The Council should reconsider the provisions of 8.11.020 Sale of flavored tobacco products prohibited. Our ordinance exempted specific restaurants from the flavored tobacco sales ban. Subsequent to the passing of the ordinance, the State of California enacted laws that are more restrictive than our ordinance. Specifically, there is no State provision to exempt a tobacco retailer (any business that sells tobacco) simply because they are a restaurant. This would seem to make our ordinance less restrictive than State law. The Council should consider repealing 8.11.020 E.
No real rush, except it will help move the tobacco permit item forward.
