SUBJECT: ADOPTING A LIST OF PROJECTS FOR FISCAL YEAR 2025- 2026 FUNDED BY SENATE BILL 1: THE ROAD REPAIR AND
ACCOUNTABILITY ACT OF 2017

RECOMMENDATION
It is recommended that the City Council approve the attached resolution adopting one project, Street Rehabilitation (2025-2026) to receive funding from Senate Bill 1: The Road Repair and Accountability Act of 2017 (SB 1).

EXECUTIVE SUMMARY
Senate Bill 1 (SB 1) helps agencies with supplemental funding to address basic road maintenance, rehabilitation, and critical safety needs of the local street system. The FY 2025-2026 SB 1 funds may be used toward new projects and projects earmarked to receive SB 1 funding in previous years. To satisfy the requirements for receiving SB 1 funding, it is necessary to pass a resolution adopting the projects which will utilize this funding. It is recommended that the City Council adopt a resolution adopting a new CIP project: Street Rehabilitation (2025-2026).

BACKGROUND/ANALYSIS
SB 1 was filed with the Secretary of State on April 28, 2017. This bill established a Road Maintenance and Rehabilitation Account (RMRA) in the State Transportation Fund to be used to address deferred maintenance on the state highway system and the

local street systems. Annual SB 1 funding amounts are determined by its sources:
increases per gallon in fuel excise taxes, increases in diesel fuel sales taxes and registration fees, and inflationary tax rate adjustments in future years.

SB 1 provides a supplemental funding source to be used to support various road maintenance projects, including street rehabilitation, bridge improvements projects, and traffic signal upgrade projects. The City’s streets and roads network is rated with a Pavement Condition Index of 78, “Good” condition. SB1 revenue will assist the City with funding to maintain its roadways in “Good” condition, one of the highest-ranking levels in San Mateo County, with the goal over the next decade to bring our street and roads into a “very good” condition.

Foster City has received SB 1 funding in previous years based on fuel sales tax and registration fees revenues. Foster City’s FY 2025-2026 revenues are estimated to be $883,812. (Attachment 2 – Projected Revenues)
Staff recommends the inclusion of one new project for utilization of SB 1 funding for FY 2025-2026:

Street Rehabilitation (2025-2026)
This project is intended to repair/resurface public streets on Foster City Boulevard South of East Hillsdale Boulevard, and Altair Avenue, including pavement grinding, base repair, asphalt overlay, slurry seal, thermoplastic pavement striping and pavement markings, signage improvements, accessibility upgrades to ramps, curb and gutter repair, sidewalk repair and adjusting utility covers to grade. The City uses a Pavement Management System to select the streets to include in subsequent roadway repair projects to ensure funding is being used on the most high-priority projects. The program also helps to determine the most cost-effective treatment to extend the life of the roadways.

Approving the attached resolution will satisfy SB 1 requirements, ensuring compliance with the following Streets and Highways Code:
2034.
(a) (1) Prior to receiving an apportionment of funds under the program pursuant to paragraph (2) of subdivision (h) of Section 2032 from the Controller in a fiscal year, an eligible city or county shall submit to the commission a list of projects proposed to be funded with these funds. All projects proposed to receive funding shall be adopted by resolution by the applicable city council or county board of supervisors at a regular public meeting.

CEQA
Categorically Exempt pursuant to CEQA Guidelines Section 15061(b)(3) and 15301(c) – Existing Facilities

FISCAL IMPACT
Adoption of the resolution allows the City to continue to receive SB 1 funding, estimated at $883,812 for FY 2025-2026, to supplement predetermined road maintenance projects.
