TO: SPENCON CONSTRUCTION INC.
CHANGE REQUESTED BY: SpenCon Construction Inc. and City of Foster City Based on mutual agreement, SpenCon Construction Inc. and City of Foster City agree to amend the original Agreement dated May 16, 2022(“Agreement”) pursuant to Section
1.02 of the Agreement:
ORIGINAL CONTRACT AMOUNT – YEAR 1 $ 100,000
ORIGINAL CONTRACT AMOUNT – YEAR 2 $ 100,000
AMOUNT OF CHANGE ORDER NO. 1 $ 400,000
REVISED CONTRACT TOTAL AMOUNT $ 600,000
Section 2 of the Agreement shall be revised to add additional on call work to mitigate hazardous sidewalk conditions at Pitcairn Drive and Santa Catalina Lane, and on Shell Boulevard, other curb and sidewalk repair work identified that was not included in the original scope of work identified in Appendix A of the Agreement, and work that is expected to be identified by City staff as part of the ADA transition plan process, as well as repairs identified as part of typical maintenance activities.
Section 1.04 Duration of Contract, of Appendix A of the Agreement, shall hereinafter read in its entirety as follows:
“1.04 DURATION OF CONTRACT
The Sidewalk Repair & Replacement will be for a contract period of four (4) years from July 1, 2022-June 30, 2026. The contract start date will be finalized after approval of the agreement by the Foster City Council.”
Appendix D, Construction Performance Bond, and Appendix E, Construction Labor and Materials Bond, will be updated based on the revised contract amount. 2 0

Except as specifically modified herein, all other terms and provisions in the Agreement shall remain unchanged.
SpenCon Construction Inc. have given careful consideration to the work proposed and hereby agree, if this Contract Change Order No. 1 is approved, to provide all equipment, furnish all materials except as may otherwise be noted above, and to perform all services necessary for the work above specified, and to accept as full payment therefore the prices shown above.
