A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FOSTER CITY
APPROVING AN AGREEMENT WITH PENINSULA CLEAN ENERGY TO

AUTHORIZING THE CITY MANAGER TO EXECUTE THE CUSTOMER
PARTICIPATION AGREEMENT WITH PENINSULA CLEAN ENERGY AND FINDING
THE APPROVAL OF THE AGREEMENT EXEMPT FROM THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT (CEQA) PURSUANT TO CEQA GUIDELINES SECTION 15061(b)(3))
CITY OF FOSTER CITY
WHEREAS, Peninsula Clean Energy’s Gov EV program is designed to provide expert assistance to local governments to plan for and implement charging infrastructure and electric vehicle (EV) purchases; and
WHEREAS, the Public EV Fleets program provides no-cost technical assistance, project planning, and funding; and
WHEREAS, public agencies entering into the agreement commit to replace at least five standard vehicles with electric options or install at least five EV chargers within twelve months and agree to share ongoing charging data with Peninsula Clean Energy; and WHEREAS, projects identified through the Gov EV program will be included in the City’s Vehicle Replacement Program and/or 5-year and 15-year Capital Improvement Program budget starting in Fiscal Year 2024-2025.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Foster City that the approval of this Agreement with PCE is not subject to review under the California Environmental Quality Act (CEQA) pursuant to Public Resources Code Section 21000, et seq. and the CEQA Guidelines (14 Cal. Code Regs. §§ 15000 et. seq.) as this “project” is exempt under the “common sense” exception (14 Cal. Code Regs. § 15061(b)(3)) because it can be seen with certainty that there is no possibility that this action may have a significant effect on the environment.
BE IT FURTHER RESOLVED that the City Council hereby authorizes the City Manager to enter into the Public EV Fleets Program Customer Participation Agreement with Peninsula Clean Energy in the form with minor revisions that may be approved by the City Attorney and to execute any other necessary documents to effectuate the terms of the Agreement.
