A RESOLUTION OF THE BOARD OF DIRECTORS OF THE ESTERO MUNICIPAL
IMPROVEMENT DISTRICT ACCEPTING THE ANNUAL DEVELOPMENT IMPACT FEE AND CAPACITY FEE REPORT FOR FISCAL YEAR 2022-2023
ESTERO MUNICIPAL IMPROVEMENT DISTRICT
WHEREAS, local agencies often charge fee as a condition of approval for development projects to fund improvements to compensate for the demands that the developments have on public resources known as Development Impact Fee; and
WHEREAS, in 1989, the State Legislature passed Assembly Bill 1600 (AB 1600), which added Sections 66000 et seq. to the California Government Code known as Mitigation Impact Fee; and
WHEREAS, City/District assesses four Development Impact Fees – Affordable Housing Commercial Linkage Fee, Park Facilities Impact Fee, Public Safety Impact Fee, and Transportation Impact Fee – and two Capacity Fees – Water Capacity Fee and Wastewater Capacity Fee; and
WHEREAS, pursuant to Government Code Section 66006 (b)(1), AB 1600 requires local agencies to report the Impact fees and Capacity fees collected and their use annually; and WHEREAS, staff has completed the annual development impact fee and capacity fee report for FY 2022-2023; and
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Estero Municipal Improvement District does hereby: Accept the Annual Development Impact Fee and Capacity Fee report for the Fiscal Year 2022-2023; and
PASSED AND ADOPTED as a resolution of the Board of Directors of the Estero Municipal Improvement District at the Regular Meeting held on the 18 th day of December 2023 by the following vote:
