RESOLUTION NO.____________

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FOSTER CITY ACCEPTING AND ADOPTING THE SPEED LIMITS IN THE 2023 ENGINEERING AND TRAFFIC SURVEY (E&TS OR ‘SPEED SURVEY’) AND DIRECTING STAFF TO FILE THE 2023 E&TS WITH THE TRAFFIC COMMISSION

CITY OF FOSTER CITY
WHEREAS, the California Vehicle Code requires that an Engineering and Traffic Survey (E&TS) be conducted every five, seven or ten years, depending on roadway conditions and enforcement procedures, so that speeding tickets issued by the Police, based on the use of radar, can be upheld in Traffic Court; and WHEREAS, the last E&TS for the City of Foster City was adopted by the City Council on December 19, 2016, and per the California Vehicle Code, was extended two additional years based on certain conditions being met, with an expiry date of December 19, 2023; and
WHEREAS, on August 21, 2023, the City Council adopted Resolution 2023-85, authorizing the award of a Task Order with Hexagon Transportation Consultants, Inc. to perform the new 2023 E&TS; and
WHEREAS, based on the speed data collected, an analysis of the collision rate for each study segment, and review of other physical and traffic conditions at each location, Hexagon recommends reducing the existing speed limit by 5 miles per hour (mph) to 35 mph on the segment of Foster City Blvd., between E. Hillsdale Blvd. and Bounty Dr., while keeping the existing speed limits on all other roadway sections the same; and
WHEREAS, Public Works and Police staff reviewed the E&TS report, found the results to be reasonable, and recommend that the proposed speed limits be accepted, adopted, and filed with the Traffic Commission.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Foster City does hereby authorize:

1. The acceptance of the speed limits recommended in the 2023 E&TS Report (commonly called a “Speed Survey”) prepared by Hexagon Transportation Consultants, Inc; and
