Balclutha Drive to be closed to through traffic between the round-about and Shell Boulevard
Shell Boulevard exit off the far South Service Road on the PJCC campus to be closed.
The exit off Civic Center Drive onto Shell Boulevard, just west of the round- about on the PJCC campus to Shell Boulevard to be closed.

In addition, the Leo Ryan Park meadow will be unavailable from Monday, August 11 at 8:00 AM for placement and breakdown of some of the carnival rides through Tuesday, August 19, at 12:00 PM.

Signage will be placed on A-frames to draw attention to the parking lot and street closures. City staff will announce the street closure in the City's bi-monthly e-newsletter, City Calendar, as well as include details in the Foster City Islander. Information on the event and street and parking lot closures will be posted and distributed through the Community Center and The VIBE Teen Center, and in classes and activities that generally take place at these locations. The City has also shared this plan with the PJCC and Wornick Jewish Day School as it can impact their patrons.

BACKGROUND
On May 14, 2018, the City Council directed staff to create a new, revenue-generating large special event managed by City staff. City Council direction was to develop an event that would have a local/community focus with a Citywide celebratory appeal and would be self-sustaining or revenue positive. On February 22, 2022, the City Council authorized the addition of Summer Days as an on-going annual community event.

Summer Days is a multi-day event that will incorporate the elements of a traditional community carnival with a modern twist. This event has traditionally featured food trucks, handmade craft vendors, local community organizations and businesses, beer and wine, entertainment, carnival rides, and the Rubber Ducky Races. Due to ongoing construction and limited viewing space along the boardwalk caused by fencing, the Rubber Ducky Races will be reimagined this year as a fun scavenger hunt rather than a traditional race on the lagoon.
2025 Summer Days Activity Schedule:

Carnival (Meadow & Shell Boulevard)
Friday, August 15 - 5:00 PM-10:30 PM
Saturday, August 16 - 11:00 AM-11:00 PM
Sunday, August 17 - 11:00 AM-7:00 PM
Craft Vendors (Shell Boulevard)
Saturday, August 16 - 11:00 AM-6:00 PM

5.2 5.2 Staff Report

15 Sunday, August 17 - 11:00 AM-5:00 PM
Food and Beverage (Shell Boulevard & Parking Lot)
Saturday, August 16 - 11:00 AM-8:00 PM
Sunday, August 17 - 11:00 AM-5:00 PM
Entertainment (Amphitheater & Shell Boulevard)
Friday, August 15 – 5:00 PM-8:00 PM
Saturday, August 16 - 1:00 PM-5:00 PM
Sunday, August 17 - 1:00 PM-5:00 PM

ANALYSIS
The street festival concept encompasses a significant portion of Leo J. Ryan Memorial Park, as well as Shell Boulevard. The proposed layout for 2025 includes and anticipates the following:
Shell Boulevard (between East Hillsdale Boulevard and Foster Square Lane) closed to through traffic from 9:00 AM on Tuesday, August 12 until 5:00 AM on Tuesday, August 19. Due to the loss of access to the Recreation Center and its full parking lot, the street will be closed for an additional two days compared to previous years to allow for the increased setup time.
Shell Boulevard (between Foster Square Lane and Bounty Drive) closed to through traffic from 9:00 AM on Thursday, August 14 until 5:00 AM on Monday, August 18.
Balclutha Drive (between the round-about on the PJCC campus and Shell Boulevard) closed to through traffic from 9:00 AM on Thursday, August 14 until 5:00 AM on Monday, August 18.
Shell Boulevard exit from South Service Road of the PJCC campus will be closed from 9:00 AM on Thursday, August 14 until 5:00 AM on Monday, August

18. Shell Boulevard exit from Civic Center Drive will be closed from 9:00 AM on Thursday, August 14 until 5:00 AM on Monday, August 18. Leo Ryan Park meadow will be temporarily closed to the public from 8:00 AM on Monday, August 11, through 12:00 PM on Tuesday, August 19, to accommodate the setup of carnival attractions. This area is a new addition to this year’s event preparations. While the meadow will not be fenced off, we would request that patrons avoid the area for safety reasons. Park pathways will remain open and accessible to the public during this time. Security guards at barricades around the clock during the weekend, thus reducing the hours of reserve police officers.
A wide walkway for attendees to move through the venue, therefore increasing public safety.
Emergency access routes within the layout of the event Use of The VIBE Teen Center and surrounding park

5.2 5.2 Staff Report

16 Parkside Towers parking structure and Century Plaza parking lots will be used to provide public parking and monitored by local service club organizations. Vendor parking will be at City Hall lot which will be monitored by Security. Accessible parking will be located at the Community Center/Foster City Library lot.

The street festival concept allows participants to move from one side of Shell Boulevard to the other, while enjoying a wide variety of vendors and avoiding congestion.

SUBJECT: 3-YEAR MICROSOFT ENTERPRISE AGREEMENT,

PURCHASED THROUGH DELL, FOR A TOTAL AMOUNT
NOT-TO-EXCEED $394,675.84

RECOMMENDATION
It is recommended that the City Council approve the attached resolution authorizing the Mayor to execute a three-year renewal of the Microsoft Enterprise Agreement (“EA”) through Dell in an amount not to exceed $394,675.84.

EXECUTIVE SUMMARY
The City’s current Microsoft EA comes to an end on July 30, 2025. The proposed agreement for City Council consideration will provide the City with consistent pricing for Microsoft software for the next three (3) years for a total amount not to exceed $394,675.84.

BACKGROUND/ANALYSIS
The City of Foster City has been using Microsoft software for at least 30 years. Over those years, the City has used various licensing models to procure the required licenses to use the software.

This EA is based on a Cooperative Purchasing Agreement negotiated by the County of Riverside which provides substantial discounts compared to retail pricing for the City’s Microsoft licensing needs. The IT Division also considered another cooperative

5.3 5.3 Staff Report

22 agreement (negotiated by the California Department of Technology). That contract had less flexibility in which packages could be chosen, which would have resulted in higher costs.

The Microsoft EA has been beneficial in helping the City standardize its server and productivity software, and provides maintenance benefits, upgrade rights, cloud-based services, technical support, online training, and simplifies license management to ensure the City is consistently in compliance with Microsoft.

In this renewal, staff is recommending to include a G5 Security add-on that will unlock many security features that will help protect both the City’s internal network as well as cloud-based email and file storage.

The not-to-exceed amount includes three (3) annual payments to cover the current licensing ($119,598.74 x 3) plus an annual 10% contingency ($11,959.87 x 3) to cover any additional licensing that may be needed to purchase during the agreement term.

FISCAL IMPACT
Funding is budgeted and available for the Microsoft licensing in the approved FY 2025- 2026 Information Technology (IT) budget. Future year’s EA payments will be requested in the IT operating budget for those respective years.

RECOMMENDATION
It is recommended that the City Council adopt the attached Resolution (Attachment 1) authorizing the Mayor to execute Contract Amendment No. 2 to the existing agreement with 4LEAF, Inc. (4Leaf) for professional on-call building services for an additional amount of $100,000, approving the supplemental appropriation of $100,000 for Building Division professional services (account No. 001-0820-424-4251) from the General Fund reserves, and find the request exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines 15061(b)(3).

EXECUTIVE SUMMARY
The Community Development Department (CDD) is committed to planning, maintaining, and improving the quality of life and public safety of Foster City in keeping with the vision of the City Council in the General Plan and other measures that reflect the City’s heritage as a Master Planned community. CDD is comprised of the Planning/Code Enforcement, Housing/Sustainability, and Building Divisions.

5.5 5.5 Staff Report

The Building Division is responsible for ensuring that all construction projects permitted within the City comply with the California Building Code, the Foster City Municipal Code, and all other applicable codes and regulations. The Building Division provides permit intake, plan check, and building inspection services to ensure compliance with the California Health and Safety Codes.

The Building Division has a limited staff comprising of six (6) personnel providing services related to all construction permit activity in the City. A limited staff poses a significant challenge in providing continuous and uninterrupted building division services. To help address these challenges, on July 15, 2024, the City Council approved professional on- call building service agreements with 4Leaf and West Coast Code Consultants (WC3) in an amount not to exceed $150,000 each for two years ending June 30, 2026, to provide coverage during staff absences, ensuring continuity of services, increased flexibility, cost- effectiveness, and enhanced customer satisfaction.

On April 7, 2025, Contract Amendment No. 1 in the amount of $75,000 was added to the 4Leaf agreement for continuing on-call building services. At the time, the unspent personnel budget from the vacant Chief Building Official (CBO) position was used for funding the agreement.

As of June 30, 2025, the City has utilized approximately $159,625.60 of the combined $225,000 authorized under the original contract and Contract Amendment No. 1 with 4Leaf. Currently, the Plans Examiner position is vacant, and the Senior Building Inspector is on extended leave. While the agreement remains in effect through June 2026, the remaining balance will not be sufficient to continue supporting the City's needs for temporary staffing, specifically for the vacant Plans Examiner and Senior Building Inspector positions.

Staff recommends that the City Council approve Contract Amendment No. 2 with 4Leaf in the amount of $100,000 to continue utilizing their services to provide essential on-call building support.

BACKGROUND/ANALYSIS
Currently, the Building Division is staffed by one (1) Chief Building Official (CBO), one (1) Plans Examiner (vacant), two (2) Inspectors, and two (2) Permit Technicians, which proves challenging during staff absences due to vacation, training, illness, and 9/80 off days, as well as during periods when positions are vacant and recruitment is underway.

Over the last two (2) years, there have been significant challenges in staffing, including vacancies and staff absences:
The CBO position was vacant from March 19, 2024, until March 17, 2025. The Permit Technician position was vacant from July 10, 2024, until December 2, 2024.
The Plans Examiner position is currently vacant from May 29, 2025.

5.5 5.5 Staff Report

52 9
7 7
The Senior Building Inspector has been on extended leave since June 2, 2025.

These vacancies and absences pose a significant challenge in providing continuous and uninterrupted services. Therefore, staff have been using current on-call consulting services with 4Leaf and WC3 to augment staffing needs.
4Leaf has been providing services for CBO and Building inspection services, and WC3 has been providing services related to Permit Technician and plan checks. As of June 30, 2025, these are the approximate balances for the two (2) on-call building service agreements (Table 1).

$75,000
Total $225,000
$61,216.40
WC3 June 30, 2026 $150,000 $108,042.28
As noted earlier, the Plans Examiner position is vacant, and the Senior Building Inspector has been on extended leave for over a month. The recruitment for the vacant Plans Examiner can take anywhere between 2 and 4 months before the position is successfully filled. In recent times, filling vacancies and finding qualified candidates has been a challenge given the current job market, and when competing with other jurisdictions that have similar job openings.

Development activities in the City have ramped up, and there has been an increase in permit applications. In terms of large-scale construction activity, Gilead Sciences has one (1) lab building under construction and another scheduled to start construction in August 2025. These buildings under construction require extensive plan check services and daily building inspections.

The remaining balance in the 4Leaf contract is approximately $61,216.40, which is insufficient to continue providing uninterrupted services to the community. Although funds remain available in the WC3 contract, they are unable to provide building inspections and permit technician services.

Staff recommends that the City Council approve Contract Amendment No. 2 to the existing agreement with 4Leaf for professional on-call building services, in an additional amount not to exceed $100,000. This would bring the total contract amount to $325,000 (original $150,000 + Contract Amendment #1 $75,000 + Contract Amendment #2, $100,000). Staff recommends continuing to use 4LEAF for on-call building services due

5.5 5.5 Staff Report

53 9
7 7
to their familiarity with ongoing projects and consistent availability. The additional funds are necessary to ensure staffing coverage during upcoming training or unforeseen extended absences and vacancies.

Although there are unspent funds from the vacant Plans Examiner position, since this is the start of the new fiscal year, the funds are not accumulated to cover the cost of Contract Amendment #2. Thus, staff is requesting a supplemental appropriation in the amount of $100,000 for Building Division professional services (account No. 001-0820- 424-4251) from the General Fund reserves.

FISCAL IMPACT
The agreement for on-call services includes building inspections, permit support services, and plan reviews. Therefore, for staff augmentation services, staff is requesting a supplemental appropriation of $100,000 for Building Division professional services (account No. 001-0820-424-4251) from the General Fund reserves.

SUBJECT: SOLE SOURCE PURCHASE OF SENSUS LARGE WATER
METERS FROM THIRKETTLE CORPORATION, dba AQUA-

METRIC SALES COMPANY, IN AN AMOUNT NOT TO EXCEED
$150,000

RECOMMENDATION
It is recommended that the Board of Directors of the Estero Municipal Improvement District (District Board) approve the sole source purchase of approximately ten (10) large water meters for an amount not to exceed $150,000 from Thirkettle Corporation (dba Aqua-Metric Sales Company).

EXECUTIVE SUMMARY
Ensuring that water meters are functioning properly and replaced at the end of their useful life is a proactive measure to guarantee that unaccounted water loss is kept to a minimum. This is typically done by monitoring the age of the meters, testing for accuracy, and then replacing meters when inaccurate or in danger of possible failure due to age.

The purchase and replacement of approximately ten (10) large water meters will also enable EMID to recover costs due to inaccurate meters and recapture water loss.

5.6 5.6 Staff Report

88 BACKGROUND/ANALYSIS
The Maintenance Division schedules the replacement of water meters to coincide with the end of the meter’s useful life and prior to it actually failing. On average, the useful life of a Sensus meter is approximately 20 years.

Purchasing and replacing aging water meters leads to recovery of revenue that would be lost to water meter inaccuracy and also minimizes water loss through detection of unaddressed leaks. This purchase will be comprised of meters planned for immediate installation as well as reserved meter inventory for planned future replacements.

The Water Distribution System uses various sizes of meters depending upon the needs of the location. The largest meters range in size from 4-inch meters to 10-inch meters.

This order will include 6-inch and 8-inch meters.

The EMID’s water distribution system exclusively utilizes Sensus water meters. These types of meters are designed to be more efficient and are compatible with the EMID’s Advanced Metering Infrastructure (AMI) system. A substitute product does not exist.

Sensus meters can only be ordered from Thirkettle Corporation, dba Aqua-Metric Sales Company, a sole distributor for the Northern California region, with offices located in Sacramento, California.

The EMID Purchasing Policy requires that purchases over $50,000 are approved by the District Board. Staff recommends that the District Board authorize the sole source purchase of approximately ten (10) large water meters from Thirkettle Corporation, dba Aqua-Metric Sales Company for an amount not to exceed $150,000.

CEQA
The resolution approving the purchase qualifies for CEQA’s common sense exemption, as CEQA applies only to projects with potential significant environmental impact. Since this activity poses no significant environmental effect, it is not subject to CEQA (CEQA Guideline Section 15061(b)(3)).

FISCAL IMPACT
Funding in the amount of $150,000 is allocated and available for this purchase in the FY 2024-2025 Equipment Replacement Fund budget (Account No. 408-0110-413-4385).

SUBJECT: ESTABLISHING THE APPROPRIATIONS LIMIT FOR FISCAL YEAR 2025-2026

RECOMMENDATION
It is recommended that the City Council/EMID Board of Directors hold a public hearing and then adopt the attached resolutions establishing the appropriations limit for FY 2025-2026.

EXECUTIVE SUMMARY
California Govt. Code Section 7900 establishes limits on annual appropriations (spending) of state and local governments to annual growth in population and inflation (known as the "Gann Limit"). Staff has applied the appropriate inflation and population adjustment factors to calculate the combined EMID and Foster City FY 2025-2026 appropriation limit of $193.1 million. The FY 2025-2026 appropriation subject to the limit is only $45.6 million.

BACKGROUND
Proposition 4 (Gann Initiative) was approved by voters in the November 6, 1979 Special Election, which added Article XIIIB to the State Constitution. Subsequent legislation

6.1 6.1 Staff Report

94 4
0 3
added Section 7900 et seq. to the Government Code which provided additional interpretation and instructions implementing Proposition 4. The combined effect of the legislation restricts the total amount of appropriations enacted by local government in their annual budgets and subsequent adjustments to inflation and population growth.

The adjustments are provided annually by the California Department of Finance.

In June 1990, Proposition 111 was approved by the voters which, among other things, revised the spending limit calculations for state and local government effective July 1, 1990. The base year for determining an agency’s limit was set as FY 1986-1987 with two annual adjustment factors for:
Inflation – either (a) the percentage change in the California Per Capita Income or (b) the percentage change in the local assessment roll from the preceding year due to the addition of local non-residential new construction. Population – either (a) the City’s own population growth or (b) the population growth of the entire County.

ANALYSIS
The inflation factor selected by the City is the percentage change in California per capita income because it exceeds the assessed value in the preceding year due to new non-residential construction (6.44% vs 5.12%). Similarly, San Mateo County’s population change was selected as it was higher than Foster City’s population growth (0.07% vs. -0.60%). Growth data was published by the California Department of Finance in May 2025.

The resulting combined growth rate is 6.51%, as calculated by multiplying the California Per Capita Personal Income and the San Mateo County population growth rate.

Using the methodology for calculating the appropriations limit in accordance with Proposition 111, the following chart shows the appropriation bases, and the appropriation growth factors to establish the appropriations limit for FY 2025-2026.

The total appropriations subject to the Gann Limit are calculated as the total of all appropriated expenditures in the General Fund, Special Revenue Funds and the City CIP Fund, less all revenue sources that are not considered general tax proceeds (e.g. permits, recreation programs, rental income).

As required by law, the information used to calculate these limits is available in the Financial Services Department that will allow the public to determine the validity and bases for the appropriations limit recommended for adoption. Accordingly, the City Council/District Board is requested to hold a public hearing on these limits this evening and, subject to any public testimony received, adopt the attached resolutions to approve the appropriations limit specified herein.

DEPARTMENT: City Manager
SUBJECT: DISCUSSION REGARDING CALIFORNIA SENATE BILL 63 (SB 63) SAN FRANCISCO BAY AREA: LOCAL REVENUE MEASURE:

TRANSPORTATION FUNDING

RECOMMENDATION
It is recommended that the City Council, by Minute Order, discuss SB 63 San Francisco Bay Area: Local Revenue Measure: Transportation Funding and provide input.

EXECUTIVE SUMMARY
At its June 16, 2025 meeting, Mayor Jimenez requested a future agenda item to discuss SB 63, a request that was supported by a majority of the Council. SB 63 authorizes the creation of a Transportation Revenue Measure District (TRMD), governed by the Metropolitan Transportation Commission (MTC). As outlined in Government Code §67711(a), the TRMD initially includes Alameda, Contra Costa, and San Francisco counties. San Mateo and Santa Clara counties may opt into the district by August 11, 2025, per the operative language: “It is the intent of the Legislature to afford the Counties of San Mateo and Santa Clara the opportunity to opt into the district by August 11, 2025.” The county board and SamTrans must decide whether to opt in — choosing between a ¼-cent or ½-cent tax by the August deadline.

Once formed, the TRMD would be authorized to place a regional transportation sales tax (retail transactions and use tax) of up to 1% on the November 3, 2026 ballot (Gov.

Code §67730). This sales tax would fund transit operations and modernization efforts

7.1 7.1 Staff Report

99 throughout the participating counties, subject to approval by a majority of voters across the district.

BACKGROUND
Existing law establishes MTC as a local area planning agency to provide comprehensive regional transportation planning for the nine-county Bay Area region.

MTC is responsible for developing the Bay Area’s federally mandated long-range transportation plan and state-mandated sustainable communities strategy, a 25-year roadmap to achieving state-mandated goals to reduce greenhouse gas emissions (GHG), including planning for adequate housing near jobs and transit to accommodate expected population growth. The MTC manages about $850 million annually in federal transportation funds for the Bay Area’s 9 counties, 101 cities, and 27 transit operators — including $650 million for transit capital projects. It also allocates nearly $1.1 billion in state and local transit operating revenues, of which $750 million is discretionary.

While public transit ridership has declined nationally and in California for decades, the Bay Area—California’s highest transit user—resisted this trend until the COVID-19 pandemic. With the onset of the COVID-19 pandemic during the first half of 2020, transit ridership plunged from 50% to as much as 94% in California. In May 2020, MTC created the Blue Ribbon Transit Recovery Task Force to guide the future of the Bay Area’s public transportation network and recovery from COVID-19. Their June 2021 final report, the “Bay Area Transit Transformation Action Plan (Link),” outlined steps like fare integration, improved customer info, transit priority on roadways to increase bus speeds and reliability, network planning, data collection and coordination, accessibility, and funding in an effort to reform and improve the transit network.

Despite significant state and federal subsidies, MTC projects a growing operating shortfall for Bay Area transit operators: $169 million in 2024-25, rising to $800 million by 2026-27. State relief funds and $300 million from MTC close deficits through 2025-26, but operators face “fiscal cliffs” in 2026-27, risking transit service cuts without additional funding, as noted in MTC’s Transportation Revenue Measure Select Committee report (Link).

ANALYSIS
SB 63 (Link), also known as the Connect Bay Area Act, was introduced on January 9, 2025, with the final amendment introduced on May 23, 2025. The bill is a response to the financial challenges facing Bay Area transit agencies, exacerbated by the COVID- 19 pandemic and the resulting decline in transit ridership. The bill supports a $2 billion budget request to sustain and improve public transit as funding shortfalls threaten devastating service cuts at BART, MUNI, Caltrain, AC Transit, and other systems. The bill proposes a regional funding measure on the November 2026 ballot to provide sustainable funding for these systems. The bill authorizes a half-cent sales tax on the November 2026 ballot in Alameda, Contra Costa, and San Francisco counties (San Francisco has the option to raise the rate to up to a full cent, in 0.125% increments to

7.1 7.1 Staff Report

100

fund Muni), with San Mateo and Santa Clara counties given the option to “opt in” by August 11, 2025.

SB 63 amends Public Utilities Code §131102 to remove the legal barrier for San Mateo County to exceed the standard 2% local sales tax limit. Specifically, the amended section states: “[A] county may impose a retail transaction and use tax applicable in the incorporated and unincorporated territory of the county... in 0.125% increments not to exceed 1%, for purposes of funding transportation improvements or programs.” This means that San Mateo County would not need additional state legislation to exceed the cap if the TRMD tax is placed on the ballot and approved by voters. The language eliminates a procedural hurdle and facilitates regional funding coordination.

The bill does include several provisions intended to support transparency and oversight. Notably:
Government Code §66513.5 requires MTC to prepare and submit a transit ridership forecast and revenue report to the Legislature by March 31, 2026. Government Code §67752 mandates annual independent financial audits of TRMD expenditures.
Government Code §67753 requires MTC to adopt and publicly post a five-year implementation strategy and progress reports.

On April 21, C/CAG, the San Mateo Transit District and the San Mateo County Transportation Authority (TA) submitted a joint comment letter documenting feedback from the Legislative Committee and the C/CAG Board on the proposed Regional Measure, especially regarding the desire for local countywide transportation authority control of revenue, revenue allocation structures and the need for appropriate accountability measures (Link).

At the June 12, 2025 C/CAG board meeting, an update on SB 63 was provided. SB 63 was amended to reflect an August 11th deadline for additional counties (San Mateo and/or Santa Clara) to opt in. The recommended process was to have the SamTrans Board of Directors make the final vote as to whether or not to opt in in August, and to have the C/CAG Board provide a recommendation as to whether or not to opt in at the July Board meeting.

At the July 2, 2025 meeting, the SamTrans Board of Directors heard the results of a public opinion poll conducted by the TA. Voters showed strong support for funding local and regional transit, including BART and Caltrain, at the Citizen’s Initiative passage threshold of 50% plus one. The only scenario that passed the 2/3 required for a measure placed on the ballot by the TA was a renewal at the existing rate of Measure A. Measure A is a ½ cent transportation sales tax administered by the TA that expires in 2033 and is a critical source of primarily infrastructure funding for local pothole repair, street resurfacing, grade separations, highway interchange and roadway safety projects, plus bike and pedestrian improvements across the county. The SamTrans

7.1 7.1 Staff Report

101

Board directed staff to continue negotiations with a particular focus on ensuring accountability of service quality as a prerequisite of joining the 2026 Regional Measure.

On July 30, C/CAG will be meeting to provide direction regarding SB 63.

SamTrans board vote is scheduled for August 6, with August 11 being the firm deadline to join. The county board and SamTrans must decide whether to opt in — choosing between a ¼-cent or ½-cent tax — by early August 2025. If they decide to opt in, San Mateo joins ballot in November 2026.

Impact of SB 63 in San Mateo County
Funding for local/regional transit (SamTrans, Caltrain, BART) is bolstered — potentially preventing severe service reductions.
Service quality could improve with more frequent, reliable service, especially benefiting commuters and transit-dependent residents.
Regional integration becomes stronger, aligning San Mateo with broader Bay Area coordination and transit planning efforts.
Local reinvestment: A portion of tax revenue returns directly to San Mateo, funding county-specific transit needs.

Key Considerations for Foster City
SB 63 outlines a strategy to stabilize regional transit funding, but several factors may influence local decision-making. Foster City, like other cities in the County, is already subject to a 2.125% district/local add-on tax (9.375%1 total). The bill raises concerns about voter receptiveness to higher cumulative sales tax rates. Its amendment to Public Utilities Code §131102 enables San Mateo County to exceed the 2% local sales tax cap in 0.125% increments, up to a total of 1% for transportation purposes. Although this removes a legal barrier to implementation, it may affect local tax strategies and reduce flexibility for future revenue measures. SB 63 raises money countywide but does not guarantee proportional returns to each city. Residents and businesses may pay into a regional system without proportional services returning to the city. Foster City, which has limited transit access compared to other cities, might see less direct benefit from SB 63 funds — while its residents still pay the tax.

Legislative Timing And Process
On July 14, SB 63 (Wiener) passed the Assembly Revenue and Taxation Committee 4- 2, with the Republicans voting no. The bill is now headed to the Senate Appropriations Committee, which will decide if it advances to a full Assembly floor vote. If it advances, the bill could move to the Assembly floor for a vote later in July or August. Upon 1 Foster City’s 9.375% Sales Tax includes the State Sales Tax 6%, Bradley-Burns Local Share 1.25%, Countywide Transactions and Use Taxes (TUTs) – Measure A 1.50% (1988, 2012 & 2016 – 0.50% each) and Measure W (2018 – 0.50%) and Measure RR – 0.125%. passing the Assembly, it would proceed to the Governor’s desk, which is likely in late summer or early fall—to be signed into law.

FISCAL IMPACT
The bill outlines how revenue would be allocated but does not guarantee that funds raised within a specific county will return to that county or to its cities. Per Gov. Code §67750(c), initial revenues are directed to five regional transit priorities: BART, Muni, AC Transit, Caltrain, and up to 10% for MTC regional initiatives. Only afterward does the bill state in §67750(d)(1): “Any remaining revenues shall subvene all remaining funds directly to the counties contained in the district.” However, the bill is silent on how counties must allocate their share, offering no requirement that cities like Foster City receive a specific portion of those funds. This creates significant uncertainty for local jurisdictions and transit operators outside prioritized regional systems.

If San Mateo County opts in and the ballot measure passes:
A significant portion of revenue may flow to regional operators like BART and Muni, which do not directly serve Foster City.
Any residual funds go to the county, which has full discretion on how to allocate them, with no statutory obligation to reinvest locally. Foster City has no guarantee to ensure that tax dollars collected from within the City are returned to support its infrastructure, local shuttle services, or Caltrain access.

DATE: July 21, 2025

TO: Mayor and Members of City Council
VIA: Stefan Chatwin, City Manager

FROM: Nate Cruz, Finance Director
Diane Pitman, Administrative Services Director
DEPARTMENT: Finance
SUBJECT: OVERHIRE OF A FINACIAL SERVICES MANAGER AND

APPROVING THE SUPPLEMENTAL APPROPRIATION OF
$96,100 FROM THE GENERAL FUND

RECOMMENDATION
It is recommended that the City Council adopt the attached resolution authorizing an overhire for the Financial Services Manager in the Finance Department and approving a supplemental appropriation of $96,100 from the General Fund.

EXECUTIVE SUMMARY
The Financial Services Manager position in the Finance Department is anticipated to become vacant on December 31, 2025.

This key position is responsible for leading and coordinating development of the Citywide Budget and directly manages the utility billing and collection functions.

The incumbent in the position has considerable tenure which brings with it substantial knowledge and experience that will be difficult to transfer without cross training. Finance is requesting:
Authorization to overhire the position, with an estimated start date of October 1, 2025 (depending on the hiring process and timeline); and A one-time supplemental appropriation of $96,100 in FY 2025-2026 for the cost of salary and benefits.

8.1 8.1 Staff Report

104

BACKGROUND
The Finance department is responsible for all financial operations of the City, including accounting, budgeting, debt, cash, investing, reporting, internal controls, accounts payable and receivable (including water and wastewater), annual audits, and payroll.

The Financial Services Manager is the primary manager of the Citywide budget process and directly manages utility billing and collection. The incumbent in this position has been with the City for 16 years, where she led budget preparation for nine (9) years including implementation of new budgeting software (OpenGov). Given her tenure and deep expertise in the complex budgeting process, it will be challenging to transfer knowledge without adequate opportunity for crossover training.

ANALYSIS
The Financial Services Manager position is anticipated to become vacant in December 2025. In anticipation of this opening, the Finance and Administrative Services Departments would like to conduct a recruitment to establish a list of eligible candidates for this key classification.

To proactively prepare for the transition of duties associated with this key position, staff recommends that the City Council authorize an overhire of the position anticipated to start on October 1, 2025. Overhiring is a key tool used in succession planning and can be an effective strategy for managing staffing transitions, thus minimizing the workload impacts to remaining staff and impacts on service levels to the community during staff turnover.

Filling this overhire position would allow the incumbent to conduct one-on-one orientation and training with the successor on all aspects of this complex and pivotal role.

CALIFORNIA ENVIRONMENTAL QUALITY ACT
The request for overhire of the position is exempt per CEQA Guideline Section 15061(b)(3), Common Sense Exemption.

FISCAL IMPACT
The additional cost to overhire the Financial Services Manager position is estimated to be $96,100 in salaries and benefits, fully chargeable to the General Fund in FY 2025-2026.
