The City's property tax revenues continue to be the bedrock of General Fund revenues with assessed value growth supported by price gains of home sales. Excess ERAF surpassed the City's conservative estimates. Property Tax in lieu of VLF revenues exceeded budget as the State provided funding for prior period shortfalls. While the County continues to advocate a legislative fix for its annual VLF shortfalls, the State has been reluctant to accommodate.1 2 3
4 FY 2022-23 sales tax revenues were $4.4 million or $1.3 million above budget estimates. The higher price of gas and merchandise along with strong consumer spending contributed to the robust results.
Although TOT revenues have yet to reach its pre-pandemic levels, the recovery trend has been encouraging. FY 2022-23 revenues surpassed budgeted estimates by $975,000 and are now at 78% of the $4.39 million high back in FY 2018-19.
FY 2022-23 interest and rental income were $3.2 million or $1.7 million higher than estimates as the Federal Reserve’s Federal Funds rate ascended 350 basis points in FY 2022-23 and demand for facility rentals accelerated. 5 6
Several projects including the Hotel at the S/W Corner of Metro Center and Shell and the Biomed Realty Lincoln Center Drive Phase II project have been postponed, while the Life Sciences building on Vintage Park was delayed resulting is the substantial miss on impacts fee revenues for FY 2022-23.
Wastewater enterprise operating fund revenues for FY 2022-23 raced $1.6 million past budget as investment income surged by $1.2 million.

ADDITIONAL SIX MONTHS, FROM JANUARY 1, 2024 THROUGH
JUNE 30, 2024 FOR THE LEVEE PROTECTION PLANNING AND
IMPROVEMENTS PROJECT (CIP 327-657)
RECOMMENDATION
It is recommended that the City Council adopt the attached resolution authorizing the Mayor to execute Contract Amendment No. 3 (CA 3) with Regional Government Services Authority (RGS) for the Levee Protection Planning and Improvements Project (Project) Management Consulting Services to increase the current contract by a not-to- exceed amount of $57,000 and extend the services for an additional six months, from January 1, 2024 through June 30, 2024, on a time and materials basis.
EXECUTIVE SUMMARY
Given the complexity and scale of the multi-year Levee Project, the City had engaged RGS to provide specialized project management services for project delivery and coordination beginning January 1, 2021. The contract allowed the City to extend the term for up to two one-year (12 month) increments through December 31, 2023. In the
9.1 9.1 Staff Report
179
second extension, a provision was added to allow additional extensions at the City’s sole discretion to support the completion of the project.
Staff has been satisfied with RGS’ services, and RGS provided a no fee extension for the 2022-2023 term, which will end on December 31, 2023. The current contract cost of $334,620 is projected to be expended in November. CA 3 includes a request for an additional amount not-to-exceed $10,000 for the term ending December 31, 2023.
Additionally, staff is requesting an agreement extension from January 1, 2024 through June 30, 2024, at the rate of $199.79 an hour for approximately 9 hours a week, not-to- exceed $47,000.
BACKGROUND
At the December 17, 2020 City Council Meeting, the City Council adopted City Resolution No. 2020-133, awarding an agreement to RGS in an amount not to exceed $187,200, for a one-year term to provide project management consulting services in support of the Levee Project. The agreement included an option for the City to extend the term, at the City’s sole discretion, for up to two one-year (12-month) increments through December 31, 2023.
At the December 13, 2021 City Council Meeting, the City Council adopted City Resolution No. 2021-174, authorizing Contract Amendment No. 1 with RGS in an amount not-to-exceed $147,420, for an additional one-year term to provide project management consulting services in support of the Levee Project.
At the December 5, 2022 City Council Meeting, the City Council adopted City Resolution No. 2022-139, authorizing Contract Amendment No. 2 with RGS maintaining the existing contract amount with no cost increase, for an additional one-year term to provide project management consulting services in support of the Levee Project through December 31, 2023.
ANALYSIS
Paul Nagengast has served as the Project Advisor for the Levee Project over the last three years and has 30 years of experience in executive management for local government agencies. Over the past three years, Paul has been instrumental in the progression of the Levee Project. He has continued to provide guidance in monitoring the work, and regarding various construction items such as, but not limited to, contract change orders, requests for quotes, and requests for information. Paul has assisted in monitoring the invoicing of the Construction Manager and Contractors to ensure their respective scope and billings remain within the intent and scope of their contractual agreements. In addition, Paul has supported staff in preparing staff reports, presentations and attending several project-related City Council meetings.
9.1 9.1 Staff Report
180
Staff is satisfied with RGS’ services and has determined that it would be in the City’s best interest to exercise the option to extend the contract for an additional 6-month period from January 1, 2024 through June 30, 2024. Staff is requesting an additional amount not-to-exceed $57,000 to ensure adequate coverage and support during the 6- month extension, and anticipated leave of the staff member currently managing the project beginning November 2023. With approval of the agreement extension with RGS for Management Consulting Services, Paul Nagengast would continue to serve as the Project Advisor as outlined in the attached CA 3.
CEQA
An Environmental Impact Report was prepared for the Levee Protection Planning and Improvements Project (State Clearinghouse No. 2016012012). The services that will be provided under this Amendment were contemplated as part of the Project that was considered in the EIR.
FISCAL IMPACT
CA 3 modifies the duration of the Agreement with RGS and adds an additional $57,000 to the current contract amount of $334,620, which includes an amount not-to-exceed $10,000 for the remaining months of November and December, and an amount not-to- exceed $47,000 for the six-month term from January 1, 2024 through June 30, 2024.
RGS bills the City on an hourly basis based on actual amount of work performed. The billing rate for the months of November and December 2023 will remain at $191 per hour, and will be $199.79 per hour for the six-month extension as agreed upon by RGS.
The 2024 hourly rate reflects a 4.6 % increase from $191 an hour. There is sufficient balance in the Levee project Account No. 327-0910-657-4251 to cover RGS’ services for remaining term and extension.
With the execution of Contract Amendment 3, the revised contract amount will be $391,620:

SUBJECT: CONTRACT AMENDMENT NO. 2 TO THE AGREEMENT WITH WILSEY HAM IN THE AMOUNT OF $75,647, AMENDING THE
FEE SCHEDULE AND EXTENDING THE CONTRACT TERM TO
DECEMBER 31, 2024 FOR ON-CALL SURVEY SUPPORT
SERVICES FOR THE LEVEE PROTECTION PLANNING AND
IMPROVEMENTS PROJECT (CIP 327-657)
RECOMMENDATION
It is recommended that the City Council adopt the attached resolution authorizing the Mayor to execute Contract Amendment No. 2 (CA #2) with Wilsey Ham in the amount of $75,647, amending the fee schedule, and extending the contract term to December 31, 2024, for on-call survey support services for the Levee Protection Planning and Improvements Project (Project) (CIP 327-657) and approving a contingency of $10,000 and authorizing the City Manager to approve expenditures up to the contingency amount. An Environmental Impact Report was Prepared for the Levee Protection Planning and Improvements Project (State Clearinghouse No. 2016012012).
EXECUTIVE SUMMARY
In 2021, the City hired Wilsey Ham as land surveyor professionals to provide a range of land survey services for construction of the Levee Project. In May 2023, the City Council authorized Contract Amendment No. 1 (CA #1) to the Agreement to extend the existing
9.2 9.2 Staff Report
189
4 6
8 scope of work to include additional surveying work not included in the original scope.
With CA #1, the revised total contract amount was $83,046.
CA #2 would provide for an additional $15,647 necessary to complete the final As-Built Top of Wall Verification required by the Federal Emergency Management Agency (FEMA). Further, another $60,000 is needed for Legal Description/Plat technical review for new easements, license or fee conveyances. Adding a total of $75,647 to the contract would bring the total contract amount to $158,693.
The original contract was for the duration of construction that is through January 2024.
The remaining services to be provided are anticipated to take longer than the time provided in the agreement, so extending the contract term to December 31, 2024, is also recommended.
Finally, staff is recommending establishing a $10,000 contingency for CA #2 and authorizing the City Manager to approve expenditures up to the contingency amount.
There is adequate funding in the Project budget for both CA #2 and the contingency.
BACKGROUND
On March 31, 2021, the former City Manager executed an agreement with Wilsey Ham, in an amount not-to-exceed $44,946 for On-Call Survey Support Services for the Project.
Specifically, the agreement included the following scope of work: verifying the Contractor’s survey control; performing property line staking; verifying top of wall elevations as the project progresses and at the end of the project; and supporting the Construct Management Team and Engineering Consultant on an as-needed basis.
On May 1, 2023, the City Council executed CA #1 in the amount of $38,100 for additional scope not accounted for as part of the original agreement amount. CA #1 included the following scope of work: verify access point conform elevations and to verify project related easement information and property line information.
ANALYSIS
A final As-Built Top of Wall Verification is required by FEMA to document the top of wall elevations of the levee. An estimate to perform this work was considered as part of the original agreement cost and scope of work. Now that the project is near completion, it has become apparent that it will take more work to complete. The additional work consists of surveying more elevation points than initially estimated. An additional $15,647 is needed to complete the task.
The project also needs to provide Legal Description/Plat technical review for new easements, licenses or fee conveyances in 15 areas, a new task not anticipated in the original contract or in CA #1. Wilsey Ham is estimating a budget of $4,000 per area, or a total of $60,000 in additional scope for these technical reviews. Staff is recommending

8 that a contingency of $10,000 be established for CA #2 with authorization given to the City Manager to approve expenditures up to the contingency amount. All work under CA #2 will be performed on a time and materials basis. SUBJECT: AUTHORIZATION FOR A ONE TIME INCREASE TO CITY
MANAGER APPROVAL AUTHORITY ASOCIATED WITH
CONTRACT CHANGE ORDER THIRTY SEVEN (CCO 37), IN AN
AMOUNT UP TO $50,000, AS NECESSARY, TO COMPLETE
CHANGE WORK FOR THE LEVEE PROTECTION PLANNING
AND IMPROVEMENTS PROJECT (CIP 327-657)
RECOMMENDATION
It is recommended that the City Council adopt the attached resolution providing authorization for a one time increase to City Manager approval authority associated with Contract Change Order Thirty Seven (CCO 37), in an amount up to $50,000, as necessary, to complete critical change work during the permitted work window for the Levee Protection Planning and Improvements Project (CIP 327-657).
EXECUTIVE SUMMARY
The change work (the Work) related to CCO 37 includes the removal of the temporary sheet piles at the Baffin and Egress Bridge; slope remediation on the slope adjacent to the Baffin Bridge; the purchase and installation/removal of protective materials to facilitate heavy equipment across the newly constructed levee improvements in order to perform the sheet pile and slope remediation work; and mobilization/demobilization costs associated with the sheet pile removal and slope remediation as further discussed. A portion of bay trail slope adjacent to the Baffin Bridge is compromised. As tidal flows
9.3 9.3 Staff Report
198
move through the area, the slope continues to erode increasing the risk of undermining the trail, an existing major gas line facility, and an existing water line facility. It is imperative that action is taken swiftly to perform change work to remediate the slope and remove the sheet piles. This work must be performed within the in-water work window per the San Francisco Bay Conservation and Development Commission (BCDC). The in- water work window ends on November 30, 2023. If the Work is not performed by November 30, 2023, the City could not return to perform the slope repairs and sheet pile removal until September 1, 2024.
Per City Resolution No. 2020-76, authorization was given to the City Manager to execute contract change orders up to $250,000. On October 30, 2023, the City Manager executed CCO 37 directing the Contractor to perform the Work on a time and materials basis for a not-to-exceed amount of $250,000. The Work is expected to occur between October 30- November 30, 2023. Per the contract documents, the Contractor is required to notify the City in writing when approaching the not-to-exceed amount and if an increase to the limit is required.
Due to the critical nature and timing of the Work associated with CCO 37, staff is recommending the City Council adopt the attached resolution providing authorization for a one time increase to City Manager approval authority associated with Contract Change Order Thirty Seven (CCO 37), in an amount up to $50,000, as necessary, to complete the Work during the permitted work window. Staff does not anticipate the Work exceeding the current not-to-exceed amount. However, in the event it does exceed the current not- to-exceed amount, the City would be at risk of not having the Work completed within the permit window due to there being inadequate time to take an additional change order to City Council for approval.
BACKGROUND
Sheet Pile Removal & Slope Remediation
As part of the BCDC permit requirements for the Levee Project, the City is required to restore full tidal flows to the O’Neill Slough. In order to meet the requirements of the permit and restore full tidal flows, two pedestrian bridges (Baffin Street Bridge and Egress Bridge) were constructed on either end of the O’Neill Slough. As part of the construction of the two pedestrian bridges, a temporary cofferdam/sheet pile was installed. The removal of the temporary cofferdam/sheet pile in January 2022 raised concerns with adjacent City of Belmont residents. City staff determined it was prudent to reinstall a temporary cofferdam/sheet pile to restrict tidal flows until the City confirmed the effects of unimpeded tidal action.
The effects of unimpeded tidal action were analyzed and an addendum to the environmental impact report brought to City Council on September 18, 2023. At the September 18, 2023 City Council Meeting, the City Council, by Minute Order No. 1935, approved the recommendation to remove the existing temporary cofferdam/sheet piles to restore tidal flow back into the O’Neill Slough as required by BCDC and accepted the
9.3 9.3 Staff Report
199
addendum to the certified 2017 Foster City Levee Protection Planning and Improvements Project Final Impact Report. The Notice of Determination associated with the addendum was filed at San Mateo County Clerk-Recorder on September 21, 2023.
On June 7, 2023, an individual from the community took action to dig a trench around the temporary sheet pile wall at the Baffin bridge, thus allowing water to flow between the bay and O’Neill Slough. Since then, as tidal flows move through the area, the slope has eroded considerably, increasing the risk of undermining the trail, an existing major gas line facility, and an existing water line facility.
At the July 20, 2020 City Council Meeting, the City Council adopted Resolution No. 2020- 76, awarding an agreement to Shimmick Construction Company, Inc. (Shimmick) and establishing a contingency in the amount of $9,000,000 with authorization given to the City Manager to execute contract change orders up to $250,000.
ANALYSIS
For tidal action to return to the O’Neill Slough, the temporary sheet piles must be removed. Further, until the temporary sheet piles are removed, the conditions of the BCDC permit cannot be met and therefore the BCDC permit restrictions remain in effect, including bird nesting restrictions.
Flows from the bay continue to erode the slope adjacent to the Baffin Bridge, increasing the risk of undermining the newly improved Bay trail, an existing major gas line facility, and an existing water line facility. This causes a concern over both public safety and the gas line that services a large neighborhood in Belmont. Per the BCDC permit, the Work must occur during the in-water work window which falls between June 1 – November 30 of each year. Further, the Work must also comply with the bird nesting restriction that limits construction activities from September 1st - January 31st of each year.
Accounting for both the in-water work window and the bird nesting restriction, the Work must cease between November 30 th and September 1, 2024. With the upcoming storm season approaching, particularly an anticipated El Niño winter, the project team and City staff are very concerned that the slope will continue to erode. In the essence of time, it was recommended that the Work be performed by Shimmick now. The Work will be performed under a contract change order because slope remediation at Baffin Bridge and the pulling of sheet piles for a second time at both bridges were not accounted for in the construction agreement.
The Work was directed on time and materials due to both parties not being able to agree upon an upfront lump sum cost. While the City moved forward on a time and materials basis, the estimated lump sum costs were used to determine the
9.3 9.3 Staff Report
200
time and materials not-to-exceed amount. CCO 37 includes the direct costs to perform the Work only.
Per the contract documents, the Contractor is required to notify the City in writing when approaching the not-to-exceed amount and if an increase to the limit is required. Due to the critical nature and timing of the Work associated with CCO 37, staff is recommending the City Council adopt the attached resolution providing authorization for a one time increase to City Manager approval authority associated with Contract Change Order Thirty Seven (CCO 37), in an amount up to $50,000, as necessary, to complete the Work during the permitted work window for the Levee Project. Staff does not anticipate the Work exceeding the current not-to-exceed amount. However, in the event it does exceed the current not-to-exceed amount, the City would be at risk of not having the Work completed within the permit window due to there being inadequate time to take an additional change order to City Council for approval. Any supplemental costs to the CCO 37 not-to-exceed amount would be executed as a subsequent change order.
CEQA
An Environmental Impact Report was prepared for the Levee Protection Planning and Improvements Project (State Clearinghouse No. 2016012012). An addendum to the Environmental Impact Report that analyzed specifically the restoration of tidal action into the O’Neill Slough was prepared and filed in September 2023.
FISCAL IMPACT
There is adequate funding in the project budget to cover the anticipated cost associated with CCO 37.
