RECOMMENDATION
It is recommended that the City Council/EMID Board adopt the attached resolution designating the City/District Manager and the Public Works Director as authorized agents on behalf of the City of Foster City/Estero Municipal Improvement District for the purpose of obtaining federal financial assistance for any existing or future grant program as specified in the attached California Governor's Office of Emergency Services (CalOES) Designation of Applicant’s Agent Resolution for Non-State Agencies Form (Form 130).

EXECUTIVE SUMMARY
CalOES sub-grants the FEMA Legislative Pre-Disaster Mitigation (LPDM) grant program to local jurisdictions throughout the State. The LPDM program provides

9 1
0 funding to plan and direct hazard mitigation projects before a disaster. Funding these plans and projects reduces overall risk to the population and structures and funded projects also reduce the need for federal funding in actual disasters. CalOES requires a Designation of Applicant’s Agent Resolution for Non-State Agencies to be on file for the purpose of obtaining federal financial assistance.

BACKGROUND/ANALYSIS
The City of Foster City has been awarded an LPDM in the amount of $1,344,343.07 in support of the Lagoon Pump Station Seismic Rehabilitation and Capacity Enhancement project. This project adds a third and fourth lagoon pump and related infrastructure, and provides for lagoon pump station building rehabilitation (Currently CIP 301-717 and CIP 301-718). The project will provide long-term, permanent risk reduction by enhancing the Lagoon Pump Station’s capacity. This enhancement will improve flood protection and safeguard critical infrastructure against earthquake damage, ensuring the pump station remains operational.

CalOES requires a Designation of Applicant’s Agent Resolution for Non-State Agencies to be on file for the purpose of obtaining federal financial assistance. The attached Form 130 and resolution designate the City Manager and Public Works Director as authorized agents on behalf of the City of Foster City.

Further, in the event that EMID applies for funding in the future, it is recommended that a completed Designation of Applicant’s Agent Resolution for Non-State Agencies is on file with CalOES. The attached Form 130 and resolution designate the District Manager and Public Works Director as authorized agents on behalf of the Estero Municipal Improvement District.

Once authorized, the forms will remain active on file with CalOES for a period of three years.

FISCAL IMPACT
There is no fiscal impact associated with approving the proposed resolutions.

Previously appropriated funds will be expended on eligible project costs, then reimbursed by the LPDM grant. The designation approved by the resolutions is required to be on file for the City to be eligible to apply for reimbursement for the Lagoon Pump Station Seismic Rehabilitation and Capacity Enhancement project in the amount of $1,344,343.07. If EMID applies and is awarded funding in the future, the designation is required to be on file for EMID to be eligible to apply for reimbursement. 9 1
