TO:

Mayor and Members of the City Council
President and Members of the Estero Municipal Improvement District (EMID) Board of Directors

FROM: Edmund Suen, Interim City Manager

SUBJECT: FISCAL YEAR 2022-2023 CITY/DISTRICT BUDGET

RECOMMENDATION
It is recommended that the City Council/EMID Board of Directors (City Council) approve the attached resolutions approving the Fiscal Year 2022- 2023 Final Budget.

EXECUTIVE SUMMARY
As part of the annual budget process, the City Council held a budget study session on February 28 to review the mid-year projections for FY 2021-2022 and to provide policy direction on the preparation of the FY 2022-2023 budget and 5-year financial plan. Budget study sessions were also held on March 28 and May 9. The City Council held a public hearing on the preliminary budget on June 6 and provided direction for non-profit agency funding that same evening. Tonight, staff recommends City Council’s approval of the FY 2022- 2023 Final Budget.

ANALYSIS
The City continues to grapple with revenue shortfalls for sales tax, business license tax, recreation programs and rentals, and especially transient occupancy tax as a result of the continued economic impacts of the COVID- 19 pandemic. In addition, challenges such as high inflation, supply-chain 538
disruptions, labor shortages/escalating cost of labor, and impacts from the Russia-Ukraine war have weighed on City finances. As a result, the FY 2022-2023 Budget and 5-Year Financial Plan reflects ongoing operating structural deficits before applying the anticipated receipt of American Rescue Plan Act (ARPA) relief funding in July 2022. After applying the ARPA funding of $4.05 million, a small surplus of $114,010 is projected for FY 2022-2023; however, continued structural deficits are anticipated for the remaining out- years of the 5-year financial forecast. In an effort to address the General Fund structural deficits, the City Council directed staff to consider an amendment to its business license tax ordinance for a potential revenue ballot measure at the November 2022 general election. The FY 2022-2023 Final Budget incorporates all of the City Council direction received at various budget study sessions and the public hearing.

The Final FY 2022-2023 General Fund budget and five-year financial plan is as follows:

In addition, staff has increased the FY 2022-2023 General Fund expenditure budget by $2,847 based on the revised Foster City JPA member contribution as determined in the SMC Fire Department's final adopted budget. Staff has also made various non-General Fund adjustments totaling $640,772 in revenues and $130,300 in expenditures (see Attachment 4). The majority of those adjustments are in Internal Service Funds (ISFs) to increase/reconcile revenues to the ISF assessments charged to various City/EMID departments.

The financial and personnel summary pages for the FY 2022-2023 final budget are attached to this report (Attachment 3). The proposed final budget is available on the City’s website at
539
https://www.fostercity.org/finance/page/annual-budget. Having reviewed the preliminary budget and having held a public hearing on the preliminary budget, it is recommended that the City Council adopt the attached resolutions approving the FY 2022-2023 Final Budget.

FISCAL IMPACT
Adoption of the annual budget authorizes expenditures identified in the budget document.

CITY COUNCIL VISION, MISSION, AND VALUE/PRIORITY AREA
This item is in alignment with City Council’s Vision Statement for a Sustainable Foster City under the economic sustainability framework.

SUBJECT: CITY/DISTRICT PAY PLAN FOR FISCAL YEAR 2022-2023

RECOMMENDATION

It is recommended that the City Council/EMID Board of Directors (hereinafter referred to as City Council) adopt the attached resolutions amending the City of Foster City/Estero Municipal Improvement District (herein after referred to as City/District) Pay Plan.

EXECUTIVE SUMMARY

The City Council approves a Pay Plan at regularly scheduled meetings as part of the budget adoption process and amends the Pay Plan if there are changes during the fiscal year. With the approval of the Fiscal Year 2022- 2023 budget, staff has prepared an updated City/District Pay Plan to include the salary scale for newly approved positions, staff pay increases and the new minimum wage, and is recommending the City Council approve the amended pay plan.

BACKGROUND

During the budget adoption process, the City Council regularly reviews and 563
approves a new Pay Plan for the fiscal year. Amendments are brought to the City Council if there are any changes during the fiscal year. Most recently, the Pay Plan was amended on April 4, 2022 to update the City Manager's pay rate for the most recent Interim City Manager appointment.

The California Public Employees Retirement System (CalPERS) requires public agencies to provide a publicly available pay schedule under Government Code 20636 and CCR section 570.5. To meet this requirement, City staff presents updated pay plans to the City Council for approval, and then posts them on the City’s website for public access.

ANALYSIS

Staff is updating the pay plan to incorporate the following changes:
Newly Approved Positions - Staff recently recommended and the City Council approved two new job classifications, Housing Coordinator and Irrigation Technician. Staff is adding these new positions to the updated pay plan.
Staff Pay Increases - The City Council approved agreements with both of our bargaining units, AFSCME and the FCPOA, which include a pay adjustment based on the April 2022 CPI-U for San Francisco-San Jose- Oakland area, with a minimum of 3% and a maximum of 5%. The City Council also amended the unrepresented Management Compensation and Benefits Plan to have a pay adjustment based on the same formula. The April 2022 CPI-U was 5.0, so the pay adjustment for employees in each of those groups will be 5%.
New Minimum Wage - Effective July 1, 2022, the new minimum wage for Foster City will be $15.75 per hour. This new minimum wage directly affects three classifications that are currently under that rate and will need to be adjusted. Those classifications are Recreation Leader I, Building Service Assistant, and Clerical Assistant. Staff has made the appropriate starting salary adjustments to these classifications to meet the new minimum wage requirement with Step 1 starting at $15.75 per hour and Steps 2-5 being incrementally increased by 3.5%, which is the past practice for these hourly, part-time and seasonal classifications. Staff also notes that the Recreation Leader II, Recreation Leader III and Building Services Coordinator Assistant positions will reflect starting salary adjustments as well to create a 564
proper spacing between the different classifications and reduce salary compaction.
Assistant City Manager - In July 2019, the Assistant City Manager position's salary rate was adjusted with a 5% increase. This was due to the additional assignment of co-supervising the newly appointed Community Development Director with the City Manager at that time. As that responsibility is no longer assigned to the Assistant City Manager position, the salary range is being reduced by 5% to bring it back in line with the Community Development Director and Public Works Director salary ranges. This position is currently unfilled and there is no intent to fill a position of Assistant City Manager at this time.

To meet CalPERS requirements under Government Code 20636 and CCR section 570.5, which requires public agencies to provide a publicly available pay schedule, staff is bringing an updated Pay Plan forward with the above noted changes for the City Council's approval to ensure the City's pay schedule is updated effective July 1, 2022.

FISCAL IMPACT

The FY 2022-2023 Pay Plan reflects the currently approved salary range for all positions in the organization, including the newly adopted Housing Coordinator and Irrigation Technician classifications, and are in line with the FY 2022-2023 budget. No additional budget allocation is required.

CITY COUNCIL VISION, MISSION, AND VALUE/PRIORITY AREA

These actions support "Staff Empowerment and Operational Excellence" Value/Priority Area, allowing the organization to focus on key outcomes of attracting and retaining high-caliber talent to support service delivery. By meeting these key outcomes, the City will continue to be able to proactively provide exceptional service to our community.

To City Council of Foster City:

We are writing to address the proposed increase of the business license tax and would like to point out a few bullets and request further discussion and (re)-consideration regarding this proposal:

1. To go from a cap (which still produced a meaningful tax, but not unreasonable necessarily) to effectively no cap – which produces, in our case, a 1,000% increase in tax (both a substantially meaningful and unreasonable amount) and such proposed revisions will produce even greater amounts for other companies which are overly economically burdensome, perhaps unconstitutional and needs more discussion;

2. We are not out of the Covid burden yet and Sycomp has not meaningfully occupied our Foster City leased space in over 2 years (and we are already paying an enormous amount, which you tax already via the real estate owner), whereby this gross revenue is not being sourced in Foster City, as remote employees are scattered through CA and the US;

3. Further, as this is a gross receipt model, the City is failing to consider that the companies may not be profitable – not considering profit especially during Covid and the supply chain limitations again we could be broaching constitutional taking and other issues here;

4. We are dealing with rising inflation, discussions of a global recession, uncertainty in the marketplace, hybrid workforces and you are proposing a potentially 1,000 % increase in an already competitive marketplace;

5. This increase will be the tipping point for us and many other companies and will force companies to leave Foster City; and

6. We are talking to other companies and we can confirm that this increase is enough where creating a litigation fund to oppose this exorbitant increase is cheaper than paying said increase for the companies at issue.

William E. Rainey
