SUBJECT: PRIMARY GRANT AGREEMENT WITH THE SAN MATEO

COUNTY TRANSPORTATION AUTHORITY FOR FUTURE

MEASURES A AND W FUNDING

RECOMMENDATION
It is recommended that the City Council adopt a resolution authorizing the City Manager to execute a Primary Grant Agreement with the San Mateo County Transportation Authority for future Measures A and W funding; and finding the Agreement exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines section 15061(b)(3).

EXECUTIVE SUMMARY
Historically, the San Mateo County Transportation Authority (TA) has executed separate funding agreements, memoranda of understanding, and associated amendments for each phase of each project funded by Measures A and W. To streamline the contracting process, the TA has developed a new Primary Grant Agreement (PGA). In order to be eligible for TA Measures A and W funding over the next 10 years, the TA requires sponsors’ governing boards to adopt resolutions approving a primary grant agreement no later than March 1, 2025.

BACKGROUND
In 1988, San Mateo County voters approved Measure A, a 20-year half-cent sales tax to fund and leverage additional funding for transportation projects and programs in San Mateo County. The approval of Measure A created the TA to manage and administer the

6.3 6.3 Staff Report

14 7
5 8
sales tax revenues generated in conformance with the Transportation Expenditure Plan (TEP).

The 1988 sales tax expired on December 31, 2008. In 2004, San Mateo County voters reauthorized the Measure A half-cent sales tax and adopted a new TEP for an additional 25 years (from January 1, 2009, through December 31, 2033). The TEP established funding categories for Transit; Highways Improvements; Local Streets/Transportation; Grade Separations; Pedestrian and Bicycle Improvements; and Alternative Congestion Relief projects.

In 2018, San Mateo County voters approved Measure W, a 30-year one-half percent sales tax, from July 1, 2019 through June 30, 2048, to fund and leverage additional funding for transportation projects and programs in San Mateo County that are consistent with the Measure W Congestion Relief Plan. The San Mateo County Transit District (District) levies this tax and administers investments for the 50% of the proceeds assigned to the County Public Transportation Systems category in the Congestion Relief Plan. The TA is responsible for administering the remaining 50% of funds assigned to: Countywide Highway Congestion Improvements; Local Safety, Pothole and Congestion Relief Improvements including Grade Separations; Bicycle and Pedestrian Improvements; and Regional Transit Connections.

Historically, the TA has executed separate funding agreements and memoranda of understanding, and associated amendments for each phase of each project funded by Measures A and W.

ANALYSIS
To streamline the contracting process, the TA has developed a new PGA through which the TA and project sponsors will document the structure of their relationships and related obligations. Concise individual project supplements will detail each funded project and any specifically-associated requirements during the 10-year term of the PGA.

To be eligible for TA Measures A and W funding over the next 10 years, the TA requires sponsors’ governing boards to adopt resolutions no later than March 1, 2025, authorizing the sponsors’ chief executive, mayor or designee to sign a PGA with the TA. The PGA language is included as Attachment 2.

Foster City uses Measure A and Measure W funding for eligible Streets-related Capital Improvement Projects (CIP), including the annual Street Resurfacing projects as well as traffic signal projects and bicycle and pedestrian improvement projects. Maintaining these funding sources provides an alternative to the City Capital Fund and the General Fund as a means for maintaining Foster City’s Pavement Condition Index (PCI).

CALIFORNIA ENVIRONMENTAL QUALITY ACT

6.3 6.3 Staff Report

15 7
5 8
The approval of the Primary Grant Agreement is not subject to review under the California Environmental Quality Act (CEQA) pursuant CEQA Guidelines 15061(b)(3), as it can be seen with certainty that there is no possibility that this action may have a significant effect on the environment. Any projects undertaken with the grant funds will be subject to a Project Supplement document and the City will conduct appropriate environmental review for those individual projects.

FISCAL IMPACT
Over the past ten years, Foster City has received almost $6.7 million in Measure A and Measure W funding that has been used to maintain the City’s PCI and street network.

Approving the execution of the attached agreement will enable the City to continue to qualify for available funding for these purposes.

SUBJECT: ADDING A NEW SECTION 2.28.075, “MEETINGS-ABSENTEEISM” OF CHAPTER 2.28, “PLANNING” TO THE FOSTER CITY

MUNICIPAL CODE TO SPECIFY THE NUMBER OF ABSENCES

THAT WOULD CONSTITUTE A RESIGNATION

RECOMMENDATION
It is recommended that the City Council introduce by title and waive further reading of an Ordinance adding a new Section 2.28.075, “Meetings-Absenteeism” of Chapter

2.28, “Planning” to the Foster City Municipal Code to specify the number of absences that would constitute a resignation.

EXECUTIVE SUMMARY
On November 4, 2024, the Council considered a request by former Councilmember Jon Froomin to agendize a discussion regarding attendance requirements for resident appointees to City Committees and Commissions. A majority of Councilmembers supported having that discussion. Given that these changes would be very minor amendments, staff prepared a draft ordinance to add absenteeism requirements for the Planning Commission by adding a new section 2.28.075. Since there is an established policy for absenteeism for the Citizens Advisory Committees in the FCMC Section

2.36.200, staff is recommending to keep the current absenteeism wording for the Citizen Advisory Committees as there are varying meeting schedules for each committee.

8.1 8.1 Staff Report

60 7
5 8

BACKGROUND
The City Council has the power to establish Citizen Advisory Committees and a Planning Commission, pursuant to Government Code section 65100, and to delegate certain duties to those bodies. In Foster City, there are a number of Citizens Advisory Committees that recommend and advise the Council on special issues. Citizens Advisory Committees include the following: Audit, Parks and Recreation, Traffic Review, Youth Advisory, Citizens Sustainability Advisory Committee and the Building Board of Appeals. Each advisory committee has varying meeting schedules, where some committees meet more often than others. The Planning Commission is a decision-making body as well as an advisory body to the Council and plays a vital role in the overall site and architectural development, and the redevelopment of properties of all commercial, industrial and residential districts in the City. The Planning Commission has regular meetings twice per month, with additional special meetings scheduled as needed.

The Citizens Advisory Committees and the Planning Commission are established by formal action of the City Council and are therefore subject to the California Brown Act meeting requirements, including that a majority of the body are necessary to conduct a “meeting.” The City Council has also established various procedural rules and regulations for Citizens Advisory Committees (codified in Chapter 2.36 of the City’s Municipal Code) and the Planning Commission (codified in Chapter 2.28 of the City’s Municipal Code).

With regard to absenteeism for Citizens Advisory Committees, currently Section

2.36.200 of FCMC Chapter 2.36 requires, among other things, that any absence of a committee member for three consecutive regular meetings without formal notification to the committee chair or staff liaison is deemed to constitute resignation from the committee. The staff liaison is then required to provide notice of resignation to the City Clerk. For the Planning Commission, Chapter 2.28 does not have any requirements regarding absences.

Compliance with the Brown Act and the procedural requirements in Chapter 2.28 is critical to ensure that the Planning Commission can effectively conduct the City business delegated to them by the City Council. Absenteeism can impede the ability of the Planning Commission to conduct its business. When members of the Planning Commission are consistently absent and do not attend meetings, the body can oftentimes struggle to come to a consensus or even convene a meeting when less than a majority (or quorum) of the body is present. Absenteeism not only affects the productivity and efficiency of the Commission but it also creates additional work for City staff in having to cancel and reschedule meetings.

ANALYSIS
Staff has prepared the attached proposed ordinance (Attachment 1) to add a new Section 2.28.075 for absences of the Planning Commission.

8.1 8.1 Staff Report

61 7
5 8
Section 2.28.075- Planning Commission
This new section 2.28.075 adds absenteeism requirements to the Planning Commission requirements in Chapter 2.28 and builds upon the requirements for Citizens Advisory Committees. Similar to the committee requirements, absence from any three (3) consecutive regular meetings without formal notification to the commission chair or staff liaison shall be deemed to constitute resignation from the Planning Commission. The primary difference, however, is that in subsection “B” of section 2.28.075, Planning Commissioners’ absence from any five (5) regular or special meetings (either consecutive or non-consecutive, with or without formal notification to the committee chair or staff liaison) during a calendar year shall be deemed to constitute resignation from the Planning Commission. The proposed ordinance has been drafted to allow the Planning Commission to be absent from two additional meetings because the Planning Commission typically meets more often than the Citizens Advisory Committees, but attendance is crucial. The proposed number of absences is a suggestion by staff and Council may decide to increase or decrease the number of absences prior to introduction of the proposed ordinance. (See Attachment 2 - Redline of Section 2.28.075)

0 2.28.120 Architectural and site plan review—Principles.

In carrying out the purposes of this chapter with respect to architectural and site plan review, the following principles shall apply:

A. It is a principle of this chapter to exercise the minimum controls necessary to achieve the overall objectives of this chapter. It is not a principle of this chapter to control architectural character so rigidly that individual initiative is stifled in the design of any particular building, or that substantial additional expense is required.

B. Good architectural character is based upon the suitability of a building for its purposes, upon the appropriate use of sound materials, and upon the principles of sound harmony and proportion in the elements of the building.

C. Good architectural character is not in itself more expensive than poor architectural character, and is not dependent upon the particular style of architecture selected.

D. The relationship of a building to its surroundings is of greater importance than the quality of design of the individual structure.

E. The relationship of structures to a site and to surroundings is affected by:

1. Design and location of the building in relation to provision of adequate light and air to itself and its neighbors;

2. Landscaping, screening and fencing to preserve privacy and mitigate adverse effects on neighboring properties;

3. Location of entrances and exits and layout of internal circulation in relation to traffic safety and ease and convenience of movement;

4. Arrangement and intensity of night lighting in relation to public safety and effect on adjoining properties;

5. Size and design of the structure in relation to the size, shape, and topography of its site to create a proper balance, unity and harmonious appearance;

6. Accessibility of off-street parking areas and the relation of parking areas with respect to traffic on adjacent streets; and

0 7. Reservation of landscaping areas for the purposes of separating or screening service and storage areas from the street and adjoining building sites, breaking up large expanses of paved areas, separating or screening parking lots from the street and adjoining building sites, or separating building areas from paved areas to provide access from buildings to open space areas.
