CITY OF FOSTER CITY

THE CITY COUNCIL OF THE CITY OF FOSTER CITY DOES FIND AND ORDAIN, AS FOLLOWS:

Section 1. The City Council, based on facts and analysis in the Staff Reports, written and oral testimony, and exhibits presented, finds:

1. The proposed Rezoning and the planned development will be in furtherance of and in accordance with the City of Foster General Plan because the proposal provides for high quality new development, enhanced educational, cultural and recreational facilities, and integrates such facilities into the neighborhood in a manner that promotes joint private and public use as stated in the General Plan Land Use and Circulation Goals and Policies and the Parks, Open Space and Conservation Goals and Policies, including LUC-B Promote Proper Site Planning, Architectural Design and Property Maintenance, LUC-D Maintain a Variety of Land Uses, LUC-K Provide Adequate Parking, LUC-37 Public and Semi-Public, LUC-43 City-Owned and Controlled Lands, LUC-47 Permitted Land Uses on Vacant Sites, LUC-63 School Site and Public Park and Recreation Facilities, LUC-71 School Facilities, PC-A Provide Sufficient and Diverse Recreational Opportunities, PC-3 Multi-Purpose Gym, Pool or Additional Recreation Center.

2. The establishment of a K-5 school, a cultural arts center and auditorium, a fitness center with indoor pool, an outdoor pool, and other associated educational, cultural and recreational facilities will not be detrimental to present and planned surrounding uses, as shown in the City's adopted General Plan, but will have a beneficial effect through integrated design with surrounding neighborhoods and provision of uses which could not be achieved without being located in a Planned Development district.

3. On-site circulation is suitable and adequate to carry anticipated traffic and the proposed project density will not generate traffic in such amounts as to overload the street network outside the development beyond acceptable City-established levels of service as indicated by the fact that there are no significant unavoidable impacts identified in the EIR related to traffic.

4. Existing and proposed utility services and facilities and other public improvements are adequate for the educational, cultural and recreational uses and intensities proposed.

5. The proposed ratios for off-street parking are substantially consistent with the purpose and intent and parking regulations of the City, as provided in Chapter 17.62, Off-Street Parking Regulations, of the Foster City Municipal Code given the provision that peak demand parking will be shared among the three entities that will occupy the site: the PJCC, ESP and City of Foster City Government Center via a pool of parking that exceeds 850 parking stalls.
