A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FOSTER CITY AUTHORIZING THE AWARD OF CONSTRUCTION CONTRACT TO G. BORTOLOTTO & COMPANY, INC. IN THE AMOUNT OF $1,989,541.55 FOR THE CONSTRUCTION
OF THE STREET REHABILITATION PARK PATHWAY RESTORATION PROJECT (2023-2024) CIP301-716; AND THE EXECUTION OF A TASK ORDER WITH CSG CONSULTANTS IN THE AMOUNT OF $198,940 FOR CONSTRUCTION
MANAGEMENT, INSPECTION SERVICES, AND MATERIAL TESTING SERVICES; APPROPRIATION OF $500,000 FROM FUND 102 (MEASURE A); AND FINDING THE
APPROVAL EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) PURSUANT TO CEQA GUIDELINES §15061(B)(3) AND 15301(C)—EXISTING
FACILITIES
CITY OF FOSTER CITY
WHEREAS, at the meeting on April 15, 2024, the City Council adopted Resolution No. 2024-45 approving the reissuance of plans and specifications and authorizing the Call for Bids for Street Rehabilitation and Park Pathway Restoration Project (2023-2024) CIP301-716; and
WHEREAS, one (1) bid was received and opened on June 12, 2024, and G.
Bortolotto & Company, Inc.’s base bid plus bid alternates 1 and 2 in the amount of $1,989,541.55 was found to be responsible and responsive; and WHEREAS, based on the bid received and the cost compared to the Engineer’s Estimate, Staff recommends awarding the base scope plus alternates 1 and 2; and WHEREAS, a project contingency in the amount of $200,000 will enable expedient resolution of changes to the plans resulting from any unforeseen conditions; and WHEREAS, inadequate funding is available in the approved project budget to fund the base scope plus alternates 1 and 2; and
WHEREAS, the appropriation of $500,000 from Fund 102 (Measure A) will allow the base scope plus alternates 1 and 2 to be awarded; and WHEREAS, CSG Consultants will support the City during construction to provide construction management, inspection services, and material testing services; and WHEREAS, funding in the amount of $2,478,247.48 was approved for the project budget for CIP301-716.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Foster City does hereby authorize:
1. The appropriation of $500,000 from Fund 102 (Measure A) to the existing project budget 301-0910-716-4251; and
2. The Mayor to execute an agreement with G. Bortolotto & Company, Inc. in the amount of $1,989,541.55 for the construction of the Street Rehabilitation and Park Pathway Restoration Project (2023-2024) CIP301-716; and
3. The establishment of a construction contingency for G. Bortolotto & Company, Inc. in the amount of $200,000 with authorization given to the City Manager to execute contract change orders up to the contingency amount; and
4. The Mayor to execute a Task Order with CSG Consultants in the amount of $198,940 for Construction Management, Inspection Services, and Materials Testing Services for CIP301-716; and
5. The establishment of a construction management contingency for CSG Consultants in the amount of $20,000 with authorization given to the City Manager to execute contract change orders up to the contingency amount.
BE IT FURTHER RESOLVED that the City Manager is hereby authorized to execute the Agreements with minor, non-substantive revisions that may be approved by the City Manager and the City Attorney, and to execute any other necessary documents to effectuate the terms of the Agreement.
