collect the annual FBID assessment for fiscal year 2026-27 at a flat rate of $25 per qualifying business; and (iii) provided notice of this public hearing and the right of businesses subject to the annual assessment to submit a written or oral protest against the assessment.
As required by law, the Resolution of Intent and the notice of this public hearing was published in a newspaper of general circulation within the City at least seven (7) days prior to the date of this public hearing.
The purpose of this public hearing is to determine whether the FBID annual assessment should be levied for the 2026-27 fiscal year. The Council may authorize the assessment unless sufficient written protests against the assessment are received by the City Clerk at or before the time fixed for the public hearing.
A protest is successful if written protests are received from the owners of businesses in the assessment area which will pay 50 percent or more of the assessments proposed to be levied and protests are not withdrawn so as to reduce the protests to less than that 50 percent. The Council must also consider oral protests during the public hearing, but only written protests that meet the content requirements are counted for purposes of determining whether the protest is successful.
Business Agenda Item 4a
Each written protest must contain a description of the business in which the person submitting the protest is affiliated sufficient to identify the business and, if a person submitting is not shown on the official records of the city as the owner of the business, the protest must contain or be accompanied by written evidence that the person submitting is the owner of the business. A written protest which does not comply with these requirements shall not be counted in determining a majority protest. The Council may, however, waive any irregularity in the form or content of any written protest.
If the protest is successful, the Council may not levy the assessment for the particular fiscal year.
If the protest is not successful, the Council may authorize and levy the assessment by adopting Resolution 2026-15, attached hereto.
Staff recommends that the Council adopt the proposed resolution, assuming the protest is unsuccessful.
FINANCIAL IMPACT:
An FBID assessment of $25.00 per business would generate approximately $16,500 annually.
The total expenditures for Fiscal Year 2025-26 year-to-date are $8,759.88.
RECOMMENDED COUNCIL ACTION:
1. Receive staff presentation and review Council questions with staff
2. Open Public Hearing
3. Receive any testimony
4. Close Public Hearing
5. Determine whether a protest exists
6. If the protest is unsuccessful, motion to adopt Resolution 2026-15, read by title only.
Roll Call Vote.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL THAT:
1. The recitals set forth above are true and correct.
2. The City Council does not make any change to the boundaries of the Fortuna Business Improvement District.
3. There being an unsuccessful protest, the City Council authorizes the levy and collect assessments in the annual amount of $25 upon all businesses, trades and professions located within the boundaries of the Fortuna Business Improvement District.
4. The activities and improvements authorized by section 5.40.070 of the Fortuna Municipal Code shall remain unchanged for the 2026-2027 fiscal year.

TO: Honorable Mayor and Council Members
FROM: Amy Nilsen, City Manager
SUBJECT: Consideration of Designating the Redwood Transit System Stop at 11th & N Streets as a "Major Transit Stop" in Humboldt County Association of Government’s Regional Transportation Plan
STAFF RECOMMENDATION:
It is recommended that the City Council:
1. Provide direction on whether to support designating the Redwood Transit System (RTS) stop at 11th & N Streets as a "major transit stop" in Humboldt County Association of Government’s (HCAOG) Regional Transportation Plan RTP) (VROOM 2026–2046), and authorize the City Manager to sign and transmit a comment letter to HCAOG reflecting the Council's position.
2. If supportive (or supportive with conditions), direct staff to: (a) prepare parking management and objective design standards applicable within 1/2 mile of the stop; and (b) evaluate any needed adjustments to traffic impact fee schedules to comply with AB 2553 (2024).
EXECUTIVE SUMMARY:
HCAOG has initiated a formal agency comment period on adding 14 additional "major transit stops" to its RTP, using a defensible methodology based on stops with at least 50 average daily boardings/alightings (serves a minimum of 1% of regional ridership). One of the proposed additions is the Redwood Transit System stop at 11th & N Streets in Fortuna. Following Policy Advisory Committee discussion on February 19, 2026, HCAOG deferred final inclusion of the Fortuna stop pending City comment; written comments are requested by May 8, 2026, with HCAOG consideration on May 21, 2026.
Designating a "major transit stop" has direct land-use and CEQA implications within a one-halfmile radius: (1) AB 2097 (2022) generally prohibits minimum off-street parking requirements for most developments; (2) AB 2553 (2024) requires lower vehicular traffic impact fees for qualifying housing near major transit stops and updates the statutory definition of "major transit stop"; and (3) Governor’s Office of Planning and Research (OPR) CEQA Technical Advisory presumes certain projects within one-half mile of a major transit stop have less-than-significant Vehicle Miles Traveled (VMT) impacts, which can streamline environmental review.
Business Agenda Item 4b
Council action today would provide policy direction for the City's comment letter to HCAOG and, if supportive, initiate local implementation work (e.g., parking management and objective standards) to responsibly realize benefits while addressing community concerns.
BACKGROUND:
On February 19, 2026, the HCAOG Board considered adopting the RTP update (VROOM 2026– 2046) and discussed expanding the list of "major transit stops." The first cut-off of stops that serve over 150 daily average boardings/alightings which are the original seven locations designated as major transit stops in 2024 and located in Eureka, Arcata, and Humboldt County (College of the Redwoods). HCAOG staff identified a second threshold—stops serving 50 average daily boardings/alightings (serves a minimum of 1% of regional ridership)—yielding 14 proposed new locations. Following interagency discussion, staff recommended deferring the additions for a short, formal local review period. HCAOG’s March 5, 2026, letter to the City opens a comment period through May 8, 2026, and notes that the Fortuna stop (RTS 11th & N) is a proposed addition to be brought back to the Board on May 21, 2026.
Designating major bus stops in an RTP qualifies those locations as a 'major transit stop' for the purposes of state infill-encouragement legislation. Under the Public Resources Code (PRC), "major transit stop" includes specified rail/bus rapid transit stations, ferry terminals, and intersections of two or more major bus routes meeting a service frequency threshold. AB 2553 (2024) amended PRC §21064.3 effective January 1, 2025, to set the bus frequency criterion at 20 minutes or less during peak periods and harmonize related housing/fee provisions.
Key effects within 1/2 mile of a designated stop.
• Parking: AB 2097 generally precludes cities from imposing "minimum" off-street parking requirements on most residential, commercial, and other specified developments within 1/2 mile of a major transit stop (with limited exceptions and documentation requirements).
This can lower project costs and support infill housing but may raise on-street parking management considerations.
• Impact fees: AB 2553 requires local agencies that levy vehicular traffic impact mitigation fees on housing to set lower rates for qualifying projects near major transit stops/transit priority areas.
• CEQA Vehicle Miles Traveled (VMT): OPR Technical Advisory provides a screening presumption that certain projects located within 1/2 mile of a major transit stop will have a less-than-significant VMT impact, reducing time and cost for CEQA review. Local VMT guidelines still apply for detailed cases.
The 1/2-mile radius from 11th & N would encompass much of central Fortuna. If designated, future private projects in that area could opt to build less parking without a "minimum" requirement; qualifying housing could see reduced traffic impact fees; and many projects could rely on streamlined VMT analysis. The City would retain authority to adopt objective design standards, shared/managed parking policies, and curb management to address spillover and safety.
Staff can return with a draft toolkit (permits, time limits, shared-parking agreements, and data collection) if Council supports designation.
Business Agenda Item 4b
HCAOG is seeking local input on the “50 average daily boardings/alightings (serves a minimum of 1% of regional ridership)" methodology. If Council has concerns, the comment letter could request: (a) documentation of stop-level counts for RTS 11th & N; (b) a commitment to refresh counts periodically; and (c) a formal amendment schedule to add/remove stops as data evolve.
OPTIONS:
1. Support designation and transmit a letter of support and authorize the City Manager to sign. Direct staff to prepare a local implementation workplan (parking management, objective standards, fee schedule compliance) and return within 90 days.
2. Support in concept, contingent on HCAOG providing stop-specific boarding data, a periodic update protocol, and a commitment to map-based coordination; transmit a conditional support letter.
3. Do not support designation at this time; transmit a letter requesting deferral pending further data/methodology refinements.
4. Provide other direction to staff.
FISCAL IMPACT:
No immediate direct fiscal impact is associated with transmitting a comment letter. If the stop is designated, there may be longer-term fiscal implications: potential reductions in traffic impact fee revenues for eligible housing within the 1/2-mile area; staff time to prepare parking management tools and objective standards; and potential eligibility benefits when competing for state/federal funding that favors transit-oriented infill. Staff will return with resource needs if Council directs an implementation workplan.
RECOMMENDED COUNCIL ACTION:
1. Receive staff presentation and review Council questions
2. Open Public Comment
3. Close Public Comment
4. Motion to select an option above and authorize the City Manager to sign a comment letter to HCAOG. Roll call vote.

• HCAOG Letter to City of Fortuna re: Major Transit Stop Designation (March 5, 2026) March 5, 2026
To: Amy Nilsen, City Manager, City of Fortuna
From: Brendan Byrd, HCAOG Executive Director, HCAOG
Subject: Agency Comment Period Regarding Major Transit Stop Additions and Methodology in 2026 RTP Update
Dear Mrs. Nilsen,
At their meeting on February 19th, the HCAOG Board approved expanding the definition of a ‘major transit stop’ as defined the Humboldt County Regional Transportation Plan (RTP), VROOM 2026-2046. As part of the proposed expansion, all regional transit stops with at least 50 passenger boardings/alighting’s are included, which in the final draft RTP resulted in 14 newly proposed designed major transit stops. One of the proposed new stops is located in the City of Fortuna, at 11th and N Streets (a Redwood Transit System stop).
As part of the final Board motion adopting the 2026 RTP, the proposed major transit stop in Fortuna was removed from the final document pending a formal notification and comment period for the City. This letter is to inform you of the proposed addition of Fortuna’s major transit stop designation at 11th and N streets, and requests that the City consider the revision and methodology and provide written comments back to HCAOG by Friday May 8th. HCAOG staff are planning on bringing this item back to the HCAOG Board with Fortuna’s input at the May 21st HCAOG Board meeting.
For reference, major transit stops designed in the RTP provide for the following outcomes:
• AB 2097 (2022) prohibits local governments from enforcing minimum parking requirements for most developments within 1/2 mile of a major transit stop; and
• AB 2553 (2024) says that agencies cannot justify new or higher traffic impact fees at qualifying stops and projects in the 1/2 mile buffer; and • OPR guidance presumes that projects within 1/2 mile of major transit stops have less than significant VMT impacts which can streamline CEQA review.

Business Agenda Item 4c
STAFF REPORT
Business Agenda Item
DATE: May 4, 2026
TO: Honorable Mayor and City Council Members
FROM: Amy Nilsen, City Manager
SUBJECT: Transactions and Use Tax Measure
STAFF RECOMMENDATION:
Staff recommends that the Council:
1. Receive a report from staff regarding a proposed ballot measure to authorize an additional ¾-cent transactions and use tax within the City, commencing April 1, 2027, to fund essential services.
2. Introduce, on first reading by title only, and submit to the voters Ordinance 2026-785, an Ordinance of the City of Fortuna authorizing an additional City transactions and use tax to be administered by the California Department of Tax and Fee Administration, subject to approval of a majority of the electors voting on the tax measure at the general municipal election to be held on Tuesday, November 3, 2026.
3. Adopt Resolution 2026-12, which:
a. Submits Ordinance 2026-785 to the qualified voters at the November 3, 2026, general municipal election;
b. Requests the election on the ordinance be consolidated with the Statewide General Election;
c. Sets dates for submission of arguments for and against the proposed tax measure; d. Sets dates for submission of rebuttal arguments;
e. Authorizes the Mayor to submit a written argument in favor of the measure on behalf of the Council;
f. Requests the City Attorney prepare an impartial analysis of the measure; and g. Agrees to reimburse the County for the costs of conducting the election on the measure.
DISCUSSION:
In November 2016, a majority of voters approved a local ¾-cent transactions and use tax (Measure E) with the intention of funding previous cuts to public safety and to help maintain and enhance public safety services, support local businesses, provide essential services, and stabilize the City budget. The tax was originally set to expire on March 31, 2025; however, in November 2020, a Business Agenda Item 4c
majority of voters approved an extension of the tax through March 31, 2033. The proposed 2026 measure would not eliminate the current voter-approved ¾-cent transactions and use tax, which would remain in effect through March 31, 2033. Instead, the proposed measure would authorize an additional ¾-cent transactions and use tax commencing April 1, 2027. If approved, the combined City transactions and use tax rate would be 1.5-cent from April 1, 2027, through March 31, 2033, after which the existing voter-approved tax would sunset and the additional voterapproved ¾-cent tax would remain in effect unless ended later in accordance with the ordinance and applicable law.
Measure E revenues are essential for the City to maintain and continue to improve certain essential City services and to maintain a balanced budget. However, as discussed in more detail below, the City has experienced a significant increase in the cost of providing essential services since 2016 and additional funds are necessary to meet current and projected costs.
The City of Fortuna has experienced several consecutive years of structural financial challenges driven primarily by stagnant or declining revenues and rapidly increasing operational costs— particularly for public safety, insurance, and core community services.
1. How Fortuna Reached this Fiscal Crossroads
a. Sales Tax Revenues Are Not Keeping Pace With Inflation The City’s largest unrestricted revenue source is sales tax, and sales tax has not kept up with inflation. Under normal inflation, revenues would have increased to $5.2M by FY 2026–27. Actual projected revenues are only $4.1M. This results in a gap of over $1,000,000. This means the City effectively lost the purchasing power of nearly one million dollars over a five-year period. See below chart.
Business Agenda Item 4c
b. Transient Occupancy Tax (TOT) Revenues Have Declined Significantly Traditionally, TOT helps fund City services and tourism-related impacts. The City’s TOT revenue has dropped sharply since FY 2021–22. Expected inflation-adjusted TOT for FY 2026–27 is approximately $1.1M. Actual projected TOT is $700,000, a gap of over $400,000. This decline appears linked to regional lodging patterns and reduced tourism activity. See below chart.
c. Liability Insurance Costs Have Skyrocketed
Liability insurance—an unavoidable cost—has increased more dramatically than any other major expense category. Actual costs for liability insurance in fiscal year 2021– 22 were $435,894. Projected costs for fiscal year 2026-27 is $1,051,372, an increase of over $615,000, or over 140%. The resulting gap compared to inflation-adjusted expectation is over $500,000. These increases are consistent with statewide trends affecting municipal risk pools. See below chart.
Business Agenda Item 4c
The result of these three trends is a General Fund structural budget deficit. These combined trends demonstrate rising costs and flat to declining revenues. In order to address these trends the use of reserves and a hiring freeze has been put into place. In addition, there is a potential for reductions in services to maintain critical operations.
To better understand voter attitudes toward these challenges and gauge the feasibility of a future sales tax measure, the City commissioned EMC Research to conduct a statistically valid public opinion survey from February 23 to March 5, 2026, collecting 200 interviews with a margin of error of ±6.9%.
At a regular meeting held on April 6, 2026, the Council reviewed EMC Research public opinion results and subsequently voted to place a ¾-cent sales tax measure on the November 3, 2026 ballot.
The draft resolution incorporates the ballot language used during EMC Research’s public opinion polling and reviewed on April 6, 2026, as follows:
Fortuna Essential Services Funding Measure
Shall the measure to maintain essential City services, such as protecting public safety; increasing and restoring police officers; repairing aging/ deteriorating streets and potholes; providing programs for seniors and youth; and keeping parks clean and safe, by authorizing a ¾-cent sales tax in the City of Fortuna, generating $1,800,000 annually for general government use until ended by voters, requiring independent audits, community oversight, and all funds staying in Fortuna, be adopted?
Yes
No
Included with this Staff Report are two attachments:
• Attachment A is the final proposed ordinance that, among other things:
Business Agenda Item 4c
o Authorizes an additional ¾-cent transactions and use tax commencing April 1, 2027;
o Maintains the existing voter-approved ¾-cent transactions and use tax through March 31, 2033;
o Provides that from April 1, 2027, through March 31, 2033, the combined City transactions and use tax rate would be 1.5-cent;
o Maintains the independent audit requirement;
o Maintains the oversight committee; and
Preserves the authority to reduce or repeal the additional tax as provided in the ordinance.
• Attachment B is the final proposed resolution that, among other things:
o Submits the ordinance (Attachment A) to the qualified voters at the November 3, 2026, general municipal election;
o Requests the election on the ordinance be consolidated with the Statewide General Election;
o Designates the ballot title and question;
o Sets dates for submission of arguments for and against the proposed tax measure;
o Sets dates for submission of rebuttal arguments;
o Authorizes the Mayor to submit a written argument in favor of the measure on behalf of the Council;
o Requests the City Attorney prepare an impartial analysis of the measure; and
o Agrees to reimburse the County for the costs of conducting the election on the measure.
Authorizing an additional ¾-cent transactions and use tax will allow the City to continue to have more competitive salaries and fund special programs beyond normal operation. Not pursuing additional tax revenue will make it harder for the City to recruit and retain employees and limit the ability to do special projects. It is important to note, that while the sales tax would be administered by the California Department of Tax And Fee Administration (“CDTFA”), the revenues are earmarked exclusively for use by and within the City – the State would not be able to take or borrow these funds.
FISCAL IMPACT:
Without the proposed additional ¾-cent increase to the City’s existing transactions and use tax, the City will continue to lose the ability to fund all but the necessary projects and would struggle to retain staff by paying competitive salaries. If the tax is not increased in 2026 then the City would look to work toward balancing future budgets by reducing services and staffing. In addition, the following essential services would be at risk for elimination or reduction:
• Capital Improvement Projects (CIP) that are scheduled for the repair and/or replacement of deteriorated City infrastructure will continue to be postponed and/or cancelled • Fewer staff and maintenance projects for city streets • Fewer repair projects for city drainage facilities
Business Agenda Item 4c
• Fewer staff and expansion or improvement of city parks RECOMMENDED COUNCIL ACTION:

The approval of this Ordinance is exempt from the California Environmental Quality Act (Public Resources Code §§ 21000 et seq., “CEQA,” and 14 Cal. Code Reg. §§ 15000 et seq., “CEQA Guidelines”). The transactions and use tax enacted by this Ordinance is a general tax that can be used for any legitimate governmental purpose; it is not a commitment to any particular action. As such, under CEQA Guidelines section 15378(b)(4), the tax is not a project within the meaning of CEQA because it creates a government funding mechanism that does not involve any commitment to any specific project that may result in a potentially significant physical impact on the environment. If revenue from the tax were used for a purpose that would have either such effect, the city would undertake the required CEQA review for that particular project. Therefore, pursuant to CEQA Guidelines section 15060 CEQA analysis is not required.

Pursuant to California Elections Code Section 9280, the City Council hereby directs the City Clerk to transmit a certified copy of the measure to the City Attorney. The City Attorney shall prepare an impartial analysis of the measure, not to exceed 500 words in length, showing the effect of the measure on the existing law and the operation of the measure, and file the impartial analysis with the City Clerk by August 12, 2026.
SECTION 6. The City of Fortuna recognizes that additional costs will be incurred by the County by reason of this consolidation and agrees to reimburse the County of Humboldt for all costs associated with the conduct of the City of Fortuna’s municipal election to be held on November 3, 2026.
SECTION 7. That notice of the time and place of holding the election is given and the City Clerk is authorized, instructed and directed to give further or additional notice of the election, in time, form and manner as required by law.
SECTION 8. That the City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original Resolutions.
SECTION 9. The approval of this Resolution is exempt from the California Environmental Quality Act (Public Resources Code §§ 21000 et seq., “CEQA,” and 14 Cal. Code Reg. §§ 15000 et seq., “CEQA Guidelines”). The transactions and use tax to be submitted to the voters is a general tax that can be used for any legitimate governmental purpose; it is not a commitment to any particular action. As such, under CEQA Guidelines section 15378(b)(4), the tax is not a project within the meaning of CEQA because it creates a government funding mechanism that
does not involve any commitment to any specific project that may result in a potentially significant physical impact on the environment. If revenue from the tax were used for a purpose that would have either such effect, the city would undertake the required CEQA review for that particular project. Therefore, pursuant to CEQA Guidelines section 15060 CEQA analysis is not required.
NOW, THEREFORE, BE IT FURTHER RESOLVED the City Clerk is hereby directed to file a certified copy of this resolution with the Board of Supervisors and the Humboldt County Registrar of Voters.
